The history of the development of the ideas of the legal and social state and the practice of their implementation in foreign countries

The object of the study is public relations related to the formation and implementation of ideas of legal and social statehood. The subject of the research is the relations in the field of formation of the concepts of the legal and social state in the political and legal thought of the countries of Europe, America and Asia. The authors explore the issues of legislative consolidation of the principles of the legal and social state abroad. Special attention is paid to the specifics of the implementation of these concepts in various legal families. The problematic issues of the implementation of the principles of the rule of law are investigated. Attention is paid to the economic basis of the state as a necessary condition and prerequisite for the formation of a social state. The subject of the study is the influence of ideology on the practice of implementing social policy of the state. The interrelation of the legal and social state is substantiated. The research methodology is determined by the object and subject of the study. The key methods used are comparative methods: comparative legal, comparative historical; logical methods of cognition: analysis, synthesis, induction and deduction; as well as the formal legal method, which was used to analyze normative legal acts. The conducted research of the ideas of legal and social statehood and the practice of their implementation in various countries has allowed us to state that despite the presence of common features and the identification of common signs of these concepts, the implementation of these progressive views in real state-building faces significant difficulties. This is due to the presence of various legal systems, dominant ideologies, the degree of economic development and the social structure of society. The authors come to the conclusion that liberal ideology hinders the implementation of the concept of a social state, since by providing maximum economic freedom, the state fairly relieves itself of many social obligations. At the same time, in the countries of socialist law, the most favorable conditions are created for the practical implementation of the concept of a social state. The novelty of the conducted research also consists in substantiating the conclusion that the principles of legal statehood are fully implemented in countries with European legal systems. While in States with religious legal systems, it is difficult to consolidate the signs of a rule of law state.

Recommendatory Documents Adopted by International Organizations Through the Effects Prism in Report to the States Mandatory Obligations

The international normative system is one complex in which legal norms have a special role. Practice shows, despite the fact the violation cases number or non-compliance with international law norms are increasing, however states and other international actors try to justify their actions through arguments based on international law. But, such an approach can and should be seen as a recognition of the legal norms role and place within the international normative system. The international law evolution and codification process clearly demonstrates the approach by states to the gradual recognition of the international law supremacy in the process of regulating international relations. The 20th century second half was characterized by the “forceful” codification of international law, including thanks to the efforts undertaken by the International Law Commission empowered by the UN General Assembly with the noble function.

Unraveling the Nexus of Industrialization, Human Development, Democracy, Trade Openness, and Renewable Energy in EU Environmental Degradation

This study aims to unveil the effects of industrialization, human development, compliance with the rule of law, and renewable energy on CO2 emissions and the ecological footprint of consumption in EU countries over the 1990-2022 period. The empirical findings, based on the MMQR analysis, reveal that the magnitudes of coefficients between factors affecting CO2 emissions and the ecological footprint vary. Industrialization and human development are the main contributors to environmental degradation, while renewable energy use consistently mitigates environmental degradation across all quantiles. Trade openness also mitigates CO2 emissions in all quantiles with a diminishing trend, but the same correlation is only observed in the lowest quantile for the model with ecological footprint. Compliance with the rule of law has a statistically insignificant effect on the ecological footprint; however, in the lowest quantile of CO2 (0.1), the rule of law exacerbates CO2 emissions, whereas in the highest quantile, it has a mitigating effect. While industrialization and human development contribute to both dimensions of environmental degradation, the different impacts of trade openness and the compliance with the rule of law underscore the need for specific strategies in designing policies to mitigate CO2 and ecological footprints from a policy perspective.

