PELAKSANAAN BIMBINGAN PRANIKAH BAGI CALON PENGANTIN PENYANDANG DISABILITAS

Pre-wedding guidance is a mandatory series for every bride and groom who will get married. However, in its implementation in several KUA in Palembang there are still many prospective brides with disabilities who do not receive premarital guidance. Persons with disabilities have the same right to get the opportunity to take part in pre-marital counseling as bride and groom in general so that justice is created for all Indonesian people. The research method used is qualitative research with an empirical normative approach. This study aims to find out the implementation of premarital counseling for brides with disabilities at the KUA in Palembang city and to explain the review of Islamic law on its implementation. The results obtained from this study were that the implementation of premarital guidance for brides with disabilities at KUA Ilir Barat I, Ilir Barat II and Bukit Kecil was not effective because there were no specific rules governing the implementation of premarital guidance for persons with disabilities so that the organizers lacked preparation. However, on the other hand, prospective brides with disabilities already have the same rights as ordinary brides so they can attend marriage counseling at the KUA. According to Islamic law, the implementation of pre-marital guidance can be categorized as maslahah in order to achieve justice for prospective brides with disabilities in participating in marriage counseling at the KUA and are treated the same as ordinary brides. Anak Yatim dan Wali

Children are an important part of the younger generation who play a strategic role in shaping better families. Therefore, children need adequate guidance and protection to ensure their physical, psychological, mental, and social growth and development. This research discusses the management of orphaned children's assets in Gampong Mongeudong and the review of Islamic law and the Marriage Law on the management of orphaned children's assets. The research method used is field research conducted in the real life of the community. The results of the research show that the management of orphaned children's assets is done by family members, including fathers, mothers, grandmothers, or uncles. However, the process of determining the guardian of orphaned children does not comply with the provisions of the law. From the perspective of Islamic law, the maintenance of orphaned children's assets should be carried out by the guardian who is the closest relative in the line of guardianship. However, this guardianship must comply with several provisions, including the prohibition for the guardian to mix their assets with the assets of the child under their guardianship, the prohibition to excessively consume the child's assets, and the obligation to return the child's assets when the child reaches adulthood.

The Construction of Islamic Law on the Law on Halal Product Assurance from the Maqashid Sharia Perspective (Law No. 33 of 2014 and Law No. 11 of 2020 Article 48)

This article describes the construction of Islamic law on the halal product guarantee law that applies in Indonesia. The shifting of operators in halal product guarantees from private institutions to the government has strong legitimacy, which requires business actors to comply. The status of halal certification has increased from voluntary to mandatory in line with the 1945 constitution, and Sharia principles should be achieved. However, the weakness of this law is that there are no strict sanctions for business actors who need to certify their products. This type of research is an explanatory qualitative with a mashed Sharia approach and a review of Islamic law. The research findings show that Sharia obligations that do not contain legal sanctions cause individuals or groups not to comply; this has implications for Muslim consumers being unprotected from the need for halal products because there are still many products that are not halal certified. In conclusion, the construction of Islamic law regarding the guarantee of halal products in Indonesia is still weak but better than before.

Islamic Law Review of Discounts Obtained by Having Multiple Accounts on The Shopee Platform

The implementation of online buying and selling transactions through the shopee marketplace is included in the buying and selling category that is currently in vogue, because indeed the convenience offered is also the various discounts provided, including tempting discount promos including: price discount discounts, cashback, postage discounts and so on. Various methods have been used by some Shopee account users to get these discounts; one way is to have more than one Shopee platform account. The formulation of the problem in this study is how is the practice of having multiple accounts by certain users to get discount promos and what is the review of Islamic law on discounts that are obtained by having multiple accounts on the Shopee platform. The purpose of this study is to find out the practice of having multiple accounts by certain users in order to get discount promos and to find out an overview of Islamic law on discounts that are obtained by having multiple accounts on the shopee platform. The research method used in this study is a qualitative method. The main type of data source taken is in the form of primary data, namely interviews with Shopee account users, and secondary as supporting data obtained from literature studies such as the Al-Qur'an, hadits, books of fiqh, books, previous research, journals and others. Data collection techniques include interviews, observation and documentation. The data analysis technique in this study is a descriptive way of explaining the research problems by describing the events that occurred and using the legal basis to discuss the problems of the study in this research, namely Islamic law. The results of this study are that buying and selling through the shopee platform as well as the discounts provided are permissible in Islam, but the practice of using multiple accounts on the shopee platform is a sharia violation because this practice is included in the tadlis category and also violates the ethics of honesty in buying and selling.

