Abstract

This paper explores the implications of the Working Time Regulations for the midwife. It discusses the fundamental provision that working time including overtime should not exceed an average of 48 hours for each seven days. Regulations relating to night work and to documentation are also considered. While doctors in training and ambulance officers are specifically excluded, midwives are exempt if their activities involve the need for continuity of service in relation to the treatment or care provided by hospitals. Individual midwives may agree to work longer than 48 hours a week, but this must be voluntary and put in writing.
