Legalization of Medical Marijuana Use in Legal Perspectiveand Human Rights

Provisions in Law Number 35 of 2009 concerning Narcotics regulate that marijuana is included in class one. Marijuana is a narcotic which is categorized as an addictive substance with a very high scale of danger to health. Marijuana is a substance/drug that can cause a decrease or change in consciousness, loss of taste, reduce pain and is addictive (dependence). Marijuana is included in a group that cannot be used in general, but in certain doses and with the permission of the government, in this case the Minister, it can be used for the development of science. Researchers say that Marijuana makes a positive contribution, and is generally safer to consume than drugs other than Marijuana which contain many chemical ingredients, thus causing side effects in the medical world. What is discussed in this research is how the use of marijuana is regulated by law in Indonesia and whether the use of medical marijuana violates human rights in Indonesia. The research method in this writing is normative research, using a statutory approach, case approach and conceptual approach. This research concludes that regulations on the use of marijuana are contained in Law No. 35 of 2009 and the use of medical marijuana does not violate human rights.

Konstitusionalitas Pembatasan Hak Mantan Narapidana untuk Menjadi Notaris

This article aimsto discussthe juridical analysis of the provisions which state that former convicts cannot become notaries. The type of method used is normative juridical with a statutory approach, conceptual approach and historical approach. Legal material sources consist of primary and secondary legal materials, analysis techniques using grammatical and theological interpretation. The provisions of Law Number 2 of 2014 in Article 3 letter h which states that the condition for becoming a notary isto never be subject to imprisonment for a minimum of five years or more is unclear and unfair. Limiting the length of sanctions regardless of the type of criminal act is not appropriate, there should be certain types of criminal acts related to the notary profession or the code of ethics that is the reference. In several regulations there are criminal offenses that carry a sentence of less than five years, however the criminal offenses committed are closely related to the professionalism that a notary must possess. This provision also does not provide a sense of justice because someone who has served his sentence means that he has received sanctions for the actions he has committed and has the right to get a decent job as regulated in Article 27 and Article 28 of the 1945 Constitution of the Republic of Indonesia.

Penerapan Ipteks Undang-Undang Nomor 1 Tahun 2022 Tentang Hubungan Keuangan Antara Pemerintah Pusat dan Pemerintahan Daerah

The capacity building of employees at the Regional Revenue Agency (Bapenda) of Jayapura Regency in understanding and implementing Law Number 1 of 2022 on Financial Relations between the Central Government and Regional Governments is crucial for optimizing regional financial management. This new regulation brings significant changes in the mechanisms of fund transfers, as well as tax and regional retribution management, requiring deep understanding and technical skills from the employees. The purpose of this community service is to enhance the understanding and skills of Bapenda Jayapura Regency employees in drafting academic papers and regional regulations (Raperda) related to taxes and retributions. Thus, it is expected to improve the effectiveness and efficiency of regional revenue management in accordance with the provisions of the new law. This community service is conducted using lecture and mentoring methods. The lecture method is used to provide theoretical understanding of Law Number 1 of 2022 and its implications for regional governments. Meanwhile, the mentoring method is used to assist employees in directly drafting academic papers and Raperda, ensuring that these documents comply with legal principles and local needs. The results of the community service show a significant increase in employees' understanding of the new financial regulations. Bapenda Jayapura Regency employees successfully drafted academic papers and Raperda on taxes and retributions in accordance with the provisions of Law Number 1 of 2022. Additionally, this activity also encouraged collaboration and interactive discussions that enriched the practical and theoretical understanding of the employees.

The Validity of Signing an Authentic Deed by a Notary Virtually in the Covid-19 Pandemic

The purpose of this writing is to find out the legal consequences carried out by Notaries who are signing the deeds virtually in the Covid-19 pandemic situation and to find out the urgency of changes that occur regarding authentic deeds that virtually will obtain certainty, benefit and legal protection not only for notaries but also for the community. The results of the research and analysis in this writing are that electronic signatures have actually been regulated in Indonesia in Law Number 19 of 2016 concerning Information and Electronic Transactions. It's just that virtual signing of deeds using electronics has not yet obtained a strong legal basis in Indonesia. Legal certainty also cannot be achieved because there are still conflicting provisions in Law Number 2 of 2014 concerning the Office of a Notary. During the Covid-19 pandemic, many professions were able to carry out their duties by utilizing electronics but notaries were excluded because there were no specific rules that clearly regulated it and there were various legal consequences which resulted in uncertainty, injustice and no legal protection for notaries. Therefore, changes to laws and regulations or legal products are needed in order to achieve legal synchronization and harmonization. The government needs to increase the role of the notary in accordance with the times and regulate the legal force and data authenticity as well as the power of electronic deeds in proof which have been an obstacle so far.

