Development of deontological principles for professional activities of judicial process participants in the context of judiciary digitalization

This research is dedicated to analyzing the impact of judiciary digitalization on the development of deontological principles of professional activities of judicial process participants. In modern conditions, digital technologies become an integral part of the legal system, changing the traditional methods of work of judges, lawyers, investigators, and other specialists. The implementation of electronic case management systems, online conferences, and digital communication tools enhances the efficiency and accessibility of judicial services, reduces the time for case review, and decreases the risks of corruption. However, this process is accompanied by challenges such as ensuring cybersecurity, protecting personal data, and providing equal access to digital resources for all participants. Digitalization also affects the ethical norms and professional responsibility of judicial process participants. Enhancing the transparency of judicial processes requires professionals to adhere to principles of honesty and openness, as well as ensuring the confidentiality of information. The use of electronic communication tools imposes the need to maintain high ethical standards in the virtual space, including avoiding conflicts of interest and ensuring fairness in interactions between parties. One of the key aspects of the study is the necessity for ongoing professional training and adaptation to rapid technological changes. Participants in the judicial process must master new digital tools, understand their capabilities and risks, which promotes the development of ethical awareness and professional competence. This ensures high quality of judicial decisions and increases public trust in the judicial system. The conclusions of the study emphasize that the digitalization of the judiciary is a catalyst for the development of deontological principles of professional activity, contributing to the creation of a more transparent, fair, and reliable judicial system. Characteristics and Predictors of Interprovincial Migration Following HIV Diagnosis Among Men Who Have Sex with Men - China, 2016-2022.

Men who have sex with men (MSM) are highly vulnerable to human immunodeficiency virus (HIV) infection and demonstrate significant mobility patterns. Understanding post-diagnosis migration patterns among HIV-positive MSM is crucial for targeted case management, yet comprehensive data from China remains limited. Among 204,394 HIV-positive MSM, 20,117 (9.8%) migrated after diagnosis, with primary movement from economically developed regions like Guangdong Province and Shanghai Municipality to less developed provincial-level administrative divisions such as Sichuan Province and Anhui Province. Key predictors of migration included age under 50 years, unmarried status, lower educational attainment, employment as commercial staff or student status, and diagnosis before 2020. Enhanced healthcare resources, strengthened case management systems, and targeted HIV-related services are essential to ensure consistent treatment access and improved health outcomes for migrant HIV-positive MSM.

Child welfare worker perspectives on documentation and case recording practices in Canada: A mixed-methods study protocol.

In health care and child welfare, clinical records and case notes serve multiple functions. When records are aggregated and processed to create administrative data, they can be analyzed and used to inform policy development and decision-making. To be useful, such data should be complete, accurate, and recorded in a standardized way. However, sources of bias and error can impact the quality of administrative data. During the development of national child welfare data in Canada, child welfare sector partners expressed concerns about the accuracy and completeness of data about children and families. This protocol describes a study that seeks to answer two questions: 1) What individual and institutional factors influence how client data is recorded by child welfare workers in Canada? 2) What data quality issues are created through documentation and case recording practices that may impact the use of clinical case management system data for public health statistics? In this protocol, we describe an exploratory mixed methods study that involves an online survey, interviews with a purposive sample of child welfare workers, and a document review of case recording guidelines. To be eligible for the study, participants must have worked at a child welfare agency or department with clinical documentation responsibilities as a part of their job. We will use descriptive statistics to analyze the survey data and thematic analysis to analyze the qualitative data. This study will help uncover strengths, limitations, and possible sources of bias created through case recording and documentation practices in child welfare. Study results will be shared through presentations to interest holders and will inform the further development of national child welfare data in Canada.

