Procedure of the Saratov State Law Academy, Legal Practitioner In this article, despite the impossibility of embracing the immensity, several institutions of civil procedural law are identified, which have their own characteristic questionable features of unresolved (we will clarify as we increase): third parties without claims regarding the subject matter of the dispute, special proceedings, arbitration proceedings. The importance of the role of third parties in justice has been given over a different number of times, the practical orientation of resolving indisputable cases puzzles persons in their procedural position of the arbitration court — the applicant and interested persons, or interested entities together with the applicant with the involvement of third parties without claims in the case.

Metabolic profiling identified phosphatidylcholin as potential biomarker in boosting lipid accumulation in multiple microalgae

The scenario of this work was to excavate co-owned metabolic biomarkers responsible for lipid accumulation by freshwater Chlorella protothecoides (CP), polar Coccomyxa subllipsoidea (CS), and marine Nannochloropsis oculata (NO). The dose-time effects between lipid content and urea concentration showed that CP, CS, and NO reached optimal lipid content of 57%, 63.84%, and 59.95% with 0.5, 1.0, and 0 g/L urea induction for 24 h, 12 h, and 24 h. Metabolomics revealed that 16 compounds including phosphatidylcholin (PC) were excavated as co-owned metabolites in optimal lipidic CP, CS, and NO. In light of contributions in influencing cluster formation of S score plot that 8 of 16 compounds were identified as potential metabolic biomarkers served for lipid accumulation in microalgae. Preliminary verifications demonstrated that PC experienced neomycin biosynthesis inhibition allowed 138.74%, 145.24%, 100%, and 168% increments in lipid contents of CP, CS, NO, and newly-employed Chlamydomonas reinhardtii (CR). Another indisputable case was that lipid productivities were 2.09-, 2.20-, 1.71-, and 2.6-fold more than that of controls and C16-C18 fatty acid proportions (>76%) in CP, CS, NO, and CR were also recommendable for biodiesel-making. These co-owned metabolic biomarkers might be universally-available targets in boosting lipid accumulation and would offer valuable clues in delving into regulatory mechanisms of lipid biosynthesis in microalgae.

Abstract Nowadays the growth of courts’ caseload is usual for most jurisdictions. However, post-socialist countries have extremely high rates of caseload. Authors prove that main reason of such caseload is more ineffectiveness of legal system and court organization as well as unjustified access to justice. This article focuses on the indisputable and small cases in Russian courts. The court system is overloaded as a result of necessity to engage in non-targeted activities. Thus, the judicial system is largely idle to the detriment of its primary purpose.

Entrepreneurial management education needs in the Republic of Croatia, Poland and the United Kingdom

Purpose – The purpose of this paper is to take the emergence of the knowledge mobilization as an opportunity to develop an understanding of needs for catching up appropriate knowledge application in SMEs in the Republic of Croatia, Poland and the UK. It draws upon the “frame mobilization” literature, which illuminates the role that acts as interpretation play in instigating, promoting and legitimating collective action with aim to provide “quality entrepreneurial education”. Design/methodology/approach – A questionnaire survey based on a literature review built by Stimulating Learning for Ideas to Market (SLIM) project partner was employed to test the given perspective. A total of 380 businesses completed the survey from 12 to 20, November 2013. Participants have different profiles, act in diverse roles and industrial sectors. Identification of appropriate types of support, education, training and advice was made to recognize what small businesses need and can use to improve their operations. Findings – Empirical research evidence conducted among entrepreneurs, 213 were from Croatia, 100 were from Poland and 67 were from the UK, respectively. Results identified the nature of management education according SMEs’ needs to increase innovative activities and intellectual property adapting a more business-like approach, scanning the horizon and identifying new markets and opportunities for growth. It discussed the impacts of formal and informal ways of intellectual property protection in sales and exports market (SLIM) project partner was employed to test the given perspective. Research limitations/implications – Main limitation lay in unequal sample response among countries. However, results proofed very similar response in all questions among three countries even size, entrepreneurial development, GDP or historical background are highly different. Practical implications – Therefore, the original contribution of the paper lies in the authors’ empirical investigations into the current thinking and practice of existing entrepreneurs by suggesting some implications of this point, which should be of interest to all stakeholders who design courses in IP and who engage in social mobilization. Social implications – There are important organizational culture barriers with this target group, such as the emphasis on the need to publish and an unstable/unavailable IP budget. The integration of IP tools into curricula is an important step to improving the use of IP tools by future researchers. There is an indisputable case for integrating IP as an R & D output and increasing the valuation of IP for academic promotion. Originality/value – This paper illustrates the current challenges on SMEs’ educational needs and intellectual property rights carried out in among 380 entrepreneurs across the Republic of Croatia, the Republic of Poland and the UK. Most intriguing suggestion, perhaps, is that the role knowledge cooperation with universities may play as a breaking point to fully exploit SMEs’ innovative potential. Surprisingly, needs for establishing a classification of diverse IP-management and collaboration-management tools useful in university-enterprise collaborations, within a general context of IP and open innovation has not been recognized.

