The aim of this research is to find out more clearly and in depth about legal certainty regarding Druwe Pura land through complete systematic land registration (PTSL). This research is a type of normative legal research (doctrinal legal research). Article 19 of the Basic Agrarian Law states that in order to ensure legal certainty that the Government will carry out land registration throughout the territory of the Republic of Indonesia, the National Land Agency as the implementer of duties in the agrarian sector in Indonesia is obliged to serve the needs of the people who wish to register their land. To implement the order contained in Article 19, Government Regulation Number 24 of 1997 concerning Land Registration was issued. Parisada Hindu Dharma Indonesia (PHDI) has made a Memorandum of Understanding with the National Land Agency (BPN) Number: 189/PH.PHDI.Pusat/V/2023; Number: 20/SKB-HK.03.01/V/2023 concerning Implementation of Land Registration, Assistance for Prevention and Handling of Land Asset Problems under the auspices of Parisada Hindu Dharma Indonesia. The implementation of this Memorandum of Understanding is further regulated in the Cooperation Agreement between Parisada Hindu Dharma Indonesia and the National Land Agency (BPN), with Number: 269/PH.PHDI.Pusat/II/2024; Number: 4/SKB-100. To achieve nationwide land registration in Indonesia, despite regulatory support, systematic challenges persist in expediting the process known as Complete Systematic Land Registration (PTSL). These hurdles may impede the fulfillment of the mandate outlined in Article 19(1) of Law No. 5 of 1960. The research conducted is of a normative legal nature, focusing on legal norms, aligning with Peter Mahmud Marzuki's definition of legal research as inherently normative. The findings on Complete Systematic Land Registration in the Tapin Regency Land Office Area indicate that unregistered land owners face uncertainty and lack legal protection until their land is officially registered. Although Indonesia's land registration publication system allows for objections or lawsuits, legal certainty and protection are only guaranteed post-registration. The government aims to enhance certainty and protection through the PTSL program, emphasizing the importance of land certificates. However, despite serving as legal evidence of ownership, these certificates are not absolute in legal proceedings and can be subject to civil, criminal, or administrative challenges due to Indonesia's adversarial land registration system.

Service Performance Level in Land Registration in Ecological Farming Area

This research aims to determine the influence of the level of satisfaction and trust of the community on service performance (case study of the Complete Systematic Land Program Secretariat Office in Sumberbendo Village). The influence you want to know is direct or indirect influence. This type of research is quantitative which explains the causal relationship between variables through hypothesis testing. This research used a sample of 100 respondents. Sampling used the Saturated Sampling Method technique, with the characteristics of the Community Participating in the Complete Systematic Land Registration program in Sumberbendo Village. The test equipment used was data reliability and reliability testing. From the results of this test it can be concluded that Community Satisfaction and Community Trust have a significant influence on Service Performance.

Juridical Analysis of Communities' Rejection on Community Participation Complete Systematic Land Registration Program (PTSL-PM)

The PTSL-PM program aims to register land so that it can provide guarantees of legal certainty and rights to a land owned by the community, while its implementation cannot be separated from obstacles. One of them happened in Mundu Pesisir Village where some people rejected the PTSL-PM program. The purpose of writing this journal is to find out the reasons for the rejection of some Mundu Pesisir Village Communities against the government program, namely a complete systematic land registration program, The research method used by the author is empirical juridical through interviews and observations, based on the results that the authors get is the internal condition of their own families who are confused about ownership of inheritance land certificates that are prone to causing conflicts between families. This resulted in some family members being reluctant to implement the program because they were worried that it would cause jealousy among them regarding the name that would be included in the land certificate that could be misused in the future, causing conflicts over land disputes within the family.

ANALYSIS OF PARTIAL COMMUNITY REJECTION OF THE COMPLETE SYSTEMATIC LAND REGISTRATION PROGRAM WITH COMMUNITY PARTICIPATION (PTSL-PM)

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency has created a national priority program called the Accelerated Complete Systematic Land Registration (PTSL) as regulated in Ministerial Regulation ATR/BPN No. 6 of 2018. The PTSL program will be implemented throughout the Republic of Indonesia with the aim of accelerating the provision of legal certainty to all land rights holders, thereby helping to prevent land disputes in the community. The research contribution is the identification and analysis of the reasons why some members of the Mundu Pesisir Village community reject the PTFL-PM program. The study found that the response of the community to the program was very positive. However, there are internal family barriers to its implementation. Strategies of the Cirebon Regency Land Office and the Land Data Collector at the Land Office to Ensure the Proper Implementation of the Program are discussed.

