PENGEMBANGAN MASYARAKAT LINGKAR TAMBANG DALAM PENGUSAHAAN PERTAMBANGAN

Indonesia is a country rich in mining resources. Mining resources include gold, silver, copper, oil and gas, coal and others. There are a large number of companies operating in the mining sector and investing in the mining sector. Mining operations in Indonesia have caused a lot of controversy. On the one hand, mining operations benefit the government and entrepreneurs, but on the other hand, they sacrifice the environment, causing many problems for the lives of people around the mine. The aim of this research is to analyze the legal aspects related to mining operations and analyze the legal regulations regarding the development of mining communities and the forms of development of mining communities carried out by PT. MSM. The first research method used is a normative juridical research method to find the truth from a normative perspective through a legislative approach from Laws, Presidential Decrees, Presidential Decrees, Ministerial Regulations and concepts regarding the development of mining communities in mining operations. The second research method is empirical juridical research to discover forms of community development around the mine through direct interviews with related parties. The research results related to mining business regulations are based on Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia that states that the Earth, Water and Wealth contained therein are controlled by the state and used as much as possible for the prosperity of the people. Other regulations are contained in Law No. 4 of 2009 concerning Mineral and Coal Mining which has been amended with the enactment of Law No. 3 of 2020. Regulations related to the development and empowerment of communities around mines are also regulated in Minerba Law No. 3 of 2020 and related to CSR, it is regulated in Law No. 40 of 2007 concerning Limited Liability Companies which requires PT business entities to carry out CSR programs. Furthermore, in Minister of Energy and Mineral Resources Regulation No. 41 of 2016 regulates Community Development and Empowerment in Mineral and Coal Mining Business Activities. The existence of PT MSM as a company that carries out gold mining business activities in North Minahasa Regency, North Sulawesi Province has contributed to the development and empowerment of communities around the mine through CSR programs in the fields of infrastructure, education, use of labor and the environmental sector.

Exploring conditions for just lithium mining in South America. The case of the EU responsible sourcing strategy

Abstract To advance its climate neutrality and electromobility goals, the European Union (EU) depends on a reliable supply of lithium. The “lithium triangle”, comprising Chile, Argentina, and Bolivia, contains 53% of the world’s lithium resources and supplies 85% of the EU’s lithium imports. In 2023, the EU and Latin America launched a new cooperation agenda under which the EU signed Memorandums of Understanding (MoUs) with Chile and Argentina aimed at jointly developing sustainable value chains for critical raw materials. That same year, the EU adopted the European Batteries Regulation (EBR), which mandates due diligence to address social and environmental risks in the mining of battery minerals. The EBR and MoUs form the foundation of the EU’s responsible sourcing strategy for lithium from South America. This study, using the energy justice framework and results from a Delphi survey, investigates whether the EBR and MoUs align with the conditions for a just lithium battery value chain for the lithium triangle. Our findings indicate that the EU-South America agenda reflects cumulative learning by addressing mutual interests, such as local industrialization. However, the current EU responsible sourcing approach overlooks critical local-level justice considerations —distributive, procedural, and recognition justice— that are highly relevant to the lithium triangle. We argue that for the EU to ensure a just lithium supply from South America, additional issues must be prioritized, including the equitable participation of local communities in the economic benefits of lithium mining, institutional strengthening, and the proper implementation of free, prior, and informed consultation with Indigenous peoples.

This essay aims to reignite the debate over the allocation of revenue from the Fee for Control, Monitoring, and Supervision of Mineral Research, Mining, Exploration, and Exploitation Activities (TFRM), established by Pará State Law nº 7,591/2011. The primary focus is on the flexibility of using TFRM revenue beyond its original purpose. The discussion emphasizes the challenges excessive revenue earmarking presents for public management and references Brazilian case law, highlighting the non-mandatory nature of such linkages, except in cases explicitly defined by law, like judicial fees. Although the Brazilian Constitution prohibits earmarking tax revenue, it does not impose the same restriction on fees unless specifically legislated. Drawing on Supreme Court decisions, this analysis questions the automatic presumption that fee revenue must fund the specific public services that justify their collection.

