This article aims to deepen our knowledge of legislation and social practice relating to the establishment of the principle of free soil in Spain, as considered in the case of a black African slave from the West Indies called Rufino. The court's decision in this case became a fundamental pillar of abolitionist legislation. The immediate precedent had been set by the Royal Order of 29 March 1836, whereby slaves brought to the Peninsula were declared to be free. The authors have analysed the documents arising from the case of Rufino to explore the establishment of free soil in Spain, and the wider European context.
