Analysis of The Legal Strength of Land Tenure Statement (SPPT) as a Basis for Land Rights in East Kutai Regency, East Kalimantan Province

Research on the legal strength of land tenure statements (SPPT) as a basis for land rights in East Kutai Regency, East Kalimantan, aims to find out the position of the SPPT as proof of land rights in the land law system and the legal strength of a land tenure statement as proof of ownership rights. Above ground. This research was carried out because many landowners in East Kutai still rely on the legality of their land using SPPT as proof of land ownership. They assume that having the SPPT is strong enough as proof of ownership of land rights. This can be seen in the number of land cases that enter the judicial process where the SPPT is still recognized. Meanwhile, based on the negative land law system with a positive tendency adopted by Indonesia, the strongest evidence for land ownership rights is only a certificate issued by the National Land Agency, and even then it still has the potential to be sued as long as the truth can be proven. In this research, normative and descriptive juridical research methods are used to answer legal issues by describing, analyzing, assessing, and explaining appropriately and analyzing applicable laws and regulations as well as various opinions of legal experts, with the aim of answering the problems raised.

ACTIVITIES OF THE STATE LABOR SERVICE OF UKRAINE: STRENGTHENING OF LABOR STANDARDS, MONITORING OF COMPLIANCE WITH LABOR LEGISLATION AND INTERNATIONAL COOPERATION

An attempt was made to comprehensively analyze the activities of the State Labor Service of Ukraine as the central body of the executive power, its control and supervisory powers, the reform process, which should serve to increase the efficiency of its activities, the perception of the State Labor Service, first of all, not as a punitive, but as a service body, to change working conditions labor inspectors, implementation of international legal standards, in particular, in light of the implementation of the provisions of the Association Agreement with the EU. The mission of State Labor Service of Ukraine, as this body considers it, is to ensure declared (control over the registration of labor relations), safe (during the performance of work in all areas: from metallurgy to hospitals and schools), paid (timely and full payment of wages, compliance minimum size and minimum payment guarantees), as well as healthy (monitoring of medical examinations, the presence of harmful factors during working months) labor relations. This activity is primarily aimed at protecting the rights of employees, but, based on consultations with the parties to the social dialogue, it should also support the other side of labor relations - employers, by providing recommendations, advisory assistance, conducting voluntary audits, etc. The content of the main international norms, which contain standards regarding the activities of labor inspectors - ILO Conventions No. 81 and No. 129, as well as the Protocol of 1995 to the Convention on Labor Inspection of 1947 (No. 81) is analyzed, the need for their implementation into Ukrainian legislation is emphasized. The task of labor inspection, its status, organization and main powers of labor inspectors in industry, trade and agriculture, defined in these international normative acts, are given. An overview of the content and tasks of a number of international projects with the participation of the State Labor Service of Ukraine, as well as their main results, was carried out. Some issues of distinguishing between supervision and control, problematic issues of its implementation, and opinions of legal experts regarding ways to solve them are analyzed. The main modern problems in the field of labor relations as a whole are highlighted: still a high share of undeclared labor relations, which entails a number of problems for employees, employers and the state, the relocation of enterprises from the east of the country in connection with armed aggression against our state, the need to ensure healthy and safe conditions at the workplace, etc. The main shortcomings in the activity of State Labor Inspectors of Ukraine are outlined, in particular, heavy workload, low wages, limitations in activity caused by inconsistency of legislation.

PERKAWINAN BEDA AGAMA PASCA SEMA NO.2 TAHUN 2023 (Analisa Yuridis Sosiologis Perkawinan Beda Agama di Indonesia)