Mining in Africa: Are local communities paying the price of the global energy transition?

The energy transition is crucial to unlocking the potential of the Paris Agreement and the global climate goals. To meet the projected demand for the transition, critical mineral extraction is expected to significantly increase in countries of the global South. The critical mineral mining boom has the potential to drive economic development, contributing to the achievement of the Sustainable Development Goals (SDGs) under the 2030 Agenda. However, considering historical tensions between extractive industries and development, critical mineral mining risks exacerbating socio-economic inequalities and poverty.Against this background, the paper investigates factors influencing the local socio-economic impact of critical mineral extraction. Using satellite data and mining data from the S&P database, the study examines the socio-economic effects of 94 critical mineral mines that opened in Africa between 2000 and 2020, focusing on mineral-specific attributes and contextual factors, as well as factors related to governance.Findings indicate that critical mineral extraction can have significant positive impacts on local socioeconomic activity, particularly in areas distant from existing infrastructure and urban centers. The results highlight the complex role of institutional quality in mediating the socio-economic impact of mines, and shift attention to the underlying factors that shape institutional performance to deliver local benefits.

Error analysis and visualization of 3D geological models of mineral deposits

The accuracy of 3D geological models of mineral deposits has a significant impact on the precision and reliability of mining production decisions. High-precision 3D geological models can provide more accurate geological information of mineral deposits. A scientific error analysis method is proposed to quantify the errors in geological models and visualize these errors by assigning them to geological model entities. The errors in 3D geological models of mineral deposits mainly originate from modeling data and interpolation methods. By analyzing the generation and processing of modeling data, an error model for the modeling data is established. The Kriging interpolation method is used to quantitatively describe the errors in the modeling methods, and these errors are integrated into the 3D geological model. By using Boolean operations, the 3D geological model is combined with the open-pit mine entity model to generate an error-containing mining site model and mined rock model, and to calculate their mining and stripping volumes and errors, achieving error visualization. Using an open-pit coal mine in Inner Mongolia as a case study, the construction of its 3D mineral deposit and mining field models demonstrates the effectiveness and superiority of the proposed method in practical applications, highlighting its importance in improving the accuracy and reliability of mining production decisions.

LEGAL LIABILITY FOR UNAUTHORIZED MINING CRIMES (CASE STUDY OF BANDUNG HIGH COURT DECISION NUMBER 91/PID.SUS/2023/PT BDG)

This research aims to examine how regulations concerning Mining Permits for People (Izin Pertambangan Rakyat/IPR) are viewed from a legislative perspective and to analyze the legal considerations of judges when imposing criminal sentences on perpetrators of illegal mining based on Bandung High Court Decision Number 91/Pid.Sus/2023/PT BDG. The research methodology used is normative juridical research, which involves the analysis of secondary data or literature. The findings of this research are as follows: First, permits for mining activities in People’s Mining Areas (Wilayah Pertambangan Rakyat/WPR) with limited area and investment are known as People’s Mining Permits (IPR). Law No. 03 of 2020, which amends Law No. 04 of 2009 on Mineral and Coal Mining, and Government Regulation No. 25 of 2024, which amends Government Regulation No. 96 of 2021 on the Implementation of Mineral and Coal Mining Business Activities, include provisions on People’s Mining, as well as procedures and requirements for obtaining a People’s Mining Permit. Criminal sanctions and further penalties apply to those engaging in mining activities without authorization. Article 158 and Article 164 of Law No. 03 of 2020 concerning the Amendment to Law No. 04 of 2009 on Mineral and Coal Mining contain these provisions. Second, the appeal was based on the fact that the panel of judges at the first level failed to carefully analyze the objections and misinterpreted the indictment articles based on the defense notes and evidence presented by the defendants. Article 158 of Law No. 03 of 2020, in conjunction with Article 55 Paragraph (1) of the Indonesian Penal Code, was a significant consideration for the judges in evaluating the first alternative indictment. According to the judges, this indictment was appropriate and accurate. Concerning the second indictment, Article 107(a) of Law No. 39 of 2014 on Plantations, in conjunction with Article 55 Paragraph (1) of the Penal Code, the High Court Judge stated that the Cibadak District Court Decision Number 365/Pid.Sus/2022/PN Cbd was not entirely accurate. The author argues that in interpreting and establishing Article 158 of Law No. 3 of 2020, which amends Law No. 4 of 2009 on Mineral and Coal Mining, the Public Prosecutor’s demands and the content of the indictment were incorrect.

