COMPARATIVE LAW APPROACH TO THE “INTERNATIONALIZATION” OF LEGAL STUDIES IN BUSINESS

College business courses addressing legal topics, such as business law and legal environment of business, are gradually adding an international perspective. Assuming that the incorporation of internationallegal considerations into a student's graduate or undergraduate experience is desirable/ it is helpful to explore the various methods whereby such internationalization is accomplished. Many colleges and universities are developing and offering a separate international business law course. Others are limiting their efforts to the addition of international issues and cases to the traditional sequencing of topics covered by such courses. If a degree program has sufficient room to accommodate an international business law course, students have the opportunity to explore the subject with considerable depth. But if the program cannot reasonably accommodate a separate course, it becomes necessary to examine the business law and legal environment of business courses to see to what extent international considerations may be incorporated into the traditional course materials. The Standards and Burden of Proof in International Arbitration

The following seven contributions are the edited and revised papers delivered at the Joint Colloquium of the School of International Arbitration at the Centre for Commercial Law Studies, Queen Mary and Westfield College, University of London and the Institute of International Business Law and Practice of the International Chamber of Commerce, which was held in London in 1992. ANY EXPERIENCED lawyer who is faced with putting forward, or defending, a claim on behalf of a client will start by asking that client a series of questions. Sometimes these questions may be so much to the point that the client will be drawn to protest: ‘Whose side are you on? Their side or mine?’ But is essential to know not only the strengths but also the weaknesses of any case, before putting it forward. Once the outline of the case becomes clear, another series of questions emerges. ‘How are we going to prove our case? What evidence is there? Are there any documents which support the factual arguments we want to put forward? Who are the relevant witnesses and what are they likely to say? Do we need expert opinions to back up our submissions on technical matters? And, in the context of an international commercial arbitration, where the arbitral tribunal may well come from different legal disciplines, how are we going to establish the submissions of law on which we rely? There is a burgeoning literature, in monographs and journal articles, on the establishment, jurisprudence and significance of the Iran-United States Claims Tribunal, which has been hearing and determining claims at The Hague since 1982. It has not yet completed its work, but the Reports of its awards already run into many volumes. Westberg is peculiarly well-qualified to offer this commentary and evaluation of some of the more important aspects of that jurisprudence, as he has not only been involved in numerous cases before the Tribunal but also practised international business law in Teheran for some fifteen years up to the Revolution of 1979. He serves as Scientific Counsellor to the Institute for Legal and Political Sciences, a division of the Hungarian Academy of Sciences. He holds a professorship in Comparative and International Business Law at the School of Economics in Budapest. He has served as Deputy Chairman of the National Deregulation Board of Hungary, and as a member of Hungary's Constitution Drafting Committee. He founded the Hungarian League for the Abolition of the Death Penalty. He has served as a consultant to the World Bank, and authored books on social and legal change, international law and legal philosophy. ANDREW ARATO is currently a Professor of Sociology in the Graduate Faculty of the New School for Social Research in New York. The morning star of informatics law and the need for a greater sense of urgency

The author acknowledges that the proliferation of emerging technologies in genetics, computers, and telecommunications is straining relations between countries not only in commerce, defence and culture, but they are also fundamentally straining international law. The author outlines the roles which many international agencies are currently playing in dealing with these problems as presented in the instance of Trans Border Data Flow (TBDF) and notes that even though some progress has been made, it is far too little in light of the rapid changes. The author identifies the numerous difficulties in dealing with these questions on an international scale and urges that energies be concentrated on a core of issues such as privacy protection, freedom of information, crime and infofraud, the legal concept of sovereignty, and international property and business law to ensure that internationally accepted rules can be established to transcend borders and to provide an atmosphere in which Trans Border Data Flow transactions can flourish.
