The Catalog of Procedures as Part of Recordkeeping

The Regulation of the Government of the Republic of Serbia on recordkeeping of state administration bodies, which applies to other holders of public administration bodies from 2023, adapted recordkeeping to the needs of e-administration. The designed ePisarnica (Serbian erecords centre) as a unique software solution for recordkeeping and managing centralized registry of records, and a unique system for managing documents as a separate software solution, caused a number of changes in the way of managing registries on files in regard to the so far way of recordkeeping. The catalog of procedures is a new element in office business, it is a record of all administrative and non-administrative procedures of administration bodies and entities exercising public powers. The catalog also contains a codebook of records categories with retention periods. The paper will show the development and innovations in recordkeeping and the role of the catalog of proceedings in the central record of cases with special reference to the catalog of proceedings of provincial bodies.

Actions by administrative authorities justified by a state of higher necessity

This article deals with the actions of the administrative proceeding authorities justified by a state of higher necessity. In Poland, the state of higher necessity does not constitute a title for the encroachment of public administration bodies on the rights and obligations of persons without a legal basis. In terms of its essence, the state of force majeure under the Administrative Procedure Code is not uniformly understood. It may be treated narrowly or broadly. However, regardless of its treatment, it conditions the application of special and very often inherently exceptional solutions. This includes issuing decisions with the application of special regulations in matters of peace, security and public order, and sometimes in situations dictated by an even differently understood state of higher necessity. This article deals with the actions of the administrative proceeding authorities justified by a state of higher necessity. Scientific concepts of development of public services in Ukraine

The scientific article is devoted to highlighting the state of scientific development of the provision of public services in Ukraine. The achievements of administrative scientists and approaches to understanding the categories of public and administrative services provided by public administration bodies are highlighted. Administrative and legal principles of the provision of permit services by subjects of public administration; Skoromnyi Y.I. «Administrative services in agriculture of Ukraine; Sorokina I.S. «District State Administration as a Subject of Provision of Administrative Services»; Ter-Stepanyan O.V. «Administrative and legal principles of providing administrative services in the field of telecommunications and postal communication»; Khymychuk K.V. «Legal regulation of the provision of administrative services by the justice bodies of Ukraine», Pryimak L.I. «Public services in the activity of the State Tax Service of Ukraine: organizational and legal principles», etc. It was concluded that the attention of both scientists and practitioners is paid to the general principles of public service provision in Ukraine (the concept, essence of administrative services, principles of classification, quality assessment, etc.); the study of legal problems of public administration bodies has gained special development, the result of which is the introduction of a number of changes and additions to the current legislation that concerns the provision of public services; considerable attention is paid to the issue of providing public services in various areas or to a certain entity, etc. At the same time, the analysis of scientific publications, monographic studies, practical recommendations, as well as the results of the activities of public administration bodies on the provision of public services in Ukraine show that a complex scientific approach is needed to study the peculiarities of the provision of public services in Ukraine.

International practice of state regulation in the field of gambling

State regulation in the field of gambling is an important factor for the harmonization of these relations and their adjustment. Currently, world practice does not have special legislation that would establish international requirements for the organization and conduct of gambling. However, the development of gambling business in other countries of the world has a long history and considerable experience of successful state regulation of these legal relations. Accordingly, the purpose of this study is to study similar practices of other states and their possible consideration for further improvement of state regulation in the field of gambling in Ukraine. The article presents certain aspects of state regulation of activities related to the organization and conduct of gambling in some countries of Europe (Switzerland, France, Malta) and North America (United States of America, Canada). It is emphasized that public management and administration in the field of gambling should be aimed at solving the main problems of this sphere of social relations: meeting the needs and interests of a certain group of people; prevention of gambling; protection of citizens from criminal encroachments that pose a danger to a large segment of the population; full and timely receipt of taxes provided for by law to the state budget and their allocation to socially important needs; prevention of types of gambling addiction not permitted by law; combating corruption offenses and legalization (laundering) of proceeds obtained through crime, etc. As evidenced by international practice, in order to solve these problems and eliminate existing problems and risks in this area, a more or less permanent trend is developing in the world (for those countries in which gambling is allowed and controlled): the adoption at the national level of a special regulatory law (legal act); creation of a system of relevant authorized state bodies of public administration with the distribution of organizational, permitting, supervisory and jurisdictional powers; maintenance of the necessary balance of public interests and the interests of business entities and individuals by introducing a system of permissive, agreeable and prohibitive methods of legal regulation and relevant organizational and legal measures.