An Empirical Analysis on Institutional Quality, Fiscal Policy and Debt Sustainability in Sub-Saharan Africa (SSA)

Many Sub-Saharan African (SSA) countries are finding it difficult to fulfill their massive debt repayment obligations, which bilateral financial institutions have declared to be unmanageable. Government institutions are to blame for such disparities in the budgetary components, which have been empirically confirmed to be detrimental. Part of the reason for SSA's income generation and debt management problems is related to fiscal policy components where there has been an unwarranted exaggeration of government expenditure. Accordingly, the current study used a panel Autoregressive Distributed Lag (ARDL) to examine how fiscal policy and institutional quality affected the sustainability of debt in 48 SSA nations between 2008 and 2022. The study’s findings suggested that the elements of fiscal policy (expenditure and revenue) as well as indicators of institutional quality (governance), such as control of corruption, effectiveness of government, political stability, absence of violence, regulatory quality, the rule of law, voice, and accountability, were important in explaining the long-term sustainability of public debt. The speed of adjustment to the long-run equilibrium was slow, which may be related to the unstable governance in each of the cross-sectional nations. Hence, the study concluded that the interactive effects of institutional quality and fiscal policy significantly influenced debt sustainability in the long run. The study’s conclusions can be very helpful to policymakers, particularly in those nations where major fiscal and external imbalances are being generated by low ratings for key institutional quality indices.

The rights and obligations of consumers, banks and developers in the home purchase agreement through the home ownership loan facility (STUDY PT.PILAR WAHANA SEJATI)

This study aims to (1) Examine and analyze the legal relationship between consumers and developers due to the Home Purchase Agreement. (2) reviewing and analyzing the legal protection of Home consumers due to the obligations of the developer due to the house sale and purchase agreement. The research method used is juridical normative by using conceptual (conceptual approach). Data analysis is done qualitatively by utilizing relevant positive theories and laws. Legal protection of consumers is regulated in law No. 8 of 1999 on consumer protection this law is expected to protect consumers in buying and selling homes through home ownership credit facilities. Based on the rules of law ,then in making the sale and purchase of houses must be made in the form of an authentic deed that is a deed that is made in the form specified by law and made before the competent public officials. Deed of sale and purchase under Article 617 of the Civil Code Kepmenpera number 09/1995 and PP24 / 1997, The Deed of sale and purchase must be signed by the seller and buyer in the presence of PPAT.

„Traps” of Institutional Capacity of the Ukrainian State: Causes of Emergence and Ways to Overcome

In the article, based on the use of international indices (governance effectiveness, corruption perception, democracy, rule of law, and others), an assessment of the institutional capacity of the Ukrainian state is given, particularly during the Great War. The article also analyzes "capacity traps" as gaps in legislation that undermine the effectiveness of the state governance system, and as a result, devalue the institution of political accountability and deteriorate the state’s institutional capacity. The author also explains, based on sociological surveys regarding trust in state institutions, why the decline in trust towards government bodies (with the exception of the Armed Forces and the President) increases the risks of delegitimizing the government, as this translates into a reluctance of many citizens to fulfill their civic duties, particularly with respect to mobilization, tax payments, etc. The author identifies the inefficiency of the system of checks and balances as the key problem of the institutional capacity of the Ukrainian state, which leads to duplication of powers between branches of government, ineffective functioning of the parliament and government, excessive concentration of power in the hands of the president, and the nullification of the role of the government as the center of executive power. The author thoroughly analyzes the existing in Ukraine "capacity traps" (what has been done for the first time in domestic political science), emphasizes their cumulative negative effect, outlines the negative consequences if they persist, and proposes effective instruments of non-electoral legitimacy of power, which are extremely necessary during wartime. Particular attention is paid to the need to reform Ukraine’s constitutional system to eliminate these institutional traps. Several ways to enhance institutional capacity are outlined, including the self-legitimization of power through information policy under conditions of forced restrictions on rights and freedoms; amending the constitution and legislation to eliminate the "capacity traps"; and the use of non-electoral instruments of legitimacy of power as a temporary measure that can strengthen the state's institutional capacity, but only during the war.

Do governance indicators have a role in remittances-growth nexus in Egypt?

Purpose ― Drawing on annual data from 1996 to 2022, this study aims to examine the effect of Egypt’s real GDP growth. Methods ― Autoregressive Distributed Lag (ARDL) and Cointegration technique are applied by first examining the stationarity of the series by utilizing the Augmented-Dicky-Fuller (ADF) unit root test. The bound cointegration test is then implemented to evaluate the existence of cointegration among the variables. Findings ― The results indicate that the GDP growth rate has a long-run positive relationship with remittance inflows in Egypt. This paper also finds that the average governance indicators in Egypt, which include government effectiveness, political stability, control of corruption and regulatory quality, voice and accountability, and the rule of law, could help facilitate the long-run effect of remittances on GDP growth. Implication ― The findings imply that maintaining high levels of governance indicators is essential for helping Egypt benefit from remittances and enhancing its economic growth.Originality/value ― The study is a pioneer in including the average governance indicators in the remittance-growth nexus study for Egypt. Its purpose is to assess whether governance quality affects the nexus and whether there exists a threshold for the average governance indicators below which the flow of remittances does not encourage economic growth.

