BIOMECHANICS OF FACET JOINTS: SYNCHRONIZED SPATIO-TEMPORAL AND MECHANICAL ANALYSIS

AbstractObjectivesWhile spinal fusion is known to be associated with adjacent disc degeneration, little is known on the role of the facet joints in the process, and whether their altered biomechanics following fusion plays a role in further spinal degeneration. This work aimed to develop a model and method to sequentially measure the effects of spinal fusion on lumbar facet joints through synchronisation of both motion analysis, pressure mapping and mechanical analysis.MethodsParallel measurements of mature ovine lumbar facet joints (∼8yr old, n=3) were carried out using synchronised load and displacement measurements, motion capture during loading and pressure mapping of the joint spaces during loading. Functional units were prepared and cemented in PMMA endcaps. Displacement-controlled compression measurements were carried out using a materials testing machine (3365, Instron, USA) at 1 mm/min up to 950 N with the samples in a neutral position, while motion capture of the facet joints during compression was carried out using orthogonal HD webcams (Logitech, Switzerland) to measure the displacement of key facet joint features. The pressure mapping of load transfer during displacement was carried out using a flexible pressure sensor (6900 series, Tekscan, USA). Each sample was imaged at an isotropic resolution of 82 microns using a μCT scanner (XtremeCT, Scanco, Switzerland) to quantify the curvature within the facet joints.ResultsRelative facet joint displacement under load, in a neutral position, showed more displacement (2.36 ±1.68 mm) compared to the cross-head when under compression (2.06 ±1.19 mm). Motion capture indicated the relative displacement of the facet joints was more posterior with some lateral motion. For five of the six facet joints, pressure measurement was possible only on 24±7 % of the surface due to the large change in curvature. Partially measured loads through the facets was 10.5 ±1.1 N.ConclusionsThe relative displacement of the lumbar facet joints compared to the crosshead displacement was consistent with previous studies of cervical facet joints, despite the differences in anatomical geometry between cervical and lumbar joints. The difficulties in accurately measuring the load transfer through the facet joints was due to the age of the tissue and the degree of curvature of the facet joints. Synchronisation of the biomechanical data will provide a setup to assess the effect of interventions such as spinal fusion, with curvature-related issues unlikely to occur in human spines.Declaration of Interest(a) fully declare any financial or other potential conflict of interest

ASSESSMENT OF HEMIARTHROPLASTY IN AN ANATOMICAL HIP SIMULATOR

AbstractBACKGROUNDHemi-arthroplasty (HA) as a treatment for fractured neck of femur has slightly increased since 2019 and remarkably after the COVID pandemic. The main drawback of the treatment is ongoing cartilage deterioration that may require revision to THR.OBJECTIVEThis study assessed cartilage surface damage in hip HA by reproducing anatomical motion and loading conditions in a hip simulator.METHODSExperimental design. HA tests were conducted using porcine acetabula and CoCr femoral heads. Five groups (n=4) were included: a control group comprising natural tissue and four HA groups where the acetabula were paired with metal heads to allow radial clearance (RC) classed as small (RC<0.6mm), large (2mm<RC<4mm), extra-large (4mm<RC), and oversized (RC<−0.6mm). Tests were carried out in an anatomical hip simulator that reproduced a simplified twin peak gait cycle, adapted for porcine hip joints, from the ISO 14242 standard for wear of THR prostheses (peak load of 900N). The test length was 6 hours, with photogrammetry taken at 1-hour intervals. Ringers solution was used as a lubricant.RESULTSNo changes were observed in the control group. However, cartilage surface changes were observed in all hemi-arthroplasty groups. Discolouration on the cartilage surface was noticeable at the posterior-superior part of the acetabulum after 1-hour (extra-large and oversized groups). Damage severity and location were characteristic of each clearance group. Of all the groups, the oversized group showed more significant damage. Assessment of Damages and Compensation in the Context of ISDS Reform Proposals

