Abstract

This chapter focuses on the Hazardous Materials Transportation Act (HMTA), with emphasis on waste. The HMTA authorizes the Department of Transportation (DOT) to regulate the transport of hazardous materials by land, water, or air, including transport through pipelines. The hazardous materials/waste shipper bears the responsibility of correctly identifying, classifying, packaging, labelling, and completing shipping papers for the transport of hazardous materials. Hazardous wastes are a special category of hazardous materials and are regulated by both Environmental Protection Agency (EPA) and DOT. Hazardous wastes are treated similar to hazardous materials with the exception that most waste shipments require a manifest. The waste generator is responsible for completing the manifest and seeing that it is fully executed. The HMTA safety regulations apply to all regulated hazardous materials, not just wastes. The receiving facility is responsible for verifying that all hazardous wastes documented on the manifest are received at the facility.