The norms of administrative law as a form of implementation of public administration

Being a systematically implemented activity of state authorities and local self-government, public administration is aimed at regulating social relations, ensuring a stable state and development of social processes in the interests of optimal functioning and development of society and the state. The norms of administrative law play an important role in this context. Through public administration, there are qualitative transformations of the methods and functions of state administration, which from abstract prescriptions of administrative law norms become means of performing the tasks of state administration in specific legal situations. On the one hand, public administration is implemented through the norms of administrative law, since it is the norms of administrative law that regulate the activities of subjects of public administration, form the basis of administration in all spheres of the life of society and the state. On the other hand, the main form of public administration is the adoption and implementation of administrative acts, which are understood as decisions or legally significant actionsofanindividualnature, adopted(committed) by an administrative body to resolve a specific case and aimed (directed) at the acquisition, change, termination or realization of rights and/ or duties of an individual (persons). An administrative act can be issued both by a representative of public authority performing public tasks/functions and by a subject of delegated powers - a subject of public administration. At the same time, the following acts: contain legal norms that specify the norms contained in legislative acts of higher legal force, and also provide a mechanism for their implementation; define typical rules of conduct in the field of public administration; establish the organizational and legal status of public administration bodies; establish the necessary prohibitions and restrictions; grant special rights and assign special duties in the field of public administration; the conditions of interaction and coordination of activities of public administration bodies are formed; implement socio-economic programs; do not resolve cases that arose in the body, the subject of which is the regulation of the internal activity of the public administration.

Access to justice in Albania and EU policies

Abstract Access to justice is a fundamental element of the rule of law and a cornerstone of justice. Access to justice is the constitutional guarantee that enables individuals to have their violated rights protected. Governments must guarantee the right of every individual to address the court or other bodies of public administration. The right of access to the court in order to oppose an act of the public administration bodies is an autonomous fundamental right and an element of due process. This principle closely relates to another principle guaranteeing justice and democracy in society, which is the principle of the rule of law. Albania has not yet adopted a law that provides for the vital minimum; calculation of financial insufficiency threshold by considering only the income of a person rather than the necessary and obligatory living costs that really need free legal aid. National and international acts provide for Access to Justice, and the onus remains on the government to provide this right to its citizens. In 2022, the number of courts in Albania dropped significantly with the new judicial map, which significantly reduced the access of citizens. Why reduce the number of courts? This led to the increase in the stock of court files and the failure of judges to try cases within the legal deadlines. Albania should reflect without further delay and increase the number of courts, taking an example from other developed European countries, so that citizens may easily go to the courts

Коммуникативные приемы управления цифровой репутацией органов исполнительной власти

The article considers the concept of digital reputation in relation to the executive authorities of the Russian Federation, as well as identifies the technological and communicative methods of its formation and maintenance. The digital reputation of a public administration body is a multicriterial assessment of its activities. It appears in media space and reflects the opinions of socially active population. Digital reputation is not identical to digital image. The authors revealed the following discursive factors that shape stereotypes about public administration. For instance, an indefinitely wide range of addressees lack basic knowledge in public administration; public assessments are flexible and unpredictable; some Internet users practice provocative speech behavior, etc. The research featured internet posts made by the Ministry of Science and Higher Education of the Russian Federation in the social network VKontakte. The service Popsters.ru made it possible to rate them by user involvement. A discursive and stylistic analysis of the posts with a high engagement coefficient revealed the following effective tools for managing the digital reputation of the authorities: hashtags as means of data distribution and systematization, dialogical and personalized presentation, interactive forms of communication (voting, polls, etc.), timely reaction to user comments, etc.

