CURRENT CHALLENGES AND PROSPECTS OF LEGAL REGULATION OF PUBLIC ADMINISTRATION OF THE SOCIAL SPHERE IN THE TERRITORIAL COMMUNITIES OF UKRAINE

The article defines that public administration is a system of activities of state authorities aimed at optimizing the use of resources to achieve the priority goals of social policy. It is emphasized that the social sphere covers a wide range of services that ensure the well-being of citizens, including health care, education, social protection and other critically important elements. The study of the problems of public management of the social sphere in territorial communities reveals a number of challenges, such as insufficient financial support, the absence of a clear legal framework, and a low level of public involvement in decision-making processes. Analysis of modern approaches to legal regulation in this area showed that effective management of social policy requires the integration of innovative methods, in particular digitalization of processes, which will contribute to the transparency and accountability of local self-government bodies. As a result of the research, it was found that the public management of the social sphere in the territorial communities of Ukraine is a complex, multifaceted process that requires a comprehensive analysis and a comprehensive approach to its improvement. The development of recommendations for improving management mechanisms should become a priority for researchers and practitioners in this important field. Effective management of the social sphere requires systematic control over the implementation of state policy. This involves not only an internal audit of the activities of local self-government bodies, but also mechanisms of public control that would allow residents to actively participate in the processes of evaluating the effectiveness of social programs. The study showed that the key factors in the effectiveness of public management of the social sphere in territorial communities are: adaptability of management mechanisms; integration of modern technologies; formation of partnership relations; personnel training and development; community involvement in decision-making processes, etc. Legal regulation of public management of the social sphere in territorial communities of Ukraine is conditioned by the need to create effective management mechanisms that meet modern challenges. Among the prospects for the development of legal regulation of public management of the social sphere in the territorial communities of Ukraine, the need for: improvement of the legal framework was emphasized; strengthening of financial autonomy; development of professional training; integration of modern technologies; community involvement in decision-making processes; focus on inclusiveness; monitoring and evaluation of efficiency; cooperation with international organizations; adaptation to changes in the socio-economic environment; increasing the level of trust in the authorities, etc. It is emphasized that the successful implementation of public policy in the social sphere depends on the effective interaction of all interested parties, which in turn will ensure sustainable development and increase the quality of life of the population.

This study draws conclusions from the analysis of the activities of governmental bodies and the public administration system in ensuring the resilience of the country. Resilience is understood as the state and capacity of society to counteract both external and internal threats without significant losses to the vitality and integrity of the nation. The viability of a country depends on a variety of conditions and factors that affect its existence and position at a particular time. The study reveals the management subjects and the mechanisms for implementing state policy. Systemic errors in the implementation of state policies aimed at ensuring national resilience are identified. Furthermore, ways for improving the public administration system as a mechanism that fosters the achievement of this goal are proposed. The main task of public policy for ensuring national resilience is the development of society and the overcoming of uncertainty and chaos in the relationships among individuals, society, and the state under the influence of both internal and external threats. “Freedom” as a systemic category characterizes the quantity and quality of connections among the elements of the system. It can be stated that the greater the freedom afforded to social systems – characterized by fewer moral, ethical, spiritual, legal, and other ties – the lower the level of security within such a society. In addressing the challenge of ensuring the resilience of the country, enhancing the effectiveness of the public administration system demands firm political decisions and operational management.

Legal regulation of the international activities of the Ministry of Youth and Sports of Ukraine

The article is devoted to highlighting the features of the normative and legal regulation of the international activities of the Ministry of Youth and Sports of Ukraine. The content of the concepts of «legal regulation» and «normative and legal regulation» is clarified, taking into account existing scientific approaches to their understanding. It is determined that normative and legal regulation is a part of legal regulation and focuses on influence through normative legal acts, whereas legal regulation includes a broader spectrum of tools and mechanisms of legal influence. It is concluded that normative and legal regulation is carried out exclusively through legal norms, the external expression of which is the sources of normative and legal regulation. The author analyzes the normative and legal framework that regulates international cooperation in the field of youth and sports, including the laws of Ukraine, decrees of the President of Ukraine, resolutions of the Cabinet of Ministers, as well as international agreements ratified by Ukraine. Special attention is paid to the mechanisms of implementation of international standards into national legislation, as well as the role of the Ministry of Youth and Sports in the formation and implementation of state policy in the relevant field. The main problems and challenges faced by the Ministry in the context of ensuring effective legal regulation of international activities are identified, and recommendations are provided for improving the normative and legal framework. Improvement of the legal framework and active participation in international projects will help Ukraine to achieve high standards in these fields. As a result of the study, the author concludes that cooperation between the Ministry of Youth and Sports of Ukraine and other state and non-state institutions involved in international activities is a prerequisite for the successful development of youth policy and sports in Ukraine. Improving the legal and regulatory framework for the international activities of the Ministry of Youth and Sports of Ukraine is a prerequisite for increasing the efficiency of its work, improving international cooperation and integrating Ukraine into the global sports movement.