Ineffectiveness of the Issuance of Investigation Orders After Examining the Reporter in the Investigation Process at the Indonesian National Police

This study examines the ineffectiveness of issuing Investigation Orders (Surat Perintah Penyidikan or Sprindik) following complainant examinations in Indonesia’s law enforcement process, contributing to case backlogs. Using a normative juridical method, the research analyzes legal regulations, administrative procedures, and relevant case examples. A statutory approach involving legal reviews and a conceptual approach exploring legal accountability and procedural justice principles were applied. Key findings reveal that high investigator workloads, inadequate training, and administrative mismanagement hinder effective Sprindik issuance. A lack of standardized protocols for evaluating initial evidence leads to premature suspect designations, causing judicial delays. Limited use of investigative technologies and procedural misunderstandings further exacerbate inefficiencies. To address these issues, the study recommends revising police regulations to standardize evidence evaluation, expanding investigator training, streamlining administrative processes, and adopting digital case management systems. An oversight mechanism should be established to monitor Sprindik issuance, ensuring greater accountability and transparency. These reforms aim to modernize investigative procedures, reduce case backlogs, and promote fairer, more efficient law enforcement practices. The study’s integrated approach combines legal analysis with policy solutions, offering a roadmap for sustainable improvements in criminal investigation management.

Disparity in the Charges of Customs Crimes: A Study of Decision Number 42/Pid.B/2024/PN Rhl and Decision Number 43/Pid.B/2024/PN Rhl

This research aims to analyze the disparity in the charges of customs crimes in a case study of Decision Number 42/Pid.B/2024/PN Rhl and Decision Number 43/Pid.B/2024/PN Rhl. This normative legal research employs a tripartite approach, encompassing a statute approach, a comparative approach, and a case study approach. Data analysis uses a qualitative content analysis approach to describe the problems and address the research objectives. The research results indicate a significant disparity in the charges between the two decisions, while both defendants were proven to have jointly committed acts that fulfil the elements of a criminal offence as regulated and punishable under Article 102 point an of Law Number 17 of 2006 Juncto Article 55 section (1) of the Penal Code. Conversely, the Public Prosecutor presented substantially different charges: two years imprisonment for one defendant and four years for the other defendant. This disparity in the charges, which reached twice as much, raises serious issues regarding proportionality and fairness, violates the principle of equality before the law, negatively impacts legal certainty (rechtszekerheid), which in turn can erode public trust in the judicial system and hinder fair law enforcement. To mitigate the disparity in the charges, comprehensive and systemic efforts are needed, including the establishment of detailed and structured sentencing guidelines, increasing the capacity and professionalism of Public Prosecutors, strengthening oversight and evaluation mechanisms of the Public Prosecutor’s performance, and implementing an effective case management system to identify potential disparities early on.

ONLINE DISPUTE RESOLUTION IN UKRAINE: EXPECTATIONS AND REALITY

Background: As digital interactions and transactions grow, people are more inclined to participate if they feel secure and assured of fair procedures. However, online dispute resolution is still rarely used in Ukraine due to a lack of regulations. This research article provides a legal analysis of online dispute resolution (ODR) in Ukraine, concentrating on defining the ODR landscape, as well as on considering its potential in e-commerce and traditional court proceedings. Besides, the article presents a vision and proposals for the future adoption of European laws in Ukraine while discussing the current challenges in the online justice system that hinder its successful implementation. As a result, the article emphasises the need for an adequate legal instrument to regulate ODR in Ukraine, particularly in the context of e-commerce. It highlights the importance of implementing EU legislation, developing ODR platforms and ADR institutions, and ensuring their decisions are binding. It also addresses the challenges related to remote hearings in the judiciary during different circumstances and suggests adopting cloud-based case management to improve efficiency and reduce the risk of document destruction. Methods: The research methodology for this study on online dispute resolution in Ukraine included a comprehensive literature review, a comparative analysis of ODR systems in European countries, and a systems analysis to forecast the future trajectory of ODR in Ukraine. This approach aimed to assess the current state of ODR in Ukraine, identify areas for improvement, and explore potential achievements and challenges in its implementation. Results and conclusions: The article concludes that Ukraine is in the process of establishing a legal framework for online dispute resolution, which is expected to progress further after the war. The implementation of EU legislation and the development of ODR platforms and ADR institutions are crucial, along with ensuring accessibility for all, including vulnerable groups without internet access. Related to online courts, it is necessary to address challenges such as judges' absence during remote hearings. It is also recommended that the process be expedited and the risk of document loss internally in the case management system minimised.

A Cohort Study of Lt. Col. Luke J. Weathers VA Medical Center Patients with Positive FIT and Incomplete GI Evaluation during the COVID-19 Pandemic.

