Abstract

The article analyses the new special procedure for hearing witnesses in criminal proceedings under Article 185e of the Polish Code of Criminal Procedure, based on the model in pre-trial investigation. The provision discussed is part of a wide-ranging amendment of the so-called anti-violence act 2.0. The authors consider the currently applicable catalogue of activities that the courts undertake in pre-trial investigation, and subsequently analyse the special hearing procedure under Article 185e of the Code of Criminal Procedure, which is a new procedure for the courts in pre-trial investigation. The authors of this article believe this amendment should be evaluated as positive, because it makes the justice system more friendly to the excluded. Furthermore, this is a starter for a discussion on changing the judicial review model in pre-trial investigation and specifying the role of authorities taking part at this stage of proceedings.
