Patent Protection Policy and Firms’ Green Technology Innovation: Mediating Roles of Open Innovation and Human Capital

Green innovations such as renewable energy technologies and cleaner process modifications are important technical routes and critical directions for reducing carbon emissions from industrial production processes. This study examines the impact of intellectual property protection on green technology innovation, constructing a progressive difference-in-differences model using 849 listed manufacturing firms panel data from 2007 to 2019 and taking the Chinese Intellectual Property Rights model cities as a quasi-natural experiment. Our study finds that the pilot policy significantly enhances corporate green innovation. When considering heterogeneity, the policy treatment effect is more remarkable for large firms, state-owned enterprises, and industries where technology can be easily imitated. Moreover, the mediating effect shows that the policy promotes green innovation by encouraging firms’ research and development cooperation and increasing human capital levels. This study proposes that policymakers should reinforce intellectual property protection, encourage companies to be better and bigger, and emphasize the intermediary function of open innovation and human capital in green technology innovation.

Intellectual Property and Health Technological Innovations at the time of the Pandemic

Abstract Technological innovations at the time of the pandemic and post pandemic is the focus of this paper which examines the relationship between intellectual property (IP), artificial intelligence (AI) and the healthcare sector. Research in this area includes the rapidly growing artificial intelligence industries in the healthcare sector and the impact of intellectual property protection on emerging technologies. Taking an interdisciplinary and diverse perspective, this paper enriches the evolving scope of ethical discourse literature by focusing on intellectual property assets that use AI and regulation that shape the healthcare sector. Considering the gap between law and development theory and practice, this paper bridges academic knowledge in unpacking ethical and governance issues in the intellectual property industry, healthcare law and emerging technologies. Unpacking these issues is important in the law and development context as ethical issues that arise from emerging technologies using AI systems and the responses from policymakers in governing their developments create long-term implications to individuals and populations. Governance responses often vary according to the local contexts, and are dependent on the unique socio-cultural structures, institutional organisations and legal frameworks.

The impact of intellectual property protection on the performance of fossil fuel extraction and production companies in developing countries

This paper seeks to evaluate how intellectual property (IP) influences the sustainable performance of Chinese companies involved in fossil fuel exploration and production. The study meticulously delineates specific variables aimed at advancing sustainability through strategic IP measures. Utilizing data spanning from 2010 to 2021 and employing the Cross-Sectionally Augmented Autoregressive Distributed Lag (CS-ARDL) approach, we reveal a nuanced relationship between innovation efficiency and energy costs. A mere 1% improvement in innovation efficiency corresponds to a 0.6% short-term and 0.4% long-term reduction in energy costs. Larger workforces contribute to increased energy consumption, investments drive energy-intensive processes, and profitability accelerates production, amplifying energy demands. Additionally, we uncover the adverse impact of Information and Communication Technology (ICT) expenses on energy costs, emphasizing the transformative potential of digitalization. To enhance sustainability, we recommend strengthening IP strategies, providing incentives for the commercialization of green patents, leveraging green financing, and adopting Environmental, Social, and Governance (ESG) principles to attract ethical investors. Equipping a skilled workforce through training programs facilitates the integration of eco-friendly technologies with intellectual property strategies.

Research on the influence mechanism of intellectual property protection on China's digital economy

In the context of accelerating the construction of the digital economy, it is of great practical significance to study the degree of intellectual property protection to improve the development of the digital economy to help the high-quality development of China's digital economy. The data of 273 cities in China from 2012 to 2021 were selected as samples, and the level of intellectual property protection was measured by the number of intellectual property cases, and the development of the digital economy was measured by the Internet infrastructure, Internet-related output, and digital financial inclusion. It is found that 1) The protection of intellectual property rights has significantly improved the level of development of the digital economy. 2) Intellectual property protection can promote the development of the digital economy by increasing the activity of innovation. 3) The impact of intellectual property protection on the digital economy is verified from the levels of different regions, city sizes and local financial resources, and it is found that the positive effect of intellectual property protection on the digital economy in the eastern region, Type II large cities and cities with high local financial resources is greater.

The Effectiveness of the Protection of Intellectual Property Rights Through the Prism of the Behavior of Domestic Consumers of Goods and Services

Dynamism and evolution are phenomena whereby certain things gradually transform their characteristics and behavior, acquiring new meanings as a result. The forces that drive the evolution of society, development and economic competitiveness are intellectual products, information, knowledge, scientific and cultural potential. Under the impact of these phenomena, consumers develop new lifestyles, purchase and consumption behaviors, attachment or refusal of trademarks. In this sense, the concept of intellectual products acquires new valences in modern society, and the efforts of state institutions to invest in strengthening IP regimes are not considered investments generating added value and economic growth through innovation, quality and competitiveness. That is why, this article highlights the significance of intellectual property, the role of the IP system and the impact of intellectual property protection on the behavior of the consumer of goods and services in the Republic of Moldova.

