ANALISIS PEMBERLAKUAN TARIF MIKRO ANGKUTAN ANTAR KOTA TRAYEK KOTA GORONTALO PAGUAT

Analysis of the Implementation of Micro Tariffs for Inter-City Transport on the Gorontalo Paguat City Route. The aim of this research was to overcome the existence of micro drivers who charge their own transportation rates which are not in accordance with the provisions of established regulations. This article wants to look in depth at Deli Serdang Regency's policy of establishing smoking-free areas. This policy is contained in Deli Serdang Regency Regulation No. 2 of 2021 concerning non-smoking areas. The urgency of establishing this regulation is to discipline the public so that they do not smoke in random places, for example in health facilities or offices. The problems that will be studied include the extent to which it is effective in curbing the smoking habit and how acceptable it is to society because quite a few people say that smoking behavior is part of their lifestyle. The form of research is field research or field research, namely authentic data collection activities directly to the research location to see the object to be studied. In data collection techniques, researchers use observation and interviews, both methods will be straightforward in terms of extracting information. The results of this research show that the implementation and implementation of the Deli Serdang district regulations still finds several problem points and challenges, these problem points include: (1). Socialization that is not continuous, (2). Disobedient community attitude, (3). Insufficient facilities, (4). Sanctions that are not burdensome. The Deli Serdang Regency Government has made enforcement efforts, both repressive and preventive, for the community. These activities include providing education regarding the dangers posed by cigarette smoke and most importantly for the smooth running of government services by not spreading cigarette smoke to others. Apart from that, the government has also carried out monitoring and evaluation of people who violate it. Even though the overall implementation of these regulations has not been optimal, this is due to the absence of sanctions that have a deterrent effect on anyone who violates the regulations, so each of them needs strengthening.

Water Resources Management In Small Islands: A Review of Public Policy Implementation In The Development of Lekloor Reservoir, Nomaha Island

Water scarcity in small island regions, including Kisar Island in Maluku, presents a pressing issue due to inadequate water resource management. This article aims to describe a holistic approach to addressing the challenges of water resource management and water scarcity on Kisar Island, Maluku. The research methodology employed is a mixed-method approach, combining technical feasibility studies for reservoir technology, policy analysis through literature reviews, and field assessments to evaluate the topographic, hydrological, and environmental conditions of Kisar Island. In the technical context, the article analyzes reservoir technology as a solution to address water issues, supported by the topographic and hydrological characteristics of Kisar Island. Additionally, the article examines relevant public policies, such as Government Regulation No. 7 of 2013 on National Spatial Planning, Provincial Regulation No. 16 of 2013 on Provincial Spatial Planning in Maluku, and District Regulation No. 1 of 2023 on District Spatial Planning in Maluku Barat Daya. Through this review, the article highlights the crucial role of policy in establishing a supportive framework for water resource management. Furthermore, the importance of local community participation in water resource management on Kisar Island is emphasized, asserting that active engagement from the local community is key to achieving success in sustainable water management efforts.

Halal Tourism in West Sumatera: a Bibliometric Study

West sumatera is a halal tourism destination in Indonesia. It was acknowledged by Global Muslim Travel Index in 2016. All stakeholders have given more intention to this halal tourism. Beyond the strengthening district regulation on it, the studies on halal tourism in West Sumatera have been increasing every year. This study aims to map the research about halal tourism in West Sumatera. Bibliometric approach was conducted to map the different studies on this topic. By using Publich or Perish, the data were taken from Google Scholar database. Several keywords were used to do it, i.e. halal tourism in West Sumatera, Islamic tourism in West Sumatera, wisata halal di Sumatera Barat and wisata Sariah di Sumatera Barat. The metadata were described by tables and graphs. Again it is also visualized by VOSViewer to find the research cluster on the topic and trend of relationship among the keywords. The study found that the research on Islamic tourism in West Sumatera is still limited. It only found 35 journal articles or proceeding in tens of years. The theme is also limited on description of the opportunity and challenges and stakeholders perception about Islamic tourism in West Sumatera.