Combining APCS-MLR model to evaluate the distribution and sources of rare earth elements in a large catchment

Rare earth elements (REEs), functioning as indicators for environmental tracking, revealing the impacts of human activities on changes in aquatic ecosystems. However, systematic research on the geochemical characteristics of REEs in large river basins remains relatively scarce. Therefore, this research investigates the geochemical properties of REEs within the Yangtze River basin, analyzing the quantity and spatial distribution of REEs in surface aquatic environments across the upstream, midstream, and downstream segments of the Yangtze River, and quantitatively assessing their sources. Results indicate that the REE concentration in the upstream and downstream areas are significantly higher than in the midstream, with average concentrations of 0.69 μg/L, 0.56 μg/L, and 0.39 μg/L, respectively. REEs in the Yangtze River basin are enriched in light rare earth elements (LREEs), exhibiting a slight negative cerium (Ce) anomaly and a pronounced positive europium (Eu) anomaly. The Ce anomaly correlates with pH levels, and the Eu anomaly is largely attributed to the selective chemical decomposition and solubilization of feldspar minerals. Correlation analysis indicates that REE sources are related to manganese (Mn). Utilizing the Absolute Principal Component Scores-Multiple Linear Regression (APCS-MLR) model, the principal sources of REEs are further determined to be mineral sources (36.80%), industrial sources (45.61%), and mixed sources (17.59%). Further analysis suggests that mining and dissolution of Mn-bearing feldspar minerals, along with the discharge of industrial wastewater, considerably influence REE concentrations in the basin. This study reveals the anthropogenic and natural factors influencing the distribution of REEs in the Yangtze River basin, laying a foundational framework for investigating how human activities affect the dispersion of REEs in aquatic environments.

The Law of Natural Resources Management for Economic Prosperity: A Critical Analysis of Law No. 3 of 2020 on Mineral and Coal Mining

This research critically analyzes Law No. 3 of 2020 on Mineral and Coal Mining, focusing on its impact on natural resource management for economic welfare in Indonesia. Utilizing a normative legal research method, the study examines the law’s potential to strengthen the mining sector and increase its contribution to the national economy. While the law aims to boost investment and revenue, it faces significant challenges related to environmental sustainability, local community rights, and governance. The findings reveal that criticisms of Law No. 3/2020 underscore the need for a more balanced approach, ensuring that economic interests do not compromise environmental protection and social justice. To achieve sustainable, fair, and transparent mining sector management, governance reforms and stronger law enforcement are essential. This will ensure that Indonesia's natural resources are managed equitably for the benefit of all, not just a select few.

Perencanaan Biaya Tahun 2025 pada Kegiatan Reklamasi di Banko Barat PT Bukit Asam Tbk Tanjung Enim Sumatera Selatan

Based on Law no. 3 of 2020 article 140 concerning Mineral and Coal Mining which states that "Every holder of a Mining Business Permit (IUP) and Special Mining Business Permit (IUPK) is required to submit a reclamation plan and post-mining plan when applying for a Production Operation IUP or Production Operation IUPK as basis for placing reclamation guarantees. The aim of this research is to calculate the direct and indirect costs required for PT Bukit Asam's reclamation plan. The research method used in this research is using activities in the form of visits and direct observations in the field and also collecting articles as support. Direct costs include recountouring costs, revegetation costs and maintenance costs, which are planned at Rp. 12,889,010,229. Meanwhile for indirect costs, the amount is determined from the indirect cost graph, the plan is Rp. 3,054,695,424, so the total cost of the reclamation plan for the West Banko Pit is Rp. 15,943. ,705,653 with an escalation calculation of 5.51%, it becomes IDR 19,758,945,354.

