Pendampingan Persiapan Menuju Pendaftaran Tanah Sistematis Lengkap Di Desa Matangaji

Community enthusiasm decreased when the legalization program initiated by the Government failed to be implemented well in Matangaji village, Cirebon Regency. The purpose of this writing is to regenerate people's interest to register land. The method used is by providing counseling and mentoring. The results of the research show that the majority of the Matangaji village community is no longer interested in registering their land. They think that having controlled a piece of land for a long time, since elder generation, is sufficient as an owner even though they don’t have land certificate. Counseling and mentoring provided by KKN students, limited knowledge and lack of legal awareness regarding the importance of proof of ownership of land rights began to gradually disappear. Mentoring is a differentiating factor because the community feels helped to fulfill land registration requirements. The people of Matangaji village hope that the PTSL program will soon be carried out again.

The purpose of this research is to analyze the legal consequences of a land sale and purchase agreement under a former eigendom right (customary law) based on customary law and Government Regulation Number 24 of 1997 concerning land registration. The study also aims to construct the procedure for land registration applications on the former eigendom right based on current applicable regulations. This research adopts a normative legal research approach with legislative and conceptual approaches. The results of the research indicate that a land sale and purchase agreement under a former eigendom right cannot be registered with the land office as the institution issuing land certificates, even though the agreement is considered legally valid under customary law because it adheres to the principles of real, cash, and clear. The land office accepts the application for registration of land under the former eigendom right based on the regulations, namely the Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 18 of 2021 concerning Procedures for Determining Management Rights and Rights to Land, Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 3 of 2020 concerning Procedures for Determining and Registering Rights to Land Formerly Owned by Individual Citizens of the Netherlands or Legal Entities Owned by the Netherlands, Minister of Agrarian and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Regulation Number 16 of 2022 concerning Delegation of Authority for Determination of Land Rights and Land Registration Activities, and Minister of Finance Regulation Number 31/PMK.06/2015 of 2015 concerning Settlement of Former Foreign/Chinese-Owned Assets.

Issues Of The Land Office In Determining Land Rights On Duplicate Certificates

Land is one of the fundamental sources of human life, ensuring human survival. Every individual who owns land requires proof of ownership, namely a land certificate, which is issued by the Land Office. Certificates can be issued upon land registration with the aim of providing protection and legal certainty to land rights holders. However, it is not uncommon for issues to arise with some land certificates, leading to legal disputes, such as Duplicate Certificates. The purpose of this research is to identify, analyze, and examine the issues in determining land rights holders in cases of Duplicate Certificates. This research employs an empirical legal research approach, conducted at the Land Office of the ATR/BPN in Klaten Regency. It is supported by literature review to obtain necessary data such as theories, doctrines, principles, and other legal provisions. Secondary legal sources used include textbooks, legal dictionaries, legal journals, and commentaries on court decisions, which are relevant to primary legal sources and aid in the analysis of this research. The findings of this research indicate that the issue arises when disputing parties fail to reach an agreement through mediation, leading to legal proceedings in court and ultimately, a binding legal decision.

KONUT İŞLEM HACİMLERİ ARACILIĞIYLA KONUT PİYASASININ MEKANSAL ANALİZİ: MENTEŞE, MUĞLA

As there is a reciprocal relationship between the patterns of investor decisions, local and central government strategies, household mobility, and housing transactions have repercussions on both macro and micro scales. Housing transactions within a metropolitan region can alter certain neighbourhood dynamics through the cycle of housing sales regarding urban development patterns, socio-economic characteristics of the residents, tenure type, neighbourhood, and housing quality. Even though the connection between neighbourhood dynamics and housing transactions is undeniable for spatial disci-plines, there are very limited studies for that matter. This study aims to explore the housing market dynamics of Menteşe via housing transactions. It employs three different datasets (Open Street Map (i), Household, housing and office data collected by the Turkish Statistical Institute (ii), Title deed transaction statistics by The Directorate of Land Registry and Cadastre (iii)). For spatial heterogeneity, Moran’s I, and spatial randomness, a local indicator of spatial association (LISA) has been applied. The findings revealed the role of centrality and the importance of mixed land use in housing markets even though all the neighborhoods on the periphery are very close to the city center in terms of distance.

