The article aims to present selected problems of the functioning of the principle of a fair disciplinary response in the matters of the Marshal’s Guard officers. The author analyzes in this study the issue of judgments issued in disciplinary proceedings and the statutory mechanisms of applying disciplinary penalties to officers of the Marshal’s Guard

Jeżeli w toku postępowania dyscyplinarnego zostały one ujawnione, zwłaszcza wcześniejsze zachowania dysfunkcjonalne z punku widzenia dobra służby parlamentarnej, choćby nie były poprzednio kwalifikowane jako przewinienia dyscyplinarne, to zazwyczaj brak jest uzasadnienia do zastosowania instytucji odstąpienia od ukarania

ZASADA TRAFNEJ REAKCJI DYSCYPLINARNEJ W SPRAWACH FUNKCJONARIUSZY STRAŻY MARSZAŁKOWSKIEJ 2 § 1 pkt 1 k.p.k.2 Na tym tle powstaje zatem problem, czy może zostać ona implementowana na grunt prawa dyscyplinarnego regulującego odpowiedzialność funkcjonariuszy Straży Marszałkowskiej[3]. W ujęciu ogólnoteoretycznym zasadę trafnej reakcji dyscyplinarnej można zdefiniować jako dyrektywę, zgodnie z którą każdy funkcjonariusz Straży Marszałkowskiej, który jest winien przewinienia dyscyplinarnego, powinien za to ponieść odpowiedzialność taką i tylko taką, na jaką wedle prawa dyscyplinarnego zasłużył.