District Regulation Surveillance System In Framework of Creating District Autonomy

The purpose of this study is to find out district regulation surveillance system in framework of creating district autonomy. The method used in this study is qualitative method. The results obtained are repressive supervision of local regulations by authorized officials with such measures. The strong impression is no different from testing in the context of maetril testing of laws and regulations carried out by the judiciary. However, repressive supervision by authorized officials on local regulations, which is formed based on the vertical division of authority based on laws and regulations, is not only limited to the formulation in existing laws and regulations, but can develop and be expanded on the basis of government policies in granting autonomy, government policy (central), provincial and other regions in accordance with government functions placed in the government and regions. Kesimpulan yang didapatkan yaitu the supervision provisions of Regional Regulations according to the legal system in Indonesia, are known for preventive supervision and repressive supervision. Preventive supervision is temporary prevention which prevents the authority from being placed on authorized officials. Although explicitly preventive supervision is not expressly stated, it is normatively regulated in Law No. 32 of 2004 which states that local regulations must have criteria that must not conflict with public interest, other regional regulations and higher laws and regulations

The Administration of Corporate Social Responsibility in the District Regulation in Indonesia

Abstract In Indonesia, Corporate Social Responsibility (CSR) is corporate activity that is regulated by the law. By means of the Investment Law No.25 year of 2007 and the Limited Liability Company Act No. 40 year of 2007, it is regulated that every company in Indonesia is obliged to implement CSR. However, these regulations are not set technically; therefore, some local governments have made guidelines for the implementation of CSR through the District Regulations. The problems of this study are: (1) how is the CSR regulation model in the District Regulation? (2) What are the company’s attitude and the company’s request towards the CSR regulation in the District? This study uses normative law research method that examines the provisions of the law, as well as empirical legal research method that used to observe the behavior and the attitude of the government and corporate actors. This research took place in several provinces in Indonesia.The results of this research are: First, the CSR regulation in regional area is formulated based on local government authorities. The provisions of these district regulations are customized to the interests of each region, although it still normatively refers to the standard legislation. Second: The Company’s attitudes prefer the self-regulated regulations arranged by their respective companies. Additionally, the setting of CSR can make the arrangement of CSR activities in accordance with the District Government program; as a result, it can speed up the community development.

This research aims to find out how the policy implementation of Bogor District Regulation Number 19 Year 2008 on Spatial Planning in 2005-2025, due to framework of buffer zone management in Bogor, West Java. The method used is descriptive with content analysis approach in policy evaluation. Regional regulations are already set up that conservation of natural resources in Puncak Regional as buffer zone in Bogor. Implementation has been conducted from district to local goverment. Building permits were based on Zero Delta Q Policy. Ciliwung watershed should be managed based on ‘one river one management’, since it consists of several administrative areas, for the mutual benefit based on environmental factors, physical, and socio-cultural as well. There are 131,548.41 ha (44,69%) protected areas in Bogor, which is sufficient. Puncak as a buffer zone of Ciliwung requires a protected areas 11,700 ha (30%). Until 2012, the areas of forest cover in district Megamendung and Cisarua was only 2,500 ha, it means that there was a shortage area of 9,200 ha. Puncak resor in Bogor area consists of three districts, Ciawi 4744.263 ha; Megamendung 6198.029 ha; and Cisarua 7281.03 ha. To meet the needs of the protected Ciliwung watershed amounted to 30%, it would require 64% of the land each district.

People's parties are defined as activities held to commemorate important things throughout human life, either individually or in groups related to customs, culture, traditions and religion, which are held for specific purposes and involve the community environment which are held at certain times. The problem of this research is because the people of Maur Lama Village, Rupit District, North Musi Rawas Regency held a people's party according to or not with the Regional Regulation of North Musi Rawas Regency No. 17 of 2019 concerning the People's Party. In this context, the problem to be discussed is formulated as a ban on Regional Regulation of North Musi Rawas Regency No. 17 of 2019 concerning People's Parties as well as a review of Islamic criminal law regarding the prohibition of people's parties which are carried out at night in Maur Lama Village, Rupit District, North Musi Rawas Regency. This research includes empirical juridical, while the specification of this research is descriptive qualitative. The sampling used in this research is purposive sampling. This research concluded deductively. The conclusion of this study is that the prohibition of people's parties at night in Maur Lama Village, Rupit District, North Musi Rawas Regency is in accordance with the enactment of North Musi Rawas District Regulation No. 17 of 2019 concerning the People's Party. Which for violators will be subject to punishment in Article 15 Regional Regulation of North Musi Rawas Regency No. 17 of 2019 concerning the People's Party which contains "convicted with a maximum imprisonment of 3 (three) months and/or a maximum fine of Rp. 50,000,000.- (fifty million rupiah)”. So that the existence of these provisions makes citizens think twice about violating these rules. In Islamic criminal law, night party sanctions are categorized as jarimah ta'zir because people's parties in Islamic law have not been legally stipulated by Syara'. As for the night party activities, it causes more harm.

