Juridical Analysis of the Village Head's Term of Office from a Constitutional Perspective

The Village Head has the position of village leader who is responsible for the prosperity and well-being of the village. The Village Head is an aspect that greatly influences the success or failure of developing a village. As the leader of the village government, the village head must be able to carry out his duties well and be able to regulate the performance of the village government to build a prosperous village and create a prosperous community. As a leader who is full of trust in managing and developing the village, the village head is assisted by village officials in handling all affairs in the village. The aim of this research is to determine the term of office of the village head from a constitutional perspective. This research uses normative legal research methods. Normative legal research is legal research carried out by examining library materials or secondary data. The revision of Law Number 6 of 2014 concerning Villages in Article 39 Paragraphs (1) and (2) which regulates terms of office and periodization is not the only way to maximize the performance of village heads, the government can make provisions for the requirements and quality of human resources. who will serve as village head because good human resources can change the quality and quantity of life of people in rural areas or cities.

The current village head's term is considered insufficient to develop the village due to tension and polarization after the village head election, and the village head's term of office is too short which will fail to achieve the vision and mission. In this research, the researcher used a normative legal research method, with this method it will be able to provide an overview of the problem of extending the term of office which has the potential to make the democratic climate unhealthy and can foster oligarchy in the village. Democracy is interpreted as an effort to limit power and build elite circulation as part of ending oligarchy and excessive accumulation of power. Extension of the village head's term of office is considered to injure the spirit of democracy itself considering that elite circulation does not occur briefly and accumulation carried out over a long period will foster dictatorial power.

Fenomena Periodesasi Masa Jabatan Kepala Desa Perspektif Fiqh Siyasah Dan Undang-Undang Nomor 6 Tahun 2014 Tentang Desa (Studi Di Desa Payaman Kecamatan Solokuro Kabupaten Lamongan)

Based on the results of interviews with several community leaders in Payaman Village, the researcher found that there was something different regarding the period of office of the Village Head in Payaman Village where the researcher found that the Village Head only had one opportunity to nominate himself as Village Head even though it was in accordance with the rules contained in Law Number 6 of 2014 states that Village Heads can be elected for a maximum of three terms of office, here researchers believe that there is a phenomenon that Village Heads only have one opportunity to nominate themselves as Village Head in Payaman Village. The objectives to be achieved in this thesis are: To find out what the phenomenon of the Village Head's term of office in Payaman Village, Solokuro District, Lamongan Regency, is like from the Siyasah Fiqh Perspective. In collecting data for this thesis, the author used the following techniques or methods: 1) Observation, 2) Interview, 3) Documentation. The data phenomenon process carried out by researchers is in the following steps: 1) Data reduction, 2) Data display or presentation of data, 3) Drawing conclusions or verification.

Potential Irregularities in Arrangements of Amendment Regarding the Term of Office of Village Heads in the Indonesian Constitutional Law System

The discourse to extend the term of office of the village head creates problems in the Indonesian constitutional system. This is because the addition will potentially extend the term of office of the village head to 27 (twenty-seven) years. In fact, cumulatively, the term of office of the village head based on Law Number 6 of 2014 concerning Villages is quite long, namely 6 (six) years and can be elected 3 (three) times, which means that the village head can serve 18 (eighteen) year. On the other hand, the duration of a village head, which has the potential to reach 18 years, is also essentially inconsistent with democratic principles which provide a maximum limit for public officials who are elected through political mechanisms to hold office. For this reason, the idea of reconstructing the village head's term of office has become an urgent issue in the Indonesian constitutional system. The research question in this article is whether there is a potential for irregularities in the arrangements regarding the extension of the village head's term of office. The type and research approach used in this article is comparative normative juridical research with a statutory approach. The hypothesis in this article is that the long term of office of the village head is contrary to the concept of democracy, namely the limitation of power.

ANCAMAN TERHADAP DEMOKRATISASI DESA DI BALIK PERPANJANGAN MASA JABATAN KEPALA DESA

The extension of the village head's term of office from 6 years to 9 years as a result of the revision of Law Number 6 of 2014 concerning Villages in Article 39, cannot be separated from the influence of compromises or political transaction relations between politicians in the DPR and village heads related to the 2024 Election. this is to analyze the decision to extend the term of office of the village head, beyond simply articulating the normative wishes of the village heads, namely as a threat to village democratization. The study method is qualitative, through literature studies, explored using data and information sources related to the extension of the position of the village head through the ratification of the revision of Law No. 6 of 2014 concerning Villages in the context of electoral interests in the 2024 elections and threats to village democratization. Then the data is classified and analyzed. The results of the study concluded that the extension of the village head's term of office to 9 years has the potential to threaten village democratization because it has implications for the tendency to abuse power, one of which is with village funds as the object, there is a saturation of the political psychology of the community, and the circulation of village leadership is jammed due to the increasing narrowing of the people's political evaluation space against the village head.

