Some theoretical and practical problems of legal protection of occupational safety: national and international aspects

The academic article deals with certain issues of the theory and practice of regulatory regulation of labour protection in Ukraine. Main organisational and legal forms of occupational safety and health, as well as main tasks of labour protection management in the country, are defined. Philosophical, general scientific and special legal methods of cognition, including but not limited to formal-legal and comparative legal methods, were used for the research. It is noted that Ukraine’s health and safety situation is one of the most challenging in Europe. The authors also state that importance of the psychological climate in the workplace and its impact on the production process cannot be underestimated, so relevant measures in the context of its improvement are proposed. The article highlights certain aspects of labour protection regulation at the international legal level in general (ensured by the International Labour Organization) and at the level of the European Union in particular, as well as the impact of relevant standards on national legislation. The authors formulate proposals for improving the labour protection institute in modern economic conditions in Ukraine, including but not limited to: implementing innovative legal education and training programs focused on occupational safety and health;, creating/improving safe working conditions under martial law, including proper equipment of shelters for use during air raids; ensuring submission of a draft law on improving penalties for violations of labour protection legislation, which will increase employers’ responsibility for compliance with labour protection legislation. It is concluded that the occupational health and safety management system shall be based not only on measures taken by the state, but also on the interest of the parties to labour relations in maintaining the proper physical condition of the employee, which is inextricably linked to the economic and social well-being of the employer.

Occupational health and safety management system and stock price crash risk

This study responds to the call of Ben-Nasr and Ghouma (2018) by providing more empirical evidence on stock price crash risk from the employee treatment perspective. With a focus on occupational health and safety management system (OHSMS), we examine whether corporate OHSMS adoption reduces stock price crash risk. We find that OHSMS adoption is negatively associated with crash risk. This negative relationship is more pronounced for SOEs than for non-SOEs, and for firms with higher levels of media coverage and with higher market competitive status. Employee welfare and internal control effectiveness are two channels through which OHSMS adoption affects crash risk. The current study extends to the health and safety factor, thus shedding new light on the determinants of crash risk. Our study also advances the understanding of the “responsible employee treatment – crash risk” relationship.

The ISO 45001 standard and its relationship with the Occupational Health and Safety Law, Peruvian case

The implementation of an Occupational Health and Safety Management System is essential in organizations to take care of the integrity of people and avoid illnesses. The objective of the study is to relate the international standard ISO 45001 with an Occupational Health and Safety Law, with the aim that organizations that are currently complying with the regulations of their country can know which provisions they are complying with link to the standard. ISO 45001 and which ones are still pending, and in this way, they have an input for compliance with the international standard. For this analysis, the Occupational Health and Safety Law of Peru will be used as a guideline, which will provide a guide so that this analysis can be replicated with the laws of other countries. From the results obtained, it is concluded that the Peruvian OSH Law partially complies with the ISO 45001 standard.

Relationship Between The Implementation Of Occupational Health And Safety Manajement Systems With Accident Risk In Fire Fighting Officers

Fires often come without warning, presenting unexpected risks for firefighters who must remain alert while on duty. This profession is classified as a job that is full of high risks, and the level of risk faced is closely related to the implementation of an occupational health and safety (K3) management system. This research uses a quantitative analytical survey approach with a cross-sectional design to explore the relationship between the implementation of an K3 management system and the risk of accidents among firefighters. In this study, 36 officers were selected as samples using the random sampling method. Primary data was obtained through questionnaires filled out by respondents and assessment sheets prepared by researchers. Data analysis used the chi-square test with a confidence level of 95% (? = 0.05). Rejection of the null hypothesis (Ho) occurs if the p value <0.05, which concludes that there is a significant relationship. Research findings show that as many as 30 field officers (83.3%) are within the scope of the K3 management system which is categorized as poor. There is a significant relationship between the implementation of the K3 management system and the risk of accidents (p=0.000). In order to minimize the risk of work accidents, increasing awareness and discipline of officers in using Personal Protective Equipment (PPE) is very important. It is hoped that the findings from this research can become a basis for related parties to make system improvements and increase the safety of firefighters in the future. Efforts to increase awareness of the importance of K3 and the use of PPE are expected to reduce the risk of accidents and better protect officers as they carry out their duties to protect the public from the dangers of fire.