Can patentee preference in patent infringement dispute resolution impact innovation?

Evaluating the impact of intellectual property protection on innovation should include multiple perspectives, of which the impact of patent infringement remedies is an indispensable perspective. The two options for resolving patent infringement disputes in China include civil litigation (CL) and administrative adjudication (AA). Despite the fact that the judicial system has been emphasized as playing the leading role in intellectual property protection, patentees have shown a strong preference for AA since 2015. The general application of AA had been criticized by scholars. Does the patentee's preference bring inappropriate protection and stifled innovation? This study used regression models and 2008–2020 data on the choice of patent dispute resolution mode in China. The number of invention patent applications was the dependent variable, and choices for CL or AA were the independent variables. The choice of AA and the invention patent application were found to have a significant and positive association, implying that AA provides an appropriate level of intellectual property protection to incentivize innovation. Characteristics derived from AA should be valued and used as a reference to improve innovation policies.

Does intellectual property protection promote green innovation in firms? A perspective on R&D spillovers and financing constraints

Although the literature has assessed the impact of Intellectual property protection on urban innovation, there is still a gap in the assessment of the impact of green innovation at the firm level. This study constructs a multi-period differences-in-differences (DID) model using China’s Intellectual Property Demonstration Cities (IPDC) as a quasi-natural experiment to investigate the impact of IPDC on corporate green innovation. The findings indicate that (1) the IPDC program significantly stimulates corporate green innovation and has long-term effects. This finding still holds after using PSM-DID as well as robust IW estimators. (2) Mechanism analysis suggests that IPDC can promote firms’ green innovation by reducing R&D spillover losses and alleviating financing constraints. (3) Heterogeneity tests show that the IPDC program has a more significant promotion effect on small, state-owned, growth-stage firms. Based on the above findings, this study provides policy implications for enhancing intellectual property protection to stimulate corporate green innovation.

The impact of intellectual property protection on business performance of high-tech enterprises: The mediating effect of political-business relations

The purpose of this paper is to study the mediating role of political-business relationship in the business efficiency of high-tech firms in terms of intellectual property protection. We find that: the improvement of the quality level of IPR protection implementation environment can promote the growth of business performance benefits; the political-business relationship can have a suppressive effect on the business performance benefits; the level of IPR protection implementation environment quality can promote the business performance benefits of high-tech enterprises under the mediating effect of political-business relationship, but there is a masking effect of this mediating effect.

IP protection and ownership in cross-border acquisitions

We use the institutional theory to examine the impact of intellectual property protection on US multinational corporations (MNCs) ownership levels of their foreign acquisitions. Based on a sample of 7238 completed international M&A deals made by US MNCs from 1998 to 2017, we found that multinationals protect their intellectual property through more ownership when they are technologically intensive and invest more when IP protection is strong. However, IP protection negatively moderates the need for more ownership for technologically-intensive multinational corporations. Our results are robust to a battery of empirical tests, including a unique instrumental variable approach. This leads us to claim that our results are not merely correlated but are causal.

Does Stronger Protection of Intellectual Property Improve Sustainable Development? Evidence from City Data in China

Achieving sustainable development goals is a challenge for countries. The core way is to enhance the green total factor productivity. While the literature has examined the various external institutional factors, there is a lack of research on the impact of intellectual property protection (IPP), which is an important external institution. This study adopts the differences-in-differences (DID) model and propensity scores matching (PSM) using the Chinese intellectual property model city policy (IPMP), as a quasi-natural experiment, and Chinese cities’ panel data from 2005 to 2019 to investigate the effect of IPP on sustainable development. The findings demonstrate that: (1) The IPMP significantly increases urban GTFP. (2) Mediation mechanism analyses show that the IPMP can support urban GTFP by fostering technological advancement, boosting human capital, luring foreign direct investment, and modernizing industrial structure. (3) Heterogeneity analysis shows that the Chinese central region, the eastern region, and the region with more fiscal transparency are where the IPMP has the greatest promotion effect on GTFP. Lastly, this study provides several recommendations for the improvement of sustainability in China.

The impact of intellectual property protection on the development of digital economy and regional entrepreneurial activity: Evidence from small and medium enterprises.

