Digitization and information technologies in the professional activity of a lawyer in modern conditions

The article is devoted to the analysis of the application of new technical tools and complex approaches to the digitization of advocacy activities to meet the needs of clients in legal assistance, which allows to ensure a higher quality level of legal business. Digitization of the legal profession, remoteness in communication with colleagues and clients has caused a demand for improving the skills of lawyers in working with various information platforms among lawyers and representatives of the legal business. A lawyer is considered as a person who uses, consumes and further analyzes legal information for the protection of legal rights and interests of clients, not as an end consumer. Problems in the digital provision of legal aid in modern Ukraine under martial law conditions have been identified, such as: the impossibility of offline meetings with clients; generation of electronic evidence for the recording of crimes or offenses and confirmation of damage caused to legal entities or individuals, paper document circulation. Digitization of advocacy as the main way to overcome the problems of defense activity. The development of information technologies in recent times and modern realities have caused a rather rapid introduction of information technologies and services in the field of advocacy and other legal areas. Therefore, the process of digitization of the legal profession is perceived as a positive phenomenon, because it can ensure the level of effective protection of the rights and legitimate interests of legal entities and individuals living or staying on the territory of Ukraine under martial law. It has been established that the application of scientific and technical achievements requires the presence of certain knowledge, abilities and skills. It is substantiated that the lack of technical support can create an obstacle in the lawyer’s proper execution of client assignments. The need to provide lawyers with their own online security and cyber security of their clients, assistants and interns is emphasized in order to prevent situations of disclosing attorney secrets, harming other lawyers, such as the authority or reputation or the institution of advocacy in general. It is noted that one of the aspects of the problems of advocacy is the dilemma of using or not using licensed software.

Evolving occupational health needs for the adult social care workforce due to changing migration patterns: a cross-sectional study

BackgroundThe proportion of the United Kingdom adult social care (ASC) workforce born abroad has been increasing due to changing migration patterns. This has implications for ASC occupational health needs related to vaccination uptake, communicable disease infection screening and vulnerability to infection exposure at work. To investigate evolving workforce needs, we conducted a cross-sectional study of recent trends in staff entering the ASC workforce from countries with higher incidence of diseases caused by notifiable agents, including tuberculosis and hepatitis B. MethodsWe compared 2017 and 2023 aggregate data from the England ASC Workforce Dataset. This contains information provided by around 50% of the country's Care Quality Commission registered independent sector employers; local authorities (LAs), who employ approximately 7% of the workforce, are mandated to provide this information. The study did not involve collection of primary data and did not meet the UK Medical Research Council definition of research and therefore no ethical approval was required. FindingsWe compared 498 838 records for ASC staff (52 667 from LAs) in 2017 with 415 176 (50 035 from LAs) in 2023 containing nationality information. From 2017 to 2023, the proportion of ASC workers who were nationals of countries with tuberculosis prevalence ≥150/100 000 (2020 World Health Organization estimates) increased from 5·82–8·73% (by 50% [95% CI 48–52%]). In LA-run homes, an increase from 2·07 to 3·43% (66% increase) was seen. Additionally, the proportion who were nationals of a country with hepatitis B surface antigen positivity prevalence ≥5% (2019 Lancet-published Global Burden of Diseases Study estimates) increased from 4·25% to 5·89% (38% increase [95% CI 36–41%]). In LA-run homes, the increase was from 1·23–2·24% (82% increase). InterpretationOur findings indicate how the changing ASC workforce demography may affect occupational health needs and increase vulnerability to diseases, including those preventable by vaccination. Despite incomplete data from non-LA organisations, our sample was large and findings were similar across LA and non-LA analyses. In the interest of staff and clients, consideration must be given to ensure ASC occupational health needs are met. FundingNo funding was received for this study.

Why hospitals hire tobacco lobbyists: conflicts of interest among lobbyists’ clients

Abstract Lobbyists sometimes represent clients with seemingly adversarial policy interests. We seek to explain the occurrence of such ostensible conflicts of interest. In hiring lobbyists, interests encounter a tradeoff between access and agency. Although some lobbyists promise access to lawmakers, they may not lobby as contracted. Interests hire seemingly conflicted lobbyists more often when access is costlier and reputational risks are smaller. We examine the hiring of tobacco lobbyists by health interests, given the possibilities for shirking and reputational damage. We find that institutions such as hospitals hire tobacco lobbyists regularly and more often than membership-based health groups. Intergroup competition for access and lobby laws, especially anti-conflict laws, affect the use of tobacco lobbyists independent of rates of multi-client lobbying. Conflicts are more common today than ever but interests can protect themselves somewhat from opportunistic agents. Our findings also suggest that reforms can improve the representation of client interests.