A small number of marriages of different religions in Indonesia are carried out because they have received court approval. The reason used as a basis is because religion is an absolute right of every person that cannot be forced and marriage is a citizen's right guaranteed by the State. This reason encourages researchers to study the problems of interfaith marriages mentioned above. The research method currently being carried out is library research, namely research that applies a conceptual approach by expressing various opinions of legal experts regarding marriage between people of different religions. The results of the research show that inter-religious marriages have two different interpretations: first, the marriage is declared valid and can be carried out based on 4 grounds, namely: 1) interpretation of the Marriage Law article 2, that marriages of different religions may be carried out, 2) The reason for submission is based on Supreme Court decision Number. 1400 of 1986, 3) Article 35 of the Adminduk Law, and 4) based on the reason that people whose marriages are not registered at the KUA, can be allowed to be united in one family and have a KTP with marital status written on it, as per the regulations in the Minister of Home Affairs Regulation No. 9 of 2016. Second, some reject interfaith marriages based on: 1) Article 2 of Law no. 1 of 1974 (with the interpretation that marriage must be of the same religion), 2) Article 4 of the KHI which prohibits marriages other than Muslims, 3) MUI Fatwa No. 4 of 2005, 4) Results of NU Congress No. 28 of 1989 and Tarjih Muhammadiyah No. 22 of 1989, 5) MK no. 56/PUU-XV/2017.

Qualitative studies are carried out by collecting library materials, reading and taking notes, and carrying out analysis on library materials that have been selected for use. Based on the results of this research, the Constitutional Court has the competence to make decisions on matters relating to the age limit for candidates for President and Vice President, where the court's decision is definite and binding.

The Law Enforcement of Guarantees Halal Products in Indonesia

Law No. 33 of 2014 concerning GUARANTEES Halal Products states that products that enter, circulate, and are traded in the territory of Indonesia must be halal certified, except for products with ingredients that are prohibited. Business actors who do not carry out their obligations in halal certification can be subject to administrative sanctions and criminal sanctions. Based on the provisions above, law enforcement for Halal Product Guarantee must at least look at the factors of legal certainty, enforcement officers, facilities, culture and society. The main problem in this research; First, how is the JPH law enforcement process considering that until now there are still many industrial products that have not carried out halal certification. Second, how are the procedures for applying criminal or administrative sanctions applied to products that violate the provisions of halal certification. This study aims to determine the law enforcement of halal product guarantees in Indonesia in terms of the aspects of legal certainty, justice and benefits for all economic actors in Indonesia. This study uses the method of literature review (library research), namely research based on the opinions of legal experts. The research results conclude that; first, in the process of enforcing the law on halal product guarantees, it refers to other provisions that have been presented by the government, such as PP No. 31 of 2019, PP no. 39 of 2021, Minister of Religion Regulation No. 26 of 2019, Law no. 21 of 2000, Law no. 8 of 1999. As of October 17, 2024, the imposition of sanctions on business actors who do not yet have halal certification has not been enforced, however, products that already have halal certification but commit serious violations by using illegal substances can be subject to criminal provisions since Law Number 33 of 2014 was declared effective (5 Years after stipulation). Second, criminal provisions for violations of halal-certified products can refer to Article 4a, Article 7, Article 8f, and Article 62 paragraph (1) of the Consumer Protection Law. Harship Doctrine Regarding Fulfillment of the Performance of an Agreement

<em>In contract law, performance fulfillment is a fundamental principle. However, in practice, unforeseen changes in circumstances can disrupt performance fulfillment. To address this, the doctrine of hardship is necessary to create a balance between performance fulfillment and unforeseen changes in circumstances. The aim of this research is to analyze the concept of the hardship doctrine in contract law and identify its impact on the interpretation and performance of contracts, as well as the protection of rights and fairness for parties bound by contractual agreements. The research method used is normative research method with a focus on analyzing the legal regulations that govern the hardship doctrine. The data sources include legal texts, regulations, court decisions, and relevant legal expert opinions, along with techniques such as legal document analysis, comparison, and drawing conclusions to generate a comprehensive understanding. In contract law, the hardship doctrine refers to the concept of unforeseen changes in circumstances significantly affecting contract performance. This doctrine allows parties to request contract modifications or terminations in situations that are no longer fair or feasible. It also impacts contract interpretation, as courts determine whether the changed circumstances meet the criteria for activating the doctrine. Although not fully regulated in Indonesian legislation, the Civil Code provides relevant legal grounds. It is important for contracting parties to understand the implications of the hardship doctrine and consider its inclusion in their agreements. The doctrine plays a crucial role in protecting the rights and ensuring fairness to parties bound by contractual agreements in Indonesia. It provides protection, flexibility, and considerations for social impact and public interests. However, its use should be limited, meet strict requirements, and align with applicable laws. Therefore, the hardship doctrine serves as an essential tool to maintain balance and justice in contract performance when used carefully and in compliance with relevant conditions. </em>