The Role of Institutional Quality on FDI: A Comparison for Pre and Post – Global Financial Crises

In this study, the relative importance of institutional quality indicators on foreign direct investment (FDI) is investigated using a dynamic panel regression model for the countries that attracted the most FDI between 1996-2021. The World Bank (2023) data shows that FDI inflows gained a significant momentum at the beginning of the 2000s and reached its highest level in 2007. However, the Global Financial Crises (GFC) created a turning point in FDI inflows and it followed a very volatile course in the following years. For this reason, the analysis focused on the periods pre and post the global financial crisis. As a result of the study, it is revealed that all institutional quality indicators (except the rule of law) have positive effects on FDI inflows in the pre-crisis period, and regulatory effectiveness, government effectiveness and corruption control have a relatively higher impact on FDI inflows. On the other hand, it has been determined that no institutional quality indicator has a significant effect on foreign direct investments in the post-crisis period when FDI inflows are highly volatile.

This paper aims to identify the implications of not regulating the term limits of political party chairmen on the principles of the rule of law and democracy and to find juridical and conceptual reasons for the government to regulate it. This research employs a normative legal method with a statutory and conceptual approach. Some of the research findings show that the implications of the absence of rules limiting the term of office of political party chairmen have negative implications for the principles of the rule of law and democracy, namely that leadership turnover or regeneration does not take place regularly. As a result, the majority of leadership in political parties has an authoritarian character where the party as an organization is not managed based on rules, but is determined by the authority and personal subjectivity of the chairperson. Initially, the limitation on the term of office of party chairpersons was not included in the regulation to prevent the Government from interfering in the internal affairs of parties, which based on past experience - especially during the Old Order and New Order, excessive state intervention has led to violations of citizens' constitutional rights to associate and assemble. Currently, the threat to citizens' freedom of association and assembly comes from the internal power of political parties, particularly from party chairpersons. Identification of Legal Psychology as an Independent Branch of Law

The science article conducts a theoretical and legal analysis of a new field of scientific knowledge – legal psychology from the standpoint of its perception as an independent branch of law. In the context of the above, the problematic aspects of legal psychology as a scientific, educational and applied branch of legal knowledge are studied on the basis of previously developed by legal psychologists levels of interaction and integration of law and psychology. The formation of legal psychology as a science and vectors of application of its achievements in judicial practice is analyzed. The author's approach in the formation of a new independent branch of law – legal psychology and determining its place in the classification of branches of law is proposed. The author emphasizes the need and urgent demand for the separation of legal psychology as a separate special branch of law that can regulate specific legal relations inherent in the fundamental (profiling) branches of law. The relevance of the article is due to the fact that in domestic legal science the division of the legal system in the field is assessed not in terms of its practical value, but rather in terms of confirming and defending certain scientific and theoretical ideas and concepts, contrary to the expediency of combining certain legal relations in the branch of law to achieve the desired social result through comprehensive study and regulation of specific relations. This, in turn, slows down the formation of new branches of law demanded by legal practice, among which legal psychology is singled out. It is emphasized that the question of the branch affiliation of legal psychology has not only theoretical but also practical significance, uniting individual legal relations in the field of law in order to achieve the desired social result through comprehensive study and regulation of these relations. Attention is drawn to the special classification of legal psychology as a special branch of law, as the latter combines the rules of law governing public relations and related to primary social relations aimed at concretization, strengthening certain rules of basic branches of law, while providing special legal regime for a particular type of social relations. By subordination in legal regulation, legal psychology belongs to the procedural types of branches of law, as it combines the rules of law that determine the procedure, the order for implementing substantive law (criminal procedure, civil procedure, commercial procedure, administrative procedure law). It is proposed to include legal psychology in an independent branch of law, given the presence of features that are inherent in the branches of law; the specificity of the regime of legal regulation; its direct connection with the needs of practice; recognition of its achievements in judicial practice; unification of certain legal relations in the subject of law; conditionality of functional purpose and the place of this industry in the legal system (its type in the classification of industries).