Ochre communities of practice in Stone Age Eswatini

Our species and other hominins have used earth mineral pigments since at least ~500,000 years ago, if not earlier. Its preservation and ubiquity within archaeological records across sub-Saharan Africa are well documented, but regional-scale networks of mineral selection, mining, transport, and use is an underdeveloped field. Here, we present a framework for interpreting regional variations within an overarching ochre-behavioral community of practice. Deep-time records of ochre provisioning span the final Middle Stone Age and Late Stone Age in modern day Eswatini, revealing longstanding cultural continuities in the intergenerational transmission of shared knowledge on landscapes, geology, and the desired physicochemical properties of mineral pigments. These communities of practice did not develop in isolation, and were part of a wider system of relations that were influenced and mediated by social interactions, such as technological learning, seasonal traveling, material culture exchange, and symbolic expression. We use compositional analyses to determine localized ochre procurement strategies and long-distance transport across a network of fifteen archaeological sites and mineral resources. Newly refined chronologies from Lion Cavern at Ngwenya using optically stimulated luminescence dating also reaffirm its antiquity as the oldest known evidence for intensive ochre mining worldwide (~48,000 years ago).

Mining and urbanization affect river chemical water quality and macroinvertebrate communities in the upper Selenga River basin, Mongolia (revised version)

Mongolia is a country with a quickly growing economy mainly based on the mining of gold, copper, coal, and other minerals. Mining, urbanization, and agriculture impact the water quality in the upper Selenga River basin in northern Mongolia, which is the center of the Mongolian economy. Previous measurements of pollution loads were alarming, but restricted to chemical measurements. Here, for the first time, we combine freshwater biomonitoring and laboratory water quality data across a broad gradient of water quality and land use intensity. We track the effects of different types of pollution on aquatic invertebrates and test their use as bioindicators. We collected water samples, environmental parameters, and macroinvertebrates at 36 sampling sites at the rivers of Tuul, Kharaa, and Orkhon and their tributaries Sugnugur, Boroo, Sharyn Gol, Gatsuurt, and Yeröö. PCA of catchment water quality distinguished three groups of pollutants prevalent at the sites, (1) nutrients, (2) salt ions (Cl−, Na+, Mg2+, So42−, Ca2+) and mining by-products (B, Sr, U, Mo), and (3) (heavy) metals, which often exceeded regulatory standards. We recorded a total of 59 macroinvertebrate taxa belonging to 31 families in seven insect orders plus Amphipoda and Gastropoda. Species diversity declined with higher impact. Five environmental factors structured macroinvertebrate community composition in RDA: elevation of sample location, site total nitrogen, dissolved oxygen, electrical conductivity, and water chemistry. We conclude that macroinvertebrate communities are an appropriate and inexpensive tool for monitoring water quality in Mongolia and suggest government action to establish a long-term monitoring program.

Discussion on Landscape Ecological Restoration Measures - A Case Study of Abandoned Mines

Abandoned mines have caused many landscape ecological problems to urban development, This paper analyses the causes of the problems from the concepts related to mineral resources and mine wasteland, and briefly describes the concepts related to ecological restoration, combining with two cases of mine restoration, discusses the effective measures for the restoration of abandoned mines, which are mainly as follows: the management measures for slopes; the tailings management measures; the soil grassroots improvement; phytoremediation of heavy metal pollution in mines; restoration of water resources in mines and microbiological restoration measures.

