Abstract

This paper constitutes a comment on an amendment to the civil proceedings introduced with the Act of 9 March 2023. The introduction contains preliminary notes on the comment. They include the general assessment of the Act of 9 March 2023 and introduce the problems of the adequate application of laws in enforcement proceedings. Next, a change of the subject-matter jurisdiction of a court has been discussed, namely art. 17(4) of the Code of Civil Proceedings. Finally, an amendment to art. 49 § 2 of the Code of Civil Proceedings has been presented, i.e. the regulation that governs the problem of excluding a judge.