EVALUASI PENERAPAN KESELAMATAN DAN KESEHATAN KERJA (K3) PADA PROYEK PEMBANGUNAN PASAR SINGAMANDAWA TAHAP I

The rapid development of the construction industry in addition to providing benefits also poses risks. The construction industry has quite a big risk and this industry can be said to be the most vulnerable to work accidents. ISO 45001: 2018 can be defined as an International Standard that regulates the requirements for occupational health and safety management systems. This study aims to determine the evaluation and application of OHS according to ISO 45001: 2018 regulations in the Phase I Singamandawa Kintamani Market development project. The type of data used is primary data obtained from distributing questionnaires and interviews as well as secondary data obtained from library sources. Data processing was carried out using Microsoft Excel and SPSS version 25. The type of research used was a combination research that combines qualitative and quantitative research, using 3 techniques, namely antecedents, transcendents, and output. The results showed that the antecedents' techniques of staff and workers stated they were very suitable with an average of 40.00 and 41.08 for the OHS policy and planning implementation stage, that the applicable laws and the commitment and leadership carried out were appropriate because of the -the contractor encourages workers to apply OHS. The averages of 37.09 and 38.04 for the OSH implementation stage are also very appropriate. In the transcendents technique, staff and workers stated that they were very compatible with an average of 34.09 and 34.63 with early identification of hazards and risk control. Whereas for the implementation of OHS, the average is 45.64 and 46.00, very appropriate, because there is supervision according to standards. At the output stage, staff and workers stated that they were very suitable with an average of 18.82 and 18.96 for the OHS performance monitoring and evaluation stage. Based on the results of the evaluation of the application of OHS in the Singamandawa Market development project, it is following ISO 45001: 2018, namely by taking the PDCA (Plan Do Check Action) approach.

Sustainability Assessment of Machinery Safety in a Manufacturing Organization Using AHP and CART Methods

Machine safety is not only a prerequisite for successful production but also the foundation for the sustainability and growth of any manufacturing organization. The latest approaches in this rapidly developing field integrate effective risk management tools and strategies into occupational health and safety (OHS) management systems. The study, through a real example from practice, describes the use of the analytic hierarchy process (AHP) method for machine safety improvement, considering the possible types of losses. Classification and Regression Tree Analysis (CART) was applied to assess the efficiency, cost-effectiveness, and, therefore, the overall sustainability level of the relevant safety measures. These were proposed risk reduction measures that typically raised uncertainty among managers regarding the estimation of cost-effectiveness. The advantage of the application decision tree approach is the possibility to identify and establish relatively homogeneous groups of undesirable events and their impact on the organization’s objectives. A comprehensive model has been developed to support management decision making in manufacturing organizations towards implementing and improving safety measures in line with manufacturing sustainability goals.

Integrating management systems in the energy sector: the case of the electricity industry in New Zealand

The New Zealand Electricity Engineers Association (EEA) asked for advice about development of a guide for a public safety management system (PSMS) for electricity distribution networks based on ISO45001 Occupational health and safety management systems. This would help eliminate overlap between legislation and standards while maintaining compliance with legal requirements. At Victoria University of Wellington we have been working on such an integrated approach and this article reports on the project and suggests how the results can be extended to include other areas of management while retaining the ability for appropriate elements to be audited and certified in accordance with systems required by legislation. The project reviewed an earlier report and literature review on PSMS for the Electricity Networks Association. Development of the legal requirements for a PSMS were reviewed and use of the International Standards Organization (ISO) framework for all management system standards proposed to encompass ISO45001 and similar standards. Relevant management content was incorporated in the high-level structure and key stakeholders contributed technical content. Use of the ISO Annex SL as a template enabled development of an integrated management system incorporating other management system standards, that would still support legal compliance while enabling elimination of duplication and clutter, and waste of resources at a time of technology change. The work was carried out in New Zealand (NZ) and may not apply in other countries with different legal requirements. Auditors may resist integrated management systems although this may not be a limitation if documentation is appropriately written. The electricity networks businesses in NZ may move to implementation of the PSMS guide but this will be an internal decision and results may take some years to declutter documentation and reduce overlapping audits under management system standards. Over the next decade the context of the New Zealand electricity industry will undergo major shifts with the need to adapt to increasing expectations for occupational health and safety and public safety, adaptation to climate change and accelerated implementation of new technologies. The electricity industry will need to apply its resources to those changes while avoiding duplicated efforts to implement multiple management systems. Developing an integrated management system that incorporates several management systems and public safety may aid protection of non-workers who cannot otherwise be “controlled” by a business.