The reasons for and incidence of delay in screening colonoscopies during the coronavirus disease 2019 (COVID-19) pandemic are of major public health interest. The risks and reasons for delay likely vary between public and private institutions. This research sought to analyze data regarding the completion of screening colonoscopies after a positive fecal immunochemical test (FIT) before and during the COVID-19 pandemic and the reasons for a delay in obtaining these results at the Lt. Col. Luke Weathers, Jr. Veterans Affairs Medical Center. The goals were to evaluate the institutional resilience and analyze the problems associated with this major healthcare crisis. This closed cohort study included all positive FITs from our local Veterans Affairs (VA) medical center from October 2019 to January 2020 and July 2020 to May 2021. A total of 115 VA patients with a positive FIT prepandemic and 157 VA patients with a positive FIT during the pandemic were included. Completion rates within 180 days were measured, and charts were reviewed to identify the reasons for lack of completion. Both community and local VA procedures for veterans were included. Univariate and multivariable analyses were applied to calculate odds ratios (ORs). The Pearson χ2 test was applied to calculate P values. VA patients' percentage of timely completion was lower pre-COVID-19 than it was during the pandemic, and the percentage of delayed completion was higher pre-COVID-19 than it was during the pandemic. Comparing patients who completed a colonoscopy with those who did not, increasing age had an OR of 0.947 (95% CI 0.920-0.975), and White race had an OR of 0.504 (95% CI 0.291-0.873). Evaluating delays in colonoscopy completion, VA colonoscopies versus referral to the community had an OR of 4.472 (95% CI 1.602-12.483), and pre-COVID-19 completion versus during COVID-19 had an OR of 4.663 (95% CI 1.727-12.594) with multivariable logistic regression. There was a statistically significant increase in timely colonoscopy completion during the study period when compared with the pre-COVID-19 period. The completion rate was higher at the Lt. Col. Luke Weathers, Jr. VA Medical Center than a large population average in 2020, possibly related to community colonoscopies and an aggressive case management system. In addition, increasing age and White race were associated with decreased colonoscopy completion. Predictors of an increased delay in colonoscopy completion included a pre-COVID-19 positive FIT and colonoscopies performed within the VA rather than being referred to providers in the community. A common reason for delay in all of the groups was patients declining intervention and delay/lack of referral.

Ultimately, this exploration underscores the potential of AI and ML to enhance social work outcomes while also emphasizing the necessity of ethical frameworks and ongoing training for practitioners.

Enhancing cross-border contact tracing in Europe: Lessons learned from COVID-19 and future directions

Abstract Introduction Health systems in the EU operate at the national level, granting Member States autonomy for outbreak preparedness and response within their territories whilst coordinating at EU level to combat serious cross-border threats. The EU’s Early Warning and Response System (EWRS) provides the platform to exchange personal data for contact tracing across 30/EEA countries and was extensively utilized during COVID-19. This study examines insights from EU/EEA countries and assesses the feasibility of integrating national digital systems with EWRS to increase its effectiveness. Methods A comparative case study surveyed representatives from 24 countries and interviewed nine, analyzing contact tracing processes, actors, digital technologies, and challenges/facilitators during COVID-19. Thematic analysis was complemented by two webinars engaging EU/EEA countries to validate findings and gather additional perspectives. Results EWRS was valued for safety and efficiency but faced challenges during peak pandemic periods due to the heavy manual workload. Integrating national digital systems with EWRS could enhance data quality, timeliness, and coordination between countries. However, countries have varied and incompatible digital contact tracing systems, limiting the feasibility of their integration with EWRS. Moreover, most countries organize contact tracing at the subnational level, with regional entities developing and managing their own digital technologies under national guidance. Smaller countries excluded, subnational contact tracing case management systems were often not integrated with each other to exchange personal data in an automated way at a national level. Conclusions While integrating national digital systems with EWRS could bolster efficiency of contact tracing across EU/EEA, the presence of diverse technologies and decentralized governance poses feasibility challenges. Other improvements are needed to enhance cross-border contact tracing during outbreaks. Key messages • Integrating national digital systems with EWRS promises enhanced efficiency for contact tracing across EU/EEA in line with Regulation (EU) 2022/2371 on serious cross-border threats to health. • Diverse technologies and decentralized governance pose feasibility challenges, underscoring the need for further enhancements in cross-border contact tracing in EU/EEA during large outbreaks.