AKAD NIKAH DENGAN VIDEO CALL

The discussion in this research is a review of Islamic law regarding the issue of marriage contracts via video calls that have ever occurred. The data studied is the fatwa of the Ulama' of the Syafi'iyyah madzhab with more focus on the fatwa of Habib Zain bin Ibrahim bin Smith. Regarding this research, researchers tried to analyze the fatwa of Habib Zain bin Ibrahim bin Smith as the main study material. By using a literature review through technical fatwa analysis. This analysis aims to find out more deeply and critically about fatwas related to the problems above. The existing data was obtained from reading classical and contemporary jurisprudence literature, focusing more on the fatwa of Habib Zain bin Ibrahim bin Smith in the book Fawaidul Mukhtarah Li Salik Tariqil Akhirah. The data is then collected and used as a legal comparison. Through this research, the following results were obtained: Description of the practice of marriage contracts via video call. Legal fatwas that can be used as a reference if a marriage contract takes place via video call. Legal conclusions and results of fatwas regarding marriage contracts via video call. Plus there is a solution if the marriage ceremony takes place via video call.

Along with the needs of Muslims for the translation of the Qur'an, various types of translations of the Qur'an emerged. Especially in this global era, Muslims are competing to provide translations of the Qur'an in digital form and make them available on websites that can be easily accessed. This study describes the review of Islamic law in the online translation of the Qur'an per word. A translation of the Qur'an by word (TQK) into Indonesian is available on websites. The purpose of this study is to explain the suitability of the practice of translating the Qur'an online word by word in accordance with Islamic law. The approach used in this research is to use a qualitative approach, which is library research, namely utilizing library resources to obtain research data. Then they were analyzed with research methods.

real goal of marriage is to build a prosperous family, not just a connection between two genders. One of the pillars in marriage is the dowry. Dowry is a husband's gift to the wife. Uniquely in Indonesia, dowry in certain customs, the amount is determined. one of them is banjar custom in Senyerang Village. In determining the dowry they have a tradition known to be honest. In this study, it is categorized as field research, and is ethnographic research. This research not only describes certain characteristics, but also analyzes why and how these things happen. The data collection techniques used in this study were in-depth interviews, observations and literature studies. The results showed that the dowry and honesty in the Banjar community in Senyerang Village were different, the amount or amount of honesty was influenced by several factors, Among them: the level of education, the parents of women and the level of beauty. But everything remains within the agreement of both parties. The review of Islamic law analyzes the honest law that exists in the society, which is contained in the honesty, namely help and the law is okay as long as it does not bring mudharatan according to Islamic teachings.

ANALISIS PRAKTEK JUAL BELI BARANG SITAAN DALAM PERSPEKTIF HUKUM ISLAM (Studi Kasus di Pondok Pesantren Raudhatul Ulum 1 Ganjaran Gondanglegi Malang)

Tinjauan Hukum Islam terhadap Penerimaan Dana Coorporate Social Responsibility (CSR) dari Bank Konvensional

