Some Features of the Crime Scene Investigation in Relation to Entrepreneurs at the Stage of Checking the Notification of the Crime

Abstract

The article discusses some features of the crime scene investigation at the verification stage of the report of a crime against legal entities. The study analyzed some questionable points affecting the observance of the rights and freedoms of entrepreneurs as participants in criminal proceedings during the verification of a crime report. Referring to the practice of considering complaints filed in accordance with Article 125 of the Criminal Procedure Law of the Russian Federation, the main unresolved issues that contribute to the admission of violations during the investigative examination are identified. Among the most widespread violations is the distortion of the process of examining the place of origin and its procedural registration, as well as the failure to take necessary actions to complete the investigative action. The issue of returning the property seized during the verification of the crime report to the rightful owner after the ruling on the refusal to initiate criminal proceedings needs to be clearly resolved. We propose specific recommendations that contribute to the elimination of the contested situations allowed during the inspection of the scene of the incident. As a result of the study of practical materials, scientific conclusions were drawn and recommendations were proposed for the elimination and prevention of errors at the stage of checking the report of a crime carried out against entrepreneurs.
