К вопросу о классификации абсолютных правоотношений

Absolute legal relations as a conflict of laws phenomenon require in-depth analysis and classification in order to ensure the most effective state of their protection. In the present article, the author raises the question of the general orientation of absolute legal relations, as well as the possibility of their differentiation into general and specific ones. The author examines their classification types depending on their belonging to private or public law; depending on the specifics of the object and its influence on the dynamic and static components of absolute legal relations; depending on the branch of law; depending on the purity of the nature of the absolute legal relations themselves. The author also analyzes the expediency of identifying quasi-absolute legal relations. The importance of resolving the issue of the correct classification of absolute legal relations is dictated by its influence on the degree of legality and guarantee of the process of realization of absolute and inalienable rights of the individual.

CRITERIA FOR THE CLASSIFICATION OF CIVIL ORGANIZATIONAL AND LEGAL COMMUNICATIONS

In this article, the author expresses his attitude towards the criteria and classification proposed by the lawyer scientists in relation to the classification of organizational and legal relations, concludes that it is necessary to introduce special norms in civil law for civil organizational and legal relations, in case of analyzing the expediency of defining the purpose of the appointment of these relations. He also put forward proposals and recommendations that organizational and legal relations can be divided into relations (initial), relations of carrying out activities of Legal Entities (corporate), relations related to property management (management of civil legal activities), which constitute legal relations and provide a legal basis for carrying out certain activities.

Types of notarial procedural relations (on the example of using general theoretical classifications of legal relations)

The types of notarial procedural legal relations are researched. Approaches of scientists to determination of kinds of notarial proceduralrelations are worked out.Applying the method of classification, which consists in the division of notarial procedural legal relations into types dependingon their individual features, the author identifies features that can not be explored through other methods of scientific knowledge. Theclassification of notarial procedural legal relations can be carried out both on the general criteria characteristic of the classification of all legal relations and on the criteria used in the classification of procedural legal relations or those criteria that may be inherent onlyin classifications of notarial procedural legal relations.In connection with the above, according to the author, we can talk about general, intersectoral and sectoral classifications of nota -rial procedural legal relations.Note that in the science of notarial process there are no special studies on the types of notarial procedural legal relations. However,as our analysis shows, the division of notarial procedural legal relations into types significantly expands the idea of their featuresand properties.Thus, the study of the types of notarial procedural legal relations (on the example of the use of general theoretical classifications oflegal relations) showed their diversity, which is not fully explored in the scientific literature. An analysis of modern textbooks on notarialprocedural law has shown that most researchers ignore this issue. However, in the theory of law, the types of legal relations are presentedproperly. Notarial procedural legal relations are a kind of legal relations, which allowed the author to establish appropriate parallels.The variety of types of notarial procedural legal relations, as well as the criteria for their distribution is due to the peculiarities oftheir elemental composition. That is why it is quite possible to establish a large number of criteria for the distribution of notarial procedurallegal relations, including those that are inherent in any legal relationship, as well as specific only to the notarial-procedural sphere.

Eine semantische Klassifizierung von Weil-Sätzen

"A Semantic Classification of Weil-clauses. In the present study, we will elaborate a classification of clauses introduced by weil ‘because’; this classification combines different views on the concepts of cause and motive and their respective linguistic realization. In this paper, the three-dimensional model proposed by Sweetser (1990) will be combined with the distinction between cause and motive made in Prandi/De Santis (2011) and Prandi (2013), with the purpose of formulating a taxonomy of linguistic causality. Corpus research aimed at testing the afore-mentioned classification shows that the subordinating conjunction weil, which is usually defined as the prototypical causal subordinator in traditional grammars, introduces different conceptual relations, which would be difficult to identify without a comprehensive classification of the semantic relations introduced by this subordinator. Finally, further applications of the proposed classification involving the opposition between clauses headed by weil with verb-end and verb-second syntax will be proposed. It will be argued that the verb-second syntax serves a particular function in the encoding of semantic relations. Simple-like independence relations in abstract elementary classes

We introduce and study simple and supersimple independence relations in the context of AECs with a monster model.Theorem 0.1LetKbe an AEC with a monster model.•IfKhas a simple independence relation, thenKdoes not have the 2-tree property.•IfKhas a simple independence relation with the(<ℵ0)-witness property for singletons, thenKdoes not have the tree property.The proof of both facts is done by finding cardinal bounds to classes of small Galois-types over a fixed model that are inconsistent for large subsets. We think that this finer way of counting types is an interesting notion in itself.We characterize supersimple independence relations by finiteness of the Lascar rank under locality assumptions on the independence relation.

A Relational Adaptive Neural Model for Joint Entity and Relation Extraction.