Law enforcement is largely determined by legal culture, because the existence of law is largely determined by legal culture in the form of community values, views and attitudes. Determination of Law Number 23 of 2014 concerning Regional Government, (State Gazette of the Republic of Indonesia of 2014 Number 244, Supplement to State Gazette of the Republic of Indonesia Number 5587) in which several provisions in Law Number 23 of 2014 concerning Regional Government have been amended by Government Regulations In lieu of Law (PERPPU) Number 2 of 2014 concerning Amendments to Law Number 23 of 2014 concerning Regional Government, has automatically replaced Law Number 32 of 2004. The research carried out by the author uses a descriptive qualitative research approach, in particular by adopting the case study method. The focus of this research is to reveal information related to the research object with the aim of measuring its level of effectiveness. Based on the results of observations made by researchers, there are findings obtained from the Management of BUMDES Bahari Makmur, starting from reporting, management, information and communication, BUMDES activities, namely: Condition: there is no Good and Correct Financial Reporting, including Financial Reporting According to Regional Regulations No. 09 of 2013, there is no BUMDES organizational structure. Cause: lack of village government involvement, where BUMDES itself is an increase in the village budget. Consequence: BUMDES Bahari Makmur is not functioning as BUMDES is a Village Institution that must exist. 1. It is hoped that the Palang Village government should improve BUMDES reporting and reactivate BUMDES so that the village can get original income. This is important because BUMDES itself is mandatory. 2. It is hoped that the Palang village government can provide information about financial reporting and BUMDES management so that readers can get information about BUMDES management. 3. It is hoped that future researchers will be able to explore in more detail and expand the BUMDES financial management process with Regional Regulation Number 09 of 2013, because in this research it is limited to management and reporting, not access to financial reporting and BUMDES management.

Juridical Analysis of Rejection of Cancellation of the Deed of Sharing Collective Rights Based on Ruling Number:803K/AG/2017

This research also uses the Normative Juridical Method which uses the library research method and also this research uses a Qualitative Method, Based on the Analysis it can be concluded in the decision of case Number 157/Pst.p/2020/PA.Sbr the judge still grants the request for dispensation because the parents or child have agreed to the granting of the dispensation, so in In his opinion, the judge will grant the dispensation of the minor, even though it is not in accordance with the applicable age provisions in Law Number 16 of 2019 contained in Article 7 paragraph (1).

However, the circulation of illegal and dangerous cosmetics poses a serious threat to the health and safety of consumers. This research aims to study the challenges faced in protecting consumers from the circulation of illegal and dangerous cosmetics, and analyze how legal protection is provided to consumers regarding the circulation of illegal and dangerous cosmetics that cause harm to consumers. The research method used in this research is normative juridical. This is based on the provisions of Law Number 8 Year 1999 concerning Consumer Protection which regulates the production of cosmetics and also guarantees consumer protection in purchasing cosmetic products. In the event of circulation of illegal cosmetics, warnings, coaching of business actors, and withdrawal of products will be given which will harm consumers themselves. Therefore, increasing supervision of the use and monitoring the circulation of cosmetics without BPOM licenses because this is one of the many illegal cosmetics at this time.