Risk management technology in the public sector: challenges and opportunities

The paper examines the importance of using effective risk management methods in the public sector, emphasizing the need for an integrated approach to this problem. The author emphasizes that public management mechanisms must be supported by appropriate technologies to ensure sustainable functioning. The use of ISO 31000 and ISSAI 9100 standards helps structure the risk management process and increase its effectiveness. Risk management should be based on the identification, assessment and response to risks and take into account the influence of various factors on the risk management process. The author also notes that risk management in the public sector is complicated by certain factors (frequent management changes, division of operating budgets and programs, lack of clear risk indicators, etc.). The analysis of the issue demonstrates that the system of assessment, management and risk reduction should play a key role in public administration. The main task of risk management as an element of public management is to make effective decisions, create the necessary conditions and plan actions taking risks into account to minimize their negative impact on planned results. As a result of the use of risk management technologies, it is possible to identify risks, determine factors and sources of risk, assess the degree and probability of occurrence of hazards and, ultimately, develop an optimal plan of management actions. The results of the study demonstrate that the issue of forming a risk management mechanism in the public sector requires further scientific research on the application of theoretical developments in the practical activities of public management and administration bodies of Ukraine. The paper also focuses on the issue of risk management in public sector organizations, and concludes that in order to assess the value, type and impact of risk, it is necessary to review the internal part of the organization and its management processes, as well as its environment. Such a review of risks should be complemented by increased risk awareness at each level of the management hierarchy and in the day-to-day activities of all employees of the organization. Thus, the need to use modern risk management technologies in the public sector is outlined in order to increase the effectiveness of the decisions made and minimize the negative impact of potential risks on the results of the work of management bodies.

PECULIARITIES OF INFORMATION AND ANALYTICAL SUPPORT IN DECISION-MAKING WITHIN GOVERNMENT BODIES

The modern world is increasingly entering the era of an information society, where the role of information becomes ever more significant. Information is accumulating rapidly and in large volumes, so quickly that people struggle to process and thoroughly comprehend the incoming information flow, leading to an overall reduction in usable information. In order to process relevant data effectively in the context of professional or other activities today, it is no longer sufficient to rely solely on traditional administrative experience to make informed management decisions. It is essential to incorporate scientific knowledge, comprehensive awareness, analytical and forecasting skills, as well as socio-political responsibilities, with an appropriate recognition of these processes. This is particularly relevant for public administration bodies—both central and regional levels of executive state power—and increasingly for local government authorities, which are gaining more authority as part of the decentralization process. In Ukraine, in particular, the ideology and framework for interaction between the state and society are changing, with an increased use of decentralization mechanisms that delegate specific functions and powers from state bodies (to varying degrees) to the level of territorial communities and even to civil society. The purpose of this article is to define the peculiarities of information and analytical support in the decision-making process within government bodies. The article systematizes approaches to information and analytical support in public administration. It identifies the subjects and objects of the information and analytical support system in state management processes and specifies the goals of such support. It justifies the need to highlight the key elements of the information and analytical support system for public administration. The article also outlines the principles guiding information and analytical activities conducted by government and local authorities. Levels of information and analytical work are established, taking into account the temporal dimension. Furthermore, the article identifies issues with information and analytical support in government bodies in Ukraine and suggests ways to address these challenges.