ONE SOLUTION OF DIGITIZING LAND SERVICES TO PREVENT LAND MAFIA IN NIGERIA

This research aims to analyze the solution of digitizing land services to prevent land mafia. The approach method used in this research is a sociological juridical approach. The research specifications used are analytical descriptive research. This type of data uses primary data and secondary data obtained through interviews and literature study. The data analysis method used in this research is descriptive analysis. The research results were concluded: 1). The implementation of digitization of land services is carried out through a special agrarian internet site. Currently, the Ministry of Agrarian Affairs has implemented four digital land services, including Electronic Mortgage Rights, checking certificates, Land Registration Certificates, and Land Value Zone information. There are two electronic services that will be added by the AGRARIAN Ministry, namely land sale and purchase deeds and transfer of rights. The implementation of digitalization of land services at AGRARIAN AGENCY Nigeria, apart from using a special agrarian internet site, is also carried out through the Touch application. Touch My Land is an application created to answer various community land problems. 2) The effectiveness of digitizing land services to prevent land mafia can effectively prevent land mafia practices and achieve the strategic goals of the Ministry of Agrarian Affairs.

An Elixir for Blockchain Scalability with Channel based Clustered Sharding

Blockchain refers to distributed ledger technology which stores records without the help of a central authority. Born with bitcoin, this brainstorming technology finds its applications in healthcare, land registry, education, pharmaceutical industry, digital records, manufacturing companies and so on. The properties of blockchain such as immutability, distributed nature, tamper-resistant made it a disruptive technology in many applications. The highlighting feature of this pioneering technology is the distributed storage of ledger on all the nodes of the network. This helps to achieve decentralization without the trust for third party. The transactions are proposed, executed, validated and are then added as blocks to the blockchain. The problems with all the blockchain framework is scalability with respect to storage space and throughput. Scalability is the most significant factor to be considered in this big data era. This article proposes a solution called Channel Based Clustered Sharding (CBCS) approach for Hyperledger fabric blockchain framework. In this work, a lookup table is maintained which helps in forwarding the transactions to the clustered shards for validation. The CBCS approach helps in parallel transaction processing which in turn improves scalability and throughput of the system. The performance of the proposed work is measured with the help of Hyperledger caliper, a benchmarking tool for the performance analysis of Hyperledger fabric. The results show that the performance of the proposed system is increased from 3000 tps to 30,000 tps.

The granting and imposition of mortgage rights for granting APHT by the PPAT in front of the parties then submitting the APHT to the land office based on the obligations provided by the Mortgage Law, PP on Land Registration and PP on PPAT Position Regulations where the PPAT is required to submit the original sheet of the second APHT and its supporting papers to the land office in physical form, but after the entry into force of the ATR/BPN Ministerial Regulation concerning electronic HT, it stipulates that the intended submission can be made electronically. Based on this, the author wants to examine the status of land registration of mortgage rights through electronic means and the responsibilities of the PPAT. The writing method uses normative juridical research and based on the results of the research it is known that submission of APHT which is no longer through submission of original files brings legal consequences for the PPAT namely the PPAT is responsible for the existence and integrity of all APHT documents stored in it.

Pengaturan BPHTB Terutang dalam Penyelenggaraan Program Pendaftaran Tanah Sistematik Lengkap (PTSL)

This paper aims to review the legal certainty of the regulation outstanding land and building rights “perolehan hak atas tanah dan bangunan” (BPHTB) in the implementation of complete systematic land registration “pendaftaran tanah sistematik lengkap” (PTSL). This study uses normative research with legal approach that related regulation land registration. The problems in this study are in the presence the norm conflicts between article 33 point 1 and 2 “ Peraturan Menteri Agraria dan Tata Ruang Nomor 6 Tahun 2018” about complete systematic land registration that holders of land rights from PTSL have the obligation to pay BPHTB that contrary to article 3 “Undang undang Nomor 20 tahun 2000” about the Duty to Obtain Land and Building Rights which states that government programs for development are not objects of BPHTB.

