Waste banks are blessed with processing. This processing has the aim of making waste into products that can be sold and gain economic value. Legal Certainty of Payment of Receivers' Fees in the Event That Bankruptcy is canceled by the Court

This research examines the implementation of payment of curatorial services in the event of annulment by the Court of the Supreme Court Decision. This study also describes the legal certainty of payment of curatorial fees from the side of the curator, debtor and creditor. Normative research is research that refers to legal norms contained in legislation and court decisions. The author uses the 1945 Constitution, Law of the Republic of Indonesia Number 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations, Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 18 of 2021 concerning Guidelines for Fees for Curator and Management Services. The results of this study are that the payment of curatorial services in the event that it is canceled by the Court on the Supreme Court Decision has been regulated in the Applicable Laws that regarding curatorial fees has been regulated in Law No. 37 of 2004 concerning Bankruptcy and Suspension of Debt Payment Obligations and in Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 18 of 2021 concerning Guidelines for Service Fees for Curators and Suspension of Debt Payment Obligations as a technical regulation governing curatorial fees. In practice, it is the Panel of Judges that determines the amount of the curator's fee after the application for the determination of the curator's fee is submitted by the Curator to the Court.

The Effectiveness of Legal Aid Standards for Suspects in the Indonesian Criminal Justice System in Achieving Access to Justice

The implementation of legal aid service standards, as outlined in Regulation No. 4 of 2021 by the Minister of Law and Human Rights of Indonesia, was expected to enhance the quality of legal aid services. However, in reality, suspects continue to experience inconsistent access to their rights, especially within the criminal justice system. This study aims to investigate the application of these standards across the police, prosecutor's office, and court sectors. Employing an empirical juridical approach with a qualitative and comparative study method, data was gathered through interviews and literature review, then analyzed using content and comparative analysis techniques. The findings reveal that the enforcement of legal aid service standards in the criminal justice system has been ineffective, marked by frequent violations of suspects' rights. These violations include providing indirect assistance, inadequate representation at various stages of trials, appointing advocates not affiliated with accredited LBH (Legal Aid Institute), and advocates displaying insufficient responsiveness and engagement in assisting suspects. Such violations significantly hinder suspects' access to justice within the criminal justice system.

Early in the Constitutional era, in Qozeleni v Minister of Law and Order 1994 3 SA 625 (E) Justice Johan Froneman called for the "rubicon … to be crossed out not only intellectually, but also emotionally before the interpretation and application of the … Constitution is fully to come into its own right". He further argued for the Constitution "to become … a living document". In his many judgements in a judicial career spanning 25 years, Justice Froneman suggested some of what such a crossing of the Rubicon could entail. He also gave meaning to the idea of the Constitution as a living document. The contributions in this special edition unpack, reflect on, evaluate and further the work of and themes tackled by Justice Froneman. Justice Johan Froneman retired from the Constitutional Court in 2020. He was appointed to the Constitutional Court in 2009 after serving as Judge of the Eastern Cape High Court, Grahamstown (1994-2009); Deputy Judge President of the Labour Court and Labour Appeal Court (1996-1999) and two terms in 2002 acting on the Supreme Court of Appeal. In 1999 he was a visitor at Harvard University by invitation of Professor Frank Michelman. He was also Extraordinary Professor in Public Law at Stellenbosch University (2003-2008) and a Visitor at the Centre for Socio-Legal Studies, University of Oxford, in 2008. He is currently an extraordinary professor in the Department of Public Law, University of the Free State. He has delivered judgements in a wide range of cases. Of particular interest is his careful deliberation on issues pertaining to transformation, legal interpretation, property and language. Justice Froneman in his many carefully argued judgements displayed not only the intellectual rigour that he was calling for, but also the emotional and very much personal crossing that he referred to in 1994.

