Abstract

The universal trend embodied by international conventions did not stop at the end of human rights statement; rather it develops the conclusion of international agreements aimed at guiding the countries to provide procedural guarantees special for the protection of rights. Thus, we find the Hague Convention related to kidnaping for 1980. It was characterized by a procedural manner consulted by States to issue a decision to return of the kidnapped child by a some extent and parents as required by the best interests of the child and the preservation of the family environment. Perhaps the Iraqi legislature has already organized that in various legislation and the judiciary supports it.
