Abstract

In the article there are determined some preconditions of the modern concept of a legal person in Ancient Rome. Researching is preceded by historiographical review aiming to summarize investigation of roman law of persons in the last centuries. The appearance of the notion “persona” is contextualized basing on ancient drama and rhetoric. The features of using that term are exemplified with texts by Gaius and Iulianus. It is concluded that ancient rhetoric made a contribution in developing of abstract view on legal person as a part of systematization of roman law. Meanwhile it is underlined the connection between perception of ancient scenic images and intuitive approach to finding legal solution. Keywords: legal person; mask; rhetoric; roman jurisprudence.