Penerapan Grasi Dalam Perspektif Hukum Pidana Bagi Terdakwa

In the presidential system of government, there are prerogative rights that are only owned by the head of state as the leader of the country. Clemency is regulated under Law Number 5 of 2010 on Clemency on the amendement of Law Number 22 of 2022 on Clemency. One of the uses of prerogative rights is to provide relief to several convicts by granting clemency. The granting of clemency by the President is based on humanity and without any interference from other parties or other state institutions. Although the granting of clemency is in the hands of the President due to the ownership of the prerogative, the consideration of granting clemency must be considered by the Supremen Court, the Prosecutor, and the Minister of Law and Human Rights so that there is cooperation between the relevant legal institutions. Clemency is utilized by several convicts, especially death row convicts, to cut the sentence imposed on them so that the executive of the sentence becomes shorter from the first time the decision is read out by the judge at the first level court.

Legal awareness plays an essential role in achieving legal values and goals. This awareness becomes the basis for realizing the values of legal certainty, usefulness, justice and legal objectives for general prosperity. The Regulation of the Minister of Law and Human Rights of the Republic of Indonesia stipulates that public legal awareness includes understanding and compliance with legal norms. The Legal Awareness Subdistrict/Village Program (DSH), which began in the 1980s, aims to increase residents' legal awareness through outreach by the Ministry of Law and Human Rights. In an effort to increase legal awareness, the government formed Legally Aware Families (Kadarkum) and Legally Aware Villages/Subdistricts. The Legal Awareness Family Competition, as held in several regions in Indonesia, involves the community in increasing their understanding of the law through various competitions. This research describes the capacity of the Mekarsari Village Government in realizing a Legally Aware Village, involving aspects of strategic leadership, organizational structure, human resources, financial management, infrastructure and program management. Despite facing limitations, Mekarsari Village has succeeded in creating an environment that prioritizes legal understanding and has become an example for other villages in strengthening legal awareness at the local level.

Legal Actions Of Notaries Who Feel Aggrieved By The Decision Of The PTUN Court On Dismissal In PTUN Decision Number 200/PK/2022 In Jakarta

As a public official, a Notary can be dishonorably dismissed if proven to have committed a criminal offense, as stipulated in the Notary Position Law. Although regulations related to dishonorable dismissal for notaries already exist, they are considered somewhat unclear. The issues discussed in this study include the substance of legal remedies for notaries who are dishonorably dismissed due to criminal convictions with a threat of less than five years. The research method used is normative juridical, with data collection through document study and literature review. The analytical approach used is qualitative. The research findings regarding the substance show that criminal offenses that can lead to dishonorable dismissal for notaries are criminal offenses with a prison sentence of 5 (five) years or more that have obtained legal force, whether committed in a personal or official capacity. Furthermore, the legal remedy for a Notary who is faced with dishonorable dismissal when convicted with a sentence of less than five years is to file a lawsuit to the State Administrative Court. This lawsuit is addressed to the Minister of Law and Human Rights as Defendant I, and the Notary as Defendant II.

Governance of Super Maximum Security Prison Karang Anyar Nusa Kambangan Indonesia in Realizing the Correctional Revitalization Program

The correctional system has undergone changes due to the emergence of the Minister of Law and Human Rights regarding the implementation of correctional revitalization which provides classification of prisons which has an impact on the existence of prisons with categories for placing high risk prisoners. One of them is the Super Maximum Security (SMAX) Class IIA Karang Anyar Nusakambangan Prison for placement of high classification prisoners. This has an impact on the problem of not being able to grant conditional rights to prisoners who do not reduce their risk of crime until they have finished serving their sentence. The aim of the research is to analyze the governance of the SMAX Class IIA Karang Anyar Penitentiary in realizing a correctional revitalization program to improve training for high risk prisoners. The research method uses descriptive qualitative research with informants from prison officers and high-risk prisoners in prison. The results of the analysis show that prison management with a revitalization program has an impact on limiting the granting of conditional rights, there is no maximum guidance carried out by the prison, guidance for high risk prisoners must involve other parties such as the National Counterterrorism Agency, the National Narcotics Agency, the Corruption Eradication Agency, and other parties who have an interest in it. Thus, it is necessary to provide appropriate guidance for high-risk prisoners to be able to change their behavior and obtain their conditional rights. Providing this guidance by applying the principles of planning, organizing, regulating and strictly monitoring during the process of changing behavior and coaching prisoners.