This article discusses the possible reforms in the assessment of damages and compensation in international investment arbitration. The article highlights the challenges of the valuation leading to the need for reforms, such as the inflation of awards issued in investment arbitration cases, the major gap between the damages claimed and damages awarded, and the difficulties posed by the large damages awards for the developing states. Other reasons for reforms include arbitral tribunals’ inconsistency in the valuation, the incorrectness of awards and potential conflicts of interests between arbitrators and damages experts. The author further discusses whether the issues of damages and compensation in investor- state disputes fall within the mandate of the UNCITRAL Working Group III, which is argued to be limited to solely procedural issues. The author concludes that the reforms could and should be developed by the Working Group III. The assessment of damages and compensation in investor-state disputes requires a comprehensive reform process based on procedural solutions as well as substantive suggestions, which the Working Group III can devise. Based on the law and economics theories, the author analyzes the appropriate approach of tackling the quantum issues, concluding that the reforms should be implemented through soft law instruments. The article dwells on viable procedural reforms on the quantification of damages and compensation in investment arbitration. The analysis focuses on the reforms prospecting to address the damages experts’ possible conflict of interest, the divergence in the parties’ experts damages amounts and the anchoring effect of the claimants’ requested amounts on arbitrators, as well as on the option of conducting early damages conferences, drawing on the insights from behavioral economics. Lastly, the article discusses substantive reforms options for the valuation that help promote the consistency and correctness of awards. The author considers the options of clarifying the use of the discounted cash flow method and setting standards that require damages to reflect a balance between the competing interests, providing guidance on the investor’s contributory fault, capping compensation to the actually invested amount and the assessment of contextual factors relevant for the calculation of damages.

Attitudes of medical students on conflict of interest: A comparative study of Korea and France.

Medical students are potential marketing targets for pharmaceutical companies because established prescribing habits are not easily altered. In 2014, Bruno Etain and several other researchers published a paper which investigated the knowledge of and opinions on potential conflict of interest (COI) with regard to preclinical and clinical students enrolled in medical schools in France and residents working in hospitals. An empirical survey study with Korean medical students concerning their educational experiences and views on conflicts of interest and comparing and contrasting the results with Etain's study of French medical students. Receipt of direct or indirect financial offerings from pharmaceutical industries was not properly recognised as COI by the medical students. Therefore, strengthening education on COI and implementing institutional improvements for COI disclosure are essential to prevent bias caused by COI and enhance awareness levels regarding COI.

Home sleep apnea tests: Conflicts of interest and funding

ObjectivePediatric otolaryngologists rely on HSAT literature to guide their diagnostic methods related to obstructive sleep apnea (OSA). Our objectives were to review the rates of presence of funding and/or potential conflict of interest (COI), as well as its relationship to the overall quality of HSAT publications in the literature over the last two decades. Data sourcesMedline, Web of Science and Embase databases. Review methodsA review was performed reviewing publications from January 2000 to December 2021. Oxford Level of Evidence (OLE) was used as a quality metric. COI and funding were recorded verbatim as self-declared in the text of the manuscript. ResultsLiterature search yielded 4257 articles with 400 articles included in final analysis. The odds of higher quality studies (LOE 1 or 2) were higher in the last five years from 2016 to 2021 (OR, 3.6; 95% CI 1.4 to 6.9). Nearly half of all articles (43.0%) lacked a statement regarding funding or COI. There was a positive correlation between level of evidence and industry funding. The largest source of funding was from industry, comprising 39.6% of all studies that had a funding statement. Of these industry-funded studies, 37.5% reported no COI or lacked a COI statement. ConclusionDespite a growing interest in HSATs for OSA evaluation, there is heterogeneity in reporting of COI and high prevalence of industry funding and COI. By focusing on the Indonesian context and based on Law Number 28 of 2014 concerning Copyright, this study analyzes the characteristics of copyright to songs as assets that can be pledged as collateral, as well as the impacts and implications of copyright utilization in the financial sector and creative industries. The results of the research show that copyright has the potential to be used as collateral in debt transactions at banks. Factors such as the economic value of the work, exclusive control, legal protection, and regular income allow copyright to be used as collateral. Copyright law regulates the process of guaranteeing, utilizing, and executing copyright as security. The use of copyright as collateral has a positive impact on the financial sector and the creative industry. Diversification of bank portfolios, easier access to finance for creative industry players, as well as increased innovation and creativity are the identified impacts. However, there are also challenges, such as complex copyright value assessments and potential conflicts of interest between rights owners and financial institutions.

