Abstract

The objective of this study was to study the possibilities instituted by the notarial deed in proving cybermobbing in the judicial process. Bibliographical and documentary research was used, with a qualitative character. In writing, the deductive procedure was used. The present work is justified by the need to prevent and suppress abuses committed in the workplace. Bullying in the work environment can be defined as a sequence of harmful acts, perpetrated by a superior or under his / her leniency, in a constant and prolonged way in time, that cause psychological and physical consequences to the employees who are victims of it. With the enhancement of electronic communications, such as the Whatsapp mobile application, these conduits can be transmitted over the internet. These dialogues can, however, be easily changed or deleted. Thus, an instrument is needed to assert them in the process. Thus, it was concluded that the notarial deed is capable of making authentic facts and situations of fact, described or narrated, by means of its record, being able to prove, documentally, the occurrence of cybermobbing