How healthy is your workplace? Testing the effectiveness of occupational health programs: insights from Germany

PurposeCompanies are increasingly struggling with the costs of absenteeism due to their employees’ physical and increasing psychological illnesses. At the same time, employers should recognize the value of healthy employees in terms of greater productivity and the development of positive organizational attitudes. Many organizations have implemented workplace health promotion (WHP) programs; however, we still have limited knowledge about the effectiveness of various measures. The present study is an examination of 18 WHP activities and their effect on employees’ perceived health support and actual absence rates.Design/methodology/approachI organized 112 German companies into four groups based on their subjective (employee perception of health promotion) and objective (absence rate) performance. Applying multinomial regression analysis, I assessed a company’s likelihood of falling into one of the four clusters if a specific measure was not implemented in it.FindingsI identified five measures that significantly differ between company clusters: healthy food offerings, sports offerings, having fitness rooms, systematically evaluating WHP programs and smoking cessation courses. Investing in occupational health management can be a strategic asset for organizations. The study results give companies recommendations on how to address WHP and how to implement these concrete measures.Originality/valueThe study’s originality lies in the incorporation of 18 concrete WHP measures and the comparison of their effects in objective and subjective terms. It shows that employers can enhance employee well-being by using simple WHP activities.

IDENTIFIKASI POTENSI BAHAYA K3 DAN PENGENDALIAN RISIKO PADA KEGIATAN PEMBORAN DI BALAI DIKLAT TAMBANG BAWAH TANAH SAWAHLUNTO IDENTIFICATION OF POTENTIAL OHS HAZARDS AND RISK CONTROL IN DRILLING ACTIVITES IN THE SAWALUNTO UNDERGROUND MINING AND TRAINING CE

OHS in mining activities is generally known as the Mining Occupational Health and Safety Management System (MOHS) which will regulate how and what forms of prevention and control both potential hazards or risks occur during mining activities. Drilling is one of the stages carried out before blasting activities. This is to obtain drilling fast, with the right position. The drilling, which was carried out at the Underground Mining Training Center, used a Jumbo drill and Jackleg machine. Risk identification is the process of identifying hazards, assessing risks and developing management strategies. The application of risk management has benefits including being able to guarantee business continuity by reducing the risk of every activity that contains a hazard, while the purpose of this study is to identify potential hazards and control the risk of work accidents for both workers and trainees at the Sawalunto Underground Mining Training Center.

[Advance in occupational health risks and management of shift work].

The occupational health issues of shift workers has received increasing attention in the field of occupational health, and discussed in this article through literature review on the health risks and management of shift work both domestically and internationally. Based on this, a series of impacts of shift work on the physiological and psychological health of workers, as well as their family and social life, are revealed. Combined with relatively mature regulations and policies in foreign countries, it is proposed that China should fully learn from the relevant experience of health management in shift work abroad, Strengthen research and explore effective management intervention measures to provide ideas for accelerating the development of scientifically feasible regulations and policies related to occupational health in shift work in China.

The impact of health and safety on construction, its regulation and improvement of quality of life in the workplace

This article aims to investigate occupational health and safety management in the construction industry, addresses occupational safety issues, expands the research overview, provides a technical basis through case studies and academic articles, establishes guidelines between safety categories, constructability, performance in the execution of a construction project. The article highlights the search for the implementation of occupational health and safety (OSH) guidelines and measures, pointing out the PCMAT document as an object of legal conduct, specific to the activity of this sector. The objective of the study is to direct the most appropriate regulation to the management of procedures, health and safety at work, to point out the best practices applied to reducing accidents in the construction segment, to point out the improvement of quality of life in the work environment. The results were evaluated with a qualitative view regarding their compliance with the requirements specified in current standards, in order to contribute to the development of architecture, engineering, and precise decision-making with regard to occupational safety, expanding opportunities for future scientific research on the topic.

The application of metaverse in occupational health.