A New Era in the Implementation of Rehabilitation and Compensation Rulings in State Administrative Courts

The implementation of court rulings on rehabilitation and compensation in the State Administrative Court has entered a new era with the issuance of execution guidelines for the supervision of rulings with permanent legal force by the Head of the State Administrative Chamber of the Supreme Court of the Republic of Indonesia. These guidelines mark the first time in the history of the Supreme Court that a compensation amount has been reassessed and determined by the Serang State Administrative Court due to the failure to implement rehabilitation in an employment dispute. The compensation awarded does not refer to Government Regulation No. 43 of 1991, which limits compensation to between one hundred thousand rupiah and two million rupiah, but instead is based on the actual losses of the petitioner. This practice has set a positive precedent for the execution of compensation or monetary payments, which is expected to be followed by other State Administrative Courts. It is hoped that the Plaintiffs/Execution Applicants will follow the legal enforcement procedures outlined in the Minister of Finance Regulation Number 80/PMK.01/2015 regarding the Implementation of Legal Decisions, enabling the realization of compensation payments, and it is recommended that the Minister of Finance execute the legal decisions, especially the Supreme Court's re-determination regarding the compensation payment amount, so that justice for the Plaintiffs/Execution Applicants can be fully realized.

Trust in Philanthropy: An Examination of Multidisciplinary Factors

This article explores and consolidates the factors that influence the donor’s trust from cross-disciplinary literature, and we put factors from these different fields to the test in one topic: the donor’s trust in the fundraiser organisation. Grounded on the literature, we can say that there are nine themes of constructs that influence trust. This research utilised a quantitative survey approach and PLS-SEM as an analysis platform to analyse the data collected. We have discovered that our respondents who represent donors strongly agree that their trust is heavily influenced by perceived security, rule of law, organisational personnel personality, communication effectiveness, reputation, perceived integrity, and perceived competence. Cross-disciplinary studies are profoundly helpful towards deeper knowledge and enhance the learning experience and enable the transfer of ideas across many areas of study easier. The findings should contribute to the theoretical knowledge specifically on trust antecedent in the philanthropy setting and other disciplines. The findings presented in this paper may also be useful as input for fundraisers to build and strengthen the level of their donor’s trust. This article explores and consolidates all factors that influence donor trust, which has been published in the literature and presents the results from the cross-examination of these factors.

Beyond mitigation: building a case for collective rights and remedies for digital ID-enabled harms

ABSTRACT National digital ID systems have been promoted by both private and public sector actor actors as a means of fostering economic development and individual empowerment, and of administering a growing digital welfare state. However, these digital ID systems have also been associated with different forms of injustice and remain flashpoints for the contestation of public sector digitalization and datafication initiatives. The complex, intersectional impacts that such systems may have on social exclusion and human rights have made it challenging to articulate rights-based approaches that cover the range of potential injustices or to institutionalize legal and administrative mechanisms capable of remedying violations. This paper posits two ways in which the legal contestation of digital ID has revealed potential barriers to obtaining adequate remedies for digital ID related harm. First, a core methodological challenge is the way in which powerful narratives about the capabilities of digital ID have worked in tandem with individualizing logics of databases, making it difficult to center the collective experiences of affected groups and balance competing interests. Second, is the way in which legal frameworks have structured governance of national digital ID systems, fragmenting responsibility across institutions and individuals in ways that compromise access to justice, rule of law, and pathways to remedies. In bringing together a data justice framework with insights from legal analysis, the paper seeks to assess both limitations and potential opportunities to work through existing legal frameworks to better address the collective harms of digital ID systems.