Substantial intellectual property management (IPM) is vital in retaining competitive advantage and managing outbound open innovation (OI), which may enhance an organization’s commercialization and entrepreneurial performance. Thus, the objective of this study was to develop an understanding of the impact of intellectual property protection on the development of the digital economy, regional entrepreneurial activity, and explore how IPM can enhance the entrepreneurial performance (EP) through open innovation (OI) and commercialization performance (CP) in the context of small and medium enterprises (SMEs) in Mainland China. Our study also shows how open innovation model constraints (OIMC) and information communication technology (ICT) enhance the performance. Using the organizational performance theory, we developed our research framework and collected usable data from 530 respondents from the management of SMEs in Mainland China. Data analyses were performed using SPSS, and structural equation modeling was performed using Amos 24 to test the hypothesis. Our results highlighted the significant effect of IPM on OI, CP, and EP. This study suggests various conclusions, stressing the mediating function of CP in improving EP and the direct and indirect effects of OI and CP on EP. This study also emphasizes that business managers need to ensure collaboration among SMEs since it is the best strategy to use each other’s resources, including OI ideas, to improve the EP, and it should be done utilizing ICT.

Intellectual property protection, religious culture and dynamic capabilities of enterprises: evidence from Chinese listed companies

ABSTRACT Using the panel data of Chinese A-share listed companies from 2010 to 2019, this paper empirically tests the impact of intellectual property protection and religious culture on enterprise dynamic capabilities. It is found that intellectual property protection and religious culture have a significant promoting effect on the dynamic capabilities of enterprises. And there is a substitution effect between intellectual property protection and religious culture. After the robustness test, the benchmark research conclusion is still valid. Heterogeneity analysis shows that intellectual property protection and religious culture have heterogeneous effects on firms with different financing constraints. Further analysis shows that intellectual property protection can improve the innovation level of enterprises by improving dynamic capabilities.

Does intellectual property protection stimulate digital economy development?

ABSTRACT The digital economy plays an important role in society and the economy. However, we know little about what factors affect the development of the digital economy. Using a self-developed index for measuring Chinese provincial-level digital economy development, this paper examines the impact of intellectual property protection on the digital economy. We find that there is a U-shaped relationship between intellectual property protection and digital economy. Our findings remain valid after a battery of robustness tests. Our findings support the importance of intellectual property protection in developing the digital economy.

Basic Legal Analysis of Intellectual Property Protection in the Adjustment of Import Structure of Developing Countries

With the continuous development of social economy, knowledge has become an important driving force for modern economic growth, which is of critical value for the improvement of the comprehensive national strength of developing countries. In this case, developing countries should systematically judge the advantages and disadvantages of their own trade import structure, make full use of the value orientation of intellectual property protection, and actively take an effective measure to optimize the import structure to promote the sustainable development of national economy. In view of this, this paper expounds the actual situation of patent and trademark application acceptance and authorization in developing countries at this stage, analyzes the deep impact of intellectual property protection on the import structure of developing countries, summarizes and proposes effective plans to improve the level of intellectual property protection to optimize the import structure of developing countries, hoping to provide some effective reference.

The impact of intellectual property protection on imports : a comparison between OECD and non-OECD member countries

지식재산권보호가 무역에 미치는 영향은 시장확대효과(market expansion effect)와 시장지배력효과(market power effect)의 두 가지로 나눌 수 있다. 본 연구에서는 전세계 122개국가를 대상으로 지식재산권보호가 수입에 미치는 영향을 실증분석하였다. 분석연도는 2000년, 2005년, 2010년, 2015년이며, 전체국가를 OECD 회원국과 비OECD 회원국으로 구분하여 지식재산권의 보호효과에 차이가 있는지도 살펴보았다. 분석결과 전체국가를 대상으로 하였을 때는 국가의 지식재산권 보호의 수준이 높을수록 수입에 긍정적 영향을 미치는 것으로 나타나 지식재산권의 보호가 무역에 미치는 시장확대효과를 지지하는 것으로 나타났다. 국가의 규모(GDP), 개방도, R&D집중도를 모형에 추가하여 분석한 결과 국가의 규모와 개방도는 무역에 유의한 양의 영향을 미치는 것으로 나타났으나 R&D집중도의 영향은 유의하지 않은 것으로 나타났다. 이러한 효과는 OECD 회원국을 대상으로 했을 때 더욱 분명하게 나타나며, 비 OECD 회원국의 경우 지식재산권이 무역에 미치는 영향은 확실하지 않다. 또한 OECD회원국을 대상으로 규모(GDP)와 개방도와 R&D집중도 변수를 추가하여 분석한 결과 이들 변수는 모두 수입에 유의한 양의 영향을 미치는 것으로 나타났다.The impact of intellectual property right(IPR) protection on trade can be divided into two categories: the market expansion effect and the market power effect. This study empirically analyzed the impact of IPR protection on imports in 122 countries. The years of analysis are 2000, 2005, 2010, and 2015. We also examined whether there are differences in the protection effect of IPRs between OECD and non-OECD member countries. As a result of the analysis for all countries, the higher the level of national IPR protection, the more positive the impact on imports, thus supporting the market expansion effect of IPR protection on trade. As a result of analyzing the country s size(GDP), openness, and R&D intensity by adding it to the model, it was found that the country s size and openness had a significant effect on trade, but the effect of R&D intensity was not significant. This effect is more evident in OECD member countries, and the impact of intellectual property rights on trade in non-OECD member countries is unclear. In addition, as a result of analyzing the scale(GDP), degree of openness, and R&D intensity in OECD member countries, it was found that all of these variables had a significant positive effect on imports.