Relation extraction is a popular subtask in natural language processing (NLP). In the task of entity relation joint extraction, overlapping entities and multi-type relation extraction in overlapping triplets remain a challenging problem. The classification of relations by sharing the same probability space will ignore the correlation information among multiple relations. A relational-adaptive entity relation joint extraction model based on multi-head self-attention and densely connected graph convolution network (which is called MA-DCGCN) is proposed in the paper. In the model, the multi-head attention mechanism is specifically used to assign weights to multiple relation types among entities so as to ensure that the probability space of multiple relation is not mutually exclusive. This mechanism also predicts the strength of the relationship between various relationship types and entity pairs flexibly. The structure information of deeper level in the text graph is extracted by the densely connected graph convolution network, and the interaction information of entity relation is captured. To demonstrate the superior performance of our model, we conducted a variety of experiments on two widely used public datasets, NYT and WebNLG. Extensive results show that our model achieves state-of-the-art performance. Especially, the detection effect of overlapping triplets is significantly improved compared with the several existing mainstream methods.

About the Classification of Housing Legal Relationship to Regulatory and Protective

Statement of the problem. The question of the classification of housing legal relations into regulatory and protective ones is not debatable. But not because there is a consensus on this issue in the doctrine, but because until now it has not become the subject of special research. In some works, one can find a brief mention of the division of housing legal relations into regulatory and protective, but it is difficult to find a detailed presentation of the author’s position on this issue. Against the background of the active development of the classification of civil legal relations into regulatory and protective inattention to this issue in the science of housing law looks like a serious omission over the past decades. Goals and objectives of the study. The article discusses the main provisions justifying the classification under consideration, examines the attitude towards it in the literature of a housing legal nature. Research methods: the article uses a logical method, and above all such techniques as analysis and synthesis, functional and comparative legal methods. Results, brief conclusions: ignoring the classification in question leads to contradictions in the doctrine of housing legal relations, to the ingraining of unreliable ideas about the ratio of the categories included in this doctrine. It seems important to carry out further research of housing legal relations on the basis of a consistent classification of housing legal relations into regulatory housing legal relations and protective housing legal relations.

Теория отношений Алексиуса Майнонга

The purpose of the article is to analyze the theory of relations developed by A. Meinong and to demonstrate its significance for the formation of Meinong’s theory of objects. The article is divided into three parts. In the first part, the author shows that the interest in a theory of relations was not accidental for the representatives of the school of Bren­tano: one cannot determine the characteristic features of intentional relations without determining the characteristic features of relations as such. The article considers some ele­ments of the theory of relations proposed by Brentano and by some of his closest disci­ples – A. Marty and C. Stumpf. The second part deals with two important topics in Meinong’s theory of relations: classification of relations and their status. It is shown that Meinong recognized the distinctive ontological status of relations and their indepen­dence from the cognitive activity of mind. It is also shown that an attempt to clarify the characteristic features of “ideal” relations made by Meinong within the frame­work of his classification of relations eventually led him to formulate one of the key theses of his the­ory of objects. Finally, the third part discusses the nature of relations. The author analyses two solutions considered by Meinong: the first one, suggested in 1899, presupposed that some other relations connect a given relation with its relata, and the second one, devel­oped in 1902, was a suggestion that each relation by itself connects its relata. It is shown that the second solution required Meinong to expand the ontology and to change the pre­vious epistemology. A possible contemporary interpre­tation of the second solution pro­posed by Meinong is also suggested.

АКТУАЛЬНЫЕ ПРОБЛЕМЫ ПРАВОВОГО РЕГУЛИРОВАНИЯ ДЕМОКРАТИЧЕСКОЙ ПРАКТИКИ (основы концепции Кодекса демократии)

The structure of legal regulation of democratic practice was analyzed. General normative legal regulation, during which the federal legislator and society, through the institution of referendum, develop a system of norms and form a normative legal model of democratic practice, was singled out. The organizational and legal activities of the subjects of democratic practice were described. Legal self-regulation and individual normative legal regulation of democratic practice were considered. Legal conflicts and their regulation were covered in detail. The importance of monitoring of law translation into social life and interpretation of law was emphasized. It was shown that the important public and state role played by democratic practice explains the necessity to consolidate the regulatory norms in the form of a Code of Democracy. The theoretical basis for the concept of the Code of Democracy was proposed. It was suggested that the theoretical basis should include the fundamental problems of practice reflecting the patterns of its functioning and development. In particular, the practice-forming, practice-destroying, and practice-promoting elements of democracy were analyzed. A classification of practice-forming phenomena, relations, and processes that are parts of the general legal regulation of democratic practice was provided.