Legal Review of the Granting of Mining Business Licenses to Religious Organizations

The government, through Government Regulation of the Republic of Indonesia Number 25 of 2014 concerning amendments to Government Regulation Number 96 of 2021 concerning the Implementation of Mineral and Coal Mining Business Activities, provides special rights for Religious Organizations to obtain mineral and coal IUPs without having to go through an auction process. This research aims to examine and analyze legal reviews regarding the granting of mining business permits to religious community organizations. The problem formulation in this research consists of: 1). What are the dynamics and problems of granting mining business permits to religious organizations? 2). How is the use of mining business permits in accordance with the principles of justice and equality? The research method used in this research is doctrinal legal research. The results of this research conclude that: 1). The dynamics and problems of granting mining business permits to Religious Organizations are: First, the potential for silencing public supervision. Second, the low level of experience and competence of Religious Organizations in managing mineral and coal mining. Third, the auction process is set aside by eliminating the auction obligation for Religious Mass Organizations in receiving IUPs. 2). Utilization of mining business permits in accordance with the principles of justice and equality consists of: First, the concept of implementing affirmative action for specific IUPs must be given to vulnerable communities. Second, the use of CSR should be an alternative for the Government to provide financial assistance to Religious Organizations rather than providing IUPs which have no rational reason to be handed over to Religious Organizations.

MINERAL PRODUCTION AND ENVIRONMENTAL POLLUTION IN NIGERIA

This study empirically determined the effect of mineral production on environmental pollution in Nigeria from 1985 to 2022. The research utilised time series data obtained from the Central Bank of Nigeria (CBN) data bulletin and the World Development Indicators (WDI) of the World Bank. The data analysis methodologies utilised include descriptive statistical analysis, ADF Unit Root test, ARDL Bound Co-integration test, and ARDL methodology. The result of the ADF unit root test indicated the presence of a combination of stationary and non-stationary elements. That is a mixture of I(0) and I(1). Furthermore, the ARDL limits co-integration test has shown the presence of a long-term link between the variables. Finally, the ARDL estimation revealed that crude petroleum and natural gas production, likewise mining and quarrying had significant and positive implication on emission of CO2 in both long and short runs. Coal production had positively significant impact on CO2 emission in the long run but positively insignificant impact in the short run. In addition, metal ores positively and insignificantly impacted on CO2 emission in both the long and short runs. The study's results indicated that mineral mining in Nigeria resulted in a rise in environmental contamination. The report proposed that the Nigerian government should thoroughly evaluate and revise current environmental laws and regulations in order to effectively address the environmental consequences of mineral development. This should include establishing clear standards, guidelines, and permits for mining operations, waste management, pollution control, and rehabilitation of mining sites. Assessment of the relationship between mineral extraction in the southern hemisphere and sustainable development

Sustainable mineral policies are needed to achieve environmental and social equity in the global South. This study explores the need to align mineral mining in the global South with the United Nations Sustainable Development Goals (SDGs). It studies the impact of mineral mining on sustainability in 29 global South economies from 2000 to 2021. It also conducts robustness analysis and heterogeneity tests to analyze the mediation effect and the impact of the release of SDGs on sustainability. The main conclusions are as follows: (1) Mineral mining has an inhibitory effect on sustainable development and has become a constraint for the achievement of sustainable development goals in the global South; (2) The more mineral-rich a country is, the more serious the adverse impact of mining activities is. The harm of mineral mining to sustainable development is most serious in Africa; (3) Mineral mining leads to an increase in ecological footprint and undermines environmental sustainability, while mineral rents may become a source of funds for clean production, offsetting the adverse effects of mineral mining; (4) The release of SDGs has prompted leaders of various countries to legislate and reform in the field of minerals, helping countries achieve sustainable development goals. The research results provide an effective reference for promoting environmental and social sustainable development in the global South.