The article is devoted to the definition of the system of public administration of trade in currency values, the problem of theoretical substantiation of its elements, the main types of manifestations of the administration of this sphere, the study of the subjects of the implementation of administration functions, the study of the current legislation regulating this sphere of public-legal relations. Particular attention is paid to the definition of the content of the category “trade in currency values”, the disclosure of the legal nature and features of the category “public administration”, the outline of the approaches to the definition of its content and constituent elements available in domestic science. The definition of the system of public administration of trade in currency values and its constituent elements was carried out within the framework of the instrumental theory in law. It was established that, taking into account the initial provisions of the instrumental theory, the instruments of public administration of currency trading in Ukraine should be considered the norms of the current legislation, which determine the procedure for carrying out, in particular, the licensing of this activity, its control, taxation, the application of other management measures, prohibitions in this sphere, activity and law-enforcement acts of public administration bodies that carry out such management activities are empowered to impose administrative and financial sanctions. A proper definition of the category “administration of trade in currency values in Ukraine” is proposed. It was determined that the administration of trade in foreign exchange values takes place on the basis of complexity, reasonableness, flexibility of implementation and adaptability to the conditions of application of control and other measures, the expediency of their application, and orientation towards the consistent solution of current and long-termtasks of the state’s currency policy. The peculiarities of the functioning of subjects of the administration of currency trade in Ukraine, including the National Bank of Ukraine, the Ministry of Economy of Ukraine, the National Commission for Securities and the Stock Market, the State Tax Service of Ukraine and the Cabinet of Ministers of Ukraine in general, have been determined. It was found that the main subject of the administration of the outlined spheres of public legal relations is the National Bank of Ukraine. It is he who implements administrative, regulatory, control and other instruments in the field of currency relations. At the same time, other areas of implementation of the administration are disclosed, in particular, the activity of public administration bodies within the framework of taxation procedures of the researched activity is outlined.

Evaluation of the incident management system of a bigger city during the winter flood 2023/24 in northern Germany: Organized (ir)responsibility in the pre-disaster phase

Incident management systems operate within complex and uncertain conditions during disasters. Therefore, researching their activities is challenging as there is no clear right or wrong. The winter 2023/2024 flood event in the city of Oldenburg, Germany, provided an opportunity to evaluate crisis management under high uncertainty, although no disaster has eventually occurred. Three stakeholder groups of the Incident Management System were examined through After-Action Reviews: The Emergency Operation Center (EOC), specialist advisors, and the Area Command (AC). Data on performance shaping factors (descriptions and judgements) were collected and analyzed using the Countenance Evaluation Model as a general framework in combination with a Systems-Thinking approach. The study aimed to identify variables within and between groups as well as factors in the environment that either hindered or facilitated work transactions. It emerged that the work organization in bodies of public administration is at odds with the uncertain, fast-paced, and problem-oriented structure of Incident Management System operations, causing stress and adding workload to employees. Additionally, the separation of strategic and tactical decision making led to coordination issues due to divergent time structures and task logics of EOC and AC. Furthermore, although specialist advisors played a crucial role in risk assessments and setting the direction of risk mitigation activities, it became clear that this person related resource is scarce and difficult to embed into the Incident Command System. A final finding is the importance of the larger Emergency Operation Center working environment. The spatial constraints and noise levels caused stress.

Parlamentarna kontrola organów administracji publicznej na przykładzie interwencji poselskich i senatorskich oraz ich quasi-władczych aspektów

The main aim of the article is to show parliamentary control over public administration bodies in the context of quasi-imperial influence on these bodies through parliamentary interventions. The considerations are divided into several parts. The first one concerns the definition of key concepts relevant to the discussed topic, such as control, parliamentary control and supervision. The second part addresses the position of the Polish Sejm and Senate in the context of their constitutional role and their ability to control public administration bodies. The third part focuses directly on the quasi-imperious aspects associated with the use of parliamentary interventions. The rationale behind addressing this topic is the improper use of this right by parliamentarians, who through their partially extra-legal quasi-authoritarian actions can essentially compel controlled entities to handle matters in a specified manner and within a designated timeframe, thereby exceeding the bounds of ordinary control. The analysis of these issues requires the use of a dogmatic-legal method as the primary research method.

Administrative procedure, also called formal administrative law, procedural administrative law or administrative procedure, is one of the three parts of administrative law.