All Forms of Writing

AbstractAnthropological contributions are essential to understanding the evolution of writing and its potential variation. Although Stanislas Dehaene calls for a ‘neuro‐anthropological perspective’, he neglects anthropological evidence, including the only indisputable case of independent invention of writing: the pre‐Columbian systems of the Americas. Here I argue that anthropological and historical accounts of the cultural evolution of language suggest that ecological, technological, social and political factors have all influenced the ongoing development of writing systems, even in directions contrary to that predicted by a model of increased neural efficiency. In addition, Pre‐Columbian writing systems, not subject to a diffusionist confound because of their independent invention, caution that our research on diversity in writing may represent a small, systematically biased sample. To truly understand neuro‐cognitive variation, we have to avoid both overly ambitious universalisms and radical cultural relativism.

Freedom of choice and bounded rationality: a brief appraisal of behavioral economists' plea for light paternalism

Behavioral economics has addressed interesting positive and normative questions underlying the standard rational choice theory. More recently, it suggests that, in a real world of boundedly rational agents, economists could help people to improve the quality of their choices without any harm to autonomy and freedom of choice. This paper aims to scrutinize available arguments for and against current proposals of light paternalistic interventions mainly in the domain of intertemporal choice. It argues that incorporating the notion of bounded rationality in economic analysis and empirical findings of cognitive biases and self-control problems cannot make an indisputable case for paternalism.

Whereas atheromatous lesions are not unknown in Africans, peripheral atheroselerotic occlusive arteriopathy is assumed to be scarce and even almost non existent in some medical minds. From a study spanning 15 years indisputable cases are presented to show that far from being rare the lesion is not uncommon and may have been mistaken and treated for several other pain related pathologies sometimes and, ironically to the delight of the sufferers. The quest for the function of simple epithelial keratins.

Simple epithelial keratins K8 and K18 are components of the intracellular cytoskeleton in the cells of the single-layered sheet tissues inside the body. As members of the intermediate filament family of proteins, their function has been a matter for debate since they were first discovered. Whilst there is an indisputable case for a structural cell-reinforcing function for keratins in the mutilayered squamous epithelia of external barrier tissues, some very different stress-protective features now seem to be emerging for the simple epithelial keratins. Even the emerging evidence of pathological mutations in K8/K18 looks very different from mutations in stratified epithelial keratins. K8/K18-like keratins were probably the first to evolve and, whilst stratified epithelial (keratinocyte) keratins have diversified into a large group of keratins highly specialised for providing mechanical stability, the simple epithelial keratins have retained early features that may protect the internal epithelia from a broader range of stresses, including osmotic stress and chemical toxicity.

The histologic value of adnexal (eccrine gland and follicle) infiltration in mycosis fungoides.