PARTISIPASI MASYARAKAT DALAM MENDUKUNG KEBIJAKAN PENGENDALIAN KEBAKARAN HUTAN DAN LAHAN DI KABUPATEN ROKAN HILIR TAHUN 2019- 2020

Community participation is a tool to obtain information about the conditions, needs, and attitudes of the local community, if they feel involved in the process of preparation and planning and democratic rights. So that community participation in forest and land fire control causes a decrease in the number of fires, although there are still fires in Rokan Hilir Regency. Then the handling of fires in Rokan Hilir Regency is carried out with the Rokan Hilir District Regulation No. 41 of 2017 concerning the implementation unit for controlling forest and land fires in Rokan Hilir Regency. And the urgency of this research is expected to provide a role model in solving the fire problem by changing the policy perspective from top down to bottom up. The purpose of this study was to determine community participation in supporting forest and land fire control policies in Rokan Hilir Regency. The theory used is based on 4 indicators of the form of community participation from Cohen and Uphoff, namely participation in decision making, participation in implementation, participation in benefit making and participation in evaluation. The research method used in this research is descriptive research method with a qualitative approach. In collecting data, the author uses interview and documentation techniques. The results of this study indicate that community participation in forest and land fire control policies in Rokan Hilir Regency has decreased the rate of forest and land fires in Rokan Hilir Regency in 2019 - 2020 in accordance with Government Regulation Number 45 of 2004 concerning forest protection so that community participation is achieved. in supporting forest and land fire control policies.

Along with the rapid development in the Ubud area, it must also be balanced with the developmentof accessibility that can support tourist comfort. Efforts made by the government such as providing centralparking and taking strict action against violators who still use the road as a parking lot in the Ubud tourismarea have also not been able to overcome this problem. The problems discussed in this study, namely: howis the gianyar district regulation number 57 of 2018 regarding management and engineering of traffic androad transportation and parking in the ubud tourism area and what are the inhibiting factors and effortsmade in the implementation of the gianyar district regulation number 57 of 2018 regarding managementand engineering of traffic and road transportation as well as parking in the tourism area of ubud. Theresearch used in this study is based on empirical juridical research which is also known as field research.The results of the research are that the implementation of the Gianyar Regional Regulation Number 57 of2018 has not gone well due to the many parking problems and the lack of parking facilities in the Ubudarea. Factors that influence the implementation of the Perbup are internal and external factors as well asthe efforts made by dividing the personnel of the Transportation Agency in Gianyar at several points in theUbud area. The suggestion submitted was the need for firmness from the Perbup implementing agency andvillage officials in the Ubud tourism area to help regulate parking.

IMPLEMENTASI KEBIJAKAN PERATURAN DAERAH PAMEKASAN NOMER 22 TAHUN 2013 TENTANG PENATAAN PASAR TRADISIONAL, PUSAT PERBELANJAAN, DAN TOKO MODERN DI PASAR KOLPAJUNG PAMEKASAN JAWA TIMUR

The purpose of this study was to find out the Implementation of District Regulation No. 22 of 2013 concerning Traditional Arrangements, Shopping Centers and Modern Stores at the Kolpajung Pamekasan Market. The method used in this research is a qualitative descriptive method, the case study of which was conducted at the Kolpajung Market, Pamekasan Regency. This research is focused on Government Policy in structuring Traditional Markets in Kolpajung Market to create a People's Market whose arrangement is in accordance with Regional Regulations. Primary data obtained by conducting interviews with four informants in accordance with the interview guide. The results of the study show that the traditional market arrangement for the Kolpajung market is still not in accordance with regional regulations, so market management is still not good enough.

