Abstract
It is known that real estate preservation disputes are characterized by the complexity of their procedures, their high cost, and the length of the decision-making process. There was no way out of this impasse except to find a legal mechanism for settling disputes, namely: “reconciliation”; Where the legislator sought to include it within the jurisdiction of the real estate portfolio. However, this mechanism began to raise many questions such as the extent to which the reconciliation is considered binding by the real estate governor, and what are the implications of it, and the extent to which the records completed in this regard acquire the legal value, and the extent of the efficacy of conducting it in the disputes of real estate preservation cases. This study aims to highlight the role given by the Western real estate legislator to the Governor's Institution in order to strengthen the preservation procedure through the reconciliation mechanism. To address the issue from its various aspects, according to the questions raised, we have adopted multiple approaches. Including the descriptive method, which is indispensable in the study of any legal topic, in addition to the analytical method, through which we analyze legal requirements, especially new ones, as well as the inductive method. The researchers concluded that there are several obstacles that prevent people from benefiting from the reconciliation mechanism in real estate conservation disputes.