Remediation Technologies of Contaminated Sites in China: Application and Spatial Clustering Characteristics

Screening remediation technologies through the lens of green, low-carbon, and sustainable development is crucial for contaminated land management. To better understand the applicability of remediation technologies, this paper explored their application in China based on a survey of 643 cases. By employing coupled analysis and local spatial autocorrelation methods, this study reveals the alignment between remediation technologies and pollutants, along with their spatial distribution and clustering patterns. Specifically, the four primary remediation technologies identified were cement kiln co-processing (CKCP), chemical oxidation/reduction (CO/CR), thermal desorption (TR), and solidification and stabilization (S/S), collectively accounting for over 90% of the cases. Additionally, our findings indicated significant variation in how different pollutants respond to remediation technologies, largely attributable to the characteristics of the pollutants. We observed High–High clustering patterns for CKCP, CO/CR, TR, and S/S. These were predominantly found in Jiangsu, Chongqing, Shandong, and Guizhou for CKCP and CO/CR and in Hebei, Jiangsu, Shanghai, and Chongqing for CO/CR. TR exhibited a High–High clustering in Shanghai, as did S/S. This research contributes to reducing the economic and resource costs associated with the trial-and-error of screening contaminated soil remediation technologies, offering valuable scientific and technological guidance for contaminated land regulation.

Implementasi Pendaftaran Tanah Sistematis Lengkap (PTSL) sebagai Perwujudan Kebijakan Publik di Kota Surabaya

The Complete Systematic Land Registration Program (PTSL) aims to accelerate the process of registering land parcels throughout the territory of the Republic of Indonesia. This is also applied by Dr. Kelurahan. Soetomo City of Surabaya. The purpose of this research is to explore the implementation of the PTSL policy in Dr. Soetomo City of Surabaya, taking into account the theory of public policy implementation according to George C. Edward III, there are 4 (four) indicators, namely communication, resources, dispositions, and bureaucratic structure. This research method is to apply a type of qualitative approach. Data comes from both primary and secondary. Data collection was carried out by interviews, observation, documentation, and data trackingonline. Data analysis was carried out using reduction, triangulation, and concluding as well as verification methods. The results of the study show that communication in the PTSL program has not been realized properly, as a result of the socialization delivery that has not been maximized. The resources in the PTSL program have been maximally realized, starting from people, budget, as well as facilities and infrastructure. Disposition has also been maximized, with good employee attitudes. The bureaucratic structure is good with a neat flow, but it is not strong enough because some employees are not placed according to their expertise. Implementation of PTSL policy in Kelurahan Dr. Soetomo City of Surabaya has thus been implemented well, but not optimally. due to communication factors and bureaucratic structures that are not running according to goals and plans.

The Importance of Community Legal Awareness in Land Registration

This study aims to determine and analyze the level of legal awareness of the community in Manuju District, Gowa Regency in registering their land, to find out the factors that influence the community in Manuju District, Gowa Regency in registering their land. This research uses empirical method. The research location is in Manuju District, Gowa Regency. The results of this study indicate that the level of public legal awareness in the context of land registration in Manuju District, Gowa Regency can be said to be sufficient. Judged from several aspects, namely sufficient in legal knowledge, legal understanding, legal attitudes, and community behavior. The inhibiting factors for the community in Manuju District, Gowa Regency in registering their land are lack of understanding of the functions and uses of land certificates, thinking that the land registration process takes a long time, the costs incurred in the land management process and tax payments, the supporting factors for the community in registering their land are that it can create a sense of security, obtain legal protection, can be used as strong evidence in the eyes of the law, increase selling value, and improve the community's economy, and facilitate the transfer of rights. The government should more often conduct socialization about the importance of registering land, the community should ask the local government or use the services of land officials if they do not know the land registration process.