ANALISIS HUKUM PENDAFTARAN TANAH TERHADAP TANAH KOMUNAL

Customary land rights are the highest form of land ownership under customary law, encompassing all land within a specific customary legal jurisdiction, jointly held by members of the indigenous community. The purpose of this research is to find a model for registering communal land in the land registration system and to determine the legal status of communal land in the land registration system. The research methodology used in this study is normative legal research, employing various approaches such as statutory approach and conceptual approach. The legal sources used include primary legal materials, secondary legal materials, and tertiary legal materials. The research findings indicate that the registration of communal land in the land registration system, both de facto and de jure, has been recognized and protected through two regulations that acknowledge the existence of communal land, namely Ministerial Regulation No. 10 of 2016 and the Complete Systematic Land Registration (PTSL) program. Essentially, communal land controlled by indigenous communities will be acknowledged through a decree issued by the regent/mayor/governor for the registered communal land at the local National Land Agency (BPN) office. However, the legal status of communal land in the Land Registration System shows that communal land is not included in the rights to land as regulated in Government Regulation No. 24 of 1997 concerning land registration. Therefore, a revision of the land registration regulation is necessary to ensure the legal certainty of communal land controlled by indigenous communities

Analisis Kebijakan Pendaftaran Tanah Sistematis Lengkap dan Implikasinya terhadap Pembangunan Berkelanjutan di Kota Baubau

This study aims to examine the Complete Systematic Land Registration (CSLR) policy in Baubau City and its impact on sustainable development. This study used qualitative methods by using interviews, document analysis, and field observations to collect data. A sample of respondents consisting of government officials, community members, and community leaders was selected by purposive sampling. Based on the analysis conducted, this study concludes that the successful implementation of CSLR policies in Baubau City has significant implications for sustainable development, including inclusive economic growth, social stability, and increased community participation in the regional development process. Understanding the dynamics of this policy can assist the government and stakeholders in implementing appropriate measures to ensure its sustainable benefits to the people and environment in the city. This research makes a significant contribution to the field of public policy and sustainable development by increasing understanding of policy effectiveness approaches in the context of land registration policies at the local level. This research also provides insight into the factors that influence the successful implementation of CSLR policies. However, this study on CSLR policy and sustainable development in Baubau City has some limitations. The study focuses only on policy aspects without considering the perspectives of local communities, who have unique knowledge and experience and can provide valuable insights into policy implications. Therefore, future research needs to expand the scope of analysis to include policy results, implementation processes, and constraints faced by policy implementers and the public.

PELAKSANAAN PROGRAM PENDAFTARAN TANAH SISTEMATIS LENGKAP (PTSL) DI KANTOR BPN KAB. PROBOLINGGO

Abstract
 
 The land registration program through complete systematic land registration (PTSL) which targets land registration throughout Indonesia is expected to be completed in 2025. This is the first land registration activity to be carried out simultaneously. How is it implemented and what obstacles are faced by BPN Kab. Probolinggo in implementing the PTSL program. Apart from that, this research also aims to identify steps that can be taken to overcome these obstacles and increase the efficiency of PTSL implementation. This research uses an empirical juridical approach. Data was obtained through field case studies, literature and policy analysis relevant to the PTSL Program. This research found that PTSL has an important role in providing legal certainty and protection of land rights in Indonesia. However, obstacles faced include limited human resources, geographic challenges, and administrative complexity. To overcome this, it is necessary to increase recruitment and training of human resources, use of information technology, collaboration between related parties, and a holistic, technology-based approach. By overcoming these obstacles, PTSL can be implemented more efficiently and provide greater benefits in providing legal certainty and protection of land rights in Indonesia.

Pengaturan BPHTB Terutang dalam Penyelenggaraan Program Pendaftaran Tanah Sistematik Lengkap (PTSL)

This paper aims to review the legal certainty of the regulation outstanding land and building rights “perolehan hak atas tanah dan bangunan” (BPHTB) in the implementation of complete systematic land registration “pendaftaran tanah sistematik lengkap” (PTSL). This study uses normative research with legal approach that related regulation land registration. The problems in this study are in the presence the norm conflicts between article 33 point 1 and 2 “ Peraturan Menteri Agraria dan Tata Ruang Nomor 6 Tahun 2018” about complete systematic land registration that holders of land rights from PTSL have the obligation to pay BPHTB that contrary to article 3 “Undang undang Nomor 20 tahun 2000” about the Duty to Obtain Land and Building Rights which states that government programs for development are not objects of BPHTB.

