Abstract

This article aims to propose a redefinition of the right to education, based on the association between sociological and legal aspects in order to adapt it to new social model arising with the massive use of information and communication technologies. Therefore, we start from an analysis of the critical theory of human rights, with a view approached by Herrera Flores, in order to understand the contextual of education to the characteristics of the Information Society, giving it the nature of cultural product to enhance their effectiveness and thus achieve a good instrument to combat the kind of social exclusion caused by massive use of technological resources. Therefore, it has become urgent to rethink the value quoted by the recognition of a cultural reaction in search of the goods necessary to fill the needs in the technological age, whether tangible or intangible. In this sense, education is replaced as needed member of its contents education in human and fundamental rights in order to arouse critical awareness of individuals in the use of Information and Communication Technologies in order that the human rights discourse veers the contemporary discourse of the Rule of Law, democracy and globalization in an Information or Knowledge Society. Thus, if combined, pedagogically, the ideal of rights and their effectiveness to the pluralism and the ideas of freedom and equality for all, ie a new ethical design / citizenship policy, will have offered an important step in improving the self-determination of man.