To verify the incidence and the possible diagnostic use of detecting adnexotropism in mycosis fungoides (MF). We reviewed the frequency and the intensity of the eccrine and follicular infiltration in 104 biopsy specimens from indisputable cases of MF and in a control group of 20 biopsy specimens of spongiotic dermatitis. Syringohyperplasia and follicular mucinosis were also evaluated. A prominent eccrine infiltration was noted in 32 of 104 specimens (30%). Marked acrosyringial and ductal eccrine hyperplasia was present in 5 specimens (5%). In 13 of the 32 specimens with prominent eccrine infiltration (40%), epidermotropism was slight or less evident than syringotropism. Follicular structures were visible in 59 specimens and significantly infiltrated in 57%. Follicular mucinosis was found in 5 (8.4%). In the control group of spongiotic dermatitis, a significant eccrine and follicular infiltration was found only in case (5%). Adnexal (eccrine gland and follicle) infiltration may be a useful diagnostic tool in MF, particularly in those in which epidermotropism is slight.

The Quantification of Beneficial Interests: Problems arising from Contributions to Deposits, Mortgage Advances and Mortgage Instalments

The jurisdiction over resulting and constructive trusts is much studied, but there is no specific investigation of the correct method of quantifying interests arising from contributions by way of mortgage advance and contributions to mortgage repayments.' This is surprising in view of the frequency with which properties are bought with the aid of a mortgage. The attempt to fill this gap is undertaken with some trepidation. The equitable jurisdiction is discretionary in character, and the Court of Appeal has said that it is too early to formulate the principles on which it is based.2 There are high judicial statements that the assessment of beneficial interests is not a matter for arithmetical calculation, at least in cases in which the property is bought with the aid of a mortgage rather than being bought outright.3 It is not the purpose of this article to advance a strictly arithmetical method of calculating beneficial interests. A beneficial interest may arise, or be enhanced, as a result of non-monetary contributions. Contributions may be indirect, as where family finances are pooled, so that identification of the financial contribution may be the disputed question. In yet other cases a mathematical calculation may give an inequitable result, thus justifying the retention of an overriding discretion. Cases involving indirect contributions, the acquisition of beneficial shares through improvements, and other discretionary features will not be discussed. It will be assumed that contributions to the acquisition of a property take the form of cash inputs at the time of acquisition, loans raised on the security of a mortgage at.the time of acquisition of the property or contributions to mortgage repayments. The figures to be taken should then be clear. The object is to assess the correct method of equitable accounting in such indisputable cases. The distinction between central neurofibromatosis and tuberose sclerosis.

Central neurofibromatosis and tuberose sclerosis are genetically distinct diseases but both produce hamartomas of the supporting cells of the central nervous system and malformation of other tissues. A case of central neurofibromatosis previously reported as tuberose sclerosis is presented and the distinguishing features of the two diseases reviewed. Earlier reports of their co-existence are re-examined and only one indisputable case found. Double diagnosis has frequently been made on the basis of non-specific changes common to both diseases, e. g. glial proliferation, fibrous dermal tumours; the misdiagnosis of dermal neurofibroma or adenoma sebaceum in the absence of histological proof or the misinterpretation of X-ray appearances of bone.

In Reply: Epidermolysis Bullosa Letalis

Doctor Mautner is correct in claiming to have described the first indisputable case of epidermolysis bullosa letalis under the name of pemphigus hereditarius (Monatschr. f. Kinderheil., 22:15, 1922). We certainly did not intend to deprive him of the credit for this achievement. In our article, however, we did not claim that epidermolysis bullosa letalis was first described by Herlitz. We merely credited Herlitz with first defining this condition as an entity, since he recognized it as one of the variants of epidermolysis bullosa and coined the term epidermolysis bullosa hereditria letalis.

An investigation of Huntington's chorea in Victoria.

In making an investigation of Huntington's Chorea in the State of Victoria, we have, so far, been able to collect 150 indisputable cases of this disease, and others. This figure includes 83 deceased, and 57 living. Out of a total of 74, who were certified to mental hospitals, 26 are still either in hospital or on trial leave. This represents ·34 per cent. of the total present mental hospital population. As regards sex distribution, our figures indicate that there were 68 females as compared with 72 males.

On the Direction of Rotation in Spiral Nebulae.