Main methods of Russian-Yakut translation of legal terms (based on the material of Russian-Yakut legal dictionary by B. N. Alekseev, V. N. Nikonov)

The subject of this article is the methods of terminographical translation of legal terminology of the Sakha language employed in the Russian-Yakut legal dictionary. The goal of this work consists in determination of peculiarities of legal terminological lexicon and ways of conveying it to Yakut language. Terminographical analysis of the dictionary demonstrated that there is no strict rule for selecting the framework legal terms and terminological phrases. For example, the legal status of some commonly used words is questionable; the so-called “non-terminological” parts of speech manifest as the head term, and the form of feminine gender is presented excessively, which the authors propose on the equal basis with the form of masculine gender. This article is first to conduct a detailed analysis of instances of application of Russian-Yakut translation techniques of legal terms, such as equivalent, alternative translation, calquing, transliteration, as well as descriptive, situational and other translation methods. The article is based on the inductive-deductive method and method of selective sampling for terminographical analysis of translations of translation of legal terms and terminological phrases. The results terminographical analysis of the Russian-Yakut translation of legal allow concluding on the need for comprising the more extensive Russian-Yakut dictionaries of legal and sociopolitical terms.

Head of Regional Characteristics and the Local Government Performance in Indonesia

Objective - This study aims to provide empirical evidence about the influence of the characteristics and the regional head of local government performance. Methodology/Technique - Local government performance is measured by the value of the performance evaluation of local government providers (EKPPD) derived from reports organizers of local government (LPPD). To realize the required capability of regional leaders and adequate competence in the regional administration. The population of this research is all the district / city in Indonesia in 2011. Total the study sample was 149 Government by using purposive sampling. The analytical tool used is linear regression. Findings - The results of this study indicate that the characteristics of elected regional head (term of office, incumbent, age, education). After the interaction, both individually and with other regional chief characteristics affect the regional head performance. Characteristics age was not significant individually or no effect but when the age of the head of educational interaction regions become influential attributes that the level of education to be important in the field of financial management to achieve good financial performance area. Novelty - The capability can be attributed to education, tenure, and age as the upper view eschelon theory. With a high level of education, the appropriate educational background, mature age, and work experience will be more open enough insight to regional executives can adapt to the changes and innovations to be able to create governmental achieve optimal performance. Stochastic uncertainty analysis for unconfined flow systems

A new stochastic approach proposed by Zhang and Lu (2004), called the Karhunen‐Loeve decomposition‐based moment equation (KLME), has been extended to solving nonlinear, unconfined flow problems in randomly heterogeneous aquifers. This approach is on the basis of an innovative combination of Karhunen‐Loeve decomposition, polynomial expansion, and perturbation methods. The random log‐transformed hydraulic conductivity field (lnKS) is first expanded into a series in terms of orthogonal Gaussian standard random variables with their coefficients obtained as the eigenvalues and eigenfunctions of the covariance function of lnKS. Next, head h is decomposed as a perturbation expansion series Σh(m), where h(m) represents the mth‐order head term with respect to the standard deviation of lnKS. Then h(m) is further expanded into a polynomial series of m products of orthogonal Gaussian standard random variables whose coefficients are deterministic and solved sequentially from low to high expansion orders using MODFLOW‐2000. Finally, the statistics of head and flux are computed using simple algebraic operations on A series of numerical test results in 2‐D and 3‐D unconfined flow systems indicated that the KLME approach is effective in estimating the mean and (co)variance of both heads and fluxes and requires much less computational effort as compared to the traditional Monte Carlo simulation technique.

Analytical solutions to statistical moments for transient flow in two‐dimensional, bounded, randomly heterogeneous media

In this paper we derive analytical solutions to statistical moments for transient saturated flow in two‐dimensional, bounded, randomly heterogeneous porous media. By perturbation expansions, we first derive partial differential equations governing the zeroth‐order head h(0) and the first‐order head term h(1), where orders are in terms of the standard deviation of the log transmissivity. We then solve h(0) and h(1) analytically, both of which are expressed as infinite series. The head perturbation h(1) is then used to derive expressions for autocovariance of the hydraulic head and the cross covariance between the log transmissivity and head. The expressions for the mean flux and flux covariance tensor are formulated from the head moments based on Darcy's law. Using numerical examples, we demonstrate the convergence of these solutions. We also examine the accuracy of these first‐order solutions by comparing them with solutions from both Monte Carlo simulations and the numerical moment equation method.

How to realize a concept: Lexical selection and the conceptual network in text generation

The task of natural language generation by computer requires a method for the selection of lexical items that refer to concepts. A generation system cannot assume that every concept will have an appropriate lexical entry associated with it. Similarly, a generation system must avoid redundant text and must strive for the most specific descriptions possible. This paper presents an algorithm for lexical selection that takes advantage of a conceptual network in which we represent the relationships between concepts (such as which concepts subsume each other and what differentiates concepts at different levels of generality). When the algorithm chooses a lexical realization for a concept, it first checks to see if the concept to be expressed is associated with a lexical entry. If so, that entry is used. If the concept does not have the appropriate lexical associations, the algorithm generates a phrase with a more general head term and restrictive modifiers. It does this by using the conceptual network to compute a semantically appropriate head term, and then modifying the request for generation by adding restrictions that differentiate the concept associated with the head term from the concept initially requested. Similarly, the conceptual network is used to eliminate redundant modifiers by computing the information contained in a lexical item that is chosen as a head term. Here the algorithm modifies the generation request to avoid restating the extra information. This algorithm is being implemented within Penman, a computerized system for the generation of English text from statements in a first-order predicate calculus language.