Revitalizing Sharia Advocates: Reforming the Law on Advocates in Strengthening the Role of Islamic Law in Indonesia

This study aims to evaluate the urgent need to restore the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates (UUA) to position Sharia advocates as the exclusive legal representatives in religious courts. The research uses a normative juridical method, focusing on the examination of legal norms, rules, and relevant literature. Data were collected through a comprehensive review of legal documents, statutes, and academic sources, and analyzed qualitatively to interpret and critique the legal provisions and their implications. The findings reveal that the current lack of specificity in the advocate profession, particularly in religious courts, has led to the involvement of advocates who may lack the necessary background in Sharia law, potentially harming the legal interests of Muslim clients. The conclusion emphasizes that restoring the Law of the Republic of Indonesia Number 18 of 2003 concerning Advocates to recognize only Sharia advocates in religious courts aligns with the nature of these courts and does not violate human rights. This restoration is vital for protecting the legal interests of Muslims and enhancing the professionalism of Sharia advocates in religious courts, including preparing students of the Faculty of Sharia for specialized legal roles. By promoting legal reforms, the study improves the efficiency of religious courts and ensures better access to justice for Muslim communities.

Ethical Decision Dilemma for Tax Consultants in Tax Planning

Tax consultants contribute to assisting taxpayers in overcoming difficulties caused by the complexity of tax rules. Reliable tax consultants tend to provide aggressive advice. Tax consultants as professionals must uphold the code of ethics and applicable tax rules. In this condition, tax consultants are faced with a dilemma in making ethical decisions. This study aims to interpret more deeply how the integrity of tax consultants in facing ethical decision dilemmas in conducting tax planning using a transcendental phenomenological approach. The results of this study show that tax consultants face several dilemmas, including: ethical decision dilemmas due to unclear regulations and client interest factors and responsibility to the state for tax revenue. Experienced tax consultants can overcome the dilemma by continuing to exercise good self-control, and still adhere to the rules and code of professional ethics.

Legal basis of rule-making activity of the advocacy self-government bodies

Corporate lawmaking is a special type of lawmaking by non-governmental organizations. One of the varieties of which is rulemaking by the advocacy self-government bodies. Corporate lawmaking by the advocacy self-government bodies consists in the adoption and approval of regulations governing the internal activities of the advocacy self-government bodies. These regulations are aimed at ensuring the internal organization and functioning of the bar community, ensuring high professional standards, protecting the rights and interests of clients, and maintaining the disciplinary policy among the subjects of the practice of law. Decisions issued by the advocacy self-government bodies on the basis of a special law and their binding effect on the institutional environment of the bar ensure internal regulation of the functioning of the bar by corporate norms. With regard to the decisions of the advocacy self-government bodies, these local regulations establish the rules and standards of professional conduct of advocates, the internal organization and functioning of the bar community based on generally accepted legal principles and norms established by international and national legislation. The corporate acts of the advocacy self-government bodies are: The UNBA Statute; regulations on the advocacy self-government bodies and regulations defining their legal status, rules and procedures for their organization and functioning; codes and recommendations adopted by international and regional associations and societies of attorneys; ethical rules; decisions of the general meetings (conferences); instructions approved by orders of the UNBA and the Bar Council of Ukraine; decisions made on specific issues that regulate the internal activities of the Bar or relate to certain aspects of the practice of law (e.g., the Procedure for the Advocates’ Advanced Training); explanations to the decisions of the Bar Council of Ukraine, which are an integral part of these decisions, as they are adopted as annexes to the latter (e.g., On the Length of Service in the Field of Law for Persons with a Higher Legal Education), etc. Since the Law of Ukraine «On Lawmaking» is primary and systematically regulates the sphere of relations in the field of lawmaking, it is advisable to amend Part 2 of Article 4 of the Law to supplement the list of subjects of lawmaking. In particular, paragraph 11 of Part 2 of Article 4 of the Law of Ukraine «On Lawmaking» should be supplemented with the words «state and non-governmental organizations». Accordingly, «non-governmental organizations» should be included in the list of subjects of lawmaking activities and lawmaking initiatives. Such non-governmental entities with rule-making powers are the advocacy self-government bodies that adopt corporate acts in the form of resolutions. Towards Fairness-Aware Federated Learning.

Recent advances in federated learning (FL) have brought large-scale collaborative machine learning opportunities for massively distributed clients with performance and data privacy guarantees. However, most current works focus on the interest of the central controller in FL and overlook the interests of the FL clients. This may result in unfair treatment of clients, which discourages them from actively participating in the learning process and damages the sustainability of the FL ecosystem. Therefore, the topic of ensuring fairness in FL is attracting a great deal of research interest. In recent years, diverse fairness-aware FL (FAFL) approaches have been proposed in an effort to achieve fairness in FL from different perspectives. However, there is no comprehensive survey that helps readers gain insight into this interdisciplinary field. This article aims to provide such a survey. By examining the fundamental and simplifying assumptions, as well as the notions of fairness adopted by the existing literature in this field, we propose a taxonomy of FAFL approaches covering major steps in FL, including client selection, optimization, contribution evaluation, and incentive distribution. In addition, we discuss the main metrics for experimentally evaluating the performance of FAFL approaches and suggest promising future research directions toward FAFL.

