TINJAUAN HUKUM ISLAM TERHADAP PRAKTIK TA’WIDH TANAH WARGA OLEH PEMERINTAH DAERAH KABUPATEN SAMBAS DALAM PEMBANGUNAN JEMBATAN SUNGAI SAMBAS BESAR KABUPATEN SAMBAS

Abstract

ABSTRACT
 The issue of compensation is very important because there are two interests, namely the interests of the government and the interests of the community, so an approach that can be understood and accepted by both parties is needed. In the construction of the Sambas Besar River Bridge Construction of Sambas Regency, the Sambas Regional Government must free up land for its construction and of course involve landowners affected by the development. Therefore, compensation for residents' land becomes the right of a person to get fulfillment of his demands in the form of compensation as compensation for the land. In Islamic law compensation is usually referred to as Ta'widh.The formulation of the problem in this study is: How is the practice of Ta'widh of residents' land by the Regional Government of Sambas Regency in the construction of the Great Sambas River Bridge? How is the review of Islamic Law on the practice of Ta'widh of people's land by the Regional Government of Sambas Regency in the construction of the Great Sambas River Bridge.The type of research carried out is field research, which is a type of research whose data is obtained directly from the field, and uses a normative juridical research approach when researching when researching phenomena that occur in the field related to community behavior.Based on the results of the research and discussion above, a common thread is drawn as follows: The practice of Ta'widh community land by the Regional Government of Sambas Regency in the construction of the Sambas Besar River Bridge through several stages, namely: initial survey, socialization/counseling, measurement, assessment, data verification, team meetings, deliberations on the delivery and determination of the amount of compensation and compensation. In the review of Islamic Law on the practice of Ta'widh of residents' land by the Regional Government of Sambas Regency in the construction of the Great Sambas River Bridge, in this case the government may urge/force the transfer of rights by the owner or land acquisition. However, in this land acquisition, the Government must always pay attention to aspects of benefit for the residents whose land is expropriated, so that there will be no inequality and social inequality in the future. Legal protection of community members is carried out preventively through socialization, seeking agreement with stages. which is passed for legal protection for residents of Sambas Regency district community in order to get legal certainty, get compensation as agreed.Keywords: Ta'widh, bridge, Islamic law 
 ABSTRAK
 Masalah ganti rugi ini sangatlah penting karena didalamnya terdapat dua kepentingan yaitu kepentingan pemerintah juga kepentingan masyarakat, sehingga diperlukan suatu pendekatan yang dapat dimengerti dan diterima oleh kedua belah pihak. Dalm pembangunan Pembangunan Jembatan Sungai Sambas Besar Kabupaten Sambas, Pemda Sambas mesti membebaskan lahan untuk pembnagunannya dan tentunya melibatkan pemilik tanah yang terdampak pembangunan tersebut. oleh karena itu ganti kerugian tanah warga menjadi hak seorang untuk mendapat pemenuhan atas tuntutannya yang berupa imbalan sebgai ganti rugi tanah tersebut. Di dalam hukum Islam ganti rugi biasanya disebut dengan Ta’widh. 
 Adapun rumusan masalah dalam penelitian ini yaitu: Bagaimana praktik Ta’widh tanah warga oleh Pemerintah Daerah Kabupaten Sambas dalam pembangunan Jembatan Sungai Sambas Besar? Bagaimanakah tinjauan Hukum Islam terhadap praktik Ta’widh tanah warga oleh Pemerintah Daerah Kabupaten Sambas dalam pembangunan Jembatan Sungai Sambas Besar?
 Jenis penelitian yang dilakukan adalah penelitian lapangan (field research) yaitu jenis penelitian yang datanya diperoleh langsung dari lapangan, dan menggunakan pendekatan penelitian yuridis normatif ketika meneliti ketika meneliti fenomena yang terjadi di lapangan terkait prilaku masyarakat.
 Berdasarkan hasil penelitian dan pembahasan di atas, maka ditarik benang merah sebagai berikut: Praktik Ta’widh tanah warga oleh Pemerintah Daerah Kabupaten Sambas dalam pembangunan Jembatan Sungai Sambas Besar melalui beberapa tahapan yaitu: survey awal, sosialisasi/penyuluhan, pengukuran, penilaian, verifikasi data, rapat tim, musyawarah penyampaian dan penetapan Besaran Ganti Kerugian dan Pemberian Ganti Kerugian. Dalam tinjauan Hukum Islam terhadap praktik Ta’widh tanah warga oleh Pemerintah Daerah Kabupaten Sambas dalam pembangunan Jembatan Sungai Sambas Besar, dalam hal ini pemerintah boleh mendesak/ memaksakan terjadinya pemindahan hak oleh pihak pemilik atau pembebasan tanah. Namun dalam penbebasan tanah ini Pemerintah harus selalu memperhatikan aspek kemaslahatan untuk para warga yang tanahnya diambil alih, agar tidak terjadi kesenjangan dan ketimpangan sosial di kemudian hari nanti. Perlindungan hukum terhadap warga masyarakat dilakukan dengan preventif melalui sosialisasi, mencari kesepakatan dengan tahapan-tahapan. yang dilalui untuk perlindungan hukum bagi warga masyarékat kabupaten Kabupaten Sambas agar mendapat kepastian’hukum, mendapat .ganti rugi sebagaimana telah disepakati.