Planning and construction of the British concessions and settlements in modern East Asia (1845–1876): Shanghai, Yokohama, and Tianjin

ABSTRACT Under British informal imperial policy, East Asia’s system of concessions and settlements rapidly spread and promoted modernization. Especially in the mid- to late nineteenth century, the formative phase of the concession system, Shanghai, Yokohama and Tianjin embraced modern Western urban planning and architectural ideas by implementing Land Regulations (LR). A comparison of institutions, policies and mutual influences resulting from British colonization in these three cities can reflect the intricate internal and external factors that shape their local modernization, which helps explain the urban development trajectory in East Asia. However, existing studies lack comprehensive comparative analysis, exploration of institutional motives for spatial formation and examination of correlations between urban management patterns. Therefore, this study aims to situate the relation between colonialism and modernization in East Asia through an analysis of promulgation process, content changes and spatial impact of LR, the fundamental law of the concessions. This study shows that LR had an inheritance influenced by Consul Alcock. Characteristics of modern urban planning emerged in management and space. The modernization process was shaped by the development of the British native urban governance system, changes in colonial policy and the different social contexts of China and Japan.

KONSTRUKSI HUKUM PENYELESAIAN SENGKETA PERTANAHAN ATAS TANAH EKS EIGENDOM YANG BELUM DIDAFTARKAN NAMUN TELAH DIKUASAI PIHAK LAIN

The increasing demand for land due to population growth gave rise to a focus on agrarian law. The pre-1960 dualism of land law (Western land and customary law) ended with the agrarian Basic Law (UUPA) of 1960, which unified land regulation. The UUPA aims to simplify land law for the benefit of the people. The conversion of eigendom rights is regulated by the UUPA, but the settlement of land disputes, although it can be done through non-litigation channels, often leads to litigation, especially in complex cases such as eigendom rights, conversion, and land ownership. This study raises two problems, namely the legal consequences of the former Eigendom land that has not been registered but has been controlled by other parties and the legal construction of Land Dispute Resolution on the Land of the former Eigendom that has not been registered but has been controlled by other parties.This research is normative legal research, with legislation and case approach. The technique of collecting legal materials used by the authors in this study is to collect data by reading and reviewing some literature. The result of this study is that Article 24 of Government Regulation No. 24 of 1997 on land registration provides legal consequences for owners of eigendom deeds who have not registered their land, triggering disputes with communities who have controlled the land. To minimize disputes, it is necessary to establish an alternative institution for resolving land disputes in Indonesia, such as the ex-Eigendom land examination Institute

Stelionaat Crime from a Criminal Law Perspective and Islamic Criminal Law

This research was conducted to analyze how Islamic law and criminal law view land grabbing (Stelionaat). Soil is something that is essential for human life so it is a very vital object, and at the same time problems often occur in it. This research was conducted using qualitative income with primary and secondary data sources. The results of the research revealed that there were specifically no Islamic regulations regarding land grabbing, but Caliph Umar once punished someone for committing this act. Meanwhile, criminal law is generally regulated in Law no. 5 of 1960 concerning Agrarian Principles (UUPA) and government regulation Number 24 of 1997 concerning land registration.

The Impact of Non-Point Source (NPS) Management on Non-Point Source Reduction and Water Cycle Improvement in an Urban Area