Implementasi Pendaftaran Tanah Sistematis Lengkap (PTSL) sebagai Perwujudan Kebijakan Publik di Kota Surabaya

The Complete Systematic Land Registration Program (PTSL) aims to accelerate the process of registering land parcels throughout the territory of the Republic of Indonesia. This is also applied by Dr. Kelurahan. Soetomo City of Surabaya. The purpose of this research is to explore the implementation of the PTSL policy in Dr. Soetomo City of Surabaya, taking into account the theory of public policy implementation according to George C. Edward III, there are 4 (four) indicators, namely communication, resources, dispositions, and bureaucratic structure. This research method is to apply a type of qualitative approach. Data comes from both primary and secondary. Data collection was carried out by interviews, observation, documentation, and data trackingonline. Data analysis was carried out using reduction, triangulation, and concluding as well as verification methods. The results of the study show that communication in the PTSL program has not been realized properly, as a result of the socialization delivery that has not been maximized. The resources in the PTSL program have been maximally realized, starting from people, budget, as well as facilities and infrastructure. Disposition has also been maximized, with good employee attitudes. The bureaucratic structure is good with a neat flow, but it is not strong enough because some employees are not placed according to their expertise. Implementation of PTSL policy in Kelurahan Dr. Soetomo City of Surabaya has thus been implemented well, but not optimally. due to communication factors and bureaucratic structures that are not running according to goals and plans.

Effectiveness of Complete Systematic Land Registration (PTSL) Services in the Sinjai District Land Office

The Ministry of Agrarian Affairs and Spatial Planning/National Land Agency has implemented the Acceleration of Complete Systematic Land Registration (PTSL) policy to reduce disputes and ensure legal certainty for land owners. This research aims to evaluate the effectiveness of PTSL services carried out by the Sinjai Regency Land Office. This research use desciptive qualitative approach. The data collection procedure involved observation, interviews, and documentation, with research subjects involving the Chair of the PTSL Adjudication Committee, Deputy Chair of the PTSL Jurisdiction Division, and program beneficiaries in Sinjai Regency. The research results show that PTSL services in Sinjai Regency have proven to be effective in terms of understanding the program, being on target and achieving goals. Even though there is an understanding of duties and responsibilities, as well as public awareness of the objectives and stages of PTSL, there are still obstacles in meeting indicators on time. Although most of the program targets have been achieved, some targets remain unfulfilled. The indicators for achieving the program objectives are quite effective, this is because the implementation of the PTSL program in Sinjai Regency is in accordance with the objectives of the PTSL program, namely that all land plots in the territory of the Republic of Indonesia have been mapped, but have not yet been mapped and are able to achieve the specified targets. Indicators of real change are effective because with the PTSL program, people can have ownership certificates in an easy and fast process.

Accelerating Waqf Land Certification Problem and Solution through the Complete Systematic Land Registration Program (PTSL)

This paper examines the issues with a comprehensive systematic land registration (PTSL) program's goal of expediting the certification of waqf land. This article focuses on the maintenance of waqf through the waqf certification program. Waqf assets can be preserved by registering waqf land and providing proof in the form of a waqf certificate. Due to their legal standing and ability to settle disputes, the nazhir (managers) and the waqifs (those who contribute land) will feel secure. A government invention to expedite the certification of freehold land, including waqf land, is the PTSL. The program is still in its infancy, thus there are still several issues that pose difficulties and barriers. collaboration and synchronization with other parties. This study uses qualitative techniques and primary data sources, including interviews and direct observation. In addition, literature sources on waqf from regulations, articles and other research become secondary sources. The data that has been collected is analyzed using descriptive analysis techniques. The study's findings revealed, among other things, that the PTSL approach is particularly effective in speeding waqf land certification. Second, there is still a lack of coordination between the Ministry of Religion, BWI, and other organizations, as well as the Agrarian Spatial Planning Office/National Land Agency.