What Evidence-based Medicine (EBM) Doesn't Say About Allergen-specific Immunotherapy (AIT).

Evidence-based allergology for the treatment of allergic rhinitis with allergen-specific immunotherapy (AIT) has been used in publications by the companies manufacturing AIT. The purpose of randomized controlled trials (RCTs) is to provide physicians, health authorities, patients, and their families with the best evidence upon which to base treatment decisions. However, some RCT results may do more harm than good because they serve the commercial interests of the companies producing and marketing AIT more than the interests of patients. Allergic rhinitis is a trivial disease that is not life-threatening and is easily controlled by drugs. In this paper, we analyze some of the more controversial points underlying the EBM supporting the use of AIT. The paradox behind RCT-based practice is that AIT is based on the results of incorrectly interpreted RCTs. International scientific societies and drug regulatory bodies should analyze trials more carefully, considering potential conflicts of interest.

Prospect of Tourism Development in Khaptad National Park: A Local Perspective

Tourism in Nepal has flourished over the past two decades, making it one of the top global destinations for visit. Its abundant wildlife, stunning trekking routes, snow-fed rivers, picturesque lakes, and warm-hearted locals have been contributing perpetually to appeal to the global and local tourists. With the rise of the digital economy, tourism is experiencing modern advancements. This study aims to analyze the perceptions of local residents regarding tourism development. Structural Equation Modeling (SEM) was employed to validate the research results, utilizing both descriptive and inferential statistics. A sample size of 219 respondents was conveniently selected; indicating a higher interest among males and a predominance of economically active individuals aged 21-40 years. The study shows ICT development emerging as a common challenge for visitors to Khaptad National Park. The SEM results confirmed the fit and validity of five constructs. To establish KNP as a premier tourist destination, the Tourism Board, Government, and Municipality should prioritize its development and manage the influx of tourists. Notably, motivation and subjective norms significantly influence visitors’ behavior, while perceived behavioral control and behavioral intention do not. Local communities should actively engage in promoting tourism through effective marketing strategies, and the improvement of ICT facilities will enhance travel convenience. Hence, efforts should be made to promote local business activities and products. The findings of this analysis will benefit various stakeholders, including the Ministry of Culture, Tourism and Civil Aviation, Nepal Tourism Board, Department of Tourism, hotel associations, Travel agencies, local governments, researchers, professionals, and prospective students. The conflict of interest that is so grave that we all prefer to ignore it?

Conflict of Interest declaration is the default way to mitigate the risk of harm of unconscious or deliberate promotion of self-interest causing misinformation or wrong decision-making. Public attention to the disclosure of interests caused by private sources of research funding results in a routine procedure now. At the same time, very strong interests caused by taxpayer-covered Governmental funding of research are generally badly underestimated. Researchers generally have no idea that taking public funding and promoting policy advice to provide more funds should be declared as a conflict of interest: Promotion of more funds and power under the control of bureaucratic bodies or entities is anticipated to bring more funding for the researchers themselves. For example, the COVID-19 response of most democratic governments, based on the use of emergency powers, enjoys broad support from publicly funded research – though the effectiveness of such a response is not supported by the history of previous pandemics. The explicit requirement to disclose public funding as a potential Conflict of Interest, at least in case the authors promote more power and more funds for the Government, will mitigate risks of one of the potentially dangerous biases both in research and indecision-making.