Analysing the Legal Development of the Case Management System in the High Court of Tanzania

Abstract This article traces the legal development of case management as applied in the High Court of Tanzania for the timely justice dispensation. To make it easier for the readers, the authors of this article employed a doctrinal approach by carrying out a systematic documentary review, including the constitution, legislation, reports, and case laws. This review aimed to provide a thorough historical perspective of the development of the case management system in the High Court of Tanzania. The findings reveal that Tanzania introduced a case management system to address the inefficiency of justice in the court system. Furthermore, timely dispensation of justice is the constitutional essence of the existence of the Judiciary of Tanzania. However, even with the introduction of the case management system, the need for the timely justice dispensation in the court of law has not been satisfactorily achieved.

A hybrid type II effectiveness-implementation trial of a positive emotion regulation intervention among people living with HIV engaged in Ryan White Medical Case Management: protocol and design for the ORCHID study

BackgroundThe Ryan White Medical Case Management System, which serves more than half of people living with HIV (PLWH) in the USA, is an opportune setting for identifying and addressing depression among PLWH. A growing body of research suggests that interventions that promote positive emotion may lessen symptoms of depression and improve physical and psychological well-being among people experiencing a variety of health-related stress, including living with HIV. Research on how best to integrate standardized mental health screening and referral to evidence-based interventions in Ryan White Medical Case Management settings has the potential to improve the health and wellbeing of PLWH.MethodsThis mixed-methods study will enroll up to N = 300 Ryan White clients who screen positive for depressive symptoms in ORCHID (Optimizing Resilience and Coping with HIV through Internet Delivery), a web-based, self-guided positive emotion regulation intervention. The study will be conducted in 16 Ryan White Medical Case Management clinics in Chicago, IL. Following pre-implementation surveys and interviews with Medical Case Managers (MCMs) and Supervisors to develop an implementation facilitation strategy, we will conduct a hybrid type 2 implementation-effectiveness stepped wedge cluster randomized trial to iteratively improve the screening and referral process via interviews with MCMs in each wedge. We will test the effectiveness of ORCHID on depression and HIV care outcomes for PLWH enrolled in the program. RE-AIM is the implementation outcomes framework and the Consolidated Framework for Implementation Research is the implementation determinants framework.DiscussionStudy findings have the potential to improve mental health and substance use screening of Ryan White clients, decrease depression and improve HIV care outcomes, and inform the implementation of other evidence-based interventions in the Ryan White Medical Case Management System.Trial registrationClinicalTrials.gov NCT05123144. Lessons Learned from the Launch and Implementation of the COVID-19 Contact Tracing Program in New York City: a Qualitative Study.

On June 1, 2020, NYC Health + Hospitals, in partnership with the NYC Department of Health and Mental Hygiene, other city agencies, and a large network of community partners, launched the New York City Test & Trace (T2) COVID-19 response program to identify and isolate cases, reduce transmission through contact tracing, and provide support to residents during isolation or quarantine periods. In this paper, we describe lessons learned with respect to planning and implementation of case notification and contact tracing. Our findings are based on extensive document review and analysis of 74 key informant interviews with T2 leadership and frontline staff, cases, and contacts conducted between January and September 2022. Interviews elicited respondent background, history of program development, program leadership and structure, goals of the program, program evolution, staffing, data systems, elements of community engagement, trust with community, program reach, timeliness, equity, general barriers and challenges, general facilitators and best practices, and recommendations/improvement for the program. Facilitators and barriers revealed in the interviews primarily revolved around hiring and managing staff, data and technology, and quality of interactions with the public. Based on these facilitators and barriers, we identify suggestions to support effective planning and response for future case notification and contact tracing programs, including recommendations for planning during latent periods, case management and data systems, and processes for outreach to cases and contacts.

