Abstract

Competitive dialogue, introduced in Brazil by Law No. 14,133/2021, represents a bidding modality that allows for negotiation between the public administration and bidders, aiming to achieve the best technical and economic solution for the contracted object. This approach can foster innovation, creativity, and efficiency in the procurement of complex works and services, promoting transparency, equality, and competitiveness among bidders. However, it poses challenges, such as the possibility of manipulation and increased administrative costs. The article in question analyzes the purposes of competitive dialogue, seeking more democratic and efficient administrative decisions, highlighting the associated benefits and challenges, including the need for training of public servants and the definition of clear and objective criteria for choosing the best proposal.
