One Culture, Two Legal Regimes: Abortion in China and Taiwan

Abstract China and Taiwan share the same traditional culture that prefers son over daughter, and both of their sex ratios at birth exceeds the natural ratio. Studies believe that this is mainly the result of induced abortion and prenatal sex-identification techniques. However, China and Taiwan actually have very different legal regime when regulating abortion. Abortion is legal in China but is a crime in Taiwan. Yet, free from China’s one-child policy women’s reproductive freedom and fetus life are better protected in Taiwan. This country report introduces their different legal regime on abortion and explains how it affects women’s right and fetus’ life.

Immigrant crime in Taiwan: perspectives from Eastern Asia

Unmet needs and service satisfaction of victim support for the direct and indirect victims of serious violence: Results from a cross-sectional survey in Taiwan.

Victim support services, in mature societies, aim to help victims recover after suffering a traumatic event. The effectiveness of victim support has traditionally been evaluated through rates of service utilization and incidence of psychopathology such as posttraumatic stress disorder. The current study, instead, inquires into service users’ unmet needs and satisfaction, and identifies factors that mediate such subjective measures, using data from a national cross-sectional survey on victims and surviving families of violent crime in Taiwan in 2011. The results reveal: 1) a gap between available and expected services, and 2) a correlation between service utilization and satisfaction, both consistent with previous studies. In addition, the current study identifies unsatisfied service users: They are homicidally bereaved, live with their spouse, suffer from post-crime financial distress and are still waiting for a court verdict on the incident. Victim support that helps victims heal through tailored services incorporating relationship counseling is proposed.

Investigating causality among unemployment, income and crime in Taiwan: evidence from the bounds test approach

This paper examines the long-run and causal relationships among unemployment, income and crime in Taiwan. The results clearly indicate that there is a long-run level equilibrium relationship among unemployment, income and total crime. There are also long-run relationships among unemployment, income and theft and among unemployment, income and economic fraud. The causality test results from the ECM-VAR and level VAR models indicate that there is a neutral relationship among unemployment, income and total crime, and a neutral relationship among unemployment, income and all three categories of crime. It is concluded that there is no strong evidence in favor of the unemployment-led crime (ULC) or the crime-led unemployment (CLU) hypotheses in Taiwan.

Causal Factors of Corporate Crime in Taiwan: Qualitative and Quantitative Findings

Street crimes are a primary concern of most criminologists in Taiwan. In recent years, however, crimes committed by corporations have increased greatly in this country. Employing the empirical approach to collect data about causal factors of corporate crime, the research presented in this article is the first systematic empirical study concerning corporate crime in Taiwan. The research sample was selected from a corporation with a criminal record of pollution caused by the release of toxic chemicals into the environment and a corporation with no criminal record. Questionnaire survey and interviews of corporate employees and managers were conducted, and secondary data were collected from official agencies. This research indicated the causal factors of corporate crime as follows: the failure of government regulation, lack of corporate self-regulation, lack of public concern about corporate crime, corporate mechanistic structure, and the low self-control tendency of corporate managers.

Judicial Sentencing Decisions in Taiwanese Economic Crimes: Consequences of Swift Justice

This study examines the effect of case-processing time on judicial sentencing decisions of economic crime in Taiwan. Studies have been conducted with cases involving misdemeanors and felony homicide, but not with serious economic offenses committed in countries outside of North America. As economic crime becomes increasingly an international problem, research from other countries will be more important. The hypotheses considered were as follows: as the time between the decision to prosecute and the judicial sentencing outcome decreases, both the likelihood of being sent to prison and the likelihood of receiving a longer prison sentence increases. Our findings indicated that case-processing time is not only an indicator of offense severity but also a factor in judicial sentencing decisions.

Ethnicity, Crime, and Immigration

Members of some disadvantaged minority groups in every Western country are disproportionately likely to be arrested, convicted, and imprisoned for violent, property, and drug crimes. This is true whether the minority groups are members of different "racial" groups from the majority population, for example, blacks or Afro-Caribbeans in Canada, England, or the United States, or of different ethnic backgrounds, for example, North African Arabs in France or the Netherlands, orirrespective of race or ethnicity-are recent migrants from other countries, for example, Yugoslavs or Eastern Europeans in Germany and Finns in Sweden. Important social policy dilemmas that are seen in individual countries to be uniquely their own, such as race relations in the United States or assimilation of Maghreb-derived guest workers in France or the experience of Aborigines in Australia, are not unique at all but are instead variations on common themes of social structure

Drug crime in Taiwan: A time‐series analysis from 1965 to 1994

This article examines patterns and structural correlates of drug crime in postwar Taiwan, finding that drug arrest rates in Taiwan are extremely low compared with those in the United States. The results show that heroin accounts for most of the drug seizures in Taiwan. Moreover, a typical drug offender in Taiwan tends to be an unemployed or blue‐collar employed male under 40 years old with at least a junior high school education. Using multiple regression techniques, the article reports that the gini coefficient and the strength of law enforcement significantly contribute to the explanation of drug crime in Taiwan. These results support the economic inequality and crime industry perspectives that claim that inequalities in income, property, and power relationships are key to understanding the production of drug crime in Taiwan.

Correlates of crime in Taiwan

Taiwan is known for rapid economic growth, but in 1988, the government ended 40 years of martial law, resulting in greater political and social freedoms. This paper explores the influence of economic, social, and political structures on crime in the Republic of China on Taiwan. A time series analysis examines the structural correlates of crime in Taiwan from 1964 to 1990. Both total crime and burglary/larceny rates are regressed on seven independent variables derived from various theoretical perspectives. The results support Hagan's power-control and Christie's crime-industry perspectives for total crime, while measures assessing lack of economic means and the economic deprivation were significant for burglary/larceny.
