2863 numbered Law • counterfeit objects • authentic objects • archaeometric investigation • forensic investigation of arcahaeological objects Abstract: Movable cultural assets are defined in accordance with the 2863 numbered Law on Preservation of Cultural and Natural Assets, article 23, paragraph (a). Definition states that trade of movable cultural assets can only be carried out by and/or with the consent of Ministry of Culture and Tourism (article 27). Vendors of movable cultural assets must report this case to the State Museums at first (article 30). Cultural and natural assets which are required to be preserved in domestic cannot be taken to abroad (article 32). Briefly, possession of cultural assets dated to the period earlier than the last six Ottoman Emperors (Abdülmecit, Abdülaziz, Murat V, Abdülhamit II, Mehmet Reşat V and Vahdettin) is not legal in accordance with this 2863 numbered law. Those who possess histori-cal artifacts unlawfully are sued by the reason of opposition to 2863 numbered law on Preservation of Cultural and Natural Assets. In this case, report is asked from experts registered as expert to the registration of the court, regarding if captured artifacts are covered by the 2863 numbered law and if they are original. Reports prepared by the experts without carrying out an archaeometric investigation regarding said artifacts may be resulted in punishing an innocent person or releasing a person who is indeed guilty.