Impact of intellectual property protection on the innovation efficiency in China’s hi-tech industry

ABSTRACT A plethora of publications have discussed the correlation between intellectual property protection (IPR) and innovation capability; however, regarding the hi-tech industry in transition economies, the relationship remains unclear. Based on the data from 30 hi-tech industries in Mainland China during 2004–2016, the study used the SAR Tobit model to analyse the direct, mediating and moderating effects of IPR on China’s hi-tech industry’s innovation efficiency. The findings illustrated that both R&D efficiency and business transformation efficiency of China’s hi-tech industry have significant positive spatial correlation and spatial spillover effect. In addition, IPR significantly promoted R&D efficiency and business transformation efficiency. Market segmentation exerted a significant negative moderating effect between IPR and R&D efficiency, and a significant positive moderating effect between IPR and business transformation efficiency. The technology market development has an intermediary effect between IPR and two-phase innovation efficiency. In particular, the non-linear influence of IPR on business transformation efficiency is the hinge on the level of market segmentation. Ultimately, several possible policy suggestions are proposed.

The Impact of Intellectual Property Protection through FTA on International Trade

The importance of intellectual property rights (IPRs) for innovation has grown and the protection of intellectual property in international trade has also been strengthened. AI-related patent applications have been increasing rapidly and many AI patents are being filed in various industries. Intellectual property also represents one of the main controversies of U.S.-China trade relations in the past three decades and remains one of the core issues behind the two countries’ recent trade conflicts. As a result, global protection for IPRs has been expanded in recent decades. This article investigates changes in the trend regarding the IP protection level in FTA and how the IP protection through FTAs has affected the composition of aggregate trade flows of member countries in order to provide basic findings necessary to formulate the FTA policies regarding the protection of IPRs in Korea.

Modelling the impact of intellectual property protection and spillovers on attracting foreign direct investment

Previous studies yield ambiguous results from using country-level indices of intellectual property rights (I.P.R.) protections to test their relation to foreign direct investment (F.D.I.). This study develops a simple model featuring vertically linked stages of production to show that country-level I.P.R. indices might cause the ambiguity by ignoring differences in I.P.R. protection strength across industries. We demonstrate that industry-level I.P.R. indices resolve ambiguity over the empirical nexus between I.P.R. protections and F.D.I.

How Does International Technology Spillover Affect China’s Carbon Emissions? A New Perspective Through Intellectual Property Protection

Environmental problems caused by climate change have become increasingly prominent, and the important role of technological advancement in reducing environmental pollution is receiving more attention. Under the conditions of an open economy, multi-channel international technology spillover has become an important way to improve a country’s technological innovation capabilities. Based on the establishment of China’s intellectual property protection (IPP) system, this paper integrates trade, foreign direct investment (FDI), and outward foreign direct investment (OFDI) into a unified international technology spillover framework and analyzes how international technology spillovers affect China’s carbon emissions at different IPP levels. The results demonstrate that Trade, FDI, and OFDI increase regional carbon emissions and that trade has the greatest effect on carbon emissions’ growth. The regression results of the dynamic threshold demonstrate that as the regional IPP level exceeds the threshold, trade technology spillovers can reduce carbon emission, and that FDI and OFDI further increase carbon emissions. The impact of IPP and international technology spillovers on carbon emissions has regional heterogeneity in China. For the eastern and central regions, the interaction of international technology spillovers and IPP increases carbon emissions, while it has a significant inhibitory effect on carbon emissions in the western region. Therefore, to fully realize the role of international technology spillovers and IPP in reducing car- bon emissions, China should implement differentiated IPP and international technology spillover policies.
