Unleashing the anticipatory reasonable adjustment duty: University of Bristol v Abrahart (EHRC intervening) [2024] EWHC 299 (KB)

On 14 February 2024, the High Court upheld the decision of the Bristol County Court in University of Bristol v Dr Robert Abrahart. Ms Abrahart, a physics undergraduate, took her own life in April 2018, the morning before she was meant to deliver an oral presentation. The claim brought by Ms Abrahart’s father was that in failing to remove or adjust the requirement for oral assessments, the University had discriminated against her on the basis of her disability. The High Court upheld the discrimination claims under the Equality Act 2010 while dismissing the claim in negligence on the basis that the University did not owe Ms Abrahart a common law duty of care. This note discusses the contrasting moves made by the High Court in, on the one hand, lowering the bar for finding a breach of the anticipatory reasonable adjustment duty, and on the other hand, raising the bar for finding an assessment method to be a ‘competence standard’ set by universities. Although arising in relation to the very specific facts of this case, the implications of the ruling in Abrahart are far reaching.

Developed-developing world partnerships for sustainable development (2): An illustrative case for a payments for ecosystem services (PES) approach

The Converging World (TCW) developed-developing world partnership model represents a transparent approach to addressing carbon emission management in a mutually beneficial way, with a substantial ‘multiplier effect’ achieved though reinvestment of operating surpluses from energy generation into tropical dry evergreen forest (TDEF) restoration. Carbon dioxide is averted/sequestered at a theoretical cost of £0.0058 £ per t CO2e (≈$US0.01 per t CO2e). For the City and County of Bristol, England, cumulative century-long CO2e emissions of 256,550,000t CO2e could be matched by one-off investment of £3:56 for each of Bristol City's 442,500 population in commissioning a 2.1MW wind turbine in Tamil Nadu under the TCW model. Similar considerations apply at institutional level; indicative contributory investment in turbine installation is calculated for a case study institution. Calculated investments relate to the ‘anchor service’ of climate regulation, though the TCW model also generates multiple co-beneficial ecosystem services serving local people and addressing UN Sustainable Development Goals. Restoration of other bioregional habitats could yield additional socio-ecological benefits. TCW's aspirational investment model positions social return on investment (SROI) as primary ‘interest’, rather than maximisation of financial returns to investors. We test the case for founding developing world investment on the basis for ‘payments for ecosystem services’ (PES).

Conflict and urban government in later medieval England: St Augustine's Abbey and Bristol

Conflict between the town and county of Bristol and the liberty of St Augustine's Abbey was largely the consequence of the failure of the county's founding charter of 1373 to recognize the separate existence of the liberty. In 1496 a confrontation between the abbey and the town resulted in an appeal to Council, and the production of The Great White Book, to record the evidence collected for the hearing. This allows both a reconstruction of the 1496 conflict and its precursors, and an interpretation of the Bristol political elite's rhetorical exploitation both of the conflict itself and of its representation.

Recently at the University of Bristol, the honorary degree of Master of Arts was conferred on a distinguished police officer, Mr. George Twist, C.B.E., Q.P.M., LL.M. one of Her Majesty's Inspectors of Constabulary and previously Chief Constable of the City and County of Bristol. Orthodoxy in Massachusetts: The Ecclesiastical History of Freetown, 1683-1776

THAT the colony and province of Massachusetts-Bay was a bastion of religious orthodoxy and close relationship of church and state is a truism of early American history. Even after Massachusetts-Bay lost its original charter and was forced to accept one from the Crown guaranteeing liberty of conscience for Protestants, a close connection persisted between civil and religious authority. Under laws enacted by the General Court under the new charter, each town or parish was required to have an able, learned, and orthodox minister, and the General Court maintained its right to make ecclesiastical subdivisions and ensure orthodoxy in the local communities.' In practice, this meant the perpetuation of the establishment of the Puritan church in Massachusetts-Bay. But the province was unable to maintain absolute religious uniformity, and towns with persistent resolution were able to thwart the best efforts of the authorities to perpetuate Puritan orthodoxy. The leadership in the struggle against uniformity was taken by a number of towns of Bristol County in the southeastern part of the province. These towns had been part of the Plymouth Colony-where relations between church and state were much less firmly regulated-and were adjacent to Rhode Island, the home of soul liberty.2 Probably the most fascinating example of persistent local intransigence was displayed by the town of Freetown. For British local government elections, it is necessary to divide the total voting population into sub-groups (wards) such that each sub-group elects one or more representatives. At present there are remarkably few legal requirements governing the way in which this division is done. This study emphasizes the difficulties of formulating the problem of division, puts forward criteria which (hopefully) would look respectable and acceptable if embodied in legislation, and develops a linear programming-plus-heuristics approach which is applied to Bristol County Borough data to enable comparisons with current ward boundaries.

ESTIMATING PRECENSUS POPULATIONS: A METHOD SUGGESTED AND APPLIED TO THE TOWNS OF RHODE ISLAND AND PLYMOUTH COLONIES IN 16891

ABSTRACT Estimates of both Colonial Period population sizes and densities as of about 1689 for areas of eight to eighty square miles in Plymouth and Rhode Island colonies are possible by coordinating local records and by recognizing that the Bristol County towns of similar ages had very similar ratios of families to adult men. The estimates suggest 1) smaller populations for Rhode Island and especially its chief Colonial center, Newport, than have been assumed, and 2) a kind of mathematical ordering of population densities in the region as a whole. Should the ratios prove to be applicable outside the Narragansett region, it may be possible to estimate populations of the many other places whose size of militia and date of settlement are known.

Loyalist Troops of New England

TH-E first loyalist corps raised in the American colonies was a body of three hundred men enrolled and commanded by Colonel Thomas Gilbert in the autumn of I774 at Freetown, Bristol County, Massachusetts, at the request of General Thomas Gage,' who had arrived at Boston on May 13 of the year named to supersede Thomas Hutchinson as governor. Gilbert had been a captain in the siege of Louisburg in 1745, and a lieutenant-colonel in the Massachusetts forces under Timothy Ruggles in the battle at Lake George ten years later, when he succeeded to the command of his regiment. The Boston tea party had occurred in December, I773, and had caused the British government to decide that its rebellious subjects must be dealt with by force of arms. Besides being a colonel in the militia, Gilbert, as a member of the House of Representatives, had prevailed on his town to adopt resolutions against the destruction of the tea. He was also a justice of the quorum, and it was understood that he had been made high sheriff of his county. Accordingly, in 1774, a large body of Taunton Sons of Liberty went to Freetown to warn him that if he accepted the new office, he must abide by the consequences.