Sports Development Management in the Republic of Armenia: The Structure and Statistics

Sports is one of the many branches of the national economic complex and represents a complex and unique socio-economic system, the activity of which is characterized by multifaceted social and state relations. It should be considered that the management structure of any socio-economic sector of the state is largely determined first by the state policy, the very structure of the state. It should be organically integrated into the sports movement management system. The state body responsible for the development of sports in Republic of Armenia (RA) is the Ministry of Education, Science, Culture and Sports (MESCS), which is entrusted with the functions of implementing state policy and legal regulation, as well as providing support to sports organizations and sports federations. The main goal of its activity is the formation of a positive attitude of society, the state and the entire nation towards sports as an effective means of maintaining and strengthening human health, an integral part of universal culture, and as a factor, especially in the physical and moral education of children and young people. The Ministry carries out the functions of state policy and legal regulation in physical culture, sports and youth issues and the processes of developing and implementing them. Along with that, public sports organizations in the form of NAOC of Armenia and national sports federations and units play an important role in the development of sports in the republic. Funding for mass sports and high-performance sports is increasing year by year in Armenia, which is aimed at increasing the number of events, as well as increasing the number of incentives for the achievements of people who do sports and high-level athletes.

New directions of state policy implementation in conditions of decentralisation, focused on promoting key tourist identifiers of the locality are presented, such as types of tourism, image, brand, reputation, souvenir branding and intangible cultural heritage.

MAIN DIRECTIONS OF STATE POLICY OF UKRAINE CONCERNING THE SOLUTION OF PROBLEMS IN THE FIELD OF MEDICAL, PHYSICAL AND PSYCHOLOGICAL REHABILITATION OF PARTICIPANTS IN COMBAT ACTIONS

he article summarizes information on the main directions of the state policy of Ukraine in solving problems in the field of medical, physical and psychological rehabilitation of combatants. The study of the main directions of the state policy of Ukraine in solving problems in the field of medical, physical and psychological rehabilitation of combatants has a systemic nature. Therefore, research methods are also multidisciplinary, because the research concerns administrative law, public administration, and the field of health care. The functional-competence approach was specially applied, according to which the competence of the central bodies of the executive power of Ukraine was analyzed in terms of the development and implementation of state policy. The effectiveness of state policy in the field of state financial guarantees of medical care for the population under the medical guarantee program has been analyzed. Provision of sanatorium-resort treatment and medical benefits are considered. Problems have been identified when the transition of military personnel to civilian life will become a serious challenge for the country. The problem will arise in the context of ensuring a unified approach to the provision of benefits. The issue of rehabilitation financing was considered, in particular, it was noted that all the listed services are provided either exclusively at the expense of local budgets, or under a mixed system, when local authorities receive a partial subvention from the state budget. The problem of transfer of benefits administration functions to local self-government bodies and the introduction of an automated system for servicing the needs of veterans was declared.

Currently, in conditions of intensive development of infrastructure, the main component of which is transport, one of the main tasks of the state remains to ensure road safety. Decree of the Government of the Russian Federation No. 1-r dated 08.01.2018 approved the Road Safety Strategy in the Russian Federation for 2018-2024, which defines the foundations for the formation and implementation of state policy in the field of road safety at various levels (federal, regional, municipal, intersectoral). Improving road safety and striving to achieve zero deaths in road accidents in 2030 is its goal. For 2024, the social risk indicator has been set as a target – no more than 4 deaths per 100,000 people. The article analyzes some features of the inspection of the scene of an accident in criminal cases of violation of traffic rules and operation.

Issues of the effectiveness of the implementation of industrial policy and measures of state support for industrial enterprises have reached the level of state strategic decisions in connection with the emergence of new external and internal challenges facing Russia today. The main problem that urgently needs to be solved is the development of mechanisms for implementing state policy in terms of the application of state support measures in the context of ongoing sanctions and political pressure. The authors of the article presented an evolutionary cross-section of the content of industrial policy, provided criteria for classifying its instruments and forms of implementation through a description of government support measures. Consideration of industrial policy from the historical and functional side at the macro- and meso- levels (specific territory and specific industry) contributed to the systematization of government support measures for industrial enterprises. The relevance of the research interest is related to the fact that with a significant number of publications in Russia and abroad concerning the issues of improving industrial policy and measures of state impact on industrial facilities, the problem of appropriate effective methodological and practical support for the management of state support measures remains unsolved. The article presents a systematization of state support measures for industrial enterprises, a critical analysis of the methodology for selecting enterprises receiving state support, an assessment of the results of the implementation of the applied system of support measures, as well as the reasons for the gap between the stated goals of industrial policy and its actual results. In this scientific article, the authors propose to improve the approach to assessing enterprises that are recipients of government support in order to ensure that their choices comply with the goals of industrial policy.