Viewpoint] Vaccination campaigns against Covid-19 may promote vaccine hesitancy toward mostly well-established, safe, and effective vaccines

The use of thorough clinical trials, open scientific debate and the building of trust in public institutions have been key factors in the acceptance of vaccines in the past. The Covid-19 vaccination programmes were Implemented under emergency legislation, limiting safety assessments and traditional vaccine protocols. Transparency and potential conflicts of interest were an issue, with serious side effects neglected. This has fed public distrust nurturing vaccine hesitancy. Studies on the possible relations between Covid-19 vaccines and an increase in all-cause mortality rates have not merited official concern. This Opinion argues that in order to negate a growing public perception of a causal relationship between Covid-19 vaccinations and serious adverse effects, raw data should be released further research promoted, and open debate permitted without exclusion.

Reflecting on the corporate opportunity rule in company law through a jurisprudential review of Modise v Tladi Holdings (Pty) Ltd 2020 4 All SA 670 (SCA)

Directors' fiduciary duties form part of foundational principles in corporate law. This concept has its foundations in the law of agency. Prior to the Companies Act 71 of 2008 (the Companies Act), fiduciary duties were governed under common law, however, the advent of the Companies Act resulted in the partial codification of fiduciary duties. One of the central fiduciary duties is the duty of directors to avoid conflict of interest. This duty restricts the directors of a company from having their personal interests impede those of the company. There are separate rules that flow from the directors' duty to avoid conflict of interests, including the corporate opportunity rule. The corporate opportunity rule dictates that directors must not use their position to unfairly benefit from the contracts and/or information that rightfully belongs to the company they are managing. The objectives of the corporate opportunity rule were clarified in Modise v Tladi Holdings (Pty) Ltd (the Modise case). In partially confirming the judgment of the court a quo the Supreme Court of Appeal held that the ambit of breaching the corporate opportunity rule includes the illegal use of the property and confidential information of the company by a director for personal gain. This article agrees with the reasoning of both the High Court (court a quo or trial court) and the Supreme Court of Appeal in the Modise case on the issue of prescription although the article raises concerns about the decision of the Supreme Court of Appeal on a similar issue. Further, the article concurs with the reasoning of both the court a quo and the Supreme Court of Appeal in concluding that the applicants breached their fiduciary duty when they appropriated a corporate opportunity that belonged to the company. One of the major lessons that could be learnt from the Modise case is that directors, especially those who serve on multiple boards, should exercise extreme caution with potential conflicts of interest.

Tax Planning And Financial Constraints With Moderated Effect Of Audit Quality: Evidence From East African Countries

This study aims to provide empirical evidence on the relationship between tax planning and financial constraints with the moderated role of audit quality. This study draws its sample from listed firms operating in developing countries particularly East African Countries, the region where firms are most famous for facing higher financial constraints. We used ordinary least squares (OLS,) fixed effect and feasible generalized least square (FGLS) to estimate the regression on the data spanning 2009 to 2019. The results show a negative relationship between book tax differences and financial constraints, which suggests that companies with larger book tax differences are less likely to experience financial constraints. However, this study found no significant moderated role of audit quality. Nonetheless, the negative relationship between book tax differences and financial constraints has practical and theoretical implications. It highlighted the need for tax authorities and policy makers to reform and enforce their tax regulations to limit aggressive tax planning. It also provides insights into the potential conflicts of interest that can arise between managers and other stakeholders in a company, and highlights the importance of transparency and accurate financial reporting in mitigating these conflicts.

Securities Crowdfunding (SCF) is expected to be a fast, cheap, and massive alternative funding system for Micro, Small, and Medium Enterprises (MSMEs). However, its implementation is far from ideal. Several studies in China, Britain, and America concluded that SCF is one of the riskiest investment instruments. This is closely related to the lack of implementation of audit obligations on the financial statements of MSMEs as Issuers. To analyze the above problems, this study applied doctrinal research methods and Reform Oriented Research. This study aimed to analyze the urgency of establishing the Public Service Agency of Securities Crowdfunding (BLU SCF) in the implementation of the SCF ecosystem in Indonesia and design the idea of regulating BLU SCF as an SCF auditor. This research found that: (1) the urgency of establishing BLU SCF includes the high default risk by the Issuers, the responsibility exemption from the Issuers and the Organizers for the truth of the financial statements, and there is a potential conflict of interest between the Issuers and the Organizers; (2) BLU SCF will be authorized to audit the reports and other financial documents published by the Issuers through the Organizers. Institutionally, BLU SCF will be under the auspices of the Ministry of Cooperatives and Small and Medium Enterprises. This idea is expected to improve the practice of SCF implementation in Indonesia, by prioritizing the protection of Investors’ rights to the truth of the Issuer’s financial statements.