On the Doctrine of the Direct Effect of European Provisions Regarding the Requirement of Enforceability

This paper analyses the interpretation of direct effect in terms of its contribution to the development of an efficient European legal system. A precondition for efficiency is the enforceability of provisions. The concept of direct effect, interpreted on the basis of a questionably adequate understanding of the concept of monism taken over from international law, should enhance enforceability by disabling national agents to interfere or to perform the “handover” of rights from the EU level to citizens. Such understanding leads to the national practice applying direct effect in a simplified, plain, and bureaucratic way, and distancing from the substance of provisions. In the cases where, intentionally or not, direct effect/direct applicability are sometimes denied and sometimes recognised to directives and regulations, the CJEU shows how to deal with such situations occurring in the activities of the European regulatory institutions. To fulfil its purpose, national agents applying European law should deploy the underutilised but demanding “shield and sword” approach regarding direct effect. Such an approach, which requires almost equally intense engagement as in the case of indirect effect (also insufficiently exercised at the national level), should defend individual rights from both national and supranational unfavourable influences. In doing so, fundamental rights and general principles encouraged and taken care of by the CJEU, which are and should be the cornerstone of the EU legal system, and which are ultimately a justification for the Member States to embrace the principle of supremacy of European law, should be taken into account.

Reconstructing the Cooperative Rule of Law as an Alternative for Economic Empowerment of Rural Communities in Indonesia

Cooperatives in the Indonesian economic system function as one of the efforts to achieve national development goals, namely creating a just and prosperous society in accordance with the principles of Pancasila and the 1945 Constitution. The legal basis of cooperatives in Indonesia is regulated by Law Number 25 of 1992 concerning Cooperatives. The purpose of this research is to study the development of cooperative law in Indonesia as an alternative to economic empowerment of rural communities, and analyse the legal construction of cooperatives as an alternative to economic empowerment of rural communities in Indonesia. This research is a normative legal research with a legislative approach and conceptual approach. The results show that the weaknesses in Law No. 25/1992 on Cooperatives, such as the unclear definition of cooperatives, unfulfilled principles, and lack of strict sanctions, indicate that the regulation needs to be reconstructed to address the existing problems and increase public trust in cooperatives. Thus, the reconstruction of Law Number 25 of 1992 on Cooperatives will not only improve cooperative governance, but also make a significant contribution to the economic empowerment of communities in Indonesia, especially in rural areas.

Sistem Pengelolaan dan Pengembangan Wakaf Secara Produktif di Pondok Pesantren Al-Uswah Kuala Kabupaten Langkat Menurut Undang-undang No. 41 Tahun 2004 Tentang Wakaf

The purpose of this study was to determine the productive waqf management and development system at the Al-Uswah Kuala Islamic Boarding School, Langkat Regency, and also to find out the forms of productive waqf management and development at the Al-Uswah Kuala Islamic Boarding School, Langkat Regency. This type of research includes empirical research with a qualitative approach. The subject of this study involved the Chairperson of the Al-Uswah Kuala Islamic Boarding School Foundation, Nazhir Waqf, and the Community, with a qualitative descriptive research analysis. The results of the research conducted show that the waqf management and development system productively at the Al-Uswah Kuala Islamic Boarding School, Langkat Regency is carried out by administering and collecting data on waqf assets, then recording them in a notarial deed so that they have permanent legal force, and carrying out maximum supervision so that the utilization Waqf assets are in accordance with their function and main objective, which is to develop Islamic education as a place to nurture true Muslims. Then, the productive management and development of waqf at the Al-Uswah Kuala Islamic Boarding School in Langkat Regency is carried out in two forms, namely the physical form in which waqf assets are developed by adding and constructing various buildings needed in the educational process at the institution. Apart from that, it is also being developed in the form of waqf management policies especially for the needs of the students, for example providing free tuition fees for orphans and high achieving students so as to help the Muslim community (santri's parents). While the form of waqf assets is distributed to the surrounding community in the form of donations such as groceries and so on at certain moments. So that the productive management and development of waqf assets is in accordance with Law no. 41 of 2004 concerning Waqf.