This study aims to determine the nature of CSR and the law on the receipt and use of CSR funds in a review of Islamic law. The type of research used is descriptive qualitative (non-statistical) with a normative approach and library research methods. The results of the study show that CSR in an Islamic perspective is a business practice that has an Islamic ethical responsibility. The company incorporates Islamic religious norms which are marked by a sincere commitment to maintaining social contracts in its operations. Even though there is no limit to the amount of ownership of goods, services and profits, the ways to obtain and utilize them are limited by lawful and unlawful rules laid down by Shari'a. The view of Islamic law on receiving CSR funds from these conventional banks is detailed as follows. First, when viewed from the benefit in particular, leaving the funds/assistance provided and offered from these conventional banks, whether in the form of sweepstakes, prizes, or social responsibility programs, is better because it is something that comes from unlawful assets (usury). Second, however, if we look at the general benefits, it is permissible for us to take CSR assistance/funds from these conventional banks but not to use them for personal needs, namely to use them for public needs and benefits, such as for building bridges, repairing roads, making toilets. general, and so on.

Sistem Bagi Hasil Pengelolaan Sawah Perspektif Hukum Islam (Studi Kasus Desa Pakkanna, Kecamatan Tanasitolo, Kabupaten Wajo)

This study aims to find out the review of Islamic law regarding the implementation of profit sharing in the management of rice fields in Pakkanna Village, Tanasitolo District, Wajo Regency. The type of research used is qualitative research in the form of field research with a normative and social approach. The results showed that the cooperative system for managing ricefields in Pakkanna Village used a profit-sharing system called the maruma system, in which the land owner gave his ricefields to cultivators to work on, while the seeds came from farmers. The distribution is 2:1, where 2 parts are for sharecroppers and 1 part is for landowners. Contract agreements are only made verbally, because of mutual trust. The profit-sharing system in Pakkanna Village, in Islamic law, has met the requirements because the contract is based on the Qur'an and hadith. In addition, this contract has become a custom that does not conflict with syara' and law, so the use of the profit sharing system is permissible.

Tinjauan Hukum Islam Terhadap Praktik Jual Beli Online Dengan Sistem Lelang

Buying and selling with an auction system on social media is one of the new transactions, especially buying and selling auctions on Instagram social media and is not yet known in Islamic law. Therefore it is necessary to conduct research to analyze the mechanism of buying and selling auctions on Instagram social media according to a review of Islamic law. The purpose of this study is to find out the review of Islamic law on the practice of buying and selling online with an auction system (a case study of buying and selling ornamental fish on Instagram social media). This research is a field research, namely observing directly objects related to the problem. To support this, a normative approach is carried out by looking at and discussing the problems of buying and selling ornamental fish auctions on Instagram social media. Data collection techniques with interviews and documentation. Data analysis used descriptive qualitative analysis. The results of the study can be concluded that the sale and purchase of ornamental fish auctions on Instagram social media has fulfilled the requirements prescribed in Islamic law (fulfillment of the elements of the actor, object and consent qabul and the conditions). However, there are still a number of violations committed by auctioneers, namely sending items that do not match the photos or videos, and there are unscrupulous auctioneers who make fake bids to increase the auction price, while violations committed by auction participants are not making payments.

Peran Politisi Perempuan Dalam Memelihara Keharmonisan Rumah Tangga Persfektif Hukum Islam (Studi Pada Dewan Pimpinan Daerah Partai Golkar Provinsi Bengkulu)

Abstract: The formulation of the problems that will be raised in this study are: 1. What is the role of women politicians in maintaining household harmony in the Regional Leadership Council of the Golkar Party in Bengkulu Province? 2. Basically, Islam does not prohibit women from participating in both the domestic and public spheres. The obligatory role of women in the domestic sphere is as a wife to her husband and mother to her children. Meanwhile, as a member of the community in matters of muamalah in the public domain, they are punished with an emergency rukhshah. This means that even though it is permissible, women must still follow existing Islamic rules, including when leaving the house they have to cover their private parts, get permission from their husbands and always prioritize the aspect of benefit both for the household and for the community. If it causes more harm to the family then professions outside the home must be abandoned considering something that is an emergency cannot leave things that are mandatory. Perkawinan pring sedapur : Tinjauan Urf’ dan Masalahah Mursalah