Facilitators and barriers to implementing successful exclusion among children with shiga toxin-producing Escherichia coli: a qualitative analysis of public health case management records

BackgroundShiga toxin-producing Escherichia coli (STEC) infections are a significant public health concern as they can cause serious illness and outbreaks. In England, STEC incidence is highest among children and guidance recommends that children under six diagnosed with STEC are excluded from childcare until two consecutive stool cultures are negative. We aimed to describe the barriers and facilitators to implementing exclusion and the impact of exclusion policies on young children and their families.MethodsIndividual level data was obtained from a wider study focusing on shedding duration among STEC cases aged < 6 years between March 2018 – March 2022. Data was extracted from England’s public health case management system. The case management system includes notes on telephone conversations, email correspondence and meeting minutes relating to the case. Collected data consisted of free text in three forms: (1) quotes from parents, either direct or indirect, (2) direct quotes from the case record by health protection practitioners or environmental health officers, and (3) summaries by the data collector after reviewing the entire case record. We analysed free text comments linked to 136 cases using thematic analysis with a framework approach.ResultsThe median age of included cases was 3 years (IQR 1.5-5), with males accounting for 49%. Nine key themes were identified. Five themes focused on barriers to managing exclusion, including (i) financial losses, (ii) challenges with communication, engagement and collaboration, (iii) issues with sampling, processing, and results, (iv) adverse impact on children and their families and (v) conflicting exclusion advice. Four themes related to facilitators to exclusion, including (i) good communication with parents and childcare settings, (ii) support with childcare, (iii) improvements to sampling, testing, and reporting of results, and (iv) provision of supervised control measures.ConclusionsQualitative analysis of public health case records can provide evidence-based insights around complex health protection issues to inform public health guidelines. Our analysis highlights the importance of considering wider social and economic consequences of exclusion when developing policies and practices for the management of STEC in children.

Management of COVID-19 in Universitas Gadjah Mada (UGM) Academic Hospital: Balancing to save the patients and protect the staffs

The Coronavirus Disease 2019 (COVID-19) is a worldwide outbreak disease caused by Severe Acute Respiratory Syndrome Coronavirus-2 (SARS-CoV-2). Indonesia is the fourth most populous country in the world and is predicted to be affected significantly over a more extended period. Universitas Gadjah Mada (UGM) Academic Hospital is one of the COVID-19 referral hospitals located in the Yogyakarta Special Region, Indonesia. Since the early months of the pandemic, the hospital has prepared strategies to provide effective and efficient patient care. The focus has been safety for both patients and healthcare staff. Here, we will share our experiences activating a Hospital Incident Command System (HICS) as a hallmark for preparedness and response to the COVID-19 pandemic disaster so it can be adopted in other hospitals nationwide or worldwide. The HICS in the UGM Academic Hospital includes 1) surge capacity for isolation rooms, 2) infection prevention and control, 3) human resources, 4) continuity of essential health services and patient care, 5) communication, 6) logistics and management of supplies including pharmaceuticals, 7) essential support services, 8) case management system, 9) surveillance early warning and monitoring, 10) laboratory services, and 11) additional programs including community service programs. Based on our experiences, early preparedness with a proactive response, and adapting plans to local needs, the national and global current situation are the keys to managing patient care. In this study, we evaluated the effectiveness of a novel computer assisted TFU model specifically for this demographic.MethodsAt a Taiwanese tertiary medical center, we developed a TFU protocol that included a referral and case management system within the ED hospital information system. We provided TFU to older discharged patients between April 1, 2021, and May 31, 2021. We compared this cohort with a non-TFU cohort of older ED patients and analyzed demographic characteristics and post-ED discharge outcomes.ResultsThe TFU model was successfully implemented, with 395 patients receiving TFU and 191 without TFU. TFU patients (median age: 76 years, male proportion: 48.9%) differed from non-TFU patients (median age: 74 years, male proportion: 43.5%). Compared with the non-TFU cohort, the multivariate logistic regression analysis revealed that the TFU cohort had a lower total medical expenditure < 1 month (adjusted odds ratio [AOR]: 0.32; 95% CI: 0.21 − 0.47 for amounts exceeding 5,000 New Taiwan Dollars), and higher satisfaction (AOR: 2.80; 95% CI: 1.46 − 5.36 for scores > 3 on a five-point Likert Scale). However, the TFU cohort also had a higher risk of hospitalization < 1 month (AOR: 2.50; 95% CI: 1.31 − 4.77) compared to the non-TFU cohort.ConclusionComputer-assisted TFU appears promising. Further research involving a larger number of patients and validation in other hospitals is necessary to bolster the evidence and extend the findings to a broader context.