The metaverse, as a new digital interactive platform, is garnering significant attention and exploration across industries due to technological advancements and societal digital transformation. In occupational health, there is immense potential for leveraging the metaverse to enhance work environments and occupational health management. It offers companies more efficient and intelligent solutions for occupational health management while providing employees with safer and more comfortable work environments. A comprehensive literature search was conducted using PubMed, Web of Science, IEEE Xplore, and Google Scholar databases to identify relevant studies published between January 2015 and March 2024. The search terms included "metaverse," "virtual reality," "occupational health," "workplace safety," "job training," and "telemedicine." The selected articles were analyzed, and key findings were summarized narratively. The review summarizes the broad application prospects of metaverse technology in immersive training, occupational risk identification and assessment, and occupational disease monitoring and diagnosis. However, applying the metaverse in occupational health also faces challenges such as inadequate technical standards, data privacy issues, human health hazards, high costs, personnel training, and lagging regulations. Metaverse offers new possibilities for addressing the numerous challenges faced in occupational health and has broad application prospects. In the future, collaborative efforts from multiple stakeholders will be necessary to promote the sustainable development of metaverse technology in occupational health and better protect workers' occupational health.

Efektivitas Sistem Manajemen Keselamatan dan Kesehatan Kerja (SMK3) dalam Upaya Menekan Angka Kecelakaan Kerja di Kota Batam

The Occupational Safety and Health Management System (SMK3) is imperative as a preventive measure to mitigate workplace accidents within a company's environment. Indonesia has enacted legal regulations regarding SMK3, specifically Government Regulation Number 50 of 2012 concerning the Implementation of the Occupational Safety and Health Management System. Nevertheless, the existence of these regulations does not consistently enhance workers' awareness of their safety while at work. This research employs an empirical research method, gathering data through literature studies as secondary data and interviews with the safety officer of PT. GPI as primary data. The research findings conclude that PT. GPI has implemented SMK3 in Indonesia. However, the implementation of SMK3 at PT. GPI in Batam cannot be deemed effective due to the presence of workers unwilling to comply with the applied regulations, ultimately leading to workplace accidents. In addressing this situation, the company needs to enhance strictness and supervision of each worker to ensure compliance with every applicable occupational safety and health regulation.

The implementation of Occupational Health and Safety Management systems remains a significant concern, particularly in the context of multi-storey building construction projects. Within the realm of these complex endeavors, the management of work-related accidents during formwork operations is of paramount importance. This research employs a rigorous methodology involving questionnaire distribution and interviews, complemented by advanced analytical tools such as the Frequency Adjusted Importance Index (FAII) and Bow Tie Analysis. The study focuses on the Indonesian Development University’s high-rise building project, systematically assessing potential hazards associated with formwork activities. Furthermore, this research evaluates the inherent risk levels and proposes comprehensive control measures to mitigate these hazards effectively. By shedding light on the intricate interplay between safety management and high-rise construction, this study contributes to the enhancement of occupational safety and health practices in the construction industry, ultimately promoting safer and more efficient work environments.

Обеспечение "функциональности" систем управления охраной труда: действующий обзор стандарта OHSAS 18001

Over the past decade, an increasing number of studies have yielded results on many aspects of occupational health and safety management systems, however, a review of scientific results does not provide an unambiguous sample. We eliminate this gap in the study with a realistic review of the mechanisms of occupational health and safety management systems (OSMS). After a thorough literature search, 14 articles with empirical studies were selected for the review, which we used as a realistic synthesis procedure for analyzing software theories and for analyzing context-mechanism-result (CMR) configurations. OHSAS System Analysis Standard 18001 describes three program theories: operational, institutional, and compliance. Five CMR configurations confirm the program's theories: integration, learning, motivation, translation, and attention. The configurations emphasize that certain combinations of context and mechanisms are necessary for the successful application of the QMS. Therefore, we describe specific ways to successfully implement the «Certified Occupational Health and Safety Management Systems» (SSMSS), as well as internal contextual elements. Thus, the conducted research can be used by organizations as a basis for a thorough internal assessment before the implementation of the standardization system. However, additional research is needed for a more detailed understanding of how to ensure a successful result, and for the functioning of the new ISO 45001 standard

Recommendations on the Development of a Hazard Register for Assessing the Level of Risks in the Field of Occupational Health and Safety at Food Industry Enterprises

The results of research on the implementation of the requirements of the ISO 45001 standard in the field of hazard identification and occupational risk assessment to ensure safe working conditions, preservation of life and health of employees of Kazakhstani food industry enterprises are presented. The Deming-Shuhart cycle «Plan-Do-Check-Act» is proposed as a methodology. It has been established that documentation of the hazard identification procedure and risk assessment is carried out through the development of Hazard and Risk Registers. The Register of Identified Hazards for the oil and fat industry enterprise «Shymkentmay» JSC, the Register of Identified Hazards in the production of meat products of «Karkyn-2030» LLP, the Register of Identified Risks for the operator of the ice cream production line of «Balmuzdak» LLP were developed as examples. Identification of hazards makes it possible to form a Risk map for each employee of enterprises that are taken as objects of research, depending on the existing hazards of a particular workplace. On the basis of such a map, an assessment of each risk is carried out with the establishment of its significance in three categories – high, medium and low. Depending on the established significance of the risk, preventive measures are being developed that allow to prevent the risks of occupational diseases and occupational injuries. The developed documents and completed activities serve as proof of compliance with the requirements of the ISO 45001 standard for monitoring, measurement and improvement of the occupational health and safety management system when confirming compliance with the requirements of this standard.