The question as to t~he true direction of tilt of spiral nebulae which are inclined toward the line of sight is the subject of a new discussion here. A photometric study of the distribution of intensity and color in indisputable cases, like NGC 4565, compared with typical cases, like NGC 7331, 4216, 4258, leads to a conclusion regarding the true tilt of the last-mentioned objects which is identical with the one derived by one of us in earlier papers. The importance of the "secondary" absorption on the distant half of the nebula is emphasized on the basis of new evidence. The results indicate that the dissolution of a system into spiral structure proceeds in such a way that the arms open up in the direction of rotation. The projection effects of the distribution of novae, variables, and globular clusters in M 31 are discussed. A comparison between the distributions supports strongly the contention that the brighter side of the nebula is the nearer one. Kinematical considerations, supporting the opinion that the spiral arms open up in the direction of rota- tion, are discussed for M 81 and M 33. The case of NGC 2681, which shows an outer diffuse spiral struc- ture of a direction of winding opposite to that of the interior main spiral structure, illustrates conclusions drawn from dynamical theory. It is also of importance for the interpretation of NGC 3190, though this nebula is, no doubt, to be considered as a singular object on account of disturbing effects from its neigh- bor, NGC 3187. I. The Perfect Stage of Botrytis Convoluta

The possibility of a genetic connection between Botrytis and Sclerotinia was advanced by de Bary (1866). Later, in the revised edition of his book (1884), he again refers to this, stating with assurance that Botrytis cinerea Pers. is the conidial stage of Sclerotinia Fuckeliana (de B.) Fuckel. This statement has been accepted by some mycologists and vigorously rejected by others on the grounds of insufficient evidence. In the early years of this controversy, Ludwig (1892) described Sclerotinia Galanthi, indicating that the apothecia were associated with a Botrytis form on diseased snowdrops, and he assumed a genetic connection. No opinion can be given in this paper on the validity of these early records for they have not been critically examined. It should be pointed out, however, that in this early work the evidence in support of a Botrytis-Sclerotinia connection was based on the association of the two forms on the same substrate, the close resemblance of the disease symptoms, and the similarity of the mycelia and organs of attachment. In the light of our present knowledge, no indisputable case for a genetic connection could be made from observations of this kind.

Two New Cases of Human Creeping Disease (Gnathostomiasis) in China, with a Note on the Infection in Reservoir Hosts in the China Area

From the medical and zoological points of view it is of especial interest that the nematodes of the genus Gnathostoma, which are naturally found in various animals, occur occasionally in man, causing disease. Five indisputable cases of Gnathostoma in man have hitherto been reported and all are from eastern Asia. The first case was reported from Siam by Levinsen (1887) who studied a specimen collected by Dr. Deuntzer from the abscess of a native woman and described it as Cheiracanthus siamensis n. sp. This was an immature female of Gnathostoma. The second case was that of Dr. Kerr in Siam who removed a parasite from the cutaneous node of a native. The parasite was studied by Leiper (1909) who stated that it was an immature male, identical with that of Levinsen, and must be referred to the genus Gnathostoma with the specific name G. siamense (Levinsen). Later, Leiper (1911, 1913.) discovered that G. siamense was synonymous with G. spinigerum Owen (1836), a view which is now generally accepted. The above-mentioned cases, therefore, are concerned with G. spinigerumn. The parasite of the third case was obtained by Samy (1918) in the Malay States from a thenar abscess of a Chinese coolie and also referred to G. spinigerum. The fourth case was reported by Tamura (1919) in Japan. He treated a typical creeping disease' of a Japanese woman just returning from a long sojourn in China, and removed a parasite which he referred to G. siamense (-=G. spinigerum). The fifth case, was indigenous to Japan and has recently been reported by one of us (Morishita, 1923, 1924). The patient was a male Japanese, 43 years old, who had lived long in Tokyo. In 1923 he had creeping disease in the left thenar and was operated on by Kinoshita, who excised a part of the cutaneous tissue containing a parasite which was brought to Morishita for identification. The worm, though unfortunately partly damaged, was undoubtedly a young form of Gnathostoma hispidum Fedchenko. This species is a parasite generally found in the