Indonesian Travel Documents and the ICAO Document 9303: Principles, Security, Technology, and Infrastructure

The issuance, printing, production, and distribution standards of Indonesian travel documents refer to international standards of travel documents and the Regulation of Minister of Law and Human Rights. However, significant issues have risen that the Indonesian passport holders without the bearer’s signature who applied for German visa were rejected by the Embassy of Federal Republic of Germany in Jakarta. Besides, the stolen and lost Indonesian Passport policy is fragmented between the Indonesian National Police, Immigration offices and the Interpol. Using the document analysis and policy evaluation, this paper investigates the issuance standards of Indonesian travel documents under the ICAO Document 9303 about Travel Documents and the policy and management of the stolen and lost Indonesian travel documents. This study shows the Indonesian travel documents have not fully complied with the ICAO Doc 9303 in which the bearer’s signature is a compulsory either in the biodata page or in additional pages. Data of stolen and lost Indonesian Passport have not been recorded in the Interpol Stolen and Lost Travel Documents (SLTD) database. We propose the infrastructure of the security, cooperation, and management of the SLTD, and all Indonesian travel documents must be redesigned and equipped with the chip features.

Impacts of Justice Collaborator Revocation from Prisoner Remissions for Extraordinary Crimes in Class 1 Correctional Facilities in Tangerang

The elimination of Justice Collaborator as a requirement for an Extraordinary Crime convict to obtain sentence reduction or remission, in accordance with the provisions stated in the Minister of Law and Human Rights Regulation Number 7 of 2022, which amends the Minister of Law and Human Rights Regulation Number 3 of 2018 regarding the requirements and procedures for granting sentence reduction, has changed the mechanism for granting remission to prisoners at Class 1 Tangerang Correctional Institution, both in terms of administrative and subjective requirements. This change has both positive and negative impacts on the existing regulations. The research methodology employed is empirical legal research, as it relates to the effectiveness of the law. The recommendations obtained are related to communication, education, and transparency regarding the implementation of Minister of Law and Human Rights Regulation Number 7 of 2022 at Class 1 Tangerang Correctional Institution, in order to be accepted and understood by the inmates, their families, and relevant stakeholders

Peranan Notaris dalam Kepastian Hukum Prinsip Pemilik Manfaat (Beneficial Ownership) Berdasarkan Permenkumham Nomor 13 Tahun 2018

The increasingly rapid development of globalization will have good and even bad impacts on social life. This is in line with the process of the birth of a legal entity which confirms the evidence that law involves several stages, and the role of a notary is crucial in the initial stages of forming a legal entity. Beneficial Ownership can be a serious issue in the business world. A beneficial owner is an individual or entity who ultimately owns, controls, or obtains economic benefits from a company or business entity. In Indonesia, BO is regulated in the Minister of Law and Human Rights Regulation (Permenkumham) Number 13 of 2018. The aim of this research is to explain the role of notaries in legal certainty regarding the principle of beneficial ownership based on Permenkumham Number 13 of 2018. The research method uses descriptive , namely research that describes or explains the problems discussed. The results of this research are that based on Government Regulation Number 13 of 2018 concerning the Actual Beneficial Owners of Corporations, this is a regulation that stipulates the obligation to record and report information regarding the beneficial owners of a company. Notaries have the obligation to record information regarding beneficial owners in the deed of establishment of a company. This information includes the name, identification number, address and amount of ownership of the beneficial owner. The role of a notary in the principle of beneficial ownership covers various aspects that support legal certainty and transparency in the ownership of a company or business entity.