Suwon, the capital and largest city of Gyeonggi-do, South Korea, was designated as a non-point source management area in 2010. The management period ended in 2020, so follow-up measures are needed. In this study, we investigated several projects implemented in Suwon for urban water cycle improvement and non-point source pollution reduction, and the long-term management effects were analyzed to suggest policy directions such as the revision of designation notices. During the 10-year management period in Suwon, the population and lot area continued to increase, and the non-point source-based annual Biochemical Oxygen Demand (BOD) discharge loads also increased by approximately 25% at the half sub-basins Hwangguji-cheon and Woncheonri-cheon in 2020 compared to 2010. Even under these conditions, statistical analyses show that the Biochemical Oxygen Demand (BOD) and Total Phosphorus (TP) concentrations monitored at the outlet of basin were decreased due to the promotion of a large-scale sewer management project as well as non-point source pollution reduction projects. Also, the field monitoring data-based Load Duration Curve (LDC) analysis results indicate that the loads decreased in the high-flow period of 2020 compared to 2015. Also, the Normalized Difference Vegetation Index (NDVI) values calculated using satellite images since 2017 tended to increase slightly during the period when the impervious area estimated using the land registration map increased. It is assumed that using the current calculation method for impervious areas has limitations regarding its ability to reflect changes in the small-scale Low-Impact Development (LID) facility and in ecological/landscape areas. On the other hand, the annual variation in direct runoff estimated at the outlet using three hydrograph separation methods did not show any improvement with regard to storm water retention during the management period. These results reveal that the effects on urban water cycle improvement, such as peak flow reduction and base flow increase, may not be noticeable despite some progress in reducing non-point source pollution and increasing green area. Therefore, additional efforts directed towards non-point source pollution management focused on water cycle improvement are required in the city, especially in the sub-basins with higher pollution loads such as Hwangguji-cheon and Seoho-cheon.

Introduction: Based on the reality that occurs in everyday life in the environment where the author lives, namely in the village of Waemulang, Leksula sub-district, South Buru Regency, where the community The problems that occur in the Waemulang village community in South Buru district are related to the cancellation of land rights certificates that occur in today's society. This, started with the existence of a government program regarding the National Agrarian Project Operation (PRONA) for making certificates of land rights.Purposes of the Research: This writing aims to find out the procedures for obtaining certificates of land rights based on government programs, to find out what are the grounds for objections to the issuance of land title certificates issued by the national land agency, and as one of the academic requirements in completing studies at the Faculty of Law, University of PattimuraMethods of the Research: The normative juridical research method is descriptive analysis in nature, namely obtaining data from the library in the form of documents, books, magazines and other literature related to writing. The source of legal material used is Primary legal material, Secondary legal material, and Tertiary legal material and used as a technique for collecting legal material, then processing and analyzing legal material through qualitative analysis, namely the data obtained is then systematically arranged for further qualitative analysis based on scientific disciplines. Civil law to achieve clarity of issues to be discussed.Results of the Research: The results of the study show that the procedure for issuing land certificates in obtaining land rights is carried out by the land registration process, so that there is a guarantee of legal certainty for all right-holders, while the procedure for obtaining land rights, namely the procedure for land registration is carried out sporadically at the request of interested parties, and procedures Systematic land registration is carried out according to work plans carried out in designated areas. A conflict can lead to disputes so that dispute resolution can be done in several ways: Dispute resolution through formal courts, through administrative efforts and through lawsuits.

The Patterns of Ownership and the Registration of Customary Land in Manggarai Regency, Indonesia

This research analyzes ownership patterns and the process of legalizing customary land in Manggarai Regency. The research method used is qualitative with a descriptive approach and uses secondary data. Normative socio-juridical methods are also used to view and analyze the research data that has been collected. Data was collected through observations and interviews with traditional elders and members of traditional communities. The results showed that the legalization of Ulayat land greatly affected the pattern of land ownership in Manggarai and the change of entities from indigenous land to non-indigenous land that was initially jointly controlled or communal into individual rights due to the legalization or registration of land. Legalization of Ulayat land with a public dimension can only be done by measuring, mapping, and recording it in the land register. Meanwhile, Ulayat land with private dimensions can be issued a land certificate for individuals with a release mechanism from the customary leader to be used as state land. This legalization resulted in the depreciation of Ulayat land and the fading of customary bonds in Manggarai. This research provides insight into land legalization's legal and social impacts on Manggarai, highlighting significant changes in ownership structures and the loss of customary values.
