The Empty Promise of Compassionate Conservatism: A Reply to Judge Wilkinson

CONSERVATIVE jurisprudence is in the midst of an identity crisis. After having been relegated to the sidelines during the Warren and early Burger Court eras, conservative jurists have solidified their control of the federal courts. In exercising this newfound power, however, conservatives have faced significant challenges created by their dominance. They have learned the agonizing lesson that it is far easier to criticize from the outside than it is to rule. Doctrines and principles that can be purely espoused when one is out of power are harder to maintain after one takes the reins of control. Adhering to long-standing doctrines and principles is particularly troublesome when those tenets limit the authority of those in control. Doctrines and principles are far less attractive when they serve to limit one's own authority than when they limit the power of one's ideological opponents. This dilemma has been particularly problematic for conservatives because for many years the centerpiece of their jurisprudential agenda was the call for judicial restraint. Conservatives consistently condemned as judicial activism judicial decisions that overturned the actions of elected officials.' Greater deference to popularly enacted provisions, conservatives claimed, was necessary to the rule of law.2 Things have changed. George W. Bush's War on Terrorism and Sin

In George W. Bush's inaugural address, informed by ‘compassionate conservatism’, there was a tension between two familiar goals in US political discourse: conserving the status quo and changing the world for the better by cleansing it of sin. In Bush's discursive construction of the war on terrorism, ‘compassionate conservatism’ and the construction of sin were folded into a unified discourse, with the emphasis on preventing dangerous change rather than creating positive change. A static state of safety, constantly protected by ‘compassionate conservatism’ and war, is now offered by American conservatives as the most viable and most patriotic way to stave off the forces of sin.

The Empty Promise of Compassionate Conservatism: A Reply to Judge Wilkinson

In his recently essay, Why Conservative Jurisprudence Is Compassionate, Judge J. Harvie Wilkinson's defends conservative jurisprudence against a claim that he believes unfairly derogates the normative attractiveness of conservative jurisprudence - specifically that conservative jurisprudence lacks compassion. To Judge Wilkinson, conservative jurisprudence, properly understood, can more than hold [its] against its liberal counterpart in the compassion debate. This essay responds to Judge Wilkinson's thesis. It first articulates the arguments advanced by Judge Wilkinson in support of his thesis but then suggests that even if his contentions hold some resonance, they still fall short of the goal of defending contemporary conservative jurisprudence as compassionate. To begin with, Judge Wilkinson's arguments are essentially only negative points about the purported over-use of compassion in liberal jurisprudence; they are not positive propositions suggesting that conservatism has its own unique vision or understanding of compassion. Moreover, Judge Wilkinson's attempt to defend conservative jurisprudence is misplaced because the conservatism he describes is not contemporary conservative jurisprudence. Rather contemporary conservative jurisprudence, in order to achieve its desired results, is marked with the exact same jurisprudential deficiencies that Judge Wilkinson condemns in liberal jurisprudence. Finally, Judge Wilkinson's attempt to defend contemporary conservative thought against liberal attack is misdirected because the liberal/conservative dichotomy he describes is not the primary line that currently divides the conservative and liberal camps. The division is not between a jurisprudence that inappropriately responds to individual poignancies and one that relies on sharp lines and collective concerns. Rather the essential division is between a liberal jurisprudence geared to protecting the marginalized groups in society versus a conservative jurisprudence that tends to reinforce the existing powers of dominant groups. As this essay demonstrates, conservatives have taken their role in protecting entrenched interests quite seriously. They have expanded the constitutional rights of already powerful interests. They have opposed liberal attempts to increase the constitutional protections accorded marginalized groups. They have invalidated legislative attempts that would reduce the disparities between the powerful and the marginalized in the political marketplace. They have consistently resisted both constitutional and legislative attempts to increase the access of disadvantaged litigants to courts of justice. Accordingly, the essay contends that the claim that such a jurisprudence is compassionate is difficult to sustain.

The Price of Citizenship: Redefining the American Welfare State

From earliest poor laws to the of welfare as we know it, definitive examination of question underlying all political debate in America: What does government owe individual? Compassionate Utilitarianism: The Unknown Bentham Revealed

Unlike the compassionate conservatism of George Bush, Compassionate Utilitarianism is not a confusing concept. Nor is it a newly minted version of Utilitarianism given that it is embedded in the writings of Jeremy Bentham, writings that have come to light only with the Oxford University Press publication of his Deontology in 1983 as edited by me. Bentham's An Introduction to the Principles of Morals and Legislation (IPML) expresses the standard interpretation of Hedonistic Utilitarianism. What he said in Deontology serves as the basis of Compassionate Utilitarianism.

A New Message: Compassionate Conservatism, African Americans, and the Republican Party

In 1997 and 1998, several Republican gubernatorial candidates in the South put forth a new message of “compassionate conservatism” on the campaign trail. This paper examines two of those campaigns in great detail by using interviews with political actors and analysis, content analysis of the states newspapers, and exit poll data. I show how two Republicans have attempted to win Black support: by building a relationship of trust in the Black community, stressing their religious background, and proposing a few programs that would provide African Americans some economic support. While the majority of African Americans are likely to continue voting for Democrats, Republicans do have the potential to significantly alter Democratic coalitions. I conclude that Republican appeals to Black voters will force Democrats to pay greater attention to African Americans which, in turn, will make the parties more responsive to Blacks.

Bush: The Sequel

This article examines the likely foreign policy initiatives of the U.S. under the leadership of George W. Bush. The new president has outlined a fairly thorough critique of America's international behavior in the 1990s. Because a leader's public statements arguably serve to persuade various audiences and to build support for policy change, the article takes Bush's words quite seriously—along with those spoken or written by his closest foreign affairs advisors. Bush intends to abandon the so-called Clinton Doctrine and deploy national missile defenses. He is critical of American policies toward China and Russia, but has not presented bold new initiatives toward those powers. Under the rubric of “compassionate conservatism,” Bush may alter U.S. relations toward the Global South in some interesting ways. The president and his advisors often purport to be realists, but the article demonstrates that their own words belie this claim as they often justify policies based on ideals rather than the pursuit of power.