Функціонування в Україні пенітенціарних таборів для військовополонених російської федерації

The article states that with the beginning of the full-scale invasion of the Russian Federation to Ukraine more than two and a half years have passed. During this time, law enforcement agencies initiated 127,814 criminal proceedings under various articles of the Criminal Code of Ukraine. It should be noted that many of them have already been examined by domestic courts and those guilty of criminal offenses have been held criminally liable. It has been proven that all of them are serving their sentences in a camp that functions as a correctional colony for prisoners of war sentenced to imprisonment for a certain period or to life imprisonment. Since the problem of the functioning of prison camps for prisoners of war in Ukraine has not been the subject of research yet, the article states that their creation in Ukraine is an unprecedented practice during the years of Ukraine's independence, which is connected with the events of the invasion of the Russian Federation to the territory of our country as a "special operation" on February 24, 2022. It is noteworthy that theMinistry of Justice of Ukraine ensures the functioning of prison camps for prisoners of war in Ukraine as the subject of the implementation of state policy in the field of punishment and probation. It has been proven that currently four camps for prisoners of war of the Russian Federation have been created in Ukraine. All of them comply not only with international humanitarian law, but also with Ukrainian legislation. Unfortunately, Article 13 of the Convention is simply ignored by Russian Federation, thereby demonstrating disrespect for the norms of international humanitarian law. Moreover, our soldiers are held captive not in separate camps for prisoners of war, but in ordinary penal colonies, subjecting them to physical mutilation, acts of violence and intimidation, although this Convention categorically prohibits the use of reprisals against prisoners of war. The author's definition of the Ukrainian camp for prisoners of war of the Armed Forces of the Russian Federation was formulated. These are specially equipped places on the basis of correctional colonies of the State Criminal Enforcement Service of Ukraine for the forced detention of captured enemy servicemen with the aimof their final release and repatriation. A comparative analysis of the maintenance of prisoners of war in Ukraine and Russia was carried out. It is noted that if the personnel of the camp for prisoners of war establish that persons who took part in hostilities and were captured do not belong to prisoners of war, then such persons enjoy the protection of the Convention until their status is determined by a competent tribunal. Such persons, however, use benefits and protection. They include medical and spiritual personnel who provide assistance to prisoners of war. They are also provided with all opportunities to provide medical and spiritual assistance to prisoners of war. During the performance of their medical and spiritual duties, they also use certain privileges, in particular, they are allowed to periodically visit prisoners of war who are part of work teams or in hospitals outside the camp. It is worth paying attention to the fact that after the exchange of our soldiers and their return to the Motherland, it becomes clear how many of our prisoners of war in the Russian Federation different from the Russian occupiers in the POW camp in Ukraine. If the physical and moral condition of our soldiers is suppressed, they are tired and exhausted.

Legal regulation of rehabilitation in the field of health care

The article notes that the law guarantees everyone the right to health care and medical assistance. A full-scale invasion calls for the development and updating of legal acts on ensuring a person’s right to medical assistance, in particular, to the provision of rehabilitation services. It is noted that rehabilitation assistance is aimed at a number of main areas, firstly, at supporting the functions of the patient’s body during the exacerbation of chronic diseases. Secondly, for warning, early diagnosis of disorders of the organs and systems of the patient’s body. The third direction is aimed at full or partial restoration of damaged organs or systems and compensation of lost functions of affected organs or systems. The fourth direction is related to the prevention and reduction of the degree of disability. The author emphasizes that the lack of competent and effective medical rehabilitation in Ukraine is a multifactorial problem: there is an insufficient number of inpatient and outpatient rehabilitation departments; lack of medical personnel - rehabilitation specialists, psychologists; there is not enough rehabilitation equipment; there is a need for adequate educational programs for physicians. In the article, the author emphasizes that one of the tasks of the state is to help persons with disabilities realize their constitutional rights; implementation of state policy in the field of rehabilitation of persons with disabilities, support for their integration into society, and the full-scale war on the territory of Ukraine causes an increasing urgency and need for the rehabilitation of persons injured as a result of hostilities. Such factors of the population’s health, such as the increase in morbidity, injuries, temporary loss of working capacity, premature mortality of the population require the development of the rehabilitation medicine market of Ukraine and its legal regulation. The article notes that the positive aspects are the development of new medical rehabilitation technologies, including those based on telemedicine and IT technologies, the preparation of new professional standards for medical rehabilitation at the modern level in accordance with international recommendations. All this requires the effective functioning of the system, which first of all requires the improvement and development of regulatory and legal support in the field of rehabilitation.

