Abstract
Abstract Although only about 1% of surrogate motherhood cases have resulted in litigation, it is the “Baby M” case in New Jersey that has garnered headlines and provoked heated debate in the popular media, in legal publications, and in other professional journals. Family therapists can better appreciate the emotional agonies on both sides of this relatively new response to infertility if they are aware of the arguments being offered and the reasoning behind the actions of the judiciary in this case.
