Green Public Procurement in Public Administration: Perceptions and Challenges in Practice

ABSTRACT The implementation of green public procurement (GPP) in the Maltese public administration was perceived as an important step that supports the achievement of environmental policies. Institutions are in place for the application of GPP. However, there are difficulties in practice, and more needs to be done in terms of training and capacity development. This study concludes that managerial decisions are taken to legitimize actions, so that the administrator appears to be doing the right thing in the eyes of the stakeholders. Institutions intentionally adopt GPP to adhere to the norms and values of society. Whether GPP has a positive effect on the environment is a secondary objective.

Dyadic capabilities in implementing performance-based public procurement

PurposeThis study aims to provide new understanding on operational and dynamic capabilities supportive to the implementation of performance-based public procurement by focusing on dyadic capabilities of a supplier and a buyer.Design/methodology/approachThe study is based on the qualitative analysis of 20 interviews with informants representing Finnish public organizations and their private sector suppliers. The analysis is aligned with a theoretical framework connecting the phases of procurement and the capability types studied.FindingsThe findings of the study present the role of operational and dynamic capabilities of a buyer and a supplier in the implementation of performance-based procurement at public procurement phases. Preprocurement phase is found to greatly benefit from all three dynamic capabilities, while operational capabilities suffice in the contracting phase.Social implicationsIncreased understanding on capabilities needed in performance-based procurement can increase the chances of success in reaching better value for money of public services and developing supplier markets.Originality/valueThe study contributes to the literature on performance-based public procurement and value-based selling by taking a dyadic approach to the operational and dynamic capabilities needed in business with an emphasis on performance. As the focus in public procurement shifts increasingly from resources to performance, involving a joint effort between buyer and supplier, the study provides insights into role of dyadic capabilities and explains how dynamic and operational capabilities together support the phases of performance-based procurement implementation in the public sector.

Identifikasi Penyebab Korupsi dalam Prosedur Pengadaan Barang dan Jasa Pemerintah

This study shows solution to prevent a corruption in government procurement. This study was conducted using descriptive qualitative methods with secondary data collection through a literature review. The results of the research show that cases of corruption in the procurement of government goods and services in Indonesia are due to the lack of strong regulations for procurement of government goods/services and the ineffectiveness of the government procurement system for goods/services, such as poor quality and quantity of goods, wrong goods obtained, lack of clarity in other technical requirements. , as well as the slow implementation of procurement and delivery of required goods and services, which makes beneficiaries disappointed. Maladministration is also seen as an important component of corruption in goods and services procurement procedures.

AN ANALYSIS OF THE IMPACT OF PROCUREMENT AND COMMUNICATION MANAGEMENT ON THE PERFORMANCE OF CONSTRUCTION PROJECTS IN NIGERIA

The construction sector plays a vital role in driving economic growth and development in Nigeria. However, it faces significant challenges, particularly in project performance, which can be attributed, at least in part, to ineffective communication and procurement management. This research aims to evaluate how communication and procurement management impact the outcomes of construction projects in Nigeria. To conduct this study, a quantitative research design was employed, utilizing a survey questionnaire administered to 260 construction professionals. The data collected underwent analysis employing various techniques such as descriptive statistics, confirmatory factor analyses (CFA), exploratory factor analyses (EFA), and structural equation model (SEM) utilizing software including the Statistical Package for Social Sciences (SPSS), Microsoft Excel, and LISREL (Linear Structural Relations). The SEM analysis results revealed that 31 out of the 35 hypotheses used in the study were validated. Among these, the strongest relationships observed were those between procurement management and time performance, procurement management and cost performance, time performance and cost performance, time performance and quality performance, and communication management and time performance, in that specific order. This demonstrates the critical role of effective communication and procurement management in achieving successful construction projects in Nigeria. Additionally, the analysis of factors affecting the implementation of procurement and communication management in the Nigerian construction industry highlighted the need for stakeholders to be proactive in developing strategies that facilitate effective implementation of these practices to enhance project performance. The study also emphasizes the importance of establishing effective procurement policies and regulations, embracing technology, building capacity, managing stakeholders, and continuously improving project management practices to elevate project performance in the Nigerian construction industry.