The prohibition of pring sedapur marriage is a marriage performed between a man and a woman who have the exact same weton. Although the majority of the residents of Kedungsari Village are Muslims, they still think that if this marriage is carried out, it will bring disaster. This study aims to find out in detail the explanation of pring sedapur marriage and to find out the review of Islamic law against the prohibition of pring sedapur marriage in Kedungsari, Tayu District, Pati Regency. This study uses the field research method with a qualitative approach. The sources of data for this study were primary data sources and secondary data. The subjects of this study were weton experts, village elders, community leaders, religious leaders, and perpetrators of the marriage. Data collection techniques in this study were carried out by means of observation, interviews, and documentation. Based on the data collected and analysed, it can be concluded that: 1) The definition of pringsedapur marriage is a marriage performed by a man and a woman where the couple has the exact same weton. This tradition still applies in Kedungsari village because the community believes that if the marriage is carried out, it will bring disaster to the perpetrators of the marriage itself and their families. 2) The prohibition of pringsedapur marriage cannot be used as a benchmark that prevents marriage because it is not compatible with slamic law and not regulated in the Qur'an or hadits. In terms of 'urf including 'urf fasid, and maslahah mursalah including maslahah mulghah.

TINJAUAN ISLAM TERHADAP PEREMPUAN BEKERJA

This paper is a review of Islamic law concerning working women. Many people still believe that women are second-class individuals who cannot seek employment outside of their homes. Regardless of whether there are, many of them are still under the cynical view of a conservative society that considers that women's duties and obligations are only done from within their homes. In some countries, such as Saudi Arabia and Afghanistan, restrictions on working women have even become written rules that must be followed. The concern is what will happen to Indonesia as a country with a Muslim majority. The goal of this paper is to investigate the law of working women from an Islamic perspective. Based on the descriptive qualitative research method and the sociological normative approach, it can be concluded that the law of working women is permissible. Islam even supports women who work to ensure the financial independence of their families.

SANKSI DUDUAK BASIGHIAH DI JORONG CENDRAWASIH NAGARI TIGO JANGKO KECAMATAN LINTAU BUO

Relevansi Hukum dengan Undang-Undang No. 11 Tahun 2020 tentang Cipta Kerja Menggunakan Pendekatan Maslahat

The main problem in this research is to examine issues regarding the concept of Law Number 11 of 2020 concerning Job Creation Using the Maslahat Approach, regarding the view of Islamic Law regarding Law No. 11 of 2020 concerning Job Creation, the benefits of Law no. 11 of 2020 concerning Job Creation for workers and the existence of Law no. 11 of 2020 concerning Job Creation from the perspective of Sharia Economic Law. The type of research used in this research is library research (Library Research). The data sources used are primary data and secondary data. The results of this study are that the review of Islamic law in Law no. 11 of 2020 concerning Job Creation is a form of maintaining the soul (hifzh al-nafs) in principle maqashid syari'ah as a means of defending their economic right to survive. As for the benefits of Law no. 11 of 2020 concerning Job Creation that can be felt for now, namely: creating jobs, encouraging investment, permitting systems that are easier and faster, and investment requirements made easier. The value of Sharia Economic Law in terms of Law no. 11 of 2020 concerning Job Creation, providing Islamic economic growth, especially to the Islamic finance industry in Indonesia such as Islamic Banks, Non-Bank Islamic Financial Industry, Islamic Cooperatives and Islamic Capital Markets, in the future there will be great opportunities in running their business.

