Abstract

The paper is a theoretical reconstruction of the Russian prominent civil law scholar Sergei N. Bratus conception of subjective right, which is still regarded as dominant within the Russian-speaking legal doctrine. Theoretical sources and the evolution of the Bratus conception have been analysed. Theoretical prerequisites and rhetorical technique of the partial identification of subjective right and legal permission (which is the key point of the Bratus conception) have been figured out. The Bratus conception of subjective right with all its considerable strength and weakness has an enduring effect and had a framing effect on the Russian-speaking legal doctrine.