Legal Study of the Appointment of Regional Head Officials from TNI/Polri Officials

This research aims to find out the legal rules related to the appointment of Acting Regional Heads from TNI/POLRI High Officers. The proposal to appoint active high-ranking TNI/PORI officers as Acting Regional Heads by the Ministry of Home Affairs has drawn polemics. The method used in this research is qualitative research through a normative legal approach, namely an approach that uses positivist juridical conceptions. The data collected is by using literature studies, scientific articles, legal expert opinions, and other legal sources. The data that has been obtained is then analyzed using qualitative analysis methods. Based on the research results obtained in this study, the following conclusions were drawn: (1) The appointment of Acting Regional Heads from TNI/POLRI elements is contrary to Article 109 Paragraph 2 of Law Number 5 of 2014 concerning State Civil Apparatus, which states "TNI/POLRI can fill high leadership positions after resigning from active service if needed and in accordance with the competencies determined through an open and competitive process." (2) The impact of the appointment of TNI/POLRI officials as acting governors basically violates the provisions of the Pilkada Law and also the State Civil Apparatus Law itself, besides that the appointment is also a setback for the continuity of Indonesian democracy that has been running so far.

Sanctions for violating family law are a form of legal reform. Muslim countries have different legal provisions for sanctions for violating family law. This study uses the method of literature/documentation and a normative juridical approach by examining secondary data or literature as the source. Secondary data sources used in this study are books, laws, court decisions, legal theories and opinions of legal experts relating to family law sanctions in Muslim countries as well as previous studies such as research relevant to this research. This study aims to determine the legal provisions regarding sanctions in violation of family law. The results of the discussion and research explain that not all countries have legal provisions regarding sanctions for violating family law and the legal provisions regarding these sanctions vary from one country to another. In general, these legal sanctions are related to violations of various issues related to marriage, such as underage marriages, forced marriages, prevention of marriages permitted by syara' law, prohibited marriages, registration of marriages, marriages out of court, dowries, marriage fees, polygamy. , divorce, maintenance, treatment of wife, post-divorce women's rights, and inheritance rights.

Land declaration (SPT) is the basic proof of ownership of a plot of land controlled by a person or legal entity. This right is generally used as a condition in the application process for the issuance of certificates of property rights by the National Land Agency. There are still many people who think that the Declaration of land owned is proof of ownership of land rights. It appears in many land cases in the judicial process. The results of the analysis show that basically the negative publication system adopted by Indonesia is not a publication system that does not guarantee legal certainty. This is because the negative publication system does not apply forever. The negative publication system in Indonesia still adheres to positive elements, where the government will guarantee the correctness of the data presented after 5 years of the land being registered. These restrictions actually aim to provide legal protection for land owners, so that it is possible to file lawsuits by parties who feel entitled. This can be seen in land cases in the judicial process, such as the case of decision Number 160/Pdt.G/2020/PN Plk, where the Judge stated that the Land Declaration Letter was valid and had binding legal force in the name of Mr. Baturung. Legalitas Penerbitan Akta Kelahiran Anak Yang Dilahirkan Dari Perkawinan Yang Tidak Dicatatkan

This study aims to analyze the legality of issuing birth certificates for children born out of unregistered marriages, this study uses normative juridical research methods, and uses literature that is relevant to the study of making child birth certificates for unregistered marriages. The main legal basis comes from statutory regulations, and the secondary legal basis is in the form of literature, documents, opinions of legal experts. This is also related to the legality of issuing birth certificates for children born from unregistered marriages. The results of this study are related to the making of birth certificates for children born out of marriage which are not recorded through a Statement of Absolute Responsibility (SPTJM) which refers to Permendagri No. 9 of 2016. Birth certificates for children born without marriage registration that are not listed on the Family Card are only recorded as children of a mother. Through this research, it is hoped that it can provide a better understanding of the legality of issuing birth certificates for children resulting from marriages that are not legally registered. The results of this research can make an important contribution to the development of more inclusive legal policies and better protection of children's rights.