Analisis Perbandingan antara PP No. 99 Tahun 2012 dengan Permenkumham No. 07 Tahun 2022 Tentang Aturan atau Syarat Remisi terhadap Koruptor di Indonesia

Corruption has long been a serious problem in Indonesia. To fight corruption and enforce the law, the government has issued several regulations governing remission of corruptors. Two regulations that have had a significant impact in this regard are Presidential Regulation Number 99 of 2012 and Minister of Law and Human Rights Regulation Number 7 of 2022. To combat rampant corruption, the government has taken various steps, one of which is by implementing remission rules for corruptors. In this context, a comparative analysis between two important regulations is very relevant, namely Presidential Regulation Number 99 of 2012 and Regulation of the Minister of Law and Human Rights Number 7 of 2022 concerning Rules or Provisions for Remission of Corruptors in Indonesia. Through an objective and critical approach, this journal will present a comprehensive analysis regarding the comparison between the two regulations. In analyzing it, we will look at important aspects such as the criteria for remission recipients, the requirements that must be met, as well as the social and legal impacts of implementing these regulations. This study uses a normative juridical approach, which examines the problem based on the applicable laws and regulations regarding the rules or conditions for remission of corruptors in Indonesia. Increasing these conditions aims to provide stricter sanctions against perpetrators of corruption. This latest regulation provides stricter and stricter sanctions against corruptors, with additional requirements such as payment of fines and compensation, as well as recovery of assets obtained illegally. This is expected to provide a deterrent effect on perpetrators of corruption and strengthen law enforcement in Indonesia.

The Validity Of The Additional Obligations Of The Notary Profession Through PP Number 43 Of 2015 Of The Notary As The Reporting Party

The Indonesian government has enacted Law Number 8 of 2010 concerning the Prevention and Eradication of Money Laundering, along with its implementing regulation, Government Regulation Number 43 of 2015 on Reporting Parties in the Prevention and Eradication of Money Laundering Crimes. This regulation designates Notaries as one of the reporting parties in Suspicious Financial Transactions related to Money Laundering (TFM), obligated to submit reports to the Financial Transaction Reports and Analysis Center (PPATK). Meanwhile, Article 16 paragraph (1) letter f of the Notary Law states that in carrying out their duties, Notaries must maintain the confidentiality of deed contents. Here, there is a contradiction between legal regulations. This study aims to examine and analyze the validity and legal consequences of the additional professional obligations for Notaries as stipulated in the Notary Law, supplemented by Government Regulation Number 43 of 2015, designating Notaries as reporting parties in TFM related to Money Laundering. The research indicates that the confidentiality duty of Notaries is not absolute; in other words, the obligation to maintain confidentiality in the Notary Law can be set aside by other laws, in this case, the Law on the Prevention and Eradication of Money Laundering through Government Regulation Number 43 of 2015, a directly authorized implementing regulation. The additional obligation as a reporting party cannot be considered a violation of the principle of notary confidentiality but rather a form of protection, with Minister of Law and Human Rights Regulation Number 9 of 2017 serving as an implementation of the prudence principle for Notaries in performing their duties. Furthermore, the legal consequences for Notaries, if they breach their duty as keepers of official secrets, may include criminal sanctions based on Article 322 of the Criminal Code and Law Number 43 of 2009 concerning Archives, civil sanctions under Article 1365 of the Civil Code, and administrative sanctions under Article 85 of the Notary Law. Additionally, if a Notary fails to report suspicious financial transactions resulting in criminal activities, the Notary faces the threat of punishment as regulated in Article 5 of the Law on the Prevention and Eradication of Money Laundering, which includes passive involvement in money laundering crimes (Article 55 of the Criminal Code) and active assistance in criminal activities (Article 56 of the Criminal Code).

Transformation of Limited Partnership Regulations: Impact of Minister of Law and Human Rights Regulation No.17/2018, Registration Inequality, Tax Obligations, and Legal Consequences