Aabstract. The article deals with the problem of creating barrier-free access to the benefits of civilization for a population group with disabilities. The prospects of urbanization of the population, the reasons contributing to this, and the increase in the number of persons with disabilities as a result of military actions are considered. Emphasis is placed on the fact that the problem under consideration will primarily affect large cities as sources of communication services. Examples of implementing the state’s policy on ensuring the rights of the population to receive services of various kinds by improving the existing and new infrastructure are given. Scientific novelty. Emphasis is placed on population prospects, which will lead to active urbanization of the population and, accordingly, an increase in problems related to ensuring the rights of people with disabilities. The dynamics of this process are given. Attention is drawn to actualizing the specified problem concerning the war in the country’s east. Practical value. Concrete examples of the implementation of state policy regarding persons with disabilities are shown in the example of Dnipro City.

The development and strengthening of private mediation significantly determine the possibilities of overcoming the challenges in the process of the institutionalization of mediation. Establishes an effective system of dispute resolution at the state level. The legal or practical regulation of the abovementioned should be considered a prerequisite for implementing the interests of the subjects of law and forming legal awareness. In addition, the perfect functioning of the justice system, which should ensure the implementation of the legal interests of the subjects of law, is an expression of public and private interests. The well-being and satisfaction of the civil turnover participants are significantly determined by the existence of flexible dispute resolution systems and mechanisms, the correct implementation of which creates guarantees for the stability of civil turnover. In addition, it’s in the public interest that the chain of the means of dispute resolution should be flexible and diverse and allow the interested parties to choose an acceptable method in each case. Regardless of its importance, providing fast and affordable forms of dispute resolution remains a challenge. In addition, it’s important to strengthen cooperation between the public and private sectors in this process, which will be considered an innovation in Georgia. Accordingly, following legislative changes, it is important to raise public awareness, improve legal culture, and strengthen the court’s role in implementing state policy regarding dispute resolution.

The research paper aims to substantiate the theoretical foundations of corporate social responsibility, determine its place and role in modern economic science, and analyze the features of corporate social responsibility in agribusiness. In the article, we used the abstract-logical method to identify the theoretical foundations of the development of corporate social responsibility in agribusiness. Additionally, we researched the evolution of management practice and various approaches to interpreting the concept of “corporate social responsibility” using a monographic approach. We also used the method of analysis and synthesis to identify the key characteristics of corporate social responsibility and to distinguish the levels of corporate social responsibility in agribusiness. The article explores the development of “corporate social responsibility”. It defines a system of critical concepts, introductory provisions, and approaches that form the framework of corporate social responsibility. The concept of “corporate social responsibility” is theoretically interpreted and is commonly viewed as one of the elements of sustainable development. The article also discusses the specificities of using different approaches to interpret the concept of “corporate social responsibility” in management practice — elements of scientific novelty. A thorough analysis of the main characteristic features of corporate social responsibility was carried out, and the levels of corporate social responsibility in agribusiness were determined. The essential elements of internal and external corporate social responsibility in agrarian business were identified. Research has established that the most acceptable approach is that corporate social responsibility in agribusiness is considered the responsibility of an enterprise in the agrarian sector to its employees and other stakeholders (society, consumers, state authorities, public organizations, etc.), with which the organization interacts in the process own activity. The author has developed a mechanism for implementing the concept of corporate social responsibility in agribusiness. Practical relevance. Implementation of a mechanism for the implementation of social responsibility in agribusiness developed by the author in the activities of enterprises of the agrarian sector of the economy of Ukraine (based on the systematization of internal and external CSR with a division into reactive and strategic), which will contribute to the mitigation of already existing problems and negative consequences of the company’s activities and the successful implementation of the strategy CSR regarding the formation of a positive image of agrarian formations. Characteristics and social significance of the civil service