Effects of fibre-supplemented enteral feeds on bowel function of non-critically ill tube-fed adults: a meta-analysis of randomised controlled trials.

Diarrhoea is common in enterally fed patients and can impact their nutritional and overall outcomes. This meta-analysis evaluates the potential benefits of fibre-supplemented (FS) feeds on incidence of diarrhoea and stool frequency in non-critically ill tube-fed adults. Databases including PubMed, Embase and CINAHL with full text were searched for randomised controlled trials (RCT) with adults on exclusive tube feeding, published until August 2022. The Cochrane Collaboration's tool was used for quality assessment. Studies with published results on incidence of diarrhoea and stool frequency were analysed using RevMan 5. Thirteen RCT with 847 non-critically ill patients between 20 and 90 years old without diarrhoea at the onset of enteral feeding were included. Study duration ranged from 3 to 35 d. Nine papers investigated the incidence of diarrhoea where intervention group was given FS and control was given non-fibre-supplemented (NFS) enteral feeds. Those receiving FS feeds were significantly less likely to experience diarrhoea as compared with those using NFS feeds (OR 0·44; 95 % CI 0·20, 0·95; P = 0·04; I2 = 71 %). Combined analysis showed no differences in stool frequency in those receiving NFS feeds (SMD 0·32; 95 % CI -0·53, 1·16; P = 0·47; I2 = 90 %). Results should be interpreted with caution due to considerable heterogeneity between study population, assessment tool for diarrhoea, potential conflict of interest and short duration of studies. This meta-analysis shows that FS feeds can reduce the incidence of diarrhoea in non-critically ill adults; however, the effects of stool frequency remain debatable.

Coercive Citation: Understanding the Problem and Working Toward a Solution

Academic publishing has faced numerous ethical challenges, but reviewer conflict of interest (COI) and potential associated coercive citation requests present an under-explored area of concern. Although we expect most reviewers act ethically, the drive for academics to increase their citation counts creates a potential incentive for reviewers to seek citations of their own work, presenting a potential reviewer COI. With citation counts serving as an important part of most university and journal rankings, the integrity of the research review process has far-reaching implications. This study analyzes journals’ communication to reviewers regarding coercive citation requests and COI in general, with 205 survey responses from editors of major management/marketing journals, and an assessment of a randomly selected subset of 30 leading journal websites. The vast majority of journals did not discuss reviewer coercive citation requests or COI, nor have any obvious processes to screen for it. We discuss the factors that foster an environment conducive to coercive citation requests and identify easily adoptable changes to review formats to address the problem. We also discuss the need to examine the triad of relationships among authors, reviewers, and editors, taking a systems approach. We encourage attention to balance of power as well as co-creation.

In immunotherapy, false-positive MSI testing prevents putative responding patients from receiving effective treatment, and false-negative MSI testing leads to the prescription of ineffective therapy with its adverse effects.Knowledge GeneratedThis article provides the main advantages and limitations of the standard MSI testing methods and novel approaches in clinical practice, assesses possible sources of errors, discusses best practices and guidelines, and highlights the unsolved questions that remain sources of incorrect interpretation.RelevanceAmong novel approaches, next-generation sequencing (NGS) is considered one of the most promising; its advantages include high accuracy, an expanded spectrum of microsatellites analyzed, and simultaneous assessment of a comprehensive spectrum of clinically significant markers.