Legal Review of Ship Certification After the Issuance of Law Number 11 of 2020 Concerning Job Creation

This research examines the shift in authority and processes related to the certification of fishing vessels in Indonesia after the enactment of Law No. 11 of 2020 on Job Creation. The primary objective of this study is to analyze the legal force and implications of the transfer of authority from the Ministry of Transportation to the Ministry of Marine Affairs and Fisheries (KKP) in issuing fish vessel certifications. Using a normative juridical approach, this study investigates the procedural changes, challenges, and impacts of the new regulatory framework on fishing vessel safety and compliance. The findings show that the Job Creation Law simplifies licensing procedures while ensuring the safety and seaworthiness of fishing vessels. However, the study also highlights the challenges posed by a shortage of qualified inspectors, leading to delays in the certification process. This research underscores the need for regulatory adjustments and additional inspector training to align the maritime sector with the law’s goal of promoting safety and business efficiency.

SOME ASPECTS OF THE MILITARY POLICY OF MODERN RUSSIA WHEN ENSURING MILITARY SECURITY

The study presents conclusions from an analysis of the system of views on resolving the conflict between the collective West and Russia, a general understanding of the international security system aimed at achieving peace and security in conflict zones. Conclusions are drawn from the analysis of military policy, where humanity is experiencing an era of revolutionary change. In the confrontation with Western civilization, a strong state is needed, which must be built on legal principles that exclude the disorganization of society with a clearly formulated military policy based on the stabilization and development of all spheres of the Russian national economy. It is necessary to form a new legal paradigm, built on an ideological basis, based on the vision of the future of the country’s military security. An incorrectly defined military policy also leads to various practical actions of subjects, does not reflect the essence of the phenomenon, and leads to a decrease in the effectiveness of military security. Proposals are also made for the implementation of military policy in legislative and regulatory acts that acquire legal force and govern political processes. A defensive position in military policy in the current situation is unacceptable: no conquest without moving forward towards the goal is possible; it is necessary to initiate a new construction of the world order.

Ius Constituendum on the Doctrine of Unlawful Nature in the Law on the Eradication of Corruption After the Constitutional Court Decision Number 003/PUU-IV/2006

The unlawful teachings in the explanation of Article 2 paragraph (1) of the Law on the Eradication of Corruption have been considered by the Constitutional Court as a norm that is contrary to the Constitution of the Republic of Indonesia in 1945, and does not have binding legal force. This condition has legal implications for the meaning of unlawful elements in Article 2 paragraph (1) of the Law on the Eradication of Corruption, becoming vague (vague norm). The purpose of this study is to analyze the unlawful teachings in the Law on the Eradication of Corruption in Ius Constituendum. This research uses normative legal research, which formulates the aspired law (ius constituendum) on the meaning of the element against the law (wederrechtelijkeheid) in the Corruption Eradication Law after the Constitutional Court Decision Number 003/PUU-IV/2006. The results of the discussion show that by assessing the basis of the Constitutional Court's legal considerations (ratio decidendi) Number 003/PUU-IV/2006. The cancellation of the explanation of Article 2 paragraph (1) of the Law on the Eradication of Corruption which adheres to the teachings of the nature of the act of violating formal and material laws, because it is considered that the concept of materiele wederechtelijk, which refers to unwritten law, is an uncertain measure. The unlawful element in Article 2 paragraph (1) of the Law on the Eradication of Corruption Crimes is still interpreted as against formiele wedderechtelijkeheid and against materiele wedderecjhtelijkeheid in its negative function. As for its positive function, it must be considered contrary to the principle of protection and fair legal certainty regulated in Article 28D of the 1945 Constitution.

Objective To begin with, the plaintiff is questioned about the contents of his claim. The judge can make a decision with the help of local examination. When it comes to the construction of evidence in civil cases, the duties and responsibilities of local examination of the object of land dispute is an issue that arises. shows that local examination based on Article 153 HIR, Article 180 R. Bg or Article 211 Rv as well as SEMA No. 7 of 2001 does not reflect legal certainty because it does not regulate the mechanism of local examination in the field thoroughly, which leads to many interpretations. In addition, it is still ambiguous whether local examination is a means of evidence whose value is left to the judge or whether local examination is only an examination tool or method of obtaining evidence. Research Results and Discussion Local inspection results are a valid source of evidence in civil cases, local examinations have the following legal consequences: (1) court costs if the judge requests a local examination; and (2) the evidentiary power of the local examination.