Modernization of administrative services in Ukraine based on the approval of new principles of their provision

The article is devoted to the topic of introducing new approaches to the provision of administrative services in Ukraine based on the approval of new principles of their provision. It is noted that administrative services are the leading means of realizing the rights of citizens in the field of public administration, because the absolute majority of cases decided by public administration bodies are initiated by citizens themselves and concern their subjective rights. The Ukrainian state quite successfully coped with the challenges in the field of administrative services after the beginning of the full-scale invasion of the Russian Federation on February 24, 2022. At the current stage, the format of “state-citizen” and “state-business” relations must be modernized taking into account modern technologies, optimization of procedures and improvement of service quality . Of great importance in the process of providing administrative services is the focus on modern, objective principles of their provision determined by socio-economic and technological development. After all, today a widespread phenomenon is the “digitalization” of the process of providing administrative services, which involves the introduction of electronic document management, the creation of online platforms for receiving services, and the automation of administrative procedures. The Center for Political and Legal Reforms developed the “Strategy for the reform of administrative services and their digitalization”. From the analysis of the document, it follows that the principles of providing administrative services today need a doctrinal update in their interpretation. In particular, the system of principles of administrative services should be supplemented with such things as decentralization of powers, simplification of procedures for the provision of administrative services, formality, integration of basic services in the Central Administrative Service, compensability for the provision of administrative services, unification of the procedure for resolving administrative cases, development of electronic public services, proactivity of public administration in in the field of provision of administrative services, protection of personal data.

Legal regulation of the provision of electronic services in the field of social protection of the population

The article is devoted to the analysis of the legislative consolidation of the provision of electronic services in the sphere of social protection of the population in Ukraine, taking into account the trends of reforming the institute of electronic services in the state. The current state of legal regulation of the provision of electronic services in the field of social protection of the population and directions for improvement of normative legal acts in the specified field have been studied. Summarizing the legal basis regulating the provision of electronic services in the field of social protection of the population, such acts can be classified by legal force (legislative, sub-legal) and by the content of the subject of regulation (determine general theoretical provisions and some aspects of an organizational nature; administrative jurisdictional activity of public administration bodies regarding provision of electronic services in the field of social protection of the population; guarantees of legality of the provision of electronic services in the field of social protection of the population). It has been established that today there is a significant number of normative legal acts that regulate certain aspects of the provision of electronic services in the field of social protection of the population. This is natural given the wide range of social relations subject to their regulation. Instead, for further systematized reform in this area, it is necessary to determine the general principles of organizational and legal regulation of the provision of electronic services in this area on the basis of a unified legislative act with the aim of a systematic approach to the elimination of legal gaps in the regulation of such an institution in view of the special legal position of subjects of public administration of providing electronic services in the field of social protection of the population.

The role of procedure, proceeding and process in administrative and tort relations from the point of view of justice and the activity of public administration bodies

The article analyzes the application of the concepts of ‘procedure’, ‘proceedings’ and ‘process’ in administrative-offense relations with the aim of determining the feasibility of granting courts the authority to consider cases of administrative offenses. The concept of ‘administrative process’ is disclosed in three well-known key aspects, distinguishing its general and specific features. It is determined that the process and proceedings, in a broad sense (as the activity of state bodies in general), are correlated as general and specific. Aspects of the concept of ‘administrative proceedings’ are identified. It is established that proceedings are part of the process, which may be interrupted, change subjects, i.e., the process consists of several proceedings, being their totality. It is proposed to consider proceedings as a certain period of time allocated for the consideration of a specific case. Instead, the procedure is a set of norms and rules regulated by legislation for subjects of any legal order in the understanding of Article 19 of the Constitution of Ukraine and in the context of the new legislation on administrative procedure. The characteristics of administrative procedure are disclosed. It is concluded that the administrative process is universal for any set of proceedings of state bodies, and this concept does not affect further research on the issue of excluding the consideration of cases of administrative offenses from judicial competence. In turn, the introduction by the legislator of the term ‘administrative procedure’ excludes the possibility of equating its rules and norms with judicial proceedings. It is analyzed that judicial procedures are provided for by procedural codes but do not define the specifics of considering cases of administrative offenses. It is determined that the Code of Ukraine on Administrative Offenses does not meet the requirements for modern judicial procedures and is essentially more akin to a regulator of administrative procedure, which constituted the foundation of Soviet heritage. This dissonance is revealed through differences between judicial proceedings in the judicial process and the consideration of cases provided for in the Code of Ukraine on Administrative Offenses, including in decision forms, stages of consideration, etc. It is proposed to designate the consideration of cases of administrative offenses by the court as judicial proceedings and by other bodies as administrative procedure.