TINJAUAN HUKUM ISLAM TERHADAP PERKAWINAN WANITA HAMIL: STUDI KASUS DI KANTOR URUSAN AGAMA KECAMATAN PASAR KLIWON KOTA SURAKARTA

The purpose of this study was to determine the process of registering a pregnant woman's marriage and reviewing Islamic law on the implementation of a pregnant woman's marriage at the Office of Religious Affairs (KUA) in Pasar Kliwon District, Surakarta City. This research is a qualitative research with the research subject being the Head of KUA, Pasar Kliwon District, Surakarta City. Data was taken using observation, interviews and documentation. While data analysis by means of data reduction, data exposure and draw conclusions.The results of this study are that the process of registering a pregnant woman's marriage registration is the same as the marriage procedure for women in general or women who are not pregnant, it's just that in a closed forum (jonggolan) the head of the kua gives requirements containing that he is the man who actually got her pregnant and written on a stamp of 6,000. Then a review of Islamic law on the Implementation of Marriage for pregnant women at the Office of Religious Affairs in Pasar Kliwon District, Surakarta City for a woman who is pregnant can be married as long as the person who is married is a man who actually gets her pregnant, in accordance with the opinion of the majority of scholars' and article 53 Paragraph 1 KHI as for a widow who is pregnant may not be married unless she is allowed to be married as long as she has given birth.

Zakat Hasil Pertanian di Desa Poncowarno Kecamatan Poncowarno Kabupaten Kebumen

Agricultural zakat is a zakat that is imposed on a filling staple food, on a country that has sufficient nisab and haul. The crops that are obligated to pay zakat are grains and types of staple foods that are filling and durable if stored, such as rice, dates, corn, wheat and so on. The purpose of this study was to determine: (1) the implementation of zakat on agricultural products in Poncowarno village, (2) a review of Islamic law on the implementation of zakat on agricultural products in Poncowarno village. The method used is a qualitative method with interviews, observations, and documentation. The data analysis technique in this research is descriptive qualitative. The results of this study indicate that: (1) that the practice of implementing zakat on agricultural products in Poncowarno village is carried out by the community releasing the harvest they get every year for 2 seasons in the form of dried rice which will then be weighed and the zakat calculated after it is taken from net income. Then the distribution is carried out independently to the poor. (2) A review of Islamic law on the process of implementing zakat on agricultural products in the village of Poncowarno Kebumen in practice from 12 farmers 6 of them are in accordance with Islamic law because in terms of nishab they have fulfilled/achieved and issued various zakat, some are 5% and some are 10% according to the law he follows and according to the level of agricultural zakat that must be issued. The other 2 have reached the nishab but in issuing zakat it has not been according to the levels in Islamic law. While the other 4 have not reached the nishab.

TINJAUAN HUKUM ISLAM TERHADAP PRAKTIK JUAL BELI RAMBUT SISTEM BORONGAN PADA JASA POTONG RAMBUT

The practice of buying and selling wholesale systems is one of the buying and selling practices that is commonly carried out by many business actors, one of which is a haircut service business actor. With the many practices of this wholesale system, it is necessary to have a clear review of Islamic law as the basis for the practice of buying and selling. Several opinions from various schools of thought regarding wholesale buying and selling and buying and selling of prohibited materials can become the basis for the practice of buying and selling wholesale carried out by hair cutting services.

Gelar Ata (Budak) pada Masyarakat Bulukumba dalam Perspektif Hukum Islam

This study aims to: (1) describe the description of slavery in Bulukumba; (2) analyze the review of Islamic law against slavery in Bulukumba with the system of awarding the title Ata. This research is a qualitative research using library research and using a normative juridical approach. The results of the study show that: (1) slavery against Ata today is no longer the same as slavery during the kingdom, which was very thick with caste division and slavery. The current system of slavery against Ata is not much anymore and is slowly starting to fade due to the progress and developments of the times, but there are still some people in Bulukumba who apply the system of slavery against Ata because they adhere to customs and think that their slavery is legal because it is a tradition. hereditary; (2) slavery in Bulukumba with the system of giving the title Ata is an act that deprives human rights and freedoms because the essence of Islamic law aims to uphold human rights and equal rights between men and women. Islam does not discriminate against skin color and ethnicity, all are equal before Allah. Therefore, Islam is a religion that does not justify slavery by depriving human rights and freedoms, and doing injustice to others. This is similar to slavery that occurred in the Bulukumba community with the system of giving the nickname or title Ata to certain groups of people, then being enslaved for generations, which is a form of action that is not allowed in Islam.
