Abstract

The first part of this article raises the question of the nature of shares as a key concept for solving many practical problems related to their commercial circulation. The author proves that the most descriptively accurate is the analysis of shares as a legal position in a partnership. In the second part, on the basis of this qualification, the issues of application of rules on sale and purchase to shares, determination of the moment of their transfer, influence of statutory restrictions on the transfer of shares, legal succession, as well as acquisition of shares during marriage and accompanying joint ownership regime are consistently examined.