Пределы усмотрения органов местного самоуправления в случае отмены административного акта в сфере градостроительства

The publication reviews the definition of the limits of discretionary power of local self-government bodies in the field of urban construction in case of autonomous cancellation of administrative act, which was previously issued. It was recognized that in the practice of Constitutional Court of Russian Federation and Supreme Court of Russian Federation in 2022 legal positions were formulated, connected to defining the limits of discretionary power of public administration body in case of cancellation or changes introduced into administrative act autonomously in compliance with the concept of trust protection. Summary of judicial practice materials allowed to set the perception of legal positions, which were formulated by Russian senior courts, courts when assessing the limits of discretionary power in the event of autonomous cancellation by act in the field of urban construction previously issued.

Improving the system evaluating the quality of governance and effective use of budget funds

The purpose of the study is to create proposals and recommendations to improve the system evaluating the quality of governance and efficient use of budget funds in order to improve public welfare and sustainable development. The research methodology included application of statistical methods to review scientific articles, legislative acts and other documents, study models for evaluating the quality of governance and efficient use of budget funds. Mathematical modeling and forecasting methods were also used to assess aspects of governance and predict the results when changes are made, including building a trend model and determining the forecast values of accrued taxes and mandatory payments for 2024–2026. The conclusions highlight there is a positive correlation between the accrued taxes and mandatory payments to the budget of the Republic of Kazakhstan, and an economic growth and changes in tax legislation. The key factors influencing the quality of governance and efficient use of budget funds were identified. Recommendations were developed to improve the quality assessment system and governance of budget funds in order to increase efficiency and responsibility in financial management. The results of the study can be used by public administration bodies and financial institutions to optimize the governance of budget funds.

Features of the types of control on the performance of electronic procedures in the activities of public administration entities

The scientific article highlights the essence of the types of control over the implementation of electronic procedures in the activities of public administration bodies, namely: parliamentary control; from the representative of the Verkhovna Rada of Ukraine on human rights; from the central bodies of executive power. The author substantiates the expediency of improving the legal regulation of the procedure for holding a preliminary meeting before the trial of the case. In particular, it is considered expedient to establish the terms of holding a preparatory meeting from the moment of receipt of an administrative claim, as well as to determine the cases when reconciliation of the parties is not allowed. It was established that the control carried out by local executive bodies has a much smaller scope, but is the closest to the controlled objects. The control powers of the said bodies within the scope of control over the provision of electronic services are enshrined in the Law of Ukraine «On Local State Administrations» (Clause 9 of Article 16). Part 1 of Article 28 of this law stipulates that in order to exercise the powers granted, local state administrations have the right, in particular, to conduct inspections of the state of compliance with the Constitution of Ukraine and the laws of Ukraine, other legislative acts by local self­government bodies. It was concluded that regional state administrations, within the limits of their powers, direct the activities of district state administrations and exercise control over their activities. Local state administrations control the implementation of the powers granted by law to the executive bodies of village, settlement and city councils by their executive bodies and village, settlement and city heads. It has been established that control over the exercise of delegated powers of executive bodies by local self-government bodies is entrusted to the relevant local state administrations, and in cases provided for by law, to ministries and other central bodies of executive power, their territorial bodies. Control is carried out by analyzing acts of local self-government bodies, providing local self-government bodies with information on the implementation of delegated powers of executive bodies, conducting inspections of the activities of executive bodies of village, settlement, and city councils. In addition, local executive bodies can create structural subdivisions to perform control functions.

Local Self-governments’ Competences in Administrative Procedures related to Prioritized Investments in Hungary

This study examines a special administrative procedural law instrument that serves the competitiveness of the economy in Hungary. This procedural regime on prioritized investments became a part of the law after the accession to the European Union. The research clarified the specialties of the process and the relations between them highlighted by the competent public administrative bodies, the Government and the local self-governments concerned with this procedure. The implementation of such investments raises constitutional issues, through the presumed violation of local self-governments’ competences. The analysis presents the practice of the Hungarian Constitutional Court.