The article is devoted to the problems of the categorical apparatus of the civil service in Ukraine. The civil service in our country is recognized as one of the most important institutions in the formation and development of Ukrainian statehood. It is from this institute that the quality of functioning of the social and political system as a whole and the solution of multifaceted tasks and functions of the modern state depend. Civil service has the greatest influence on the development of constitutional and legal formations and is the basis of state construction. It is argued that the civil service is a complex and multifunctional, legal and political institution, the essence of which is the performance by officials who are endowed with high professionalism, act in a complex relationship and in close interaction both among themselves and with other systemic entities, political forces, by public organizations and citizens, tasks and functions of the state within the legal field and in accordance with the authority granted to them to create social benefits, further development of social well-being and stability in the state. The most important features of the civil service are highlighted: the content of the civil service is an activity aimed at the practical implementation of tasks and functions of the state (analysis, development and implementation of state policy, ensuring the provision of affordable and high-quality administrative services, etc.); the public nature of this activity; professionalism; politically impartial character. It has been established that the priority of human rights and interests over the interests of the state should be the main feature of modern civil service. The goal of the civil service is disclosed, which consists in streamlining and increasing the efficiency of the processes of formation and implementation of state power and state administration, provided that responsibility for the performance of the powers of the position and social and economic guarantees of the civil service are combined. The main goals and tasks of the civil service have been defined in terms of ensuring the fair, effective and stable activity of state authorities in accordance with their powers and competence, aimed at protecting the rights and freedoms of people and citizens, as well as creating conditions for the development of civil society.

Formation of Inter-Ethnic Solidarity of The Kazakhstani Society Based on The Implementation of The Multiculturalism Concept in The Student Environment

The article presents the results of a sociological study on the problem of modern inter-ethnic relations among students based on the concept of multiculturalism. The purpose of this study is to identify the attitudes of urban students towards the implementation of the ideology of multiculturalism, and the implementation of interethnic communication; to identify possible strategies for their behavior in a situation of interethnic tension and conflict in the context of the implemented state policy in the field of interethnic relations. The survey showed that Kazakhstani students have a high level of interethnic tolerance and are ready to enter into interethnic relations, which confirms the existence and implementation of the ideas of multiculturalism. The ideas of multiculturalism in the higher education system of Kazakhstan are implemented through various mechanisms that allow for preserving ethnic diversity and strengthening interethnic harmony, which contributes to the formation of interethnic solidarity in society.

Ways to stimulate business towards socially responsible behavior and respect for human rights in the economic sphere

The article focuses on the growing role and importance of socially responsible business behavior. This is associated with a number of factors, such as the increasing ethical consciousness of society, the growing impact of business on the environment and people’s lives, and intensified competition in the market. It is noted that socially responsible business behavior involves respect for human rights, environmental protection, investment in human capital, and the fight against corruption. The purpose of the article is to explore and substantiate the ways to stimulate business towards socially responsible and respect human rights in the economic sphere. This goal is realized in the article by solving the following research tasks: the author analyzes the concept and essence of socially responsible business behavior and respect for human rights in international legal documents; defines the basic principles of socially responsible business behavior; studies the factors influencing the incentives for business towards socially responsible behavior; and develops and substantiates a complex of measures to stimulate business towards socially responsible behavior and respect for human rights. The author explores the role of business in society and the need to take into account social and ethical aspects in its activities. The author analyzes the impact of socially responsible behavior of business entities on economic development and positive impact on society as a whole. The expected results of the proposed measures are determined. The general conclusion of the article is that socially responsible business behavior and respect for human rights in the economic sphere are important components of sustainable development in modern society. Specific recommendations are proposed for enterprises to engage in these processes and maximize their social impact. The results of this study can be used to develop and implement state policy in the field of stimulating socially responsible business behavior, as well as for self-improvement of business entities.

This scientific article examines the legal forms, directions and tools of international cooperation in the field of preventing and countering crime against the economic system. The conditions of globalization, internationalization and digital society have significantly increased the importance of international cooperation in the field of law enforcement activities for the formation and implementation of state policy on the prevention and counteraction of criminal offenses against the economic system. The rapid spread of globalization has led to the expansion of the scope of crime and corruption, which go beyond state control and violate the international legal order. The growing scale and threat of crime emphasizes the need to increase the importance of cooperation between states in the fight against this phenomenon, as well as conducting scientific research in this area. The results of the study confirm the need to determine the specifics of legal forms, tools and directions of international cooperation in the field of crime prevention and countermeasures. It has been established that national legislation provides for the use of various legal forms of international cooperation, including the conclusion of bilateral and multilateral agreements, participation in international organizations and cooperation with international police organizations such as INTERPOL, EUROPOL, ASEANAPOL, AMERIPOL, AFRIPOL, GCCPOL, AIMC. It is also important to take into account the specifics of the activities of these international police organizations. In addition, national sources of law were identified that regulate international cooperation in the field of law enforcement. These results highlight the need to develop effective strategies and policies to counter crime that threatens the economic system at the international level.
