ЗВ’ЯЗОК ЮВЕНАЛЬНОЇ ЮСТИЦІЇ З СУЧАСНОЮ СОЦІАЛЬНО-ПЕДАГОГІЧНОЮ РОБОТОЮ ІЗ НЕПОВНОЛІТНІМИ ПРАВОПОРУШНИКАМИ

Abstract

The article conducts a complex analysis of the nature and characteristics of the juvenile justice system as a state apparatus of social and pedagogical work with juveniles that are brought to criminal responsibility. On the basis of the Cabinet of Ministers of Ukraine dated 22.04.06 № 229-p “On approval of the Concept of the National program “national action plan on the implementation of the UN Convention on the rights of the child for 2006 – 2016” presidential Decree of Ukraine from 08.04.08 No. 311/2008 on approval the “concept of reforming criminal justice in Ukraine”, and approval by the resolution 40/33 of the General Assembly of the United Nations on 29 November 1985. United Nations standard minimum rules (“the Beijing rules”), reasonably ground for the development of juvenile justice as a separate specialized court system for minors. It is formulated the relevance of the implementation of juvenile justice in the contemporary practice of social work with juvenile offenders and its comprehensive support during and after the trial. It is characterized by scientific terminology of the juvenile policy. It is established the conceptual provisions and principles of the juvenile justice system. In addition, it is identified a system of special functions linking juvenile justice with social and pedagogical work. It is restitution, rehabilitation and pacification functions.On the example of a regional model of juvenile justice it is highlighted on the introduction of client centered approach to social and pedagogical work with juvenile offenders. The model has a successful experience of practical application in social and pedagogical work with juvenile offenders. Its feature is the cooperation of the system of specialized state and non-state bodies: centres of social services for youth, services for minors, educational and medical institutions, public organizations and authorities.