Understanding the Impact of Collaborative Governance on Sustainability: Evidence from Buying Green in Local Governments in Florida, USA

ABSTRACT This paper analyzes collaboration patterns in procurement and outcomes as well as the impact of collaboration on green public procurement (GPP) implementation. It draws data from case studies in local governments in Florida and examines the literature on collaborative governance and resource exchange theory. The findings highlight collaboration patterns and note that collaboration may lead to economies of scale, more agile procurement, and enhanced capacity. The study also notes that GPP generally emerges as an unintended by-product of collaboration, rather than a deliberate outcome. It further offers evidence of the conditions under which collaboration can be leveraged to improve GPP.

Analysis and discussion on the pharmaceutical centralized procurement implementation - a case study of a large provincial hospital in China.

Unaffordable medical treatment and inflated drug prices have become a challenging issue for lawmakers worldwide. To reduce the financial burden and standardize the pharmaceutical market, the Chinese government has issued several detailed regulations, including the measures of drug recruitment and procurement in one and volume purchasing to not only ensure the high quality of approved drugs but also lower the cost of the production and sell procedure. In this work, to have a thorough overview of the enforcement of these regulations, we attempted to critically analyze the data of our hospital's centralized procurement of drugs from 2019 to 2022. We identified some concerns, such as the difficulty in determining the "quantity" of drug procurement, out-of-stock of collectively procured drugs, difficulty in managing the preallocation of associated funds, incomplete centralized procurement systems, etc. Therefore, it is essential to promote a multidimensional strategy, including the combination of the medical insurance reform and drug centralized procurement policies, strict controlling of the forecast quantity of drugs to ensure stable drug supply, improvement of the relevant policies for retaining the surplus of centralized procurement drug medical insurance funds, secureness of the drug procurement system platform, and available reference and guidance for subsequent centralized quantity procurement of drugs.

IMPLEMENTASI KEBIJAKAN PENGADAAN BARANG DAN JASA SECARA ELEKTRONIK PADA BAGIAN PENGADAAN BARANG DAN JASA SEKRETARIAT DAERAH KABUPATEN PARIGI MOUTONG

The objective of this study is to analyze the implementation of electronic goods and services procurement policies in the Procurement Division of the Regional Secretariat of Parigi Moutong Regency. This research is a qualitative study with a descriptive method. Data collection techniques were conducted through observation, interviews, and triangulation. The data were analyzed using the Miles and Huberman method, which involves data reduction, data presentation, and conclusion drawing and verification. The model used in this research is the one developed by Edward III, known as A Model of the Policy Implementation Process. This model identifies four variables that influence the relationship between policy and performance: communication, resources, disposition, and bureaucratic structure. The results of the study indicate that the implementation of electronic goods and services procurement in Parigi Moutong Regency has not been optimal. The communication aspect has been functioning well with coordination and socialization in place, but the aspects of resources, disposition, and bureaucratic structure are still suboptimal. The main obstacles are the limited number of human resources with IT expertise and inadequate infrastructure. Disposition is not yet optimal as many OPDs (Regional Government Organizations) still use manual methods, and the bureaucratic structure is not fully supportive due to the lack of clear technical guidelines or SOPs. Based on the research findings, it can be concluded that the implementation of electronic goods and services procurement in Parigi Moutong Regency has not been optimal. While the communication aspect is functioning well, the aspects of resources, disposition, and bureaucratic structure need improvement to achieve better performance.

Implementing public procurement of green innovations: Does structural alignment matter?

