This paper will discuss the potential and endowments dispute according to the legislation. Waqf is not just a religious issue or for life people, but for the social and individual problems. Therefore, there are some things that put forward, such that the endowments allow for potential dispute, the validity of the act donating (waqf), and dispute resolution that can be reached through deliberation to reach consensus, if not successful, the dispute can be resolved through mediation, arbitration, and or court

Pendahuluan Dalam sejarah kehidupan ummat Islam wakaf punya peran yang sangat penting dalam mengembangkan kegiatan sosial, ekonomi dan kebudayaan masyarakat Islam. Demikian pula dengan dikeluarkan peraturan pemerintah No 28 tahun 1977 yang lebih memberikan pemahaman bahwa perwakafan yang semula hanya merupakan ketentuan yang dikenal di dalam fikih Islam maka dengan adanya peraturan ini secara jelas ditegaskan bahwa wakaf adalah suatu lembaga keagamaan yang dapat dipergunakan sebagai salah satu sarana guna pengembangan kehidupan keagamaan, khususnya Islam di Indonesia.