ВЛИЯНИЕ ПАНДЕМИИ КОРОНАВИРУСА COVID-19 НА ОТНОШЕНИЯ РПЦ И ВЛАСТИ В РОССИИ

A conservative turn in Russian politics has made the Russian Orthodox Church (ROC) a key beneficiary of the new policy. Within the framework of Peter Berger's theory of desecularization, the ROC increased its influence through an alliance with the Kremlin. This made it possible to move smoothly from the model of «selective cooperation» to the model of «state religion», according to the classification of state-church relations proposed by Kristina Stoeckl. By early 2020, the ROC was perhaps at the height of its political influence. However, the COVID-19 pandemic seems to have paused the strong alliance of the Kremlin and the ROC. When the government announced lockdown measures and demanded that all churches cease services with the public, not all priests agreed to comply. The church-state crisis manifested in two divisions: between the Church and the state, between loyalists and fundamentalists within the ROC. We argue that although these cleavages posed a threat to the Patriarchate’s stability and power, the church leaders managed to maintain the loyalty of most believers. The authors show that the ROC proved its political loyalty to the Kremlin. Using individual-level data from the Values in Crisis project, the effect of religiosity on the support of government public health measures is explored. The findings reveal that higher religiosity is associated with higher levels of political loyalty. However, the COVID-19 crisis illustrates that the illusion of an equal partnership between the state and the church vanished.

Qualitative-geometric ‘surrounds’ relations between disjoint regions

ABSTRACT This paper explores a class of qualitative-geometric relations between disjoint regions, embedded in the surface of a sphere or in the plane. These relations combine topological information about the configuration of the regions themselves as well as of the geometric Voronoi regions surrounding them. The method uses maptrees to construct a rigorous and exhaustive framework for n-ary relations between ensembles of regions. The resulting uniquely defined relations are akin to the verbal spatial relation ‘surrounds,’ in one common interpretation. The paper provides an exhaustive formal classification of such extended spatial relations between up to three regions. A further exhaustive computational exploration of up to seven regions in the sphere also provides an algorithm to enumerate all possible configurations. The results demonstrate how the approach can be used to provide fine-grained and salient descriptions of qualitative-geometric relations for complex scenes involving ensembles of multiple regions.

The genesis of Western European sociological thought in the works of G. V. Plekhanov

The article presents the results of the analysis by G.V.Plekhanov of the genesis of Western European sociological thought based on the consideration of the social ideas of the French materialists of the 18th century, the rudiments in their philosophical systems of the historical approach to the study of society and understanding the causes of social inequality and injustice as well as overcoming them. The sources and content of the philosophical and historical theories of the French historians of the Restoration period are revealed, those who recognized the struggle of classes as the cornerstone of the social, political and mental development of European society, including the interpretation of the concept of “social environment” as a set of economic relations of classes, which was a contribution to the history of sociology. The analysis of the sociological views of utopian socialists and representatives of German classical philosophy is conducted. It was revealed that a significant contribution to the development of the theory of society were the ideas of social progress and the creation of a new social science that served the cause of social organization, developed by the utopian socialists, as well as the statement that the future of society is decided in the sphere of social and economic relations, and not political and legal ones. It is emphasized that Hegel’s application of dialectics to the analysis of social changes meant undoubted progress in the development of sociological thought, which consisted in the advancement of the idea of the regularity of the social process. The methodological basis of the author’s study of the problem of the genesis of Western European sociological thought in the works of G.V.Plekhanov is made up of dialectical-materialistic and comparative-historical methods, as well as the method of textological analysis and historical-philosophical reconstruction.

O individual e o coletivo no trabalho por plataformas digitais: possibilidades de compreensão da Constituição a partir da experiência do "Breque dos Apps"

O “breque dos apps”, realizado em julho de 2020, se destacou por aspectos como a tentativa de superação, pelos trabalhadores, dos desafios postos pela gestão empresarial por algoritmos e a visibilidade conferida aos coletivos de entregadores. Mas também revelou ambiguidades, como as atinentes à própria denominação do movimento e à classificação jurídica das relações laborais por aplicativos digitais. De toda forma, a experiência dessa mobilização permite afirmar que o debate sobre a regulação estatal do trabalho por plataformas digitais deve considerar as perspectivas e os riscos correspondentes nos planos individual e coletivo, em especial, quanto a esse último, no que diz respeito às dimensões da liberdade sindical, da negociação coletiva e da greve. A reivindicação e o exercício, por parte dos entregadores por plataformas digitais, de direitos fundados na Constituição têm o condão de indicar novas possibilidades de interpretação jurídica e efetivação do texto constitucional. Também podem servir para viabilizar a participação desses trabalhadores na discussão pública sobre a regulação jurídica do labor por aplicativos, assim como em outros espaços de debates que envolvam direitos fundamentais.