This study contributes to the theory and practice of public procurement by examining the role of structural alignment in the implementation of public procurement of green innovations. Structural alignment is defined as the coherence and harmonization between strategic aspects of an organization. The organizational aspects examined in this study are strategic goals, structural and control mechanism, and adequacy of resources. The study draws on secondary survey data collected from 379 public-sector organizations in Norway. The analysis was conducted using a novel approach that combines partial least squares structural equation modeling and necessary condition analysis. There is a positive and significant relationship between strategic goals and structural and control mechanism; between structural and control mechanism and adequacy of resources; and between the adequacy of resources and the attainment of public procurement of green innovations. The findings support the structural alignment hypothesis in that the presence of strategic goals results in the implementation of the public procurement of green innovations if structure, control, and adequate resources are in place. Finally, the results show that strategic goals are a necessary condition for enacting a corresponding structural and control design and that structural and control design are a necessary condition for allocating resources, which are themselves a necessary condition for the increased implementation of the public procurement of green innovations.

The impacts of national centralized drug procurement policy on drug utilization of medical institutions: an empirical study in a county-level hospital in China

PurposeUnder the background of the regular implementation of the National Centralized Drug Procurement (NCDP) policy, this study aimed to assess the impacts of the NCDP policy on drug utilization of county-level medical institutions, and probe into the influencing factors of the changes in drug utilization.MethodA pre-post study was applied using inpatient data from a county-level medical institution in Nanjing. Drug utilization behavior of medical institutions of 88 most commonly used policy-related drugs (by generic name, including bid-winning and bid-non-winning brands) was analyzed, and the substitution of bid-winning brands for brand-name drugs after policy intervention was evaluated.ResultsAfter policy intervention, 43.18% of policy-related drugs realized the substitution of bid-winning brands for bid-non-winning brands (6.82% of complete substitution, 36.36% of partial substitution). Meanwhile, 40.90% of policy-related drugs failed to realize brand substitution. Multiple factors affected brand substitution, including: (1) Policy effect: brand substitution was more obvious after the intervention of the first and third round of NCDP. (2) Drug market competition: the greater the price reduction of bid-non-winning brands, the more the drugs for the same indication, the more likely that medical institutions keep using the same brands as they did before policy intervention. (3) Previous drug utilization of medical institutions: brand substitution was more obvious in drugs with large number of prescriptions and weak preference for brand-name drugs.ConclusionThe NCDP policy promoted the substitution of bid-winning brands for bid-non-winning brands. However, the NCDP policy remained to be further implemented in county-level medical institutions. Policy implememtation efforts, drug market competition and drug utilization of medical institutions would affect the implementation of the NCDP policy.

An integrated structural equation modeling and fuzzy qualitative comparative analysis model for examining green procurement adoption drivers

This research examines the factors that influence the implementation of green procurement in small and medium enterprises (SMEs), namely top management commitment, regulations, costs, pressure from consumers, and transformational leadership as moderation. The research employs a quantitative approach with 206 samples from the Indonesian SME industry. It utilizes Structural Equation Modeling (SEM) and Fuzzy-set Qualitative Comparative Analysis (FsQCA). The data set includes factors such as top management commitment, regulations, costs, consumer pressure, and transformational leadership as moderation variables. The results show that management commitment, regulations, costs, and customer pressure influence green procurement. The role of the moderating variable shows that transformational leadership only strengthens the influence of costs on green procurement and regulation on green procurement. Meanwhile, the influence of top management commitment to green procurement and customer pressure on green procurement shows that transformational leadership does not strengthen these variables. The research’s novelty lies in combining SEM and FsQCA to analyze the causal relationships among variables influencing green procurement in SMEs. It highlights the importance of understanding and effectively managing these relationships for organizations adopting green procurement practices.

IMPLEMENTATION OF GREEN PUBLIC PROCUREMENT IN HIGHER EDUCATION INSTITUTIONS

Purpose: This study attempts to present the Implementation of green public procurement (GPP) along with obstacles and solutions in Higher Education Institutions (HEIs) Design/methodology/approach: The method employed is a qualitative approach using interview discussions supported by documentation on the website of three HEIs. Ten stakeholders, including procurement staff, participated in the study, providing diverse perspectives. The research takes place from October 2023 until January 2024, with the research locus in the three HEIs in Indonesia. Findings: GPP is directed to support green campus programs, including sanitation and infrastructure, waste management, water saving, transportation with low emissions, renewable energy, and education and research. Leadership style, ability to innovate, and support from all academics in higher education determine the success of implementing GPP. Obstacles in implementing the GPP consist of regulatory, resource, and provider constraints that meet the requirements of the GPP. The solution that can be given to overcome these obstacles is to create strict regulations regarding the Implementation of GPP, create environmentally friendly procurement plans, make energy-saving and resource-saving movements, and look for providers that comply with GPP. Research implications: This research provides implications for the practice of green public Procurement in higher education governance. Originality/value: This ground-breaking empirical study concentrates on GPP in State Islamic Higher Education Institutions (SI-HEIs).

