Abstract
Abstract This chapter studies Article 46 of the Treaty on European Union (TEU), which provides for the legal framework of Permanent Structured Cooperation (PESCO). Its rules are in addition laid down in the Protocol on PESCO, which forms part of primary EU law. PESCO provides an avenue under the Treaties for a group of Member States willing and able to pursue deeper integration in Common Security and Defence Policy (CSDP). It mainly aims at military capacity building. Since it operates within CSDP and the Union’s institutional framework, the Council and the High Representative maintain a role in it and the political considerations that inform CSDP apply to it as well, as clearly illustrated in the preamble of the Protocol on PESCO. The chapter then looks at the conditions for participation in a PESCO, its structure and governance, tasks, procedural aspects, and its relation with enhanced cooperation.