Purpose and principles of state regulation of non-bank financial services markets

The need for stable development and effective use of non-banking financial services market tools, as well as the imperfection of the current legislation in this area characterize the unconditional relevance of the topic of this article. The purpose of the article is to determine the purpose of state regulation of non-bank financial services markets, to define the concept of the principles of state regulation of professional financial activity, and to highlight and analyze the main principles of such regulation. It is noted that one of the main elements of state regulation of non-bank financial services markets is the purpose of such regulation. In view of the analyzed scientific positions and legislative provisions, it is concluded that the main goal of state regulation of non-banking financial services markets is: 1) ensuring transparency, reliability and openness in the markets of non-banking financial services; 2) coordination of activities of state authorities on the functioning of non-bank financial services markets; 3) protection of rights, legitimate interests and satisfaction of socio-economic needs of consumers of non-banking financial services; 4) prevention of abuses and violations in the markets of non-banking financial services. It is proposed to define the principles of state regulation of professional financial activity as the main ideas, basic principles, and general provisions of the implementation by the Regulators of a set of measures to regulate, control and supervise the activities of non-banking organizations and other participants in the markets of non-banking financial services in order to create favorable conditions for their functioning. , preventing and countering abuses and violations in the markets of non-banking financial services and ensuring the protection of the legitimate interests of clients. The main principles of state regulation of professional financial activity are highlighted: the principle of legality; principle of commensurability (proportionality); the principle of guaranteeing the rights and legitimate interests of participants in the financial services market (in particular, the rights of consumers); the principle of assessment by the Regulators of transactions, operations, circumstances and events taking into account their economic and factual content; the principle of mandatory licensing of professional financial activity; the principle of exclusivity of professional financial activity.

If advocates do not act in good faith and their actions are unrelated to their professional duties, they may be prone to committing acts of obstruction of justice. When fulfilling professional obligations, an advocate must prioritize the client's defense and act accordingly. In Article 16, the concept of good faith entails the fulfillment of professional responsibilities intending to promote justice and safeguard the client's interests following the law.

There is a consensus among industry leaders and scholars that the construction sector will lose its competitive advantages if its lethargy to adopt Industry 4.0 technologies continues. As a response, the construction industry has been advocating the more extensive use of the Design for Manufacturing and Assembly (DfMA) in projects. Research studies on this topic mainly reported technological advancement but rarely addressed the factors that lead to the development of positive organizational behavior towards the implementation of DfMA. A systematic literature review will be adopted to achieve the research aims. A total number of 18 behavioral traits were identified through the method, including client's interest, stakeholders support, availability of DfMA related resources, companies' capability, early involvement of all parties in design, development of DfMA-friendly procurement approach, the use of digital technology, government involvement, etc. The findings will shed light on DfMA adoption on behavioral aspects for global DfMA adoption in the construction industry.

Fineline Tattoo Design as a Form of Self Expression at Ingkeu Ink Tattoo Studio

The main objective of this research and art creation is to create and present the work "Designing Fineline Tattoos as a Form of Self-Expression at Ingkeu Ink Tattoo Studio" as a representation of arts and culture education. Fineline tattoo is a style of tattoo that involves creating a design with very thin and smooth lines. These tattoos are often minimalist and subtle, with intricate and detailed designs that require a skilled artist to execute. This creation is research-based, so the method consists of two inseparable parts, namely the research method and the creation method. The technique for implementing MBKM internship/work practice activities at Ingkeu ink tattoo studio is carried out using a project based learning model. In designing this tattoo design, it begins with brainstorming together to collect the concepts and topics that will be discussed. After getting a mature concept, students can continue to the stages of the work process. In this research the author will describe the Fineline Tattoo design process as a form of self-expression at Ingkeu ink tattoo studio along with an analysis of the design results. The data in this research was obtained directly from Ingkeu ink tattoo studio as a partner who has a project to be featured in the internship report using several methods. The results of the tattoos done by the author are also uploaded by partners on social media and TikTok, in this way the partners believe they are very effective in attracting client interest.

Whom to ask? Whom to trust? Parents’ preferences for sources of advice on social-emotional parenting issues

ABSTRACT Accumulating evidence shows how parents can support children’s social-emotional development with positive parenting practices. However, when confronted with parenting challenges, few parents seek evidence-based counseling. This study identifies main sources of advice for parents and examines the reasons why parents decide which sources to trust and use. Therefore, we interviewed parents of preschoolers on parenting challenges, sources of advice, general trust in these sources, and dimensions of trustworthiness. Parents’ trust was highly correlated with their intention to seek advice from someone. Furthermore, parents were most likely to seek advice within their close personal environment. Regarding the dimensions of trustworthiness, namely ability, benevolence, and integrity, we found that benevolence best predicted parents’ trust. Concerning ability, participants’ judgements were based on personal experience for some advice sources (e.g. friends, family) and on theoretical knowledge for others. Overall, this study emphasizes the important role of interpersonal trust and the dimensions of trustworthiness in advice-seeking settings. Parents already attribute evidence-based ability to professional counseling services. Consequently, we discuss how to improve evidence-based counseling by enhancing its perceived benevolence and integrity, for example, through promoting transparent and ethical practices, showing a commitment to the best interests of clients, and building strong relationships with clients.