Implementasi Manajemen Sumber Daya Manusia di Madrasah Aliyah Negeri 2 Kota Malang

Human Resources (HR) play an important role in improving the quality of education in educational institutions, including Madrasah Aliyah Negeri (MAN). So, good management is needed to achieve madrasah goals. Using a qualitative approach and combined methods, researchers describe the role of HR management, implementation of HR management, and strategies to increase the productivity of teaching and education staff. In achieving maximum results, researchers collected data through observation, interviews and analysis of related documents. The research results show that the role of HR management in MAN 2 Malang City is very important for the institution as seen from the positive impact of its implementation. Apart from that, the implementation of human resource management at MAN 2 Malang City is carried out in the implementation of management functions, namely planning, procurement, coaching and development, promotion and transfer, dismissal, compensation and employee assessment. MAN 2 Malang City also has a strategy to increase the productivity of its human resources, including continuous training and development, providing incentives and rewards, as well as effective coaching and supervision.

Institutional Transformation of Proactive Environmental Characteristics of State Procurement into Imperative Ones: The Regional Case

Ensuring sustainable economic development, environmental protection, and conservation of natural resources are the top priorities of the new edition of the "National Security Strategy of the Russian Federation". One key aspect highlighted in the strategy is the significance of green public procurement, which plays a crucial role in reducing the environmental impact of human activities and promoting environmentally responsible behavior among companies. The lack of established regulatory mechanisms and the ongoing debates surrounding the concept of "green procurement" have prompted the research objective of identifying the factors influencing the successful implementation of green public procurement through econometric modeling. The goal is to assess how well public contractors are currently implementing green procurement practices and to develop strategies to enhance their adherence to these practices by 2023, particularly within the Southern Federal District. An analysis of existing literature has revealed gaps in scientific knowledge, particularly in the realm of comparing the actualization of green economy institutions in regional strategies and monitoring the implementation of green procurement within the Southern Federal District. These research issues will guide the comparative assessment of green economy institutions, monitoring of green procurement practices, and structuring of data within the study. The study will rely on statistical data obtained from the Unified Information System for procurement, using keywords related to the environmental sustainability of purchased goods to analyze the trends in green public procurement practices. Through this research, recommendations for the institutional transformation of green procurement practices into a must-follow standard for public contractors will be developed.

Economic and legal responsibility for anti-competitive collected actions in the form of correction of the results of tender, bids, auctions, competitions as a manifestation of collected behavior of procurement participants