The role of PR in governments administration

The article describes the subject, fundamentals, classification and functions of public relations. The study is based on political PR and analyzes its executive role in public administration. The features of political communication in public administration institutions, its composition and technology are analyzed, the results of PR research in world practice are briefly described. A scientific review of the current situation in the field of political PR will be carried out. As a result of the research, the requirements for PR and its environment will be indicated.

Spatial Topological Relation Analysis for Cluttered Scenes.

The spatial topological relations are the foundation of robot operation planning under unstructured and cluttered scenes. Defining complex relations and dealing with incomplete point clouds from the surface of objects are the most difficult challenge in the spatial topological relation analysis. In this paper, we presented the classification of spatial topological relations by dividing the intersection space into six parts. In order to improve accuracy and reduce computing time, convex hulls are utilized to represent the boundary of objects and the spatial topological relations can be determined by the category of points in point clouds. We verified our method on the datasets. The result demonstrated that we have great improvement comparing with the previous method.

Introduction of the category "administrative (public) sequester" into the private law system of Ukraine

The article is devoted to the issue of legal regulation of relations for the storage of things that are the subject of dispute or removed from the possession of the owner against their will on the basis of public law regulations (sequestration). The subject of the study is the legal relationship to ensure the safety of property that arises between custodians and bodies / departments of public institutions that by law have the authority to remove such property from the owner, as well as between the latter and owners / future owners of the property. The author draws attention to the similarity of certain characteristics of such relations of such relations with the construction of judicial sequestration. Namely: the thing has a certain encumbrance and due to the provisions of the law (in a broad sense) can not be left in the possession of the owner; the decision on its seizure and transfer for storage is made by a person not interested in its further fate; such a person is endowed with the appropriate authority and acts as a representative of the state or local community (parking inspectors). While the further fate of such a thing is unknown (return to the owner, transfer to a new (determined by the court) owner, sale by public auction, confiscation, destruction, etc.), it is necessary to ensure its safety to ensure the rights and interests of the future owner. The main feature of such legal relations is the lack of free will of the owner of the thing for its transfer for storage, and accordingly the lack of contractual relations between him and the custodian (unlike the contractual sequestration). In view of this, the author concludes that it is appropriate to extend to such relations the regulation of the relevant provisions of civil law. It is proposed to use the following classification of sequestration relations in the system of private law: contractual sequestration, judicial sequestration, administrative (public) sequestration

A análise política por Max Weber da Revolução de Fevereiro de 1917: Um balanço crítico.

O presente trabalho discute criticamente a análise de Max Weber sobre a situação política da Rússia em 1917, particularmente seu artigo sobre a Revolução de Fevereiro [A transição da Rússia à pseudodemocracia]. Nele estabelecemos os nexos entre tal artigo e seus escritos dedicados à revolução russa de 1905, com ênfase para a análise das classes sociais e a viabilidade de uma coalizão democrática capaz de suplantar o czarismo. Em 1917, Weber questiona o caráter democrático do “governo provisório” e conclui que o processo revolucionário se resumiu à anulação de um monarca incompetente, sem alterar a posição conservadora das classes dominantes em relação à questão agrária, nem sua dependência perante os bancos estrangeiros. Assim, analisamos os equívocos que levaram Weber a desconsiderar a possibilidade de uma aliança entre operários e camponeses, bem como as insuficiências de seu esquema teórico para incluir a dinâmica do movimento de massas na transformação histórica.

Causative verbs and event segmentation in Ewe

This paper seeks to outline and describe the features of Ewe causative verbs and how they encode causative events. It explores the sub-lexical analysis of verbs' meanings since they form the basis of the classification of causal relations that allow us to explore the different imports between sub-events and how these events are structured, and how the participants in the events are related to the description of the event itself acknowledges that establishing causal connections between events and their participants is one the principal means by which we structure our experience of our social and verbs and ther relational environment. Previous typological studies have focussed on event segmentation into syntactic and intonational units, as well as motion events. This study is descriptive in nature and focuses on causative verbs and their relational analysis with the causative events they construe. This paper identifies that just as English and other languages do, causation is at the heart of the majority of the semantic analyses of verbs'meaning relevant to argument realization to involve the causal structure of the events they encode.

Междисциплинарность как основа реализации интегративного подхода к формированию профессиональной культуры

The paper aims to provide a theoretical analysis of “interdisciplinarity” conception within the framework of the integrative approach to forming technical students’ professional culture and to outline prospects for its practical realization. The article considers the modern tendency towards interdisciplinarity in domestic and foreign methodology, proposes a chronological classification of interdisciplinary relations. Scientific originality of the study lies in the fact that the author provides a theoretical justification of the modern conception of interdisciplinarity, reveals pedagogical conditions of professional culture formation, proposes ways for realization of the interdisciplinary approach in technical education. The conclusion is made that interdisciplinarity is a basis of the integrative approach to forming future engineers’ professional culture.
