Abstract

Popular music has always relied on a limited range of chords and melodies. Cross-fertilisation between the styles of different writers and performers has often led to charges of imitation or outright plagiarism. But new media - such as digital technologies - have opened this up in a way hitherto undreamed of. These new forms have implications for both copyright and notions of creativity itself. These issues are increasingly affecting all features of the international music industry. This paper outlines the development of digital sampling technology and examines some key cases where the use of sampling has provoked copyright disputes and raised fundamental question of creative provenance and ownership.