The article is devoted to consideration of the issue of coordinated behavior of participants and customers of public procurement. The need to observe the principles of competition in the public procurement procedure is substantiated. The key point in conducting procurement is compliance with the conditions of competitive selection of the procurement winner, elimination of the possibility of victory of the "necessary” participants and overcoming corruption and speculation. Regulation of public procurement mechanisms is a combination of economic and legal and administrative legal aspects. Relations that arise in the process of procurement have different aspects of legal regulation, as well as the subjects of offenses in this area can be both business entities and bodies of state power, local self-government, management and control. It has been proven that public procurement involves a competitive selection of the winner, in compliance with all other procurement principles stipulated by the Law of Ukraine "On Public Procurement”. It was emphasized that the main purpose of the Law "On Public Procurement” is to ensure effective and transparent procurement, create a competitive environment in the field of public procurement, prevent corruption and develop fair competition. Public institutions must make purchases in accordance with special requirements of confidentiality and security, as well as taking into account national interests. It is argued that today the field of public procurement is quite corrupt, and many cases of violations of the main basic principles of the Law have been recorded, which leads to the distortion of the results of tenders, trades, and auctions. Distortion occurs due to the concerted behavior of procurement participants, or participants and customers. That is, concerted actions can be vertical and horizontal, mixed and conglomerate actions can also take place. Any concerted behavior during public procurement violates the terms of competition, is prohibited and entails liability in accordance with the legislation of Ukraine. The article emphasizes that proving collusion in procurement and actually bringing violators to justice is a complex issue that requires improvement both from the point of view of theoretical points and procedural aspects. Of course, the state is interested in ensuring transparent implementation of public procurement, and this can be achieved thanks to the introduction of a clear mechanism to overcome the corruption component. It is argued that regulation and control by state bodies play an important role in this institute. The state acts as a special customer, which is an expression of public interests. The use of such a legal instrument as public procurement of goods, works and services gives the state the right to choose business entities that will fulfill the state order on the most favorable market terms, on the basis of compliance with the terms of competition. Unfortunately, it is not always possible to observe honest and fair procurement.
 Attention was drawn to the fact that overcoming a large number of conspiracies in the field of public procurement and ensuring compliance with the principles of fair competition during procurement is one of the tasks of the Antimonopoly Committee of Ukraine, as a public procurement appeals body. However, issues of combating and implementing effective mechanisms to prevent the occurrence of collusion between public procurement entities and, as a consequence, procedural aspects regarding appeals and prosecution of offenders for concerted actions that led to the distortion of the results of tenders (tenders) remain problematic.

Implementation of Policy Regulation of The Head of The National Land Agency Number 5 of 2012 Concerning Technical Instructions For The Implementation of Land Procurement

That this research aims to analyze more deeply the implementation of the policy of the Head of the National Land Agency Regulation Number 5 of 2012 concerning Technical Instructions for Implementing Land Acquisition Case study of Land Acquisition for the Construction of the Pekanbaru-Bangkinang Toll Road, Riau Province. The research method in this legal research uses qualitative methods. The problem formulation used in this research is how to implement the policy of Regulation of the Head of the National Land Agency Number 5 of 2012 concerning Technical Instructions for Implementing Land Acquisition and what factors hinder the implementation of the policy of Regulation of the Head of the National Land Agency Number 5 of 2012 concerning Technical Instructions for Implementing Land Acquisition. That the results of this research found that the implementation of land acquisition for the construction of the Pekanbaru-Bangkinang toll road in Riau province was not optimal, that there were obstacles in the implementation of land acquisition for the construction of the toll road in the form of land disputes, the location being included in a forest area, and resistance from residents to the development. the toll road. The conclusion of this research is that it is best to review the regulations of the Head of the National Land Agency Number 5 of 2012 concerning Technical Instructions for the Implementation of Land Acquisition which function as a fulfillment of solving public problems in the land sector and filling legal gaps if necessary and that regarding the obstacles that In the field, assistance should be provided with related officials such as the prosecutor's office and police as well as the local district court to provide a sense of security and comfort for the committee and other stakeholders involved in the land acquisition process for the public interest.

Green public procurement in the most visited European museums: a comparison and a mapping

While scholarly research on green public procurement (GPP) keeps growing, until now it has paid little attention to museums that must make decisions about GPP implementation. This paper breaks new ground by exploring GPP implementation in the most visited European museums. The proposed conceptual framework allows a comparison and a mapping of museums’ GPP implementation levels while taking account of how these levels are related to the national GPP performance. Complementing this framework with the analysis of the up-to-date data from the Tender Electronic Daily database yields two central findings. First, museums that formalized their GPP policies in their strategic organizational documents exhibit higher levels of GPP implementation than other museums that have not done so. Second, the majority of the investigated museums follow national trends of GPP implementation, with examples of exceeding or falling below these trends being rare. The article is important for policy makers and practitioners as it highlights the importance of the factor of institutionalization of green procurement in individual organizations, which is crucial for successful implementation of green procurement.