Juridical Study on Abuse of Authority in Corruption Crimes: Analysis of Law No. 19 of 2019 concerning the Corruption Eradication Commission

Eradication of Corruption Crimes is a series of activities to prevent and eradicate the occurrence of criminal acts of corruption through efforts to coordinate, supervise, monitor, investigate, investigate, prosecute, examine before courts, with community participation in accordance with statutory provisions. Corruption is a criminal act which if violated will be sanctioned, traced from the point of view of life and appears as a bad cultural image of the Indonesian nation. Corruption crimes are all negative activities related to embezzlement of funds, bribery and all forms of gratuities that are contrary to law, norms and customs. Traditionally, people can say that Indonesia's identity is corruption. This image is not completely wrong. Because the reality of the complexity of corruption is felt to be not merely a legal issue, but actually a violation of economic and social rights that has an impact on the life of the nation. Talking about corruption will indeed find the fact that corruption involves moral aspects, traits and circumstances that are not good, positions in government agencies or apparatus, misappropriation of power or authority in office due to gifts, economic and political factors, as well as placement of families or groups into officialdom under the authority of the position. Interfaith Marriage in Indonesia: The Controversy between MUI Fatwa and Surabaya District Court Decision

This article is motivated by the issue of the Surabaya District Court's decision to legalize interfaith marriage. This issue has garnered a lot of opinions and criticism because it is considered to be not in line with the MUI fatwa that has been established. Therefore, the focus of this study is firstly on the legal basis of the MUI in establishing interfaith marriage, secondly on the considerations of the Surabaya District Court judge in deciding on interfaith marriage, and lastly on the legality of interfaith marriage in law and human rights. Using a sociological and normative approach, it can be concluded that the Surabaya District Court decision was rejected by various groups, especially the MUI, which was deemed to be no longer in line with the fatwa that had been established since long ago. Regarding this issue, the MUI will hold a meeting with the legal commission to discuss this issue. Nevertheless, the Surabaya District Court remains on the decision they issued because they have a basis for the decision. This study obtained data sources from secondary data by processing data from primary legal materials and secondary legal materials in the form of laws, civil procedure law books, and opinions of legal experts and theses. The results of this study are that interfaith marriage is recognized by state law if it is recorded in civil registration, as stipulated in Article 37 of the Population Administration Law, but it is not valid according to religion.

There is an important element of democracy stated on the Constitution, namely the protection of human rights, that every citizen has the right to enjoy it. One of the rights protected in the Constitution is right to access a good and healthy living environment. For this, the environment needs to be preserved and function through administrative law enforcement. The study uses normative juridical approach with descriptive-analytics, which describes the norms and associated with theories, and opinions of legal experts. The development of a democratic nations of law can be seen from the aspect of law enforcement in particular with environmental administration. In Indonesia, it can be reviewed through the theory of organic states and the theory of pluralist states. Based on the theory of an organic state and looking at the aspects of environmental administration law enforcement in Indonesia, the state has regulated the enforcement of environmental administrative sanctions whereby the state can regulate every activity and/or business in the environmental issues. Therefore, the pluralist state theory recognized a variety of diverse interests in society that the state has accommodated all citizens rights to a good and healthy environment through pro-environment government policies

Legal Review of the Requirements Become a Candidate for DPRD Member Who Graduate from Senior High School That’s Still Pro and Contra