Erkennen und Bewältigen von Einsamkeit im betrieblichen Kontext

Recognizing and coping with loneliness in the workplace context Objectives: Loneliness manifests itself as an unpleasant feeling that arises when social relationships are perceived as inadequate. While temporary loneliness can be helpful, permanent loneliness is associated with mental and physical illness. As some causes and effects can also be found in the workplace context, companies should address the issue. Method: A systematic literature search was conducted to identify both scientific and practice-orientated publications on dealing with loneliness in the workplace context. Results: Many people spend a large proportion of their time at work, which therefore offers ideal conditions for raising awareness of the issue and taking preventative action. At present, however, loneliness still seems to be little known in German companies, although there are few reliable studies on the subject. Even if loneliness is not caused solely by the company, there are targeted measures available to protect employees so that they do not become lonely and to support those already affected with offers of help. Various approaches to prevention, early detection, and intervention for those affected by loneliness are presented, which can be applied in the workplace context. Conclusions: Loneliness must be understood as a shared task that can affect everyone and for which everyone can take joint responsibility. Although politicians are already looking for solutions, the issue should also be given greater attention in the world of work. It is important to establish the workplace as a social place that may serve as a resource for social relationships and at the same time offers opportunities for prevention and intervention. Determination of Subcontractor Selection Criteria from the View of Occupational Health and Safety in the Construction Industry

Construction industry is characterized by labor-intensive workforces, subcontractor-based production, diverse activities, and related hazards. Given the commonality of contingent forms of contracting, the majority of construction work is carried out by subcontractors. Unlike main contractors, subcontractors are typically smaller or medium-sized companies. Their awareness, practice, and compliance with health and safety legislation can be problematic. Furthermore, establishing and implementing a safety management system for a specific project requires coordination and management of multiple subcontractors. In this paper, a model has been created for selecting the most suitable subcontractor through an evaluation of their occupational health and safety (OHS) management implementation. The selection criteria have been determined based on a literature review focused on OHS, followed by the development of a questionnaire that assesses the importance of the criteria with the support of five occupational safety experts. Three shopping mall projects were chosen for implementation based on expert evaluations using scores calculated through the Analytical Hierarchy Process. Importance rates for each criterion were calculated, allowing for the identification of the most significant subcontractor selection criteria. Fifteen on-site subcontractors were evaluated using the proposed method. The research suggests that in the absence of qualification-based selection criteria for subcontractors, unskilled personnel could be selected. Consequently, this could impede the safety oversight mechanism, the execution of OHS measures, as well as the mitigation and/or prevention of potential risks, while jeopardizing compliance with the applicable legislation throughout the project. Therefore, it is imperative to choose only competent subcontractors to guarantee the welfare of workers.

UD. Farah is a well-known trading business in Situbondo that specializes in producing highly sought-after fresh seafood chips called "Ikan Kunir". However, the production capacity is still low due to the use of traditional equipment in the kitchen. To address this, the development of technology using a Rocket Stove is necessary. The Rocket Stove design allows for high-temperature wood combustion, resulting in complete combustion, increased heat energy, and smoke-free operation. It is also more fuel-efficient compared to open fire, saving up to 50% fuel. Furthermore, the current kitchen conditions lack attention to health and safety aspects, leading to smoke-filled, messy, dirty, and dark environments. To improve air circulation and increase production efficiency, a Turbine Ventilator will be installed in the combustion area. This applied research focuses on designing and innovating energy-efficient Rocket Stove technology and utilizing a Turbine Ventilator to enhance the production efficiency of Ikan Kunir chips in terms of time, cost, and energy. The breakthrough aims to improve user health by achieving complete combustion and reducing smoke emissions. The goal of this activity is to address the business partner's challenges, particularly in increasing product capacity and improving occupational health and safety management.