The legal developments related to Limited Partnership (Persekutuan Komanditer or CV) in Indonesia, following the enactment of Regulation of the Minister of Law and Human Rights No. 17 of 2018, establish new tasks in the submission of name requests, registration of establishment deeds, and changes to the articles of association of CV through the Business Entity Administration System (SABU) and the Online Single Submission (OSS) application. In this research, employing a normative juridical and empirical approach with a descriptive-analytical method, the aim is to understand the impact of this regulation on the CV registration process and the legal status of previously registered CVs. Research findings highlight that the regulatory changes mandate new CVs to submit requests and re-register through SABU and OSS, using names already registered in the District Court according to the Commercial Code (KUHD). The legal status of existing CVs becomes invalid without electronic re-registration with the Ministry of Law and Human Rights. Regulation from Regulation of the Minister of Law and Human Rights No. 17 of 2018 also stipulates the obligation of CV registration through SABU and OSS, including the name reservation stage before the re-registration process. However, for CVs still registering through local courts, they are required to re-register, and in case of name similarities, they must change their CV names. Injustice is evident for CV owners registered earlier, resulting in losses as the name changes can impact widely recognized identities. In the context of CV tax obligations, compliance such as having a Taxpayer Identification Number (NPWP), Value Added Taxable Entrepreneur (PKP) status, accurate bookkeeping, self-assessment of Income Tax (PPh), collection and withholding of Income Tax, tax payment following procedures, and tax return (SPT) reporting is crucial. Through a tax violation case involving CV Mitra Sejati, it was found that the Semarang District Court imposed strict criminal sanctions in response to tax violations. This decision reflects the seriousness of enforcing tax laws and ensuring justice in the CV business environment in Indonesia.

Madirda Lake Ecotourism Management Strategy Based on Water Quality Analysis

Madirda lake is located in Berjo village, Ngargoyoso, Central Java. The utilization of Madirda lake is relatively low although it is continuing to increase every year example for tourism, irrigation and anthropogenic activity. It affects the water quality and also impacts on population. Water quality analysis is needed to find out the quality of water, in this research used three parameters: physical (temperature, TDS and TSS), chemical (DO and pH), and biological (coliform). The result of the research shows that the quality of Madirda lake based on the water Pollution Index (IP) and STORET methods is in compliance with the class I water quality standard, which can be used as a benchmark for drinking water and/or other uses when the same function requires water quality based on water quality standards by the Law Ministry of Environmental No. 22 year 2021. These methods are easy technique and useful for representing the water quality data.

Legal Reform Urgency: A Critical Analysis of Notary Officials Convicted More Than Once with Imprisonment Sentences Below Five Years

A Notary in Indonesia is a public official appointed by the Minister of Law and Human Rights of the Republic of Indonesia. Its function is crucial in ensuring certainty, order, and legal protection in the realm of civil law. In carrying out their duties, a notary is obliged to maintain the integrity and dignity of their profession by avoiding violations stipulated in the Notary Office Law and Code of Ethics. Administrative sanctions can be imposed on a notary who violates the rules, such as written warnings, temporary suspension, honorable discharge, and dishonorable discharge. Finally, dishonorable discharge can be applied when a notary faces the threat of imprisonment for five years or more. However, if the threat of imprisonment is less than five years, the notary still has the opportunity to resume their profession after serving the sentence. The issue arises when the Notary Office Law does not provide clear provisions regarding the imposition of penalties if a notary faces a criminal threat of less than five years more than once. This situation creates a legal norm vacuum and ambiguity in the role of the Notary Supervisory Board in determining sanctions against notaries who commit such violations.

Notary Profession and Code Of Ethics In The Process Of Making A Deed Of Establishment Of A Limited Liability Company

A notary in business, especially in the growth of a Limited Corporation as a legal institution, is considered necessary. Therefore, the corporation can also gain legal protection besides obeying the rules. The presence of an authentic act- a legal product released by a notary- supports the law concept that becomes the source of justice. The procedure is the key to the established law; without proper procedure based on the established law and correct procedure based on established rules and regulations, the whole system will fail; therefore, the procedure has a vital role in maintaining a system. In founding a Limited Corporation, the role of a notary becomes the link of all procedures, especially after establishing the legal institution Administration Sistem in 2000 with the decree of the Minister of Law and Human Rights of the Republic of Indonesia number M01.HT.01.01. The year 2000 about The Enforcement of Legal Institution Administration Sistem in General Directorial of General Law Administration of Law and Human Rights Department Republic of Indonesia. The legal Institution Administration System was established to replace the ineffective manual system in founding limited Corporation Legalization. Many reasons still support manual system use, although it is against the former rule mentioned if the manual system is no longer usable.