Implementation Of The Utilization Of Village Funds During The Covid-19 Pandemic

Village funds are budget allocations on-budget that can be used directly to support efforts to mitigate the impact of Covid-19 at the household and village levels. This study aims to gain a deeper understanding of the regulation of the use and utilization of village funds during the Covid-19 pandemic, the implementation of village fund usage during the Covid-19 pandemic in the Air Batu Subdistrict, and the supervision of village fund management during the Covid-19 pandemic. The results show that the utilization of village funds during the Covid-19 pandemic remains based on the provisions of Law Number 6 of 2014 concerning Villages. The use of village funds for handling Covid-19 can also be based on the Regulation of the Minister of Village Development of Disadvantaged Regions, and Transmigration of the Republic of Indonesia Number 13 of 2020 concerning the Priorities of Village Fund Utilization for the Year 2021. This regulation explicitly governs (1) National economic recovery in accordance with the authority of the village, (2) National priority programs in accordance with the authority of the village, (3) Adaptation of new village habits. The supervision of the use of village funds during the Covid-19 pandemic is carried out by the local government of the district/city (Inspectorate), sub-district head (camat), Village Consultative Body (BPD), and village communities. As for the identification of the problem in this research, namely, whether the production sharing system for agricultural land in Nagrak Village, Cianjur District, Cianjur Regency has complied with the provisions of Law Number 2 of 1960 concerning Production Sharing Agreements? in Nagrak Village, Cianjur District, Cianjur Regency?, and what steps did the Head of Nagrak Village, Cianjur District, Cianjur Regency take in resolving the obstacles faced by farmers and cultivators in the agreement for agricultural land yields?. This research uses a normative juridical approach, which examines juridical data on the application of agricultural land production sharing agreement regulations. It is concluded that the regulation regarding production sharing agreements for agricultural land in Indonesia is still using Law Number 2 of 1960 concerning Production Sharing Agreements. The form of the agreement is made in writing before the Village Head and ratified by the Camat, but in practice Law Number 2 of 1960 concerning Profit Sharing Agreements is still not effective this is due to the ignorance of the local community with the existence of Law Number 2 of 1960 concerning Agreements Profit sharing.Keywords: Profit Sharing Agreement, Role of Village Head, Agricultural Land.

The Ambiguity of Using the Statement of Absolute Responsibility Based on Minister of Home Affairs Regulation Number 109 of 2019: Study in Dharmasraya Regency, West Sumatra Province, Indonesia

Marriages are required to be registered under the provisions of Law Number 1 of 1974, specifically Article 2. This registration plays a crucial role in establishing the legality of marriages and enables the utilization of different associated benefits. Meanwhile, unregistered marriages give rise to a range of legal issues, including uncertainties regarding lineage, concerns related to maintenance, and inheritance rights. In line with the Ministry of Home Affairs Regulation Number 109 of 2019 regarding Population Administration, couples involved have the option to obtain important documents such as the Population Identification Card (KTP), Birth Certificate, and Family Card (KK) by signing a Statement of Absolute Responsibility (SPTJM). This situation raises significant concerns regarding the legal implications of unregistered marriages. Therefore, this study aimed to employ an empirical legal approach with qualitative methods and obtained data through interviews, observations, and documentation. The data analysis used Miles and Huberman's method to uncover the meaning within Ministry of Home Affairs Regulation Number 109 of 2019 regarding Unregistered Marriages and unveiled the ambiguity in understanding the true meaning. Furthermore, a study conducted in Dharmasraya Regency in 2021 discovered the issuance of 69,144 Family Cards by the Directorate General of Population and Civil Registration, and 22,453 (32.47%) were unregistered marriages. Only 194 individuals applied for validation (isbat) within 3 years, where 101, 27, and 66 were accepted, rejected, and revoked, respectively. In conclusion, the community perceived their marriages to be legal due to the issuance of Ministry of Home Affairs Regulation Number 109 of 2019, even though the SPTJM did not legalize the concept or hold legal authority over the consequences.

The purpose of the State Administrative Court is basically to protect the legal interests of the community from arbitrary actions or abuse of authority by the government, given the vast scope of government employment. The State Administrative Court is held to resolve disputes between the Government and its citizens, namely disputes that arise as a result of Government actions deemed to have violated the rights of its citizens. elements of the state law, so that in this study the aim is to find out in the process of delaying the implementation of State Administrative decisions in State Administrative disputes, then in research using normative legal research research methods which can be defined by a process to find a rule of law, legal principles, as well as legal doctrines to answer the legal issues at hand, the result of this research is that the conditions for requesting a postponement of the implementation of State Administrative Decisions can be seen from the provisions of article 67 of Law Number 9 of 2004 and Circular Letter of the Supreme Court No. or 2 of 1991 concerning instructions for the implementation of several provisions in Law Number 5 of 1986 concerning the transition of state administration. So that in postponing a State administrative decision it can be granted if it fulfills the following conditions: a). a request for postponement of the implementation of a State administrative decision can be filed simultaneously in a lawsuit, b) there is a very urgent situation which results in the interests of the plaintiff being greatly harmed if the state administrative decision being sued is still carried out and c). there is no public interest in the framework of development that requires the implementation of the decision.

