Precedensowy charakter uchwał Naczelnego Sądu Administracyjnego

Precedensal Character Resolution of the Supreme Administrative CourtThe article presents the issue of the precedent character of some resolutions of the Supreme Administrative Court. At the same time he deals with the law-making and the precedent role of administrative courts. It deals with the issues of contemporary law change, including the transition from the syllogistic to the paradigmatic application of law. In addition, it describes Competence of the Supreme Administrative Court to adopt resolutions aimed at clarifying legal provisions, the application of which has caused divergences in the case law of administrative courts. At the end of the article is presented a review of the resolutions of the Supreme Administrative Court in the author’s assessment of the precedent character.

Decyzja jako dowód w postępowaniu podatkowym

Autorka porusza problematykę dopuszczalności wykorzystania decyzji podatkowej jako dowodu w innym postępowaniu podatkowym. Przedmiot szczegółowych rozważań stanowi kwestia uznania decyzji podatkowej za dokument urzędowy oraz tego konsekwencje. W świetle regulacji ustawowej (art. 194 Ordynacji podatkowej) decyzja, jak każdy dokument urzędowy, korzysta z domniemania zgodności z prawdą. To domniemanie jest wzruszalne za pomocą każdego przeciwdowodu, ponieważ najważniejsza w postepowaniu podatkowym jest realizacja zasady prawdy materialnej (art. 122 Ordynacji podatkowej). Domniemanie wiarygodności nie obejmuje całej treści decyzji. Zgodnie z dominującą w ostatnich latach tendencją w orzecznictwie sądów administracyjnych, domniemanie zgodności z prawdą ogranicza się do sentencji decyzji. W rezultacie okoliczności faktyczne, zawarte w jej uzasadnieniu, przestały być objęte tym domniemaniem. Dla organu podatkowego ta zmiana ma istotne znaczenie praktyczne. Uniemożliwia traktowanie „cudzych” decyzji podatkowych za jedyny i wystarczający dowód przy formułowaniu rozstrzygnięcia wraz z uzasadnieniem faktycznym „własnej” decyzji.

Agreement on the charges for staying at a nursing home in the case law of administrative courtsThis paper is devoted to the issue of concluding an agreement on the charges for staying at a nursing home in the case law of administrative courts. The debated issue is based on a very extensive case law and against this background the most important problems are discussed. The first problem concerns the sources and forms of participation in the cost of maintaining a person in a social welfare home. In the case law of administrative courts a prevailing view is that law is the source. Other opinion says that the source is an administrative decision. The second opinion cannot be accepted. The views in the case law of the courts tend to conclude that the source of the duty is the law and the agreement individualizes this obligation. Another issue concerns the refusal to conclude an agreement on participation in the cost of maintaining a person in a social assistance home. In this situation, in the case law a prevailing view is that an agreement may be replaced with a central administrative decision.

European standards for the freedom of peaceful assembly guaranteed by the Art. 11 of the ECHR specifically in terms of negative and positive obligations of the State are covered in the article. Also, the case law of administrative courts regarding cases on restricting the right to peaceful assembly is analyzed.

The Institution of Individual Interpretations of Tax Law as Provided under the Amended Provisions of The Tax Code

2005 marked the introduction of the institution of binding tax law interpretations into the Polish legal system. A period of less than THREE years of operation of these rules has demonstrated that these solutions ARE FAR FROM PERFECT. A number of defi ciencies and weaknesses has made their practical application diffi cult for taxable persons, payers, collectors, legal successors of the taxable person, as well as for third parties responsible for tax arrears, and of course, the tax authorities. The case-law of administrative courts only confi rms this state of affairs.