Discovery and Underground Mining of Large Deposits: Essential Training to Ensure Copper Supply

Editor’s note: The aim of the Geology and Mining series is to introduce early career professionals and students to various aspects of mineral exploration, development, and mining in order to share the experiences and insight of each author on the myriad of topics involved with the mineral industry and the ways in which geoscientists contribute to each. Abstract A supply shortfall of at least 6 million tonnes (Mt) Cu is expected by 2031—with total demand now forecast to increase from 25 Mt in 2023 to >36 Mt, and possibly to a suggested 50 Mt by 2050—given the present trend in demand. The deficit can be partially filled by increased mine production, expanding currently installed mine production capacity, and increasing Cu recycling. However, satisfying demand in 2050 as the demand-to-mining supply gap increases will require the accelerated discovery of at least five large Cu deposits—individually producing >0.5 to >1.0 Mt/yr Cu—and their related mine development, by 2030. These five deposit discoveries are required to replace mines scheduled to close in the 2050s, given the >20 years needed to take a deposit from discovery to mine production. The two largest sources of Cu supply, porphyry and sediment-hosted Cu deposits, can potentially fill the gap if enough discoveries are made; however, there is no evidence that this is about to occur. Future porphyry Cu discoveries are expected to be mined underground, mostly by a caving method. The demand increase is occurring at a time when the capital intensity of porphyry Cu mine development has almost doubled since 2006. We predict that the only solution to the future Cu demand-supply challenge for society and the mining industry in the short to medium term rests with simple demand-supply economics and a substantially increased Cu price. Copper substitution by other materials and recycling could potentially benefit from a significantly increased price; however, the major advantage will be conferred on deposits amenable to open-pit mining that are undeveloped because of price-dependent, failed feasibility studies. The challenge of possibly doubling Cu supply by ca. 2050 through developing mines on large Cu deposits—both discovered and undiscovered, in an unprecedented number and in a shorter period—will require a major increase in the number of competent mining industry personnel. This comes at a time when the industry faces an aging workforce, leading to a critical skills gap compounded by a chronic shortage of students graduating in the sciences and engineering with mining-related university degrees. There is an acute shortage of experienced professionals in cave mining, and the substantial number of open-pit mining professionals who are predicted to retire by 2030 will need to be replaced. On-the-job training of geoscientists and engineers after graduation, delivered by experienced practitioners through university-accredited professional development programs, is suggested as the solution.

Mathematical modeling of pollution of underground aquifers due to mining of minerals

Purpose. The research aims to create a mathematical model of salt contamination spreading through underground aquifers in the event of depressurization of the hydrocarbon production well crater for further assessment of environmental and economic damage from these processes. Methods. To predict the environmental and economic damage from salt contamination, the distribution of concentrations of harmful substances was investigated, taking into account the number of supply sources and their intensity over time, based on situ studies at the Rybalske Oil Field, Okhtyrskyi District of Sumska Oblast in Ukraine, where there were technological failures wells, accompanied by open fountains with the release of large amounts of highly mineralized water and the formation of craters. Mathematical modelling methods were used to process the data from the study of accidental technogenic pollution of underground aquifers. Findings. Based on real data from the study of the processes of potential salt contamination spread in fresh aquifers as a result of accidents at hydrocarbon production facilities, a mathematical model of salt contamination spreading in drinking groundwater in the event of depressurization of an oil field well crater has been developed. Potential economic losses in case of possible groundwater contamination with highly mineralized solution, which can into drinking groundwater aquifers, are substantiated. It has been established that in connection with the occurrence of an emergency situation due to the release of formation water to the surface in the territory of oil and gas fields, the formation of technogenic meromictic reservoirs is possible, which is confirmed by the example of the Rybalske Oil Field. It is proved that the total mineralization of crater water increases linearly with depth of the reservoir occurrence, and a similar dependence is characteristic of the chloride ion content. Originality. For the first time, a multicomponent mathematical model of mineral salt migration processes in underground freshwater aquifers in the case of depressurization of a meromictic reservoir has been developed. Practical implications. The research results obtained using numerical methods make it possible to predict the processes of spreading harmful substances in drinking underground aquifers as a result of emergencies at oil and gas fields, taking into account the number of sources of pollutants penetrating the study area, the heterogeneity of properties of the environment into which the harmful substance enters, and to assess the dynamics of changes in the concentration of these substances and time with further assessment of environmental and economic damage from these processes.