Pencegahan Fraud Pengelolaan Dana Desa Dengan Akuntabilitas, Whistle Blowing, Kompetensi Aparatur Dan Pengendalian Internal

The purpose of this study was to empirically test the effect of accountability, whistleblowing, apparatus competence and the effectiveness of internal control on fraud prevention in managing village funds. The research was conducted at the Village Government in the Province of DIY. The method used in this research is mix methods. The stages of the method are 1). quantitative method by distributing questionnaires to the respondents and continued 2). qualitative method, namely by interviewing the respondents. The analysis tool for model testing uses Partial Least Square (PLS). The results of the quantitative study showed that the prevention of fraud in the management of village funds which was tested on the Village government in the DIY Province proved to be empirically positively influenced by the accountability factor while the whistleblowing factor, apparatus competence, and internal control did not positively affect it. The results of the qualitative research can be concluded from the interview process that it can be concluded that the process of planning, compiling, implementing and reporting village funds in the Village Government of the Village of Kalurahan in the Provincial Government of DIY, as a whole refers to the mechanism of provisions and rules that have been established both at the Regional Regulation level (Perda), District Regulations and Village Regulations of the Village government. The use of village funds and reporting of village funds, regular monitoring and inspection is carried out by other parties or institutions or agencies appointed by the village village administration. In preventing and overcoming fraud in the management and use of village funds, the village government cooperates with the government inspectorate to provide guidance and assistance for routine inspections from the Provincial BPK/BPKP, and Consultants.

Legal Problems in Resolving Village Official Election Conflicts for the Position of Hamlet Head in Aursati Village, Tambang Sub-district


 
 
 
 The village official election for the position of hamlet head in Aursati Village in 2022 has led to a prolonged conflict between the village government and the candidate for hamlet head who got the highest score. This study aims to identify the resolution of village official conflicts in Aursati Village, Tambang Sub-district. This descriptive qualitative study used the statue approach and conceptual approach. Results: First, the process of selecting a candidate for hamlet heads in Aursati Village caused conflict in which the village head of Aursati issued a decree for appointing and inaugurating a hamlet head with a lower score. This resulted in the loss of the hamlet head candidate who got the highest score. Participants who get the highest score felt disadvantaged because their rights were taken away for subjective reasons that could not be proven. Thus, this case was handled legally by filing a complaint to the Pekanbaru Administrative Court. Second, the appointment and dismissal of village officials have been regulated in the Kampar District Regulation Number 12 of 2017, but there were still shortcomings and weaknesses as it has not covered the resolution of conflicts arising from the results of the village official election for the position of hamlet head.

While the data collection techniques used in this study consisted of interviews, observation and documentation and data analysis techniques using qualitative descriptive techniques. The results of this study state that the role of DLHK Padang Lawas Regency in implementing article 21 of Regional Regulation of Padang Lawas Regency Number 02 of 2014 concerning Trash Cans has not been implemented effectively. Because the socialization that has been carried out has not been evenly distributed and the distribution of trash cans that are not on target. Then from a review of siyasa dusturiyah studies. The role of DLHK in implementing Article 21 of Regional Regulation Number 2 of 2014 has not been implemented properly.

Pandumaan-Sipituhuta Community Movement Action in Defense of Customary Forest Land Taking

The Pandumaan-Sipituhuta indigenous peoples' social movements and disputes in defending their customary forest rights were impacted by the government's lack of transparency in identifying and determining concession rights, which resulted in a unilateral claim to the community's customary forest. This is the context for the Pandumaan-Sipituhuta indigenous community's social movement, which began in 2009, to achieve recognition and reclaim rights to their customary forest. A qualitative research method with descriptive-qualitative analysis was adopted. According to the study's findings, the community used a variety of techniques in their social movements, including warning letters, confiscation and burning of company equipment, rallies, and road closures. In addition to carrying out their movement actions, the community holds frequent deliberations in which all levels of society are involved to facilitate decision-making in their movement actions. Conflicts and obstacles confronting the community include the government's tardy response, which results in the community taking a long time to attain success. Finally, in February 2022, the community was legally recognized as a customary law community by the Humbang Hasundutan District Regulation Number 3 of 2019, and their rights to their customary forest were restored.