IMPLIKASI YURIDIS REMISI BAGI NARAPIDANA KASUS TINDAK PIDANA KORUPSI (STUDI KASUS DI LEMBAGA PEMASYARAKATAN KELAS IIA MATARAM)

This research aims to analyze the regulations for granting remissions to corrupt convicts in the perspective of Law of the Republic of Indonesia Number 22 of 2022 concerning Corrections and to examine how the criteria for granting remissions for prisoners in Corruption Crime cases are regulated according to the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 7 of the Year 2022 Concerning Requirements and Procedures for Implementing the Rights of Prisoners and how to implement Remission for prisoners in Corruption Crime Cases at the Mataram Class II A Correctional Institution. Formulation of the problem; (1) What is the mechanism for granting remission to corrupt convicts according to Law of the Republic of Indonesia Number 22 of 2022 and (2) What are the juridical implications of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 7 of 2022 in fulfilling the right to remission for Corruptor Convicts. This research uses empirical juridical legal research method that focuses on researching applicable laws and regulations and their application in the field. Based on the results of the research conducted, it can be seen that remission is a reduction in the period of serving a sentence given to prisoners and children who meet the requirements specified in the provisions of the regulations per the Law. The conditions for obtaining remission as regulated in Law of the Republic of Indonesia Number 22 of 2022 concerning Corrections are: having good behavior, actively participating in a coaching program, and having demonstrated a reduced level of risk. For Corruption Case Convicts, JC (Justice Collabulator) is no longer required but is still required to pay the fine and/or replacement money in full

Praktik Pencabutan Pembebasan Bersyarat Pada Narapidana Residivis di Rutan Kelas IIB Pangkalan Brandan

The Class IIB State Detention Pangkalan Brandan is Technical Implementation Unit that has duties and functions of Corrections in accordance based Law Number 22 of 2022 concerning of Corrections. Even though did service for prisoner, The Class IIB State Detention Pangkalan Brandan also provides service for inmates, one of which is Parole program consisting of Conditional Exemption (PB). Conditional Exemption (PB) is more likely to be revoked due to the long probation period. When Conditional Exemption (PB) got released, the inmates who violate general conditions and special conditions in accordance with the provisions of the Minister of Law and Human Rights Regulation Number 7 of 2022 can be revoked. This research type of normative legal was carried out to answer the process of revocation of Conditional Exemption and get the accurate results by drawing from several sources. In the case of revocation of Conditional Exemption, it starts sending a request letter by Class IIB State Detention Pangkalan Brandan Officer then examined by the Community Counselor (PK) to be brought to the Correctional Observation Team session so that the results are reported to the Director General via SPION. The decision to revoke Conditional Exemption is conveyed to the prison and state detention officer to be implemented in accordance with the decision. However, the revocation of Conditional Exemption have problems.

GOLDEN VISA GRANTING POLICY AS AN EFFORT TO INVESTMENT ATTRACTION IN INDONESIA

<p><strong><em>ABSTRACT</em></strong><em>; The Government of the Republic of Indonesia issued Regulation of the Minister of Law and Human Rights (Permenkumham) Number 22 of 2023 concerning Visas and Residence Permits as well as Regulation of the Minister of Finance Number 82 of 2023 concerning Types and Tariffs for Types of Non-Tax State Revenue. The Minister of Law and Human Rights Regulation and the Minister of Finance Regulation function as regulations for granting golden visas to investors who wish to invest their capital in Indonesia. The approach method used is empirical juridical with research specifications that are descriptive analytical. The things studied are the policy of granting golden visas to foreign investors in Indonesia and the form of incentives for granting golden visas to foreign investors to invest in Indonesia. In the end, the researchers concluded that the golden visa imposed by the government on foreign investors was a temporary residence permit with a period of 5 (five) years for individual investors and a temporary residence permit with a period of 5 (five) years to 10 (ten) years for corporate investors, then get ease in entering and exiting Indonesia, and ease in not processing a limited residence permit in Indonesia.<strong></strong></em></p>