Inconsistency in the Definition of Small Fishermen within the Indonesian Legal Framework: A Comparative Study of Legislation

This study aims to examine and analyze the norm conflict regarding the definition of small fishermen in legislation at the same hierarchical level. This study uses normative legal research with the statute, conceptual, and comparative approaches. The collected legal material is then qualitatively analyzed to describe the problem and answer study purposes. The results show that there is a conflict of norms between Law Number 45 of 2009 with Law Number 7 of 2016 in defining small fishermen. Law Number 45 of 2009 refers to fishermen with a maximum vessel size of 5 GT, while Law Number 7 of 2016 refers to fishermen who use their own or others’ vessels with a maximum size of 10 GT. On the other hand, GT is a unit of measure agreed upon as the provisions of the Convention on the International Tonnage Measurement of 1969 in determining the vessel category. To eliminate norm conflict concerning the definition of small fishermen, the Government enacted the GR in Lieu of Law Number 2 of 2022. Fatally, GR in Lieu of Law Number 2 of 2022 raises ambiguity which shows the definition of small fishermen is increasingly unclear. Therefore, it is recommended that the House of Representatives initiate amendments to Law Number 7 of 2016 and GR in Lieu of Law Number 2 of 2022. These amendments must accommodate a more specific indicator regarding vessel size, aligned with the provisions in Law Number 45 of 2009. These steps are expected to create greater legal clarity and certainty for small fishermen and provide improved guidance for all stakeholders in the maritime and fisheries sector.

For the Minangkabau people who are Muslim, marriages are carried out in accordance with the provisions of Law Number 1 of 1974 concerning Marriage. There are 2 (two) types of marriages for the Minangkabau indigenous people, namely: 1) Ideal marriage, namely marriage between close families such as children from nephews; 2) Abstinence marriage, namely marriage that cannot be carried out like the child of a mother or father. There are 2 (two) marriage procedures for the Minangkabau indigenous people, namely: 1) Marriage according to female relatives, namely the woman who is the initiator in marriage and in household life, from starting to find a mate to carrying out the marriage; 2) Marriage according to male relatives, namely the man who is the initiator in marriage and households, from starting to find a mate to carrying out the marriage and daily living expenses. Legal Protection Against Leakage of Traveloka Consumer Personal Data by the Company

The number of incidents of misuse of personal data for loan applications on the Paylater e-commerce platform is currently caused by the lack of a strict security system in digital companies in Indonesia. Currently, data leakage problems befall Traveloka consumers. Although some of them don't use the pay later feature in the app, they still find it difficult to get approval from banks due to having poor credit scores. This study aims to analyze legal protection efforts provided against misuse of consumer data on the Traveloka PayLater feature. The author uses normative legal research methods with a statutory approach and a conceptual approach analyzed through legal materials. Based on the results of the research, Traveloka as a service provider acts as a collector and manager of consumer data which is obliged to protect the data collected from the beginning until data deletion. Legal protection for consumers can be done both through internal legal protection and external legal protection, Internal legal protection can be done by considering the agreement between consumers and Traveloka companies and it is found that there is an exoneration clause in the agreement so that the agreement can be canceled. Meanwhile, external legal protection can be provided by sanctioning Traveloka as the collector and processor of consumer personal data following the provisions in Law Number 27 of 2022 concerning Personal Data Protection.

The purpose of this study is to examine how the implementation of law in Indonesia and the legal protection about termination of Industrial Relations by the company to workers who refuse mutation. To analyze the reasons for accepting and rejecting the judge's decision related to termination of employment by the company against workers who refuse to mutation with the Study Number:53/Pdt.Sus.Phi/2018/Pn.Palu, Study Number:85/Pdt.Sus.Phi/2019/Pn/Pbr, based on Employment Law. This research is used normative method, which examines the judge's decision juridically using Law No.13/2003 concerning Employment Law. The results of this study indicate that the mutations by the company in Study Number:53/Pdt.Sus.Phi/2018/Pn.Palu and Study Number: 85/Pdt.Sus.Phi/2019/Pn/Pbr violate Article 32 of the Employment Law. because the mutation did not pay attention to the workers' rights based on the principles of being open,free,objective,fair,and equal without discrimination.Keywords: Criminal; Replacement; Corruption;