The Factors Affecting Electronic Government Procurement (EGP) Implementation in Zambia’s City Councils: A case of the Lusaka City Council

The Lusaka city council was used as a case in the research to identify the factors that hinder or facilitate the successful implementation of E-GP. A non-probability sampling technique, namely purposive sampling, was used, using a sample of 80 personnel and suppliers of the Lusaka city council. The research used a quantitative and qualitative approach with a descriptive research design. Data was gathered via a questionnaire and interview, and descriptive and inferential statistics were used to assess it. The results show that the benefits were confirmed by both the suppliers and the end users. They all stated that E-GP has reduced the time and cost of doing business for both bidders and procurement entities (PEs). It has also allowed equal opportunity to all bidders because it involves the free download of bidding documents, and bidders are only charged at bid submission. In the past, there was too much corruption, but the automation of the publication of tenders and contract awards has led to greater transparency in the procurement system. The results also show that personnel working in departments related to E-GP are not receiving the required support from superiors in using the e-government procurement system. The study further indicates there is limited reliable, affordable, and fast internet, which in turn is affecting e-government procurement at Lusaka City Council. Implementing e-procurement is faced with the most prominent challenge of poor internet at the institution. This study recommends, among other things, enhancement of the system and improvement of organizational culture to allow others to be part of the process. In addition, LCC should invest heavily in the system if they want to reap the benefits of its existence in the future.

The research seeks to identify critical factors influencing the effectiveness of procurement practices and propose recommendations for improvement. Theoretical Framework: Built upon a framework that combines elements from public administration theory and legal perspectives, this research explores the intricate nature of government procurement. The theoretical underpinning incorporates aspects of administrative law, public policy, and governance to provide a holistic view of the implementation process in the context of South Sulawesi Province. Methodology: Utilizing a mixed-methods research design, this study employs both quantitative and qualitative approaches. Quantitative data is collected through surveys and analysis of procurement records, offering statistical insights. Concurrently, qualitative data is gathered through interviews with key stakeholders, including government officials, suppliers, and experts, providing nuanced perspectives on the implementation challenges and successes. Results and Conclusion: The quantitative analysis sheds light on the efficiency and effectiveness of government procurement practices in South Sulawesi Province. Findings from the qualitative phase uncover contextual insights, contributing to a deeper understanding of the challenges faced by stakeholders involved in the procurement process. The research concludes with recommendations to enhance transparency, accountability, and efficiency in government procurement. Originality/Value: This research contributes to the field by providing an in-depth analysis of government procurement implementation in a specific regional context. The integration of legal and administrative perspectives enriches the theoretical understanding of the procurement process. The study's findings offer practical implications for policymakers, procurement practitioners, and academics, emphasizing the need for tailored strategies to address the unique challenges faced in South Sulawesi Province.

Key features of the national procurement regime implementation

Difficulties with the supply of certain categories of foreign goods under conditions of foreign economic restrictions necessitate the active development of domestic production. Under the current conditions, the national regime in the implementation of public procurement is a necessary driver of the development of the Russian economy. The provisions of the regulatory framework of the national regime are aimed at supporting domestic producers of the most necessary goods for the country. That is why strict compliance with all the provisions of the national regime is an important responsibility of each customer.

Implementation of Construction Services Procurement at the Vocational High School Center of Excellence (SMK PK) in DKI Jakarta

In the era of the development of the industrial world, construction services in the world of education, especially in Central High Schools of Excellence, are very intensively carried out in order to achieve the objectives of the SMK PK program, namely to improve the quality of human resources through government assistance which focuses on student practice rooms and industrial standards. The fulfillment of these facilities and infrastructure is carried out by procuring in accordance with the reference, namely Permendikbud No.18 of 2022. The purpose of this study is to increase knowledge and information related to good procurement procedures and ethics carried out by SMK PK. The method used is literature review. The results show that the facilities and infrastructure at SMK PK are very good because they are followed by the implementation of procurement according to procedures and ethics. Starting from planning, determining providers, making agreements, and carrying out procurement in accordance with Permendikbud No.18 of 2022.
