Penegakan Hukum HAM di Indonesia dalam Perspektif Paradigma Keadilan Hukum Transendental

This research discusses how law enforcement is in Indonesia, and how does the law enforcement is in the perspective of a transcendental justice paradigm. This research is a library research using secondary data sources, namely primary and secondary legal materials. This research includes normative research with a synthetic analytic approach. Based on the results of the analysis, law enforcement in Indonesia, both criminal and civil, is still fixated on legal certainty, thus ignoring substantive justice. This is where a shift is needed from the law enforcement paradigm based on legal certainty to transcendent justice. This condition can be seen from several decisions that are very formalistic and based on laws, where legal certainty is at the forefront compared to substantive justice so that justice is not felt by the community. This condition is also strongly influenced by the legal paradigm adopted in Indonesia, namely positivist law or known as the systemic legal paradigm. Transcendental starts from irrational and metaphysical thoughts such as emotions, feelings, instincts, moral spirituality and as part of the science of building. In this context, law enforcement. The perspective of the paradigm of transcendental legal justice highlights how the objectives of Islamic law are beneficial to justice and human welfare. Where law is based on ethics (moral) so that it can produce substantive justice, not mere formalistic justice, which encapsulates human attitudes to be fair to God as the creator, fair to fellow human beings and fair to the universe.

PERSONAL INTELLIGENCE IN THE CONDITIONS OF TRANSFORMATION TO A PLANETARY-SPACE CIVILIZATION

The author considered the causes of the processes of de-intellectualization of society associated with the influence of man-made civilization, mass consumption society, and information society. Considering the importance of intellectualization of the individual, attention is paid to the fact that the term itself is used functionally, as the ability to use the intellect in certain situations, and not as the inner core of the spiritual image of the individual. Such consideration of intellectuality is substantiated in connection with the need for the functioning of modern post-classical science, as well as the study of large, complexly organized systems capable of self-organization. In order to formalize
 the concept of intellectualization, the structural elements (noosphericity, analyticity, intelligibility, creativity, heuristics, civility, intelligence, independent thinking, positive, life-affirming character), features of the manifestation of intellectuality in various spheres of personal activity, levels of intellectual development were considered. It has been proven that the need to achieve higher levels of intellectuality (evolutionary, global creative, spiritual) is connected with the need to survive the civilization at the stage of transformation to the planetary-cosmic one, use the resources of the technotronic society, and create intellectual and moral spirituality.

Law Enforcement in Indonesia in Perspective of Transcendental Legal Justice Paradigm

Morality and EFL Instruction in an Arab Context – Exploring Perceptions and Practices

This study was conducted to investigate the correlation between moral commitment and EFL teacher standard-based performance. 20 Muslim English native speaking instructors who work at Taibah University Language Centre participated in this study. The following instruments were used for investigating the correlation between teachers’ moral spirituality and their practical classroom performance: a scale of religious commitment, an open-ended questionnaire of spirituality and a standard-based observation sheet of the teachers’ performance. The present study sheds light on the nature of moral commitment and its correlation to EFL teacher performance based on different personal conceptions about Islam.