Comprehensive assessment of the earth’s surface state disturbed by mining and ways to improve the situation: case study of Kryvyi Rih Iron-ore Basin, Ukraine

IntroductionComplex mineral mining leads to critical earth’s surface disturbance and environmental pollution from industrial waste. This research aims to comprehensively study, assess and show the current scale of the earth’s surface disturbances in the largest mining region of Ukraine – the Kryvyi Rih. Iron-ore Basin and suggests ways to improve the situation based on backfill technologies for the earth’s surface rehabilitation and industrial waste utilization.MethodsTo identify the forms of surface disturbance, their parameters, and spatial location, satellite images of the region, government statistical data, and a geographic information system software suite were studied. An analysis of the effectiveness of existing reclamation measures for technogenic voids in the region was carried out, and a new concept of surface restoration was proposed using beneficiation tailings, which are difficult to utilize in the region.ResultsIt has been determined that the contribution of the Kryvyi Rih Iron-ore Basin to waste generation is 92.08% of the total volume of waste accumulations in Dnipropetrovsk Oblast and 65.5% in Ukraine as a whole, amounting to 10.7 billion tons. It is determined that 65.25% of the total disturbed land area is industrial waste, 34.76% – quarry cavities and mine failure zones, occupying 49% of the Kryvyi Rih city area. An analysis of waste accumulation density in allotted areas shows that per 1 m2 of land area, on average, 183.5 tons of dump waste rocks and 73.5 tons of beneficiation tailings are placed. Disposal of beneficiation tailings is recognized as a priority, because their utilization is slower, occupy the largest area, creating a risk of dams breaching and intense dusting from tailings dams surface, threatening the environment and public health. For the first time in Ukraine, a concept for the earth’s surface rehabilitation for various industrial purposes has been developed based on paste backfill technologies.DiscussionPaste backfill technology implementation is prioritized in the central and northern parts of the city, which can dispose of at least 65–70 million tons of waste in cavities and reclaim about 200 ha of land. The research results are valuable for the development of strategies or programs to overcome the technogenic-ecological crisis in the city. The rehabilitated earth’s surface can be usefully involved in various infrastructure projects for the development of the industrial and economic potential of an industrial city such as Kryvyi Rih.

Legal Review of Procedures for Granting Rock Mining Business Permits

This research is motivated by the granting of mining permits originally granted by the Central Government, with the issuance of Presidential Decree Number 55 of 2022 concerning the Delegation of Granting of Business Licensing in the Mineral and Coal Mining Sector, some mining permits are granted by the Central Government to the Provincial Government, but only limited to the granting of Mining Business Permits (IUP) for non-metallic mineral groups, certain types of non-metallic minerals, and rocks. The legal research method used in this research is normative juridical research which is research that is carried out or aimed only at written regulations with a descriptive analytical research nature which is a method that functions to describe or provide an overview of the object being studied. The data source used is secondary data with quantitative data analysis. The results of this study are: The Procedure for Rock Mining Business Permits is carried out by means of an application to the regent or mayor if the mining area is in a district or city, to the governor if the mining area is across district or city borders, to the minister if the mining area is in a cross-provincial border area. The procedures carried out in the procedures for rock mining permits are the determination of the mining area carried out by authorized officials, determination of mining business areas, mining business permits, regulation of mining permits if there is a violation of mining permits. Supervision of Rock Mining Activities After Obtaining a Business Permit in the Mining Sector, it is carried out by the ESDM Service where the mining permit is located. Settlement of Rock Mining Permit Disputes can be carried out through a non-adjudication process.