Pengukuran Dan Pemetaan Fotogrametris Menggunakan Unmaned Aerial Vehicle (UAV) Di Kota Samarinda Kelurahan Sungai Pinang Dalam

Soil plays an important role for all living things, where soil is a source of livelihood. It acts as a planting medium, a water reservoir, and a place for us to do activities. All of these activities are carried out on the land (Natasha Hutabarat et al., n.d.). In the community itself, land ownership is always a problem that is often encountered, whether it is the problem of unfixed land boundaries, land tenure, and land grabbing. The National Land Agency (BPN) as the institution that organizes land registration has a Complete Systematic Land Registration (PTSL) program that makes it easier for the community to register land so as to avoid land conflicts. In order to accelerate land registration, PTSL in Samarinda City this time uses media or tools to take measurements using the photogrammetric method, namely the Unmanned Aerial Vehicle (UAV) to obtain aerial images or the latest images. In its implementation, the community is asked to install boundary signs that have been delivered or socialized by BPN employees. So that the boundaries of the land plot can be seen from the UAV and visible from aerial images

Keabsahan Penerbitan Sertipikat Tanah Hak Milik Kepada Anak Dibawah Umur

This research aims to analyze property rights certificates issued by the land office based on land law. The land office will issue title certificates number 571 and 671 to minors. Issuance of property rights certificates is carried out in the Complete Systematic Land Registration program, where the applicant is a minor without attaching a guardianship determination letter from the court. This creates legal uncertainty because one of the requirements for carrying out legal actions is being legally competent (adult). Adulthood in the Civil Code is twenty-one years. This research uses normative legal methods to analyze land registration regulations and maturity as well. As a result of the research, the author obtained the result that the issuance of land certificates to minors by the Bojonegoro land office must be considered valid before there is another decision stating otherwise. However, from a procedural perspective, it is not in accordance with statutory regulations and AUPB principles, namely the principle of legal certainty and the principle of accuracy. The legal consequence of issuing a certificate of ownership to a minor by the Bojonegoro land office is that the certificate is valid and valid.

PENDAFTARAN TANAH SISTEMATIS LENGKAP (PTSL) BERDASARKAN PERATURAN MENTERI AGRARIA DAN TATA RUANG/KEPALA BADAN PERTANAHAN NASIONAL REPUBLIK INDONESIA NOMOR 35 TAHUN 2016 DI WILAYAH LOMBOK TIMUR

Most of the land parcels in East Lombok Regency have not been registered, the basis of rights used by land rights holders as proof of land ownership is only in the form of continuous and hereditary. Therefore, it is necessary to formulate a problem, namely how to implement a complete systematic land registration in East Lombok Regency. The research method used is empirical law with three approaches, namely: statutory approach, conceptual approach and sociological approach. In its implementation, the Complete Systematic Land Registration (PTSL) program in Selong District, East Lombok Regency refers to the provisions in PERKABAN Number 1 of 2017 concerning Amendments to PERKABAN Number 35 of 2016 concerning the Acceleration of the Implementation of Complete Systematic Land Registration and PERKABAN Number 37 / Kep-7.1 / I / 2017 concerning Technical Guidelines for Complete Systematic Land Registration where there are several stages in the implementation of the PTSL starting from Preparation (socialization, location determination, manpower planning and formation of an accelerated adjudication committee, training), counseling, juridical data collection, juridical data processing and proof of rights, land inspection, announcement, ratification, issuance of rights determination decrees and rights affirmation/recognition decisions, rights bookkeeping, issuance and submission of certificates, management of warrants/documents and reporting.

Implementation of Community-Based Surveying and Mapping of Land Parcels through Field Work Practice to Support Complete Systematic Land Registration (PTSL)

Cadastral surveying and mapping field work practice is an activity for National Land Collage (STPN) as one of the units under the Ministry of ATR/BPN to develop innovation that can be used as a basis for recommendations for the success of Complete Systematic Land Registration (PTSL). In the year of 2021, the Diploma I of Cadastral Surveying and Mapping Program carried out field work practice of cadastral surveying and mapping in Pagerharjo Village. This field work practice was designed by optimizing the Fit for Purpose Land Administration (FFP-LA) approach to accelerate the land parcel surveying and mapping process. The method used in the research underlying this article is a qualitative method to find out the extent to which the FFP concept can be implemented in land registration of Indonesia during the field work practice. The result of the field work practice shows several factors that determine the success of the land parcels surveying and mapping based on FFP-LA concepts, including the requirements of open areas for implementing photogrammetry-based measurements, the need of easily identified boundaries marker on Photo Map, the awareness of protecting property by the land owners, and the strength of legal guarantees based on the accuracy of measurements.
