Abstract

The fight against crime in modern conditions of economic and social development of society requires law enforcement agencies, during the pre-trial investigation, to focus on such a widespread type of crime as desecration of the bodies of the dead and their burial places. The reasons for the spread of these negative manifestations of vandalism in modern society can be attributed to the insufficient level of social and educational work with young people, the low moral and spiritual position of individuals who lead an immoral and antisocial lifestyle, etc. The facts of contempt for the burial places not only cause moral suffering to the relatives of the deceased and cause material harm, but also represent a destabilizing factor in society, the consequences of which lead to national-ethnic and political conflicts among multinational groups of the population. The article is considered the situation in which the desecration of burial places was committed as one of the main elements of the forensic characteristics of crimes provided for by Article 244 of the Criminal Code of the Russian Federation. Its correlations with other elements of the characteristic are decisive. They determine the choice by the criminal of the subject of the criminal offense, the method of committing, traces at the scene, etc. When considering the situation of criminal activity, the crimes in question, information about the immediate place of the crime was studied, as the area of the area where the consequences of criminal actions are concentrated, the influence of the administrative-territorial and socio-economic factor of the area, the time of the crime, the ethnic composition of the population. The article also highlights the key, in the author’s opinion, elements of the criminal situation, which must be taken into account in the study of the spatial and temporal properties of the scene and the subject of criminal encroachment.