Standard Patterns of Considerations in Law, District Regulation and Qanun Based on Legal Rules in Indonesia

The consequence of the state of the law is legislation to be an essential instrument in regulating public life. However, in some parts of Indonesia, they can make their regional regulation slightly different from the constitution, wherein this article will focus on Qanun in Aceh Province. The research used in this paper is normative law research. This research used sequential data or library data. Secondary data consists of primary law materials, secondary law materials, and tertiary law materials. The approach method used is the legislative approach and the conceptual approach. The formulation of the problem in this paper is how the standard pattern of consideration in the Law, Regional Regulations, and Qanun is based on legislation. The results show that in the Law in Consideration, Consider using the word "membentuk" or "form" because the law-making institution consists of legislative institutions and executive institutions. Regional regulation considers using the word "menetapkan" or "establish" because the institution that makes local regulations is a local government consisting of elements of local governments and local people's representative councils. This consideration follows Annex II of Law Number 12 of 2011 on the Establishment of Legislation as amended by Law Number 15 of 2019. However, the Qanun used the word "membentuk" or "form" due following Article 233 paragraph (1) of Law Number 11 the Year 2006 on Aceh Governance and Annex II of Aceh Qanun Number 5 of 2011 on the Procedures for the Establishment of Qanun.

Regulations matter: their effects on actors of the nonindustrial timber value chain in the Southern Highlands of Tanzania

In recent years, non-industrial private forestry (NIPF) for timber production has gained economic importance in the Southern Highlands of Tanzania. Access to benefits accrued from NIPF represents an opportunity for poverty alleviation. Access and distribution of the benefits are affected by governance, which is an important aspect in this regard. This paper focuses on state regulations, which in the context of Africa and Tanzania in particular, have received scant attention in the value chain studies. The paper seeks to respond to three main questions: i) How is the timber value chain regulated? (ii) What strategies do the value chain actors use to gain access to benefits? And iii) how do regulations affect the incomes of the chain actors? Data for the study were collected from Njombe District through documentary analysis, focus group discussions, observations and in-depth interviews with key informants. The study findings show that while the government is the sole regulator of the chain, regulations are implemented differently at the sub-national level. Industrial and non-industrial private forestry are placed under the same regulatory framework despite their many differences. This has partly resulted in high transaction costs, which are unaffordable by the majority of actors in the NIPF value chain. Despite strict regulations and many taxes paid, the actors adopt different strategies such as using locally available materials and capitalizing on social networks in maximizing their incomes from the timber business. The regulations affect incomes of all actors, however, tree growers are the most-affected category. This is because tree growers possess limited capital to engage in high value chain activities and strict regulations aggravate the situation. The paper concludes that the contribution of non-industrial private forestry to poverty alleviation is stifled by cumbersome district and state regulations that limit actors' access to profitable markets.

SMOKE FREE AREA (SFA) DISTRICT REGULATION SUPPORT FOR ESTABLISHMENT OF A CHILD FRIENDLY SCHOOL (CFS) IN KULON PROGO DISTRICT

ABSTRACTFollowing the Child-Friendly School (CFS) Guidelines made by the Deputy for Child Development, Ministry of Women Empowerment and Child Protection (2015), one of the components that must be fulfilled is a commitment to make schools a Smoke-Free Area (SFA). Kulon Progo has District Regulation No. 5 of 2014 concerning SFA, thus it can be used as a commitment by a school guide, making it an SFA. The results of interviews with the District Social Service for Women's Empowerment and Child Protection Office stated that CFS currently remains at the initiation stage. Efforts should be made to create comfortable learning conditions for children with the support of the SFA District Regulation in the formation of CFS in Kulon Progo Regency. Analysis of the implementation monitoring checklist/compliance with District Regulation No. 5/2014 concerning SFA in 2020 which is carried out by the SFA supervision task force. Descriptive analysis method by looking at trends based on the proportion of the 10 variables used. The results of the data study show that 89.5% have been exposed to the socialization of District Regulations, 52.6% have a supervisory task force, 86.8% have installed SFA signs at the Entrance, 100% have a smoking ban warning installed, 23.7% has a place specifically for smoking, 10.5% found an ashtray in the building, 7.9% found cigarette butts, 2.6% found cigarette advertisements, 5.3% found cigarette sellers, 7.9% smoked people. From the data analysis, it is known that 81.58% have complied with SFA. However, this compliance is not optimal. This is indicated by the high percentage of availability of designated smoking areas in schools and ashtrays, cigarette butts, cigarette advertisements, cigarette sellers, and smoking people found. Schools should have a zero percentage in these variables; thus, they are not fully committed as a condition for the formation of CFS. It is necessary to optimize the application of District Regulations to create a smoke-free school environment as evidenced by not providing smoking places in schools, not allowing cigarette advertisements, smoking outside, and imposing sanctions for non-smoking violators in the school environment.