DPRD is a Regional People's Representative Body as a representation of the people, has the function of Forming Regional Regulations, Budgeting and Oversight which of course requires people who are experts in their fields. The aim of the research is to conduct a legal review regarding the requirements for prospective DPRD members who graduate from high school who still have pros and cons. The type of research in this paper is normative with a statutory and conceptual approach. While the specification of the research is analytical descriptive, namely explaining the problem according to the research title. The data used is secondary data which consists of primary legal materials in the form of Law No. 7 of 2017, Law No.23 of 2014 and related laws in research journals and secondary legal materials in the form of books, journals, electronic news, laws and regulations, opinions of legal experts and writings related to research title. The legal review regarding the requirements for prospective DPRD members to graduate from high school does fulfill one of the requirements in the laws and regulations, but to become a people's representative or legislator with a high school diploma equivalent can be said to be not yet an expert or broad-minded due to limited education. Therefore, it is suggested that the requirements for candidates for legislative members need to increase the standardization of minimum education for candidates for legislative members who have graduated from university, at least a Bachelor of Laws or Bachelor degree related to executive, legislative and judicial policies.

The basis for judges' considerations in imposing criminal punishment that are relatively light for convicts in cases of valuable goods proceeding

Article 480 point 1 of the Criminal Code states that committing certain acts, which include selling and buying, of goods that are known or reasonably suspected to have originated from a crime, are categorized as a crime of collection. The purpose of this research is to explain the causes of the criminal act of collecting valuables. the factors considered by the judge in imposing a relatively light sentence on the perpetrator of the crime of collecting valuables. and countermeasures carried out against the criminal act of collecting valuables. This research uses normative method. The data in writing this thesis were obtained through library research and field research. library research to obtain secondary data by studying legislation, books, and opinions of legal experts relating to the issues discussed, while field research is intended to obtain primary data by interviewing respondents and informants. The results showed that the crime of collecting valuables was to seek profit, then followed by economic and environmental factors. Thus, internal factors or perpetrators are more dominant as a driving factor for the crime of collecting valuables in the jurisdiction of Banda Aceh City. The factors considered by the judge in imposing a relatively light sentence were that the defendant had never been prosecuted, the motive factor and background for committing the crime and the age factor. There are two ways to deal with the crime of collecting valuables, namely preventive efforts and repressive efforts. It is suggested that the sentence handed down must be maximally in accordance with the prosecutor's demands. Vigilance and suspicion must always be exercised and it is hoped that all law enforcement officials will continue to pay attention to the public interest and the rights of a defendant guaranteed by law.

While the specification of the research is analytical descriptive, namely explaining the problem according to the research title. The data used is secondary data which consists of primary legal materials in the form of Law No. 25 of 2009, Law No. 1 of 2009, Permenhub No. PM 33 TAHUN 2015, Permenhub No.PM 167 Year 2015, Permenhub No. PM 178 of 2015 and secondary legal materials in the form of books, journals, electronic news, and opinions of legal experts, laws and regulations, and writings related to research titles. Penegakan Hukum dalam Pelayanan Pemungutan Pajak Kendaraan Bermotor (PKB) di Kantor Unit Pelaksana Teknis Pengelolaan Pendapatan Daerah (UPT PPD) Pandan, Provinsi Sumatera Utara

The purpose of this study was to find out the legal arrangements, law enforcement obstacles and how to overcome them in collecting Motor Vehicle Tax (PKB) at the Pandan Regional Revenue Management Technical Implementation Unit Office (UPTPPD) based on the legal regulations in force in Pandan Region. The research method used in this research is Normative Juridical by searching and collecting data through library research from reading sources in the form of related legal books, opinions of legal experts, related laws and regulations, related websites and interview results. The results of the study show that the implementation of PKB collection at the Provsu BPPRD starts from registration, determination, payment by the taxpayer and validation to the deposit to the regional treasury by carrying out based on the Permen, Permendagri, Pergubsu that apply at UPT PPD Pandan as a form of implementation of Law no. 28 of 2009 concerning Regional Taxes and Levies. Furthermore, regarding obstacles in the implementation of motorized vehicle tax collection at the Regional Tax and Retribution Management Agency of North Sumatra Province, are the inclusion of the owner's identity (KTP and SIM) according to the tax note/STNK, technical gaps in service to taxpayers, PKB payments with the online system, payments via Banks, the large number of motor vehicle tax arrears objects both caused by the negligence of taxpayers in fulfilling their obligations to pay taxes.
