Bat'a-system of management: Managerial excellence found

We provide a short outline of Bat'a-system management principles as a contribution to the ongoing search for world-class management systems and managerial excellence in general. It appears that Bat'a-system, being both European and American in its origins and being based on labor and knowledge integration (rather than division and specialization), represents a candidate management system of uncommon appeal. More, Bat'a-system is not based on theory but rooted in practical experience of unprecedented performance, quality and business success. The Bat'a-system experience leads directly to modern theory of process-oriented quality management, based on high-technology support and decision-making autonomy of employees.

Dispute Resolution in the Nonunion Firm

This article presents a multivariate analysis of the structure, uses, and consequences of nonunion employee appeal systems in three large U.S. companies over the 1980-83 period. Appeal system data drawn from company files are matched with personnel data to determine the effects of age, race, sex, education, occupation, and work experience on appeal system usage, types of appeal issues filed, and levels of appeal settlement. Analysis of appeal settlement data shows that the probability of an employee “winning” an appeal case increases with the level of settlement, but also that the probability of any single appeal progressing through the appeal system declines markedly with the level of settlement. Quantitative analysis of appeal settlement consequences, using an ex post facto control group design, shows that appeal filers and their supervisors-managers have significantly lower promotion rates and performance ratings and significantly higher turnover rates in the post-appeal settlement period than comparable (matched) groups of nonfilers and their supervisors-managers. Implications of these findings for due process, exit-voice, and organizational punishment theories of workplace dispute resolution are identified and discussed.

ABSTRACT New Peer Review Appeals System: A formal channel has been set up to air complaints about decisions in the processing and review of grant applications to the Alcohol, Drug Abuse, and Mental Health Administration. As published in NIH Guide to Grants and Contracts, the system permits confidential examination of applicants' concerns. The appeals system does not apply to funding decisions, nor is it intended to resolve purely scientific disputes between peer reviewers and investigators. Abstract Considerable attention has, over the last few years, been focused on the reform of the Supplementary Benefits (SB) system. The changes of November 1980 may well be followed by a radical overhaul of the benefits system and the creation of one benefit for the unemployed.1 In the meantime it has become clear that the change-over to the new SB system has, in many instances, caused a reduction in some payments to claimants.

THE JUDGE AS UNCOMMON MAN

Judges are essentially technicians. The problems they have to solve require speedy, sometimes instant, solutions and the pressure of cases is not eased by their judgments. There is little time for reflecting on deeper principles. Lord Devlin's swift departure from the Bench in 1964 gave him the opportunity to stand back from the fray and to make his every judgment reserved. His new book, The Judge, a collection of addresses delivered between 1975 and 1978, demonstrates again that he has seized the opportunity with both hands. It is a tour deforce, brimming with judicious aphorisms and arresting insights into both the darker corners of the law and those paths that hitherto had appeared well-trodden. The Judge is a legal and literary masterpiece, every part of which richly repays study, and it is an enlightening and pleasurable experience to travel the roads of justice with such a guide. His sure sense of direction, his feeling for history, his frequent digressions into unexplored or little travelled by-ways, his understanding, compassion and power of description grip the attention, lift the spirit and make an exacting journey into an enjoyable excursus. The journey is exacting not because of technicalities, for these he has deliberately shunned. It is exacting because the terrain he negotiates is difficult, the issues he confronts are profound, and the intellectual forces he brings to bear are formidable. His case is always put with precision and clarity and the occasional tendency towards intellectual coursing, relentlessly pursuing hares raised by others and sometimes starting a few of his own, derives from his respect for those of opposite opinion, a respect which requires him to demolish with ruthlessness the mere semblance of a contrary argument. The result is a sustained, rigorous and powerful account of the art of judging which alleviates the sense of loss his passing from the Bench occasioned to English jurisprudence. The compass of the book is very wide indeed. Among the matters covered is the role of the judge in the development of the law, the sentencing duties of the judge, the adversary system of investigation and trial, the function of the jury, the role of precedent and the appeal system. Lord Devlin begins with a consideration of the function of the judge, in particular whether judges should be involved in creative lawmaking. His general answer is that they should not. So far as statute law is concerned the duty of the judge is to interpret and apply, not to obstruct; development of the law, if permissible at all, should inch forward with measured caution. In common law matters, where there is by contrast a general warrant for judicial lawmaking, Lord Devlin is in favour of judicial activism. Activism here means that creativity is allowable only in so far as it operates within the consensus

Faculty Unionism: The First Ten Years

The record of faculty collective bargaining in four year colleges and universities for the past decade shows that about one-eighth of all institutions have been organized. The proportion rises to about 30 percent in public institutions. Unionism is highly concentrated in public institutions, in the 22 jurisdictions where state bargaining laws have been in effect for a substantial period—only about 27 institutions remain unorganized in these states. Growth has been slowing in recent years and there is little to indicate a significant increase in the future unless the public employee bargaining movement resumes its growth and additional states enact supportive laws. While the number of elections has been declining, the percentage of rejections of unionism has been rising in public institutions and falling in private institutions in recent years. Faculty unionism appears to have increased centralization in decisionmaking, bureaucratization of administration at all levels, led to more open personnel processes, and introduced some elements of an appeal system while having inconclusive effects on compensation.

Regular reliability checks plus a formal appeal system provide assurance of fairness to students and useful feedback to the instructor.

National Insurance Local Tribunals: A Research Study – Part II

ABSTRACTTribunals, now recognized as key institutions of the Welfare State, are attracting a good deal of attention. Despite a growing volume of criticism little systematic research has been undertaken into the way they actually function. Since almost every British citizen has rights of appeal to national insurance local tribunals (NILTs) it would seem that they constitute a good starting point. An earlier article presented a general view of NILTs. This paper examines the way the appeal system works from several different perspectives. Difficulties encountered by ordinary citizens at various stages in the appeal process are discussed. The research findings on attendance, representation and success rates are analysed. Attendance by the appellant at the hearing of his appeal is shown to be of particular significance. It is also clear that expansion of facilities for providing advice and representation would be advantageous to appellants. Problems connected with expansion of these facilities are discussed, and an ‘ideal type’ representative is outlined. This leads to a discussion of different tribunal models and a ‘participation model’ is developed. Finally, some implications of the research findings for the development of social policy are considered.

Of the business firms surveyed (there are 800 respondents), I discovered just two which referred the final settlement of appeals in unilaterally granted systems to an outside arbitrator. In all the other firms with such systems, incumbent managers adjudicated disputes.

Realignment, Readjustment, Reform: The Impact of the Ombudsman on American Constitutional and Political Institutions

The idea of an Ombudsman has entered American discussion at a time of extraordinarily urgent need for attention to grievance machinery and efficiency-promoting devices in government. This is indicated by the scope and character of present discontents; the increasing contradiction between taxpayer resistance and compelling requirements for governmental spending, especially in state and local government ; and the emergence of many social forces stimulating people to assert their rights in relationship to government. The Ombudsman concept deserves wide trial in America, but, at the national level, probably will need to be modified so that a group of Ombudsmen serve, with their responsibilities divided on the basis of broad functional areas. Grievance machinery already available ought to be strengthened in several respects, including administrative appeals systems, judicial review, legislative case work, and other devices. There is need for increasing the representation of the general consuming public in the administrative process; for greater use of administrative standards and general administrative procedure legislation; and for the adoption of several promising new approaches to grievance-processing. All of these are necessary in order to make governmental response more sensitive, and to allay those pressures for redress which now strike deeply to the heart of American life.
